  1. I am going to try and keep a long story short! Sent 4 parcels with MyHermes on the 9th November. On the 5th working day only one had been delivered (They say all parcels delivered within 3-5days) After lots of chasing, unhelpfulness and general disinterest, a further two were delivered on day 7. (resulting on me also receiving negative feedback on eBay). So this leaves me with one parcel missing. After lots more chasing, I have just relieved a call from their customer services to say that they have found the packaging, but the parcel has been "tempered" with and the contents is missing. They suggest that it has been stolen. When I posted the packages I paid for the maximum compensation they give on the website which is £250. However the item was sold for £297 and the postage cost me £7, giving a grand total of £314. They have suggested that I could report the crime and potentially claim on my home insurance, however, with excess, I wouldn't retrieve the additional £64 and this would let them get off with paying anything. Is there anything that anyone knows of that I could use, either wording in a complaint letter etc that could help me retrieve all of my out of pocket expenses?   2. Hi - I am a new user. Any advice will be gratefully received. I am recovering from a serious stress related illness which started in 2003. I have been intending to check my credit card accounts,etc for ages but only just got round to it due to not being well enough through illness. I have the relevant statements. I have claims against a few companies but these go back as far as 2002. Am I right in thinking I can only claim for the last 6 yrs? Will the fact that I have not been mentally fit enough to tackle this be taken in to account at all? I also have a large claim against my bank but I am worried that they may close my account. Has this been happening? I may have problems opening another account due to a not very good credit scoring.
  3. Hi all, Back in 2010 I was supposed to be returning from Madrid to Heathrow. Despite checking for delays before traveling to the airport (there were none) the flight departed 5 hours late. I booked with BA in the UK but the flight actually turned out to be operated by Iberia under a code share (I think BA subsequently acquired them regardless). Myself and dozens of other passengers complained at the time, the Iberia staff couldn't cope as the queues at the information desk were in excess of an hour - and even when you did get to the front they had no information. Their answer was to just shut up shop and walk off. We mentioned the EU regulations we were directed to fill in a standard complaint/claim for compensation at the desk. I did this and some weeks later I received a response. The delay was dismissed with the usual nondescript extraordinary circumstances prattle. Upon reflection other flights (including the Iberia scheduled to depart after my flight left on time) so I fail to see how there could have been air traffic or weather issues. Unfortunately I gave up at this point considering that taking to Iberia to court in Spain would be far too much hassle. I no longer have their official response to my complaint as it was some time ago. With the recent changes/clarification in legislation I'm inspired to pick this up once more and I've no qualms about issuing proceedings. First question, I booked with BA but the flight was operated by Iberia. Am I correct to assume that I should be pursuing BA rather than Iberia - it would certainly be easier to deal with a UK company. As a starting point should I write to BA customer services and simply reiterate my claim for compensation? If this is a good place to start should I start sighting legislation etc or simply state that I want my 250 euros, leaving the legal references for subsequent letters? Thanks James
  4. Hi,I bought a car which had a previous owner and sent off my details to the DVLA to register the car in my name. Recently my wife received a NiP from the police saying that the car had been allegedly been caught speeding. The date of the alleged offence was 4 days after I bought the car but the notice didn’t get sent until 66 days later! Firstly this was to my wife who is not the registered keeper and secondly it was way passed the 14 days required by law. My wife wrote back saying she couldn’t complete the form that was sent as she is not and has never been the registered keeper and that I was….all that the safety camera unit did was write back to her again asking for her to fill the form out….even though she has already told them that she is not the registered keeper!It’s now been about 82 days since the alleged offence. Is the NiP enforceable as the time frame is way beyond any reasonable timeframe to notify me and there appears to be several errors on the safety camera unit’s part along the way? Thanks in advance for you help and advice
