  1. Hi I have been issued with a Statutory Demand, posted no attempt at personal service, from CQ and intend to try to get it set aside using the following No Statutory Notice of Default from OC No letter of assignment or deed of assignment No date of assignment on SD Agreement is an Egg credit card from 2000 (missing prescribed terms?) No Statutory Notice of Default from DCA Also, SD says that interest has been accrued and added from date of assignment. Are they entitled to add interest and if not then the interest amount deducted from the full amount is less than 750. Are the above valid reasons? I was paying back the debt until they suddenly out of the blue issued a solicitor's letter saying I had broken my agreement and had not made payments for 2 years. I had and could prove it. Any advice much appreciated.
  2. Hi All I've recently received a Default Notice from Egg, it's attached. For information it is on 3 seperate sheets of paper and in the top right of the first page it says the letter is about my "Egg Card" - this is incorrect, it's about my Egg Money Card.   3. :???:I had arrears of £14K from a rip off loan (including all the interest that was added on immediatly at point of sale)... Egg have now uphel a complaint from me and paid over £7k in compensation for the PPI added on but now the debt company Arrow is chasing me for the rest. It doesnt seem fair that I have to pay all the reste coz if I had the £7k in my hand I could have insisted on a settlement figure and I am sure they would have accepted as I am currently repaying it at only £10 per month. Can anyone help or advise? I really want this debt to disappear as I feel I wouldnt have got into debt if they hadnt added all the rubbish on it to begin with. Thanks guys.
  4. i have an outstandng dispute with egg card and heve been chased over the years by various DCA'sI have now heard that Barclays have brought egg.I have a barclays account can they take money from this account to settle the egg card

Hello I took out an egg loan on the Internet in 2004 I have ppi on loan That came to around 300 pounds extra The thing is at moment loan is with dca as they have bought it off egg. am I am able to try and claim ppi and if so would this put the account in dispute I have already been sent agreement from egg Thanks in advance for any help
  6. Hi I'm quite new to his forum so any help would be greatly appreciated. I had an egg CC which I defaulted on ( usual reasons; student with no money and even less common sense!). This was passed to capquest. As far as I am aware I haven't paid anything to them or acnowledged the debt since I defaulted. This was over 6 years ago as the details were removed from my credit file last year. I recently recieved a CCJ at my old address (which I still own) about 3 months ago which was forwarded to my current address last week. I have missed the 28 days to dispute the amount and judgement was entered against me on the 22nd October. I have spoken to the county court dealing with it today and was told there is a charge on my property and that I should file a N244 to have it set aside on the grounds that I never had any time to contest the debt. Do I still send the DCA a CCA request? Where do I go from here? Any help please as this is really getting me down.
  7. Today I received a letter from Bryan Carter advising that if I do not make full payment within 14 days then he will recommend to his client that proceedings be issued without further notice. The debt is from an original loan and a credit card from EGG. It was passed to Credit Solutions some years back and I was paying them at around £45 per month but a few months ago I could afford it no longer and cancelled the payments. They passed the debt to Fredrickson International who have sent me several letters all of which I have ignored. The alleged amount is £1507.68 but I have no way of checking this. The letter says I should telephone Fredrickson immediately to avoid further action but the last thing I want is them knowing my telephone number. I would be grateful of any help as to how I should proceed with this.
  8. Hi, just posting about the last "difficult" creditor I have. I had a massive paycut, followed by a year of ZERO income, which is how I got into this situation. (Full detail on Intelligent Finance thread) Long story short I wrote to both in Dec 09 with full I&E and offering £1 until I returned to employment. Neither really responded other than with a DN followed by CCJ from Egg Loan in short space of time, and a second DN (!) from Egg Card. (They defaulted me sometime in 2009 already.) At least that stopped the fees+interest. Both are in five figures. I think these are now with totally different companies in effect, as these bits of Egg bought by different people during the Crunch? Egg Loan have now obtained a Charging Order and immediately accepted £10 per month over the phone the following week. I'd been offering them that for over two years, including post CCJ, so I can only assume they need to waste their money taking me to court for accounting reasons. Egg Card have been totally quiet since the DN. It hasn't been chased by anybody. Around April I phoned to see what was happening and the guy on the phone did a lot of muttering of "what... who... who did that... doesn't make any sense..." when looking at the notes and promised to get back to me. Never did. I am now employed again at under half of my former income, but still have the same massive mortgage AND a years' arrears on it to clear, so there's nothing in the pot for unsecured. We're living to a budget that is slightly under CCCS's figures and doing OK, and as above has been in front of a court. I don't know whether to approach Egg Card or not - what are the consequences if I don't do anything? If I do approach them will I just end up with another set of court proceedings almost immediately when they realise they've dropped the ball? On the other hand I don't want to be straight with the other creditors in 5 years' time, and then find I have to start all over again with someone that has bought an old debt. I should add there is PPI on some of the balance. I made a complaint about it which they declined almost immediately, and the letter was very much of a tone of "you can't prove it" - but that was followed a month later by the letter that went out to LOTS of people about PPI asking me to claim. I did a lot of silly things with money when I had it, but I certainly was never daft enough to sign up to PPI, so I'm certain I have a case. When I phoned about the letter the regulator made them issue I was given a lot of hoo-hah about not being able to sort it until my arrears were cleared, and then crisis mode took over and I parked it until I saw some pursuit of a final defaulted balance. (Which I never have, so far!) Do I have a problem if I've complained about it once and not pursued their nonsense "final reply" in any way? Any limitations on complaining "again" - although this time it would be coming off the balance rather than being given to me in cash. Suggestions please... but not urgent because I'm paying the tenner on the loan OK and as I say there is NO collection activity on the card. And finally - would a SAR force them to release the call centre notes on my account to me? Whatever he was reading sounded fascinating...
  9. Hi, Found this forum recently and this is my first post. I have an Egg loan which dates back to 2003, it was defaulted in 2003 and has since dropped of my CR. I have various other debts but egg is the largest. For reasons which I wont go into I have buried my head in the sand when it has come to my finances and have just started to try and deal with them. I'm looking at all the different options on how to address the debt. The first thing i noticed is that it had dropped of my file, i then checked to see when last written acknowledgement/payment was made to find out when it became SB (in 2yrs). I have not heard from egg (other than standard annual loan statement) or DCA regarding this debt for nearly 18 months. I am thinking that I do nothing and wait for it to become SB. My worry is that egg will decide to proceed with court action and try to obtain a CCJ, therefore resetting the clock for SB. Does anybody have any experience of Egg not chasing the a loan for this long and then either selling it on or going to court? Any advice would be gratefully received

Hi all, Its only a very small victory, I know, but I got a lovely letter from The Apex Credit Management & Bulls*!t Production Company today telling me that Egg could not provide them with the signed credit agreement, or the default notice that was allegedly sent before assignment and therefore have returned the account to Egg and removed all CRA activity they have put on! Is there anything that I can claim from Apex (like all the payments I have made to them) to donate to CAG? I couldn't have got this far without reading the excellent advice from this site and would love to give back somehow... I still have my MBNA struggle and realise that I will soon be dealing with Egg again, but I SAR'd them yesterday and am not expecting anything new. It is just so lovely to get rid of the DCA, I find the original lenders much easier to deal with. Didn't think a bit of happy news would go amiss here! Feel free to comment RobboM
