  1. Hi there, I recently fell asleep in a services area because I was too tired to drive. I then received a Charge Notice from the lovely people at CP Plus. Below is the relevent information for my case. Any help would be very greatly appreciated. 1 Date of the infringement 11/2/18 2 Date on the NTK 20/2/18 3 Date received: Didn't note, just screamed profanities. 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? No, it mentions the Data Protection Act. 5 Is there any photographic evidence of the event? Yes 6 Have you appealed? I sent this email to MOTO which they kindly forwarded onto the appeals email. Good afternoon. My name is ..............., I am writing to you because I recently received a charge notice from CP Plus. I work in the railway and I was working at an area called Grately. I was driving back to Leyton in London where I live when I became too tired to drive and pulled over at the services area in MOTO Heston Services. I remember I was around 45 minutes from home at that time but I was just too tired to continue safely. I fell asleep almost straight away and woke up leaving the services area and overstaying by 32 minutes. I’m just an honest working guy and felt it was dangerous to continue driving. I’m appealing to you to please cancel this charge notice as it was an sincere mistake made in the sake of safety. he notice reference number is ................... I can supply any other supporting information that you may require to verify my case. Thanks for reading my email and considering my situation. Kind regards, ........ 7 Who is the parking company? CP Plus 8. Where exactly? MOTO Heston East I'm looking at an appeals template and it has this as a possible argument in it: Your Civil Parking Notice constitutes an invoice for payment. Accordingly your invoiced charge must include an element of VAT. However, your civil parking notice does not state either a VAT registration number or an invoice reference number and so cannot constitute a lawfully valid demand for payment. Any success, with this approach?

  3. Hi I tripped and fell in Sainsbury's under cover car park. There was a pool of water on the floor and I fell flat on my face breaking my front tooth and nose. No one from Sainsbury's came to my aid, two passers by helped me to my car and I phoned my daughter who drove me to A and E. I went to Sainsbury's the following day and spoke to the deputy manager, he filled in an accident form. Went to the car park with me and took photos, examined my shoes and told me he would look at the CCTV footage and call me up last week. So far nothing! I also showed him the A and E report. My dental bill so far is £350 with another £600 to replace my partial denture. Can anyone help me draft a letter as I wish to claim compensation? Do you think I have a case? I don't know what the CCTV will reveal because I was on the floor covered in blood for a while and they never sent anyone to help me.
  4. Hello I am after some advice, 8 weeks ago my car failed the mot, it failed on three reasons 1) nft tread depth 2) parking brake efficiency 3)brakes imbalanced across axle I took it to Kwik fit, they had problems removing brake drums, the brakes shoes were shot to pieces they replaced shoes and it passed the mot. It was making grinding noise and I went back to Kwik fit, they told me the brakes shoes were bedding in, I went back 3 times in all over a month, a few days ago the nsr wheel come off! The wheel bearing had failed, The garage that has repaired it found 1) the brake union loose at wheel cylinder and was leaking. 2) nsr brake spring retainer incorrectly fitted 3) osr hub nut not staked 4) nsr brake adjuster lever arm missing 5) nsr wheel bearing outer race broken The manager had quoted one price but told me if I pay cash it would be £100 less, I paid cash, the only evidence I have that i took it to Kwik fit is receipt for tyres( which was billed separately), and a detailed brake test result. (They took it to another branch to test brakes) I am lucky to be alive I had been on the motorway 2 minutes earlier. Who is the person at Kwik fit to contact? What is my best course of action, have they been negligent? Thanks in advance for any advice (apart from advice on how much of an igit I was to take it there in the first place)
  5. Hiya guys Posting this for a neighbour who's today received PCN for parking on a DYL (01-Parked in a restricted street during prescribed hours) Familiar story that the blue badge fell off the dashboard. The badge belongs to his wife (yes, she was with him) Ticket was issued in Biggin Lane , Hitchin opposite the market, vehicle parked wholly on the road, not up on the kerb. I've had a look at his PCN as well as on Google maps at the location and can't see any errors in the issuing of the ticket. My feeling is that he can only appeal with the facts and hope they are a sympathetic council (not holding breath), but also that there's no harm in running it by you more knowledgeable lot than myself Thanks
