  1. Hello all, Long time lurker, first time poster. The wisdom and knowledge of this forum has gave me the confidence to ignore all previous calls/threats but this latest letter is something new, that I haven't seen listed before, so feeling a little anxious. ARC have taken over my QQ account after QQ failed to accept my monthly standing order payments and insisted on a DD only (we all know why). I have since moved to another bank and get my wages paid into that new account. The old account still exists. I received this letter this morning. ARC have been phoning me 3-4 times a day but I have blacklisted all their numbers and it goes straight to voicemail. Any advice welcome. I have not sent the 3 letters, choosing to ignore all correspondence instead. Thankyou Kev

  4. Hi, I was a victim of identity fraud in around June 2012. "Someone at the time took out loans in my name with quick quid and lending stream". It was a lot of hassle at the time ( I went through the police action fraud, recived a crime number and after a month or so I signed a couple of letters from both companies and the matter was cleaned up. I also opted at that time to put extra restrictions on anyone else trying to fraudulently take out any more loans in my name. "Let me just say that I have never ever applied or taken out any loan in my life other that a mortgage for our home that is now fully paid off". back in June 2017 I started receiving letters from MMF motormile finance now Lantern, stating that I owed them £250 for another loan from what turns out to be taken at around the same time as the other loans in 2012! I phoned them straight away and explained what had happened. But all this did was for them to send demanding letters on a weekly basis! I forwarded the police action fraud crime number from 2012 thinking that that would be the end of the matter. But all they do is keep sending me more demanding letters. Are these people above the law or what! They keep asking for very personal details e.g bank statements from 2012, my national insurance number, payslips, photo id from a passport or driving licence. I'm sure it would be reckless to send such sensitive information to a bad debt collecting company! (Do they cover their costs by selling on this very useful and very accurate information to third parties?) It would be very lucrative if they did as they would have all the information to take out a loan in my name!! What's going to happen in another few years, Am I going to get demanding letters form another bad debt company?? As much I want to clear my name I am very sceptical about about how they would use that information. I lay awake at night worrying myself to death, I am frightened about what they might do. I have been to Citizens advice bureau who just say go to police action fraud! its bonkers. If a company doesn't accept a police action fraud number and the evidence from the time of the identity fraud then they are surly acting above the law!
  5. Hello,, Today I received a notice of intention to prosecute from Govia Thameslink Railway after an incident on Northern Rail back in January. I am extremely extremely worried about this incident and it is causing me great upset. I have read around on this forum and have prepared my response below to the notice of intended prosecution, please can you offer any advice on what I should / should not included and also indicate what the repercussions of this could be? Is there anything else I should do like ringing them etc? Any help is massively appreciated! RESPONSE: Dear Sir/Madam, I offer my most sincere apologise for my shameful actions in this case. In all other circumstances of my life, I had until this point - upheld a strong degree of integrity and character. As a young lady starting out my career, a criminal record would completely devastate my current and future employment prospects. I’m in my first job working in London and had been using carnets to travel to and from work. During the week of the 8th January, I was in the midst of moving house and with everything going on more stressed than normal. On the 10th January, I caught an extra early train at 6:21am from Letchworth Garden City to attend an earlier-than-usual meeting. Due to it being much earlier than I would typically travel, I hadn’t prepared a carnet beforehand like normal, but instead planned to complete a blank one on the train. In complete stupidity, I didn’t check there was a blank one in my bag and whilst on-board, I realised to my horror I had forgot to pack the empty carnet. In panic, I searched through my bag and could only find a previously used carnet. In a complete error of judgement, I stupidly changed the dates on the carnet to the 10th January. This was a terrible thing to do and I am extremely ashamed of my action. Upon arriving at Kings Cross, I was questioned by the ticket officer and at which point, I admitted whole heartedly to what I had done, apologised profusely and explained the circumstances. The officer thanked me for my honestly telling me he would leave a mark on my file, but advised he would have to report the incident. I made a grave mistake. I have never done anything like this before and certainly will not do anything of this nature again. I am extremely sorry for the way I acted and the damages this action has caused others. I am more than willing and able to make immediate payment to cover the unpaid fare and any other damages or administrative costs I’ve caused. I’m also happy to sign up to an annual ticket so this event can never happen again. I appreciate your consideration in this matter.
  6. Hi All Really appreciate your help on this. I have googled and I don't think there is anything we can do, but thought I'd check here. My mother had a quote for £2700 for some building work. She Emailed the builder and he set a date to start work. She had a reply saying it was confirmed etc. They sent numerous communications. Then she had a reply from the builder on a fake Email address that looked just like his asking for £900 payment to secure the date. She checked his references etc and it all seemed okay. 2 weeks later the builder called her asking for payment to get the scaffolding started. Obviously she thought she had paid. She hadn't. The bank investigated and the fraudulent account now has no money in it so they say she has lost it and it she was at fault. I told her to ask the bank in writing how long the account was open, how many frauds occurred and when was the first one. I heard you can complain based on the bank not closing the fake account in a timely manner. Anything else you would recommend? Thanks D
  7. We recently had a flood upstairs and our downstairs room was destroyed. We've had no claims insurance for more than 10 years. We put in a claim to our insurance company who were dragging their heals ( like they do) they came and asses the damage and we thought the claim was going through. Then out of the blue we were sent a letter by a different insurance company stating we had to renew our policy. My husband had insured is twice by accident for home and content insurance!!! He called the other insurance company and told them about the flood - they asked if we had any other insurance company and he said no, but he wasn't really listening to the questions properly either. Straight away they stop all claims and sent it to the investigation team.! The same underwriter looked at both cases and the second insurance company said they've rejected the claim due to fraud and the 1st insurance company who took 4-5 weeks to come to this conclusion And informed me today they also stop the claim for fraud! This was a genuine mistake - getting two policies (why didn't they tell us) and not telling each insurance company about each other. He thought they were the same company!!! We now can't get any compensation for £4000 worth of loss....my house is a mess and I've waited 8 weeks for them to come to this decision. With 4 kids running around it's quite dangerous now Can anyone help or advise on what to do? Will this effect future insurance? Have I got a leg to stand on at all?

Hi guys, I need some urgent advice, i just received three letters from Marston company asking me to pay three parking fines or they going to send a bailiff to take over all my belongings by 31st Jan 18. My driving details have been stolen in early march 2017 i been informed by DVLA in June, that someone used my details to get the new licence but after providing some security details they issued me new licence. When i asked if they found out who is the culprit then they told me that matter is with west Yorkshire police and i dont have to do anything. After that in september 2017 people from vw company came to my house to recover the car but after clarifying every thing, they advised me that i should report to the police as you are the victim of identity fraud because someone got the vw car on finance and used my details and did not pay the installment. I reported the police straight away and police gave me the fraud incident number, the criminals also used my details and got the loan around £60k as well but all companies who been [problem]med removed my name from their list after finding out that i am the victim of identity fraud. Now Marston company want around £550 parking fines and not accepting the police incident number or dvla letter. The Marston company wants police report, when i asked police about the report they said they do not issue the reports to individuals but they made a new report specifically for Marston group asked me to give the reference number to Marston then they can contact police and police will provide the police report to them. Now the problem is that Marston not accepting this they insist that i have to proivde the police report as they do not contact to third party. I do not know what to do i am victim of identity fraud Marston just want their money they are making threats that i should resolve the matter by 31st or they will come to my house to take all belongings. I never received any letter from Marston before as the culprit used different address where i never lived, now i received notices of enforcement to my address and i have no idea where shall i go from here
  9. Hello All, About a month ago I paid online for a flight with a European Airline. Somehow (no fault of my own) the payment didn't go through although at the time it showed the payment pending. The next day my bank notifies me of possible fraudulent activity and thus locks my online account. Several days later the airline later email me about this non payment. Now I am back in the UK I have contacted my bank, and furthermore contacted the fraud centre. They notified me of the fraudulent activity was actually the airline getting into my personal online bank account with no permission. So regardless of if, why or what their intentions are / were, is this not illegal for an airline, or anyone, to invade a person's privacy like this?!! Can they just get away with it?   10. I stupidly sent £300 to Olsson Capital. this was to trade in Cyber currency. My security on my master card had to be contacted to authorize the £300 payment. I stupidly did not take their advice, and I said yes carry on with the payment. then the next morning when i checked my account with Olsson Capital, I noticed they have taken a further £750, £1000. because I have authorized this one payment of £300, it has given Olsson Capital the opportunity to then take another lump of money. What can I do to get refund ? Am I cover by insurance ? Do I need report it to police.
  11. Not my debt fraud hat trick I have been reading some of the past posts and found them very helpful. But I would like some help with my own problem set out below About five years ago the payday loan company Wonga sent me a letter claiming I owed them money. It turned out someone had used my name to take out a loan. With the help of my bank and a representative from Wonga it was established that they did not have my banking details and had not taken any money out of my account. I was asked to contact the police by Wonga to report an identity fraud. The police said because I had not lost anything to the fraudster it did not warrant a crime number but the incident would be logged. Although I ‘am sure I would not have thrown the letters away, I cannot find them. Early this year I was contacted by B W Legal representing PRAC financial, claiming they had acquired a debt from Instant cash loans ltd. T/A Payday Express. I owed them £850.80 No other details about the loan were in the demand. I ignored their letters as I have never had any Payday loans in my life. I have never had any letters or any contact with Payday Express. It turns out when they threatened me with court action the details in the letter of claim i.e. the date the agreement was signed coincided with the time of the I.D. fraud with Wonga. The 26th of November 2012. In June I received a letter from Moriarty law representing Motormile finance Limited (MMF). They claimed I owe them £468.87 from a debt they acquired from Lending Stream Limited, again no information on the debt. I sent a prove it letter and a supposedly copy of the agreement with my name and address on it arrived, The date the loan was taken out is the same as the other loan 26th November 2012. I have not lost any money but the threats from the debt collection agencies to take me to court and wreck my credit rating have made life in the past months stressful and unpleasant. How many other loans have been taken out in my name? I do not know Thanks d.bick
  12. Hi , Just wondering if anyone could help . my daughter sold an I phone 6 on E Bay on the 20th June , It was in perfect working order . On the 6th of October she was contacted by the buyer asking to erase her icloud account from the phone , She replied to the buyer saying that the phone had been taken back to factory settings and she did not have anything attached to the phone . On the 9th of October the buyer had contacted Paypal and raised a claim that the phone was not as described and her paypal account was showing a minus £145 balance ?? Paypal had told him to send the phone back to her and as soon as she recieved it they gave him his £145 back !!. On receiving the phone she establised the screen to be broken and the device would not power on . she contacted Paypal to find out what was going on and to explain that the phone was broken . They said that she needed to go to and get the damaged accessed by a 3rd party who was quailified to appraise the damage . This she did through the Apple shop at the Trafford centre , she uploaded the appraisal and sent to them. She checked her account a couple of days later to find the case had been closed due to insufficient evidence ?? She questioned this to be told that they have not given an estimate for it to be repaired . They said they would hold the case for another 7 days for her to make another visit and get the estimate which she did . she sent it to them the cost to repair was £299 . Now they have closed the case again saying not enough evidence again as it has not got the assessors name on it . They are now threatening to pass the Debt on to Debt collectors which has upset her no end . She is at her wits end and does not know where to go from here . Does anyone have any advice on where to go or what to do . thanks Mark .

  14. Help – falsely accused! I have received ESA (contribution based) since 2011. After years of only receiving awards letters that notified of payment rates, I received an Interview Under Caution (IUC) a few months back, which led to me realising that having claimed my pensions early for medical reasons last year, that I should have informed the DWP. I honestly did not know this, because none of the awards letters ever mentioned mention this, the last time I went on the .gov website regarding ESA was back around 2011/2012 when claiming my pensions was the last thing on my mind. Since 2011/12 my health has worsened and I went through a difficult divorce, the reasons why I claimed my pensions early. I went to the IUC and cooperated stating that I honestly did not know I needed to inform them when being on ‘contributions based’ ESA none of my x-wife’s earnings or savings dividends etc were ever taken into account. I expected to have to pay the overpayment back AND “off recording” the DWP Officer said it was very unlikely I would be prosecuted. I paid the overpayment when the letter confirmed how much I owed. HOWEVER, imagine my shock horror when I received a letter last week asking me to pay 50% of the overpayment (with loss of benefits for a month) OR face going to court to be prosecuted and get a criminal record?! – surely this is here to target benefit fraudsters NOT those who have acted in all innocence in a way that most people would understand in the circumstances?. At the moment I cannot afford a solicitor I feel that this is very unfair and am considering going to court and representing myself to clear my name, since I understand that even paying the Administrative Penalty is an admission of guilt I do not agree that I have committed an offence, let alone ‘knowingly’ withheld information without ‘reasonable excuse’. I also now understand that the amounts of money involved are below what the DWP would normally process this way and why they did not go down the civil investigation route I don’t know? (this apparently normally ends with a Civil Penalty of £50 instead of an Administrative penalty of £700+.....). With the stress of all this, on top of worsening health, and still coming to terms post divorce where the main factor was my poor health, any tips information recommendations would be great fully appreciated. Hi, I and my partner rented a property from april 2015 to may 2016 from a private landlord and moved out after a dispute with the landlord who would not carry out any repairs (a lot needed!) at the end of the tenancy. I then moved into a rented property from a social housing provider in May 2016 (my partner and I went our separate ways). Last month I received a notification from the local council that I owed council tax for the previous property up until August 2016. I rang the council and explained when i had moved out of the property and sent them my tenancy agreement for my current address dated May 2016, I was never provided with a tenancy agreement for the previous address. A week down the line and i was then contacted again by the council who told me that the landlord had provided them with a tenancy agreement signed by both Myself and my ex for years 2015-2016 and 2016-2017, they also stated that the property was let fully furnished (it wasn't). I asked for these by freedom of information request and have received them this morning. The documents provided are two identical tenancy agreements with both mine and my ex partners signatures very obviously forged onto them, they are not even good forgeries and the signatures are completely different even on each document. I have spoken to the council who have put the case on hold until November 6th so i can try and get some advice but they are basically saying it is his word against mine and it is quite possible that i was living at both properties at the same time! I have no idea where to even start with this, it makes no sense that they are chasing up council tax from may to august 2016 when he has forged the tenancy till may 2017, i can only assume that from me moving out till him carrying out repairs and getting a new tenant took till august so he has told them i was still there so he would get me to pay it. Can anyone offer any advice? its not difficult to prove the signatures are forgeries as they are shockingly bad but the council are not interested in that for some reason.

I lived at this address about 20 years ago but have moved twice since then. I received a debt collector letter in 2013 for this and I wrote and said they have the wrong person but I did not hear a thing until March this year when I got a County Court summons. Did you receive a Default Notice from the original creditor? No Have you been receiving statutory notices headed “Notice of Default sums” – at least once a year ? No Why did you cease payments? I have never made any payments (neither has the person who opened this account) What was the date of your last payment? None Was there a dispute with the original creditor that remains unresolved? Yes, its not my account Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt management? No Hi, I am looking for any advice that I can get. TIA. I have copied the bit from the sticky and put my information in and posted it below. I have filed the defence and done all that I can. The case will be in court in a couple of weeks time. I am not nervous about the court bit, I wanted to check to see if anyone has any advice as it is a fraudulent account. I have reported it to the police via action fraud website and told BW Legal about this, but they are not listening. I have proof that the address the account was started out is not mine etc but they are not responding to any of the points that I am making. The main question that I have is: the account was started by someone using my maiden name. The account was started in 2012. I got married in 2003. Should I tell BW Legal that they are using my name wrong?
  17. Hi there, I am to appear in court for the housing benefit fraud charges. I claimed housing benefits back in October 2014 while i was working part time. i became full-time university student in September 2014. when i made claim for housing benefits online, I mentioned that i am not full-time student. then benefits started and I ended my part-time job. Housing Benefits never stopped until july 2016 when i was interviewed under caution for benefit fraud. total amount for the housing benefits came up to around £4800. I have completed my degree in may 2017 now i am looking for graduate role. I am very scared and depressed knowing that i had committed fraud. If I plead guilty would I be sent to prison?
  18. Hi Everyone, I am seeking legal help or guidance here as I am at my wits end with any Ombudsman, Sky and CIFAS. Over a year ago I applied for a Santander personal account as I had an existing business account with them, to my surprise they turned me down so I contacted them and they could not provide me with the exact reason why. I was also contacted by Santander who then stated that they had to remove my name from our Ltd company bank account. I dug into this and eventually the bank manager found out that a fraud mark had been registered against me and that was against they're criteria. I contacted CIFAS and obtained a copy of the information, in January 2016 Sky TV registered a credit card fraud mark against my name. To keep it short after many phone calls with Sky, a credit card belonging to someone else was used to pay a bill at my address. Obviously I explained this was not me nor did I have any knowledge of this and Sky told me they could no longer discuss the matter with me. At the time the payment was made I did not reside at the property and can prove this, it was rented out to my younger brother and had been for about 12 months. I confronted him about this and eventually he admits he found a card and had been using it fraudulently. I wrote to Sky and CIFAS numerous times over the past 1.5 years to try and resolve this matter, CIFAS eventually stopped replying to my letters and Sky did not once contact me. CIFAS contacted Sky who stated they were investigating the matter but again neither company ever came back to me. I contacted The Ombudsman who initially couldn't help me the contacted another and the outcome offered was a £30 payment towards the arrears that were caused with the fraud payment and a letter of apology for the poor customer service! I obviously decided as that outcome had no relevance to the issue I had. Sky recently contacted me and I called them back today to discuss the matter further, hurrah I though finally after nearly 18 months! But no, Sky once again were unhelpful and told me they would not be taking any more action on this matter! I emailed the lady who contacted me and she responded with the following: Dear Mr , Thank you for responding to my previous email and contacting us today. I am sorry if you felt that my colleague was rude and unhelpful during your phone conversation and will certainly feed this back. I can confirm that the information supplied to you by Steven is correct. In order for us to take any further action on your account we need written confirmation in the form of a headed letter from the card holder's issuing bank which was used to make the unauthorised payment stating that the payment(s) previously reported as being unauthorised are no longer being treated as such. Only once we receive this headed letter of confirmation will we be able to take any further action. Kind Regards Jacqualyn Case Investigation Consultant Escalated Complaints To say I am banging my head against a brick wall is an understatement. I have tried everything but no one will take any action. I have told Sky that my brother is actually willing to come clean and admit he was the one who made this payment but they aren't interested, what more can I do? I've asked them to look at the dialogue for the call as it would not have been me who made it! They have no evidence yet I have a guilty plea and I still can't get my name cleared! Can anyone on here help? I even think I should be compensated for this now as every single day it causes me trouble and not one single person can understand how to solve the issue. Basically if you want to ruin someones credit, get they're account number from the mail, off the TV what ever is easiest, ring them up, make payment with a hooky card and job done, ruined!   20. I made a multi-stop booking with Opodo at 2250 on 10th August, paying by credit card. The stops are: Bristol - Cape Town Cape Town - Gaborone, Botswana (via Johannesburg) Gaborone, Botswana - Bristol (via Johannesburg) When I made the booking the screen said "Free cancellation within the next 1 hour", although there is no mention of this in the confirmation emails. I immediately realised that I'd booked the wrong airport in Botswana (we need to fly to Maun) so I tried to cancel the whole lot. But I couldn't do that online, I have to phone the office and it closes at 2000h(GMT). So I phoned at 0800 today, to be told that it was too late to cancel! I can get no refund at all. I asked about changing the booking to fly directly from Cape Town to Maun instead. Opodo cannot do that, because the flight goes via Johannesburg using two operators (British Airways and South African Airways). I asked about cancelling the flight to Gaborone even without refunds and making our own arrangements. Opodo cannot do that, they can only cancel EVERYTHING and we will lose all our money. I asked what would happen if we simply did not turn up for the flight to Gaborone and made our own arangements. Opodo told me that we will be a "no show" and KLM will cancel the flights from Johannesburg back to the UK. KLM have confirmed this. Help! What can we do?
  21. A bit of a story but I am very worried about something. On 21st April 2017 my aunt passed away. She had a son and a daughter (my cousins). She treated her daughter very cruelly all her childhood, whilst favouring the son and at 16 dtr left home, cut most ties, several attempts over years to put things right, no joy. Dtr now happy, loved, housed, and fed, all by her own hand and pure hardwork lol. However, the son is dishonest, used to thieve off his employers, and steal out of his mother's purse. He then set up a business with his sons and has been bankrupt three times (although as far as we know not currently bankrupt). Aunty has left a property worth nearly £500,000, and she was also rather cash rich. Now, my mother and Aunty used to sit and joke about the little nest egg she had left my mum . Mum used to say she was going to give it to the Donkey Sanctuary, and Aunty said at least some good would come of it. Dtr also confirms that on the one occasion when she challenged her mother about the sheer injustice of all this (after all father had TWO children and had he not died at 47 Aunt wouldn't be in the wealthy position she was when she went) was told emphatically "everything to go to son outright, except a bit of money for you, my sister and her daughter. I have only left you money so that you don't try and contest the will and ruin your brother's life!" Aunt also told my mother this several times. Over the last 8 years or so Aunty became more housebound so her son and his wife took over her care and control of her bank account (although not by power of attorney). I know all this from my mother. Moving onto June 2017, my mum died unexpectedly. She was not a wealthy lady at all. I was able to give her the send off she deserved, and I asked for donations to the Donkey Sanctuary. Well, in doing this it reminded me about Aunt's will, and I thought, well if probate has been granted, then I could look at the Will (becomes a public document then?). And do what mum wanted with whatever she had been left. I really cannot imagine I would have been left anything much because my Aunt helped me out so much when I was a kid. But when I look at the Probate thing on line, they haven't registered it. Now, I told my cousin (dtr) about this, and she says "of course he hasn't applied for probate yet, he wants to empty his mother's bank account first, he is not a suitable person to deal with the estate. he is extremely sly and dishonest". Is there anything I can do here? I think my mum was left a small amount of cash, I would like to have that sent to the Donkey Sanctuary as per her wishes, but I suspect my cousin (son) is not applying for probate yet so he can continue to use the cash in my Aunt's bank account, just as if she were still with us. This cannot be right can it? I do not speak to him, and will not be speaking to him. On another note, I really feel for my cousin (dtr). She truly had an awful life with her mother. This is all confirmed by my own mother. And the things I have had to listen to from my cousin, its heart breaking. It was outright child abuse. My late Uncle (who adored his daughter) got early onset dementia and died when he was 47 . He was in a highly paid position with a fuel company, the house was paid off and Aunt received his very generous pension and all the rights that went with that until she died at 87. I feel that my cousin (dtr) should have an equal share in this, and I wonder, does she have any grounds to contest this Will, whenever we get to see what is in it? I do hope someone can help us out here, neither of us have ever had to deal with anything like this, and the first time we try to, it seems full of dishonesty and unfairness!     NHS PPC Fraud!

    Everyone please be aware of a NHS FRAUD which they say is "legal" and there is no defence! For many years I have had an NHS PPC (pre payment card) for my regular prescriptions. I was not aware that on my 60th Birthday, I would no longer have to pay for prescriptions... But the NHS did, and so in their kindness CANCELLED my PPC arrangement PRIOR to my Birthday (they say they will do this if your renewal is less than 9 months from your birthday). They say they wrote to me in Feb - but I did not see any letter from them them until April / May! They say they "wrote to me". Now have to pay for the prescription I collected a few days between the expiry of my card and my 60th Birthday, plus £100.80 fine! I accept paying the £16 or so for the prescription, however I feel that the £100.80 PENALTY payment required on top is out of all proportion to the event that they themselves engineered! Even if they did write to me to inform me - they made no attempt to confirm that I had been notified - but they say there is no defence: I signed to say I had a valid PPC when I did not (because THEY cancelled it, NOT me!), therefore I commited Fraud! Please be aware of this NHS fraud and do not get trapped! I am still arguing with them - but they say there are no grounds and I must pay. If I commited Fraud, it is because they created the situation! Is this another way of raising money for the NHS?
  23. HELLO Recently I had an car accident hit by the other car. I have the dash cam footage as well. the driver told me to deal with her wife (owner of car) and just gave her insurance company and showed me the email of the insurance. However after 2 days of that accident my insurance company told me that that car was not insured. Probably they might have cancelled the insurance before it commenced and they are not picking up my phone. I already filed a complaint against them with police . How can I get my car fixed? Do I have to hire the solicitor or can be done by myself? Can I get advices about it so I can fix my car without dealing with my insurance company.
