  1. Hello! I am pursuing a PPI claim and received a letter saying the lender has found my agreement and as it was a postal app with the box ticked and so it was non-advised and therefore I have no grounds for a claim. I may have ticked the box but the fact that even if I did I still don't actually know what the PPI covers me for, whether I would've been eligible to claim on it if, what I was excluded on and whether or not there was a different insurance on the market at the time that may have been better suited to me. If they say they have the postal app with a ticked box requesting insurance, is this the end of the road for my claim? Many thanks
  2. Hi all, Today I have received a letter telling me I'm being investigated for benefit fraud and I must attend an interview under caution. I can categorically state I've not been involved in benefit fraud and I'm a mixture of angry and worried. I called them to ask what it was about and all they would say is that they have reason to believe my partner was living with me when I claimed. Here's the situation: I was living with my partner until June 2010. Due to various reasons we separated and he moved out. From this point I claimed benefits as I was looking after our child etc. He moved into work accommodation and paid his rent, bills and registered to vote etc etc. This can obviously be proven. We had a child together and when I called benefits to advise that my partner moved out they said "will you be sorting out child maintenance?" I replied that we would sort it out between us which they were happy with. We were amicable for the sake of our daughters and he suggested paying the gas, electric, water, tv license aswell as contributing to clothes, nappies etc for kids. This contribution amounted to about the same value as the £180 per month I would get from the CSA. It made sense too as I only have a post office account so could not have direct debits. So he kept to the direct debits. His accommodation was a single room in works accommodation and due to the nature of his work it was not appropriate for kids to go there. He would come and visit the kids and take them out a few days a week. On the odd occasion he would stay overnight to look after them more. He would sleep on the sofa and didn't eat with us at all as he was on maximuscle protein shakes so didn't eat lol. By staying over on the odd occasion I mean rarely. This continued for months. In may 2011 we began to discuss getting back together and he moved in early June and we immediately informed dwp and hmrc etc. Today 6/7 weeks later we have received this letter. I'm just worried and angry as I don't see that Ive done anything wrong at all. I can prove he lived elsewhere. What evidence could they have when ive been completely above board? Any help, advice etc would be great. Thanks
  3. So glad to see my favourite forum has a special needs section!!! My middle son was diagnosed with Aspergers a few weeks ago, we have made a claim for DLA on Friday and I recieved a phonecall from a lady on Monday morning!! She asked a couple of questions on mobility and night times. She said we would get a decision in 1 - 2 weeks. Im guessing that means she wont be contacting any other agencies?! Does it sound like bad news to you?? :???:
  4. This is a bit of a strange case. I will try to be as brief as possible, ha ha! Last year my daughter (D1) moved out of the house she had rented with 2 other young women (one of which is my other daughter). They cleaned the house, and returned the keys to the letting agent and askedfor their £1500 deposit back. At this time D1 found out that the deposit had not been protected in a DPS as it had stated on the Tenancy Agreement. D1 had borrowed the deposit from her boyfriend initially and since they had broken up recentlyshe needed to return it to him. Emails went back and forth to both the landlord and the letting agent with the landlord refusing to sign off to release the deposit. He said they had damaged the property and then he disappeared. Then the Letting agent went out of business and closed the office. I work for a law office and one of the solicitors wrote a letter to the landlord at the address we had been given threatening court action if the deposit was not paid. No answer, so we filed online with MCOL. At this point my husband and I decided it was best to pay the boyfriend offto relieve some stress from D1. Served the landlord and it was returned as no one at this address. Started investigating him and found he owned 2 properties on the same street but under a different name! So, had name changed on court papers under his new name. Went to court and he showed up! He had some cock and bull story that he didn’t have time to get his evidence together as the letting agent who had proof of dilapidations had lost her husband and couldn’t find them at that time. Judge granted him an adjournment and tells him to send us his evidence. He never does. Go back to court, still no evidence of dilaps to us. Judge gives him 1 week to get them to us. He has the photos copied by the court staff. Absolute crap photos. Could be of anything! No date stamps on them, nothing to show they were of the property they had leased. Certainly not the ones from the letting agent that he had spoken of. So, long story short we got notification of Final Hearing to be held in 4 months. D1 had applied to join the army and train as a medic in July 2011 and had been waiting on a decision. She finally got written notice and the 2 dates for Selection. One of those days was our day of the Hearing. She wrote to the judge, paid £80 for an adjournment and told him how important these 2 days were and that being a woman they only have Selection a few times a year and she couldn’t miss it after waiting almost a year. The letter from the army came 2 weeks before the hearing. Court wrote back that the judge would decide on the day of the hearing if he would grant her the adjournment. He didn’t and found for the damn landlord and now she has to pay his costs! He also said that she knew she had court coming up on that day. Yes, but she didn’t know she had her Selection until 2 weeks before! The judge also said that the other 2 claimants didn’t show up. There is only 1 claimant on all the court papers and that is D1. The other 2 wrote to the judge months ago and explained why they were letting her handle it as it had been “her money” that had been put down for the deposit. So what do we do now? This has cost us over £2500! We have the original Entry Inventory and it shows what a mess the house was and the Exit Inventory was done 25 days after they moved out. They have sworn to us that they left the house in better condition than they found it. If you have got to the end of this I applaud you. Thanks for any advice on what to do next? Appeal? Complain?
  5. iv been recieving job seekers allowance for some time now and they sent me to an advisor from a different company they call it a back to work program now i still sign on as normal once every 2 weeks i just attend apointments with the other company at alternate days and times and the idea is they will help me look for work, to be fair they really just sit there and tell me to use a computer whilst im there nothing special anyway they send me apointment through the post i turn up look for work every ones happy. but the problem is i didnt recieve an apointment from the 15 of may to the end of may then i had an apointment with them then again nothing for a further 4 weeks then i have had many apointments two or three a week and the JobCentre get in touch and tell me i have aparently missed 4 apointments and ii had a letter from the Jobcentre regarding the missing apointment which i had to contact them seperatly for each one so i did this where i was asked several questions on why i missed apointments which i told them i was attending when i knew of apointments and none of these apointments i had no letter or anything they said they would be back in touch this was 2 weeks ago i then got in touch with the advisor who said, after seeing him several times and none of this ever mentioned, i had missed several and he had personnally got a record of sending these letters now in the past he has told me he has personnaly wrote me letter which i have never received yet i have recieved 15-30 apointments which i have attended so why this letters never arrived i do not know. now the jobcentre has been in touch via 4 letters today regarding each individual apointment and tell me they have decided im in the wrong and not going by the jobseekers agreement and will be loosing a mininmum of 2-3 months JSA untill further notice but i still need to see the advisor and to sign on ? i have a child with a ex partner whom i give £15 a week to help her out and so i dont feel i do nothing for the child its not much but its the best i can do also i pay board and have many bills to pay i cannot live with no money is there anything i can do to argue this out with them ? anything i can do to get some sort of benifits ? i need help asap please somebody ?# thanks in advance im writing here firstly to have a moan and to get it all off my chest and secondly to get answers
  6. Hi All I am here for some help on appealing on my partners behalf. On Monday we received a letter saying he had been giving 0 points following his medical assessment with Atos. In the letter several things we told the ATOS assessor were not included and some things he wasnt even asked had been but put down (it states he watches tv for hours at a time when he cant!). I rang up to say I was appealing and am in the process of writing a letter. The problem is we are still awaiting the full medical report so do I just pick through the letter they sent and identify where he meets the descriptors? Also his GP has written a letter but all it states is the medical operations he has undergone and now he is undergoing tests for carpel tunnel so is no help in matching up to the descriptors but should I still send it in and explain these are the reasons why he meets the descriptors? I am a bit confused as this is the first time I have ever done anything like this and as he cant read or write it is down to me to sort all these thing! Also the fact that he cant read or write is because he never learnt not through a health condition but does this still count as meeting part of the descriptors? Sorry for all the questions I just really need to sort this as we are a family of 3 and now have no income until I put this letter in and want to get it right!
