  1. I've recently missed a payment for my gym membership at Fit4less. I requested the direct debit to be taken out on the 26th of every month, although they attempted to take out the money on the 2nd - at that point I didn't have enough funds in my account to pay this. If it was on the 26th the payment would've been taken fine. Since then I've got charges outstanding for £96 (roughly) as I still haven't paid it. Am I right to fight back to Harlands and tell them that it wasn't taken on the correct date?
  2. Hi all, First off, fantastic community here. I have spent a fair amount of time researching and it really is incredible how companies can act. I have a slightly different situation which I couldn't find anything comparable from searching the forums. I signed up for a 12 month Fit4Less membership where the first payment was taken October-2016. I cancelled the direct debit sometime about August 2017 where the last payment was taken August 2017, this was due to me moving about 1.5 miles away and wanted a gym in walking distance. Therefore, I have only paid 11 of the 12 months. I know I should have waited and paid the last month but didn't check fully. Subsequently, I have received the Harlands letters like many on this forum. What are my options? Should I offer the final payment while stating I refuse to pay any admin or cancellation fees? Thanks,
  3. Good afternoon. At the end of last month around the August bank holiday weekend (2017) I decided to cancel my direct debit to Fit4Less because of an upcoming medical condition. On the same day I sent a message to my local Fit4Less on their website contact page saying I would no longer be able to attend and so I have cancelled my direct debit. I had no response. on September the 4th i receive a letter from Harlands saying: Dear MR ***, re: Your membership to Fit4Less We are writing with regards to your membership for Fit4Less as we have been advised by your bank that your Direct Debit instruction has been cancelled and as a result we have been unable to collect your monthly installment of £44.99. Due to this payment being missed you have incurred a £20.00 administration charge. We would like to help you keep up to date with your membership payments and we understand this may have been a mistake so would kindly ask you to contact the Harlands Customer Service team on 01444449029* to pay the outstanding balance and reinstate your Direct Debit. Alternatively you have the ability to make a payment and reinstate your Direct Debit using our secure online payment service by following the link and using the details provided bellow. Go to *some url* You will need the following information to hand: - Ref Number -Credit/Debit card details -Arrears to be paid £44.99 Please note you will not be able to access the club until this balance has been cleared. We remind you that under the terms of your membership you need to provide 1 month's notice and therefore need to make another monthly payment. Failure to do so will result in further action so please contact us immediately to resolve and avoid this. Yours sincerely, Harlands " My monthly installments have been on a no contract Direct debit of £24.99. I understand I should have paid his final installment but do I have a leg to stand on if i refuse to pay the admin charge. I am also going to the hospital tomorrow for his condition so I am tempted to ask for a doctors note. Any thoughts? Many thanks!
  4. Hello, I'm new to the forum. I’ve been reading some of your posts as I too received a letter from Harlands on 20 July demanding a missed payment and administration charge amounting to £42.99 after cancelling my Direct Debit (DD). My thoughts on reading the T&C on Fit4less and the advice given when I joined by the gym crew, was that I didn’t need to give any notice and cancelling my DD would be fine. Little did I realise that the contract with Harlands asks for notice! The letter advises me that 16 July payment has been missed and to contact Harlands by 3 August. Based on your threads, I did not call Harlands but sent them a letter on 24 July as follows: I refer to my membership at Fit4Less gym in XXX with Harlands’ unique reference number (XXX). My agreement with Fit4Less was on the basis of a rolling contract. The first payment of £47.99 was taken by direct debit on or just after 22 February 2017. This payment consists of £25.00 joining fee and the first monthly membership fee payment of £22.99. And then £22.99 was collected from my account via Direct Debit on or just after the 16th of every month I cancelled my direct debit mandate and this was adequate notice of my intention to cancel. I realize now that I should have given 30 days’ notice to cancel my membership so I am offering to pay one-month membership fee of £22.99 to cover the notice period, to you now. I will not pay you any administration or cancellation fees - these are penalties that are unlawful and unenforceable. If you confirm in writing that you will accept the amount of £22.99 in full and final settlement of all that I owe, I will pay you promptly. If you fail to accept my offer within 14 days or you demand any other payment, I will pay you nothing and my offer will be withdrawn. On 27 July I received my second letter from Harlands. Further to recent contact with our offices, Harlands can confirm that one months notice is required to cancel all Fit4less memberships. As you cancelled your Direct Debit too early without stating your wish to cancel, your account went into default. Please contact our offices to make your 30 days notice. We trust you find this in order. Does this mean I can make a final payment of £22.99? Will this require another letter to confirm how to make the payment to them without me phoning their offices? Will I have a default on my credit history, as I don't want this to happen, and I'd rather have a clean history report if it means just settling the full amount. Thank you for your help.
  5. Hi Guys First off thank you all for your advise on the site it has come in useful for me but I could do with a little more help if thats ok. I recently cancelled my membership with a gym called fitness4less. When I joined they said all i had to do was cancel my direct debit to cancel my membership and foolishly I took this at face value. I cancelled and then received the letter for Harlands saying I owed a months money + an admin fee. After a quick google search I found you guys and the letter from Slick. I amended it, sent it off and a couple of days ago I received a letter from Harlands. It seems to have done the trick but this is where I could use some more advice. The letter read, Dear Mr ***** Ref# ****** Further to you recent letter to our office. We thank you for sending in this information Harlands can confirm that the amount to cancel for the 30 days notice is £19.99. Please forward this payment over payable to Harlands as soon as you can. We hope to find this in order Yours sincerely Harlands As you can see they haven't given me any way to pay so my question is what do I do next? I'm happy to the £19.99 to draw a line under the whole thing but was wondering about the best way to go about it. Call them up or write asking for payment details?   6. Hello everyone, I signed up today the 13th of February with a gym membership with Fit4less in Brentford. I decided to do that online so I selected £24,99 per month no contract. I received 2 e-mails after subsrcibing, one welcome e-mail from the club and one with my DD information, the terms and conditions and other relevant information. After reading the e-mail and reading also a lot of reviews for this type of gyms I decided to cancel my membership the same day. On the e-mail they state 'Please note that if you completed this membership agreement whilst not in the club, you have a period of 7 days from today in which to cancel this membership. This right to cancel will cease once you visit the club, or the period of 7 days has elapsed, whichever is the earlier.' I decided to call them to cancel the membership. First time I talked to A advising me that they have not received my details yet and I have to call back tomorrow (at that point I didn't say the reason of my call). Second time I talked to M asking her if they have received my subscription and information she confirmed and then when I told her that I want to cancel she told me I have to call back tomorrow because they do not have all information (only name and bank details). After putting a bit of pressure she said she will check for me. After waiting for 6-7 min on the line, she replied back saying she will put a note on the system and cancel my membership tomorrow. When I asked her if I will receive a written confirmation she replied she can sent me an e-mail. When I asked her when she will sent it she replied between 9:30 and 5:30. Obviously having read a lot of information on this forum I do not have faith that they will do that automatically tomorrow. So what would your advice be? Call them again tomorrow or put my cnacellation request in writting? Thank you for your help. Kind regards,
  7. Hi everyone, it is a long time since I used this site, but would really appreciate some help and knew this would be the safe place to do so. It seems many others have been in a similar predicament. Joined Fit4Less in Halton, Leeds last summer. I was not really using it during Nov/Dec so cancelled the DD in mid December believing that I was under no contract terms as had taken a rolling monthly contract. I was away for a few days over new year and returned to a letter from Harlands requesting £16.99 missed payment and with a £20 charge slapped on for admin costs. This sounds ridiculous. Please could you advise as to what to do. Surely I shouldn't have to pay such a massive £20 charge? I have read some of the threads but am unsure of the success people are having in dealing with Harlands. I am a little anxious as feel I shouldn't pay it but don't want loads of debt collection letters. Thanks in advance

I joined this gym in May 2016 went for about 2/3 weeks before things changed and i stopped going 5 months later I realise I am still paying my direct debit which is totally my fault as i simply forgot to cancel it. October 2016 I cancel it after the payment came out £19.99. Funny enough I get a letter through the door a day or 2 later saying that your direct debit had been cancelled we see this as a mistake. Please get in touch with us to reinstate your direct debit. (Amazing that I have been paying for the past 5 months and not going at all but never got a letter to see what was happening but money stops and bang they are there) I simply ignored this letter because i did not wish to carry on my membership. 2 days ago i received another letter saying that I have missed my payment for November 2016 due to this payment being missed you have incurred a £20 admin charge which leaves my account in arrears by £39.99. In the letter it says we remind you that under the terms of your membership you need to provide 1 months notice and therefore make another payment. Failure to do so will result in further action. Now I do not think i should have to pay anything I never signed a contract, never saw any terms and conditions nothing. The website even says no contract, in fact when I signed up I told the person I only wanted 1 month. now i am not sure what I should do, do i just ignore these letters? or just pay to get them off my backs?   9. Hi there guys, I've signed up for Fit4Less gym on 23rd of February 2016. When I was in the gym to sign up the lady told me that it's a rolling contract and I just need to cancel the direct debit in order to cancel my membership. I then received an email with details about the direct debit and a PDF attached with the Terms&Conditions which I've also attached to this post. However three months ago my work and university duties became so time consuming that I didn't have any time to enjoy the gym so I recently decided to cancel my DD thinking that it will also cancel my gym contract. I've been paying £16.99 per month as per my contract. And on my only day off I've been researching this thing, because I'm not even sure they will leave me alone if I even pay those £37.   10. Hi all, I've spent a lot of time reading threads in to Harlands and am pretty confident that my situation isn't really dire or anything, however I could really use your help. I terminated my contract at fit4less Croydon by terminating my DD in online banking. I had read fit4less T&Cs on their website which quite clearly said something along the lines of "we do not enforce long term contacts" "to cancel anytime simply contact your bank" Hardlands then sent a correspondence out but obviously I know how DD's work so I needed to make up a payment for the following month because of when I cancelled the DD, which makes sense and I was told i'd have access until a date in december. There is a clear payment over the phone on my bank statement to snapdda.co.uk. Shortly afterwards another correspondence came through, this time it said you owe £0.00 Weird? or what? Now it's January and suddenly I get this letter through with further fees added to make £79.98 On the 9th of this month collection passes to a dca (still these guys I presume) incurring fees and potential court action. I'm not too worried. I have spoken to the gym and they said to me about cancelling with a letter but luckily I had memorised what I read in their T&Cs and the lady admitted there was a "common problem" with this. The gym have offered to contact Harlands on my behalf to resolve the issue as I am supposedly in the right for paying my fees as requested before.   11. Dear all, Great website and excellent information. Below is an explanation of my current situation. It's a bit long but I have given as much info as possible in order to be as accurate as possible. Here goes... I was forwarded on a letter from my Mum today (I've recently moved back from abroad and have been using my parents' address) from Harlands regarding my recently cancelled Fit4Less membership. I cancelled my membership earlier this month as when I checked their website I saw that they stated: Monthly membership – paid via Direct Debit Membership agreements are for a period of 12 months, however we do not enforce contracts, long term commitment or pursue missed payments, as we understand that customers require flexibility and freedom to chose when and where they exercise. To cancel your membership at any time simply contact your bank and cancel your direct debit instruction. Please be advised that your membership will be terminated WITH IMMEDIATE EFFECT and your access to the gym will be prohibited from the day you cancel your direct debit. To get the most out of your last month at the gym, it is advisable to cancel your direct debit about 7 working days before the date when your next subscription is due to be collected. Please do not leave it any later than this, or your bank will not have time to prevent the collection of your next month’s subscription." .fitness4less.co.uk/terms_and_conditions.html Taking this at face value I cancelled my Direct Debit via my online banking earlier this month. However I then receive the letter that states (in full): "Harlands administer the collection if all payments due under your membership agreement with Fit4Less abd you bank has recently advised us that your Direct Debit Instruction has been cancelled. The membership agreement you signed states that all payments must be made by Direct Debit. Therefore you must call HARLANDS HELPLINE... immediate in order for us to reinstate your Direct Debit over the phone. If you do not contact us by 18 october 15 you will be charged an administration fee. The telephone lines are open..." Now, the vague wording of the letter and the fact that they give me no concrete reason why I need to pay an admin fee of £25 leads me to believe they are trying to pull a fast one. Also I am not going to pay their ridiculously expensinve hotline. I have returned to my DD agreement and seen it states: "Amount to be debited from your account You will be debited £19.99 on 18/04/2015 and thereafter on the same day each month until further notice. The debit will be collected on or immediately after the date specified Start date for regular billing 18/04/2015 The company name which will appear on your bank statement is Eazipay Ltd. Your Membership details Chosen Membership: Online DD No Contract To start on: 18/03/2015" Then, on checking the T&C sent to me in April (the month I joined) I noticed the following (which is why I think they are trying to sting me here) "If your bank fails to make a due direct debit payment from your account, we will write to advise you of this. We may apply to your bank for payment by direct debit twice within one calendar month and we reserve the right to refer any missed due payments to a debt collection agency. We may charge a fee for failed direct debit payments and/or letters sent to you in respect of unpaid amounts. 5.7 Should any membership fees not be paid within 30 days of the due date, the full membership fee for the remainder of the commitment period will automatically become due and payable in full. 5.8 Any unpaid and overdue membership fees referred to a debt collection agency will be subject to a surcharge to cover the collection costs incurred. This surcharge together with all other charges and legal fees incurred in the collection of the overdue membership fees will be the responsibility of the member and will be legally recoverable from the member" At this stage I am looking for advice as how to reply. I think the website is misleading but I am willing to pay a final £19.99 for the final month membership to close the matter. The admin charge appears unlawful so I want to dispute this. Any help would be greatly appreciated and I will post back here to let you know how the matter is progressing so other people caught out can hopefully learn from my experience. Thanks Des

Hi all, After reading through many reviews and experiences of the cancellation issues with Harlands - I wanted to ask a few questions before I took any action which would get me into trouble/involve admin fees. I joined Fit4less in in September for £17.99 a month (no contract). I did use the gym at first but have not had the time to go recently and so would like to cancel the membership. However, I would like to do it in a fool proof manner so I don't end up falling into the trap of such charges and admin fees, that I have read about. What I intend to do: Send an e-mail AND a letter (recorded delivery) to the gym manager informing me of my intention to cancel, and accepting that I will pay one more monthly payment (as per the notice period of 30 days). This final payment will be in November. What I would like to ask is about the contents of the letter - Do I need to include the direct debit details? And should this letter also be sent to Harlands? Should I expect a reply from the Fit4less or Harlands, confirming cancellation? The reason why ask so many questions is that I haven't actually come across any experiences of people who have done it 'the right way' and had no issues whatsoever. So I'm just wondering if I'll get hassled regardless of how I go about cancelling my membership... Thanks very much in advance
  13. I joined Fit4less a long time ago (over a year) It was know as Energie Fitness. I have never had a problem with them until recently. When the gym became Fit4Less tehy asked me to update my DD details with them so I could continue my membership. I did so and was told I could cancel anytime. My partner gave birth to twins in June and since then I haven't had the time/energy to attend the gym. 3 months passed with me not going once so I thought well I'll just cancel my Direct Debit. A few weeks later I received a letter from Harlands redirected to my new address. Dated 15th Sept, 2 days after I cancelled the DD. The letter stated: Your bank has advised us that your final instalment has been returned 'unpaid' "instruction cancelled". We have therefore, added a £20.00 administration charge which means tehre is a balance due of £39.99. Then they go on to say I need to call this 10p per min line to collect the money. They also I could send in a cheque before the 22nd Sept. They also gone on to say they assume I do not wish to renew my membership etc. After reading similar threads on this website. I emailed this morning the following: Dear sir or madam, I refer to my membership at Fit4Less gym in Croydon. I cancelled my direct debit mandate in the middle of September 2015 and this was adequate notice of my intention to cancel. When I joined Fit4Less over a year ago (previously named 'Energie Fitness') I was told there was no contract and I could cancel at anytime. All they asked me for was my direct debit details, I did not sign anything and was not given any contract or terms and conditions. However I realise now I should have made one final payment for the September 2015 payment and offer to pay this to you now. I will not pay you any administration or cancellation fees - these are penalties that are unlawful and unenforceable. If you confirm in writing that you'll accept the amount of £19.99 in settlement of all that I owe, I will pay you promptly. Yours faithfully, Domo I hope I said the right thing, anyway you can clearly see on their website: f4l.com 'Fit4less Croydon is a great value gym at only £19.99 per month & No contract! I can't find their terms and conditions anywhere on their website and I certainly wasn't given any when I joined. Hope you can help me, any advice would be greatly appreciated as I really can't afford to be paying out extra expenses at the moment. Kind Regards
  14. Hello, Here is the deal. Before joining the gym, the company advertise between two options; A pay monthly, no contract 24.99 pound per month offer or a 12 month contract at 19.99 - No more no less. At the end of the 12 month contract Fit4Less decided to keep me charging 19.99 for the 13th month (and so on). I though 'who gives them the right to do so? My contract is finished', so i called my bank and canceled the direct debit. After some time i received a letter from them claiming that they were unable to charge another 19.99 from me (that would be 14th month) I called them, had a chat with the costumer service, they recognized that my contract should of been finished and said that i will receive a call back from the local Fit4less. Never got any phone calls back And today i received another letter claiming i owe them 39.98 for both 14th and 15th month. I called them and now they are saying to me that after contract ends the account rolls onto an automatic 'pay monthly' plan. And that it states in the Terms & Conditions. I understand that this is all legitimate and I will probably have to end up paying this fee, but what about incorrect/false advertising? Because in that case the advertising should state then '19.99 Per month for 12th Month AND then every month after unless canceled' Thus i would be aware of the situation. Am i able to complain/do anything regarding this to avoid this fee? If you go to fit4less website and click on Caspian Wharf center you can see the options available and how they present it Thank you
