  4. Hi all, new to CAG but hoping you can help! My husband has received a claim for for a PCN over a year ago which I feel is unfair and would strongly like to contest on the basis that none of the parking machines were working on the night he parked there. I have just completed the Acknowledgement of Service online amd intend to request info under CPR 31:14 but I would really appreciate any help you can offer, particularly with respect to what I should specifically request. Thanks in advance!

Thanks in advance
  6. Hello I think I've royally messed up with something and am looking for some advice please. Tonight I was having a tidy and have come across a claim form which I hadn't noticed or even opened. The issue date is the 28th June. I've gone onto MCOL and tried to request 28 days as opposed to the 14 but I suspect the clock struck at 16:00 this afternoon. I'm just looking for words of wisdom on how to proceed please. I know I've been stupid and didn't even see it mixed in with a load of rubbish that usual rubbish and takeaway menus that graces my letterbox. I've inclu
  7. Hi long time reader, first time poster. I requested a CCA from Lowells in October of last year relating to a Llyods/TSB credit card debt. The card in question was taken out in April 2004 and fell into default in late 2012. 4 months later they have sent me what appears to be a copy pasted set of terms and conditions and a copy of the last years worth payments to the account. The terms and conditions have an error in the address I was living at when the card was taken out, they've used the postcode for an address I was living at 10 years later, otherwise it's correct.

  9. Hello, I hope someone can help please. I have just checked my credit score which is 736 (fair). It states: Halifax balance £0 updated 11/8/13 Cabot balance £1280 updated 1/4/18 There are no other debts there. Am I to assume that they have dropped off? Cabot took over the Halifax debt, but both are listed as a default. If i were to offer Halifax an offer, in full and final settlement, agreed in writing, would that remove the default? If so, how long would it take? Many thanks

  11. Good afternoon, or is it? I returned home this afternoon to find a card small card posted through my door, from county court bailiff. I was very surprised, really, and contacted the number straight away. The bailiff answered the phone, seemed pleasant enough, and explained that the visit was in relation to a debt with Cabot finance, outstanding CCJ. He said he couldn't return today, due to having to be at a eviction! He also complained about being the only county court bailiff in the area. He said he might be able to return tomorrow, and he has some paper work for
  12. Hi, back in November my daughter received a PCN from Civil enforcement ltd. stating she hadn't paid for parking. The parking was in a conservative club that you had to pay for on your phone. S he arrived at 12:08 and left at 12:27. In this time she didn't have her phone on her so ran into the shop to see how she could pay as the club was closed. (the only place to park to visit this shop is the club). They couldn't help so she returned back to the car and left. She later received the PCN then a letter from ZZPS saying they will instruct their solicitors to chase up th
  13. My father appointed a contractor to do some work on a boiler in a hotel that he does property maintenance for, there was a dispute between him and the contractor and the invoice they raised was to my fathers company. The claimant being the contractor has issued a claim form but in the name of the hotel company name as the defendant. This should be my fathers company. What do i need to do? Thank you.
  14. Does anyone have a Barclaycard application form from 1990 please? I know it's a long shot, but sadly the copy they have sent me is unhelpfully more or less illegible for the relevant section, and I need the exact wording. What I can discern from it reads like you have to indicate in the box to opt out, rather than the usual indicate to opt in. The final sentence appears to say and the section is titled Here's how it looks:

  16. Hi, my name is Vanessa. Can please anyone give me some guidance regarding this problem that I'm going through? Please see the full story below: Last year I went to London and parked my car. I didn't have any change with me, so used the application "Pay by Phone" to pay for the whole morning car park. 12£. When I got back to the car, I had a penalty notice on the windscreen. I came home and I was sure that I had paid for it, so I appealed for it online. I thought this "paybyphone" app was something new and that the officer maybe didn't check my car plate online.

  18. Hi all, Anyone got a clue what I should fill in at the top of an N252 form? I have an order for divorce costs and need to have it assessed. The first box says "In the" and I assume I need to fill in the Court the matter will be heard in. Where would this be? The second box says "Claim No.". I have no idea what to put here! Thanks, Old Swanner.
  19. I am writing this on behalf of someone else. Where i use the words me i or us means the person involved. Not me. I was employed as a mobile with a well known security company. My main job was to respond to alarms and deal with them. When i started my job off i was told that i was on a gauranteed 24 hour contract (weekly). I was not given any paperwork apart from some paperwork to show how and what i should be doing. I was told be my manager that i would recieve my contract in the post during the next 4-6 weeks. I also emailed my manager and he confirmed that i h

  21. Hello all. I want to make a claim in small claims court but believe I have been given a false name for the person I wish to claim against. He sold me a car and lied on the advert. He has since claimed it was a private so sold as seen but I have evidence that would likely indicate that he is selling cars for profit. (multiple adverts for selling cars, pictures of property with multiple vehicles advertised etc). How can I find out the name of the person to make the claim against? If I use the fake name he will obviously ignore it. I do have the license plate of his car so is it p

  23. Hello to all you helpful souls @ CAG, I am hoping for some advice...... A couple of years ago I took out a payday loan with MRLENDER @ £700ish. I found myself in financial difficulty and was not able to repay. I tried to talk to MRLENDER but they were not interested in my circumstances and just insisted on full payment or interest/charges would be added etc. This annoyed the hell out of me!! Therefore I just ignored them. I have now received a letter from MORIARTY LAW (dated 09/12/16), stating; Amount Due: £1312.50 Original Lender: PDL Finance t/a Mr Lender We hav

  25. I have received a letter from B W Legal, stating that it is a `Discount Offer` to settle a PCN which they state has not been resolved. Their letter is in the usual format. Interestingly, they state that the contravention was dated 23rd June 2012, which I understand pre-dates the official inception date of POFA. I do not have any memory of this alleged event as the car was only in my name for insurance purposes and belonged to my son. As this pre-dates POFA, am I right to assume that if I state that I have no knowledge of the driver, especially after 6 years, they cannot en
