I have an A5 with an S-Tronic gearbox fault. The oil cooler has failed allowing engine coolant to flow through the gearbox, which has killed it. Diagnosed at my local Audi center last week, the car is a 12-Plate & Dealer service from New The cost of a replacement box is £12k with the car's value at about £14k The 3-year warranty expired in June 2015, however Audi still treat the car as "young", as it's less than 5 years old. Audi are saying they won't contribute towards the cost of this repair, I've raised it with Audi UK (callback tommorow.) I fully expect them to stick to their guns, I will then escalate to Audi HQ in Ingolstadt, Germany. Failing any joy with them, how do I stand, from a consumer-law point of view? I've been told that "reasonable use" with regards to a vehicle, correctly serviced at the Dealer, would be 5 years. The car is currently 4.5 years old. It also has only 28k miles on the clock, very low milage. My plan, if I cannot get it repaired by them, is to pursue a claim in the county court, but would like to know my chances of success. I've seen, in motoring forums, somebody turn an absolute "no" from the manufacturer, into a "yes", by pursuing them in the small claims court. Which I'm guessing, the manufacturer wouldn't want to go anywhere near, due to bad publicity? I feel like Audi should step-up & sort this issue, however it's going to be a battle.

I had a card from HSBC in 2002. In 2010, I had difficulties paying so I went through the sar process, discovered that I had never signed a contract and tried to negotiate a lower settlement on this basis. In 2011 I missed a deadline to acknowledge a claim from Northampton as so received a ccj via default. I only missed the deadline by one day, spoke with the court and sent in a n244. However, the case was assigned to Uxbridge and so the n244 was lost in the system. So I sent another n244 to the new court and understood that this was in place. I have now discovered that the ccj is in place. I have contacted the court but they are saying there isn't a lot they can tell me but they can confirm there was a set aside hearing but are now telling me it should have been transferred to a court local to myself. It is a little complex for me, can anyone offer any advice please?

Hi All, This is mostly for info - and comment Mum killed herself in July 2015 - dying on the 26th. On 19th Nov, we received a letter from a firm of solicitors claiming to have acted for Mum and hence seeking a payment from us of £573. The letter asks for our agreement to pay within 14 days ("accept our costs" ) or it'll take the matter to court. The first odd thing about this is that it's the first time I've come across solicitors doing work before getting their sticky fingers on money first. The second odd thing is that we're not aware of any solicitors doing work for Mum. Why should we 'accept their costs' ? we surely may accept Mum's costs, but not theirs!!! I just forwarded the letter to the SRA and stated that we're unaware of the firm and that no contract exists between them and our family. We have not heard from the solicitors again. I find myself in new territory and would appreciate some guidance if possible. My sister is terminally ill and we are a very small family. This consists of: Daughter (K) 2 Grand children Older sister in Europe (RB) Me (sister) been caring for her (RD) My niece (K) has no problem with me dealing with all official and non official things because she is not coping with her mothers prognosis. However, I am obviously aware that my niece is the next of kin and we are communicating everything together at each step of the situation as it arises. Hi everyone My dad worked in Holland for a few years but through ill health came back to England and died on the 4th October 2014, but last month (may2015) I received a letter from the Dutch pension body saying they were sorry for our loss but they overpaid my dad for the month of October by 195 euros and they wanted it back. (I didn't even know he was getting a Dutch pension) I phoned them up to explain he lived in a council flat and only had around 2000 pounds to his name which paid for the funeral and that there was nothing left , I even offered to send them bank acc details and the bill for the funeral to prove it had all gone but they replied quiet angrily saying they weren't bothered if there was nothing left, in Holland the debt goes to the children to which I said I've never had that money plus I live in England and they turned round and said if you don't pay we'll send the bailiffs round and take your stuff to cover that amount yet back in England he owed some council arrears and I explained the same thing to them and they wrote off the arrears. my questions are ? 1 Do I have to pay them or even should I pay them. 2 can they send the bailiffs round to take my stuff . I just cant understand how Dutch law can over rule English law and make me pay. I'm grateful for all and any help cause I just don't know where to turn

After some advice if poss. Partner has applied for finance on a new van for his business, he is a sole trader, so finance needs to be in his name. Credit record is good with a score in the 900's. He applied for the finance but got a call off of Close Motor Finance stating that he is being reported as deceased under a previous address on some closed Santander accounrts. On looking at his credit report from Credit Expert, under closed accounts there are 3 credit cards, a current account and a personal loan all in his name, all recorded as deceased, all opened AFTER he had moved out of the address and in to our new house in 2008. He has absolutley no knowledge of these and has never had any dealings with Santander. The current account was opened in 2009, the 3 cards in 2010 and the loan in 2011. He has emailed the CRA's to dispute the entries with a copy of his passport and tennancy agreement of where we now live. He has also done the same to Santander with a copy to the CEO to see if that will speed things up at all. My question is, does anyone have any experience of how long these entries will take to be removed as he is waiting on this to get his new van which he cannot go to work without as the old one has died? My father passed away on 21st December 2014 and his benefits stopped. Fair enough as the Housing Association flat was paid up until the end of the month. We managed to clear out the flat well before the end of the month and handed back the keys. We were then told that two weeks notice has to be given and that they want £212.52 less £100 as the flat was clean when handed over. We received the invoice this morning almost 2 months after the estate had been settled. I am not sure how my father is supposed to notify the Housing Association that he is going to die and to give them appropriate notice? They have a clause written into the tenancy agreement stating that in the event of death, two weeks notice should be given. I would have though this was an unfair clause in the contract? do they have the right and can they legally pursue us for the money although we did not sign the contract?

Hi, Hoping you lovely people will be able to give me some advice as I'm having terrible trouble with Marsden debt collectors. Around three months ago my Polish girlfriend moved in with me having been a UK resident for around three years) when she did so i told her to switch her details with the DVLA for her address which she did. Having done that it seems she flagged up on Marsdens list for a speeding ticket that had been sent to a previous address, the short version is she had 4 changes of addressing 1 year and was out of the country for several months caring for her terminally ill mother in Poland. she never received the original speeding fine as she had moved and not notified as she wasn't at a fixed address. the first we knew of it was when Marsden sent a letter saying she owes £1055 ! I contacted them right away to find out the details etc.. . and i took my girlfriend to court to make a statutory declaration to say she had never received the fine in the first place, the court said the bailiffs would be notified and the procedure of the court case would start over again. That was the end of it from Marsden, or so we thought. We received her paperwork from court saying we had a new court date (november 4th 2014) of which we would attend and tell them what happened. However today Marsden have been back to our address with very threatening attitudes saying the court hadn't contacted them so they were still under contract to collect. i tried to contact Poole magistrates court but i just get stuck in a round and round automated phone system. i explained all to the Marsden bailiff who called me a liar and said it all still stands. I have a photocopy of the statutory declaration and the new court papers etc.. but couldn't show them as they were with my girlfriend at her work. How can i stop Marsden coming back they said its not up to them to contact the court but at the same time i can't get hold of an actual person to speak to at court ? Thanks in advance, Danny

hi all Due to a recent death in the family I am trying to help sort out the debts that they have left behind and have a few questions about it as we have found various letters saying they have some debts we where unaware of. My understanding is that debts are paid from the estate if there is anything left after reasonable funeral expenses How can I find out about everyone who is owed money to?(I have some letters but may not have them all) Is it creditors job to come forward and claim or do I have to inform them? If so how do I inform them? what happens if I miss some creditors and they come forward at a later date but there is no estate left? also there is a water rate debt in their name that has been getting paid off by their partner,would they still have to pay it as she lives in the house or is that wrote off if it cannot be paid for by the estate? Hi Bit complicated but will try to explain. I bought a fish tank and external filter from an online company at the end of November last year. Stocked it with Discus fish which are very sensitive fish, and very expensive. About a month ago on a Saturday night, the filter started to leak. It leaked onto my wood floor, damaging the floor by making it swell. Also the cabinet sucked up water and became unstable. Due to this I had to empty the tank, and put the fish into an unused tank I had spare. I also had to use a smaller internal filter that has been unused for quite some time. ***Info bit - when you have fish, you need a matured filter with enough bacteria in it to consume the waste and excess food from the tank. The bacteria eats ammonia and nitrite which are both poisonous to fish, so a matured filter takes care of this and keeps the tank/fish healthy. Using a new or unused filter means there is no bacteria in it to eat the ammonia/nitrite, so the tank goes through a cycle of ammonia growing, being converted to nitrite (poisons and cause diseases) and then nitrate, which is safe for fish*** My unused filter I had to use had no bacteria, so my tank with the Discus in it (tank I had to move them to) started a cycle, creating ammonia etc. A cycle with fish in the tank is very dangerous to the fish, even the hardiest of fish struggle. Doing this with a tank of Discus is much worse because they are so sensitive. Anyway, even though I did water changes daily to keep poisonous levels of ammonia/nitrite down, it wasn't enough and my fish died. I am an experienced fish keeper so I did everything possible to save the fish, but putting them into a new tank with new filter = disaster. When this originally happened, on the Saturday I emailed the company hoping for a reply on the Monday. No reply by mid morning so I rang, but was told the number I rang was only for sales, and that any complaints/problems have to be done via email. It took them 6 days to get a new filter and cabinet to me. By this time the good bacteria inside my old leaking external filter had died, so I had to basically start again with the new filter and the tank had to run the cycle of ammonia-nitrite-nitrate. As I said, over the next couple of weeks my fish died from various diseases caused by the water quality, which was due to the new filter. My problem is, if they would have let me speak to someone on the Monday morning when I rang I could have had a new filter and cabinet the following day(they do next day delivery), which would have meant I could have been set up, the bacteria in the old filter would have still been alive so I could have used the materials inside in my new filter and all would have been great. Making me wait 6 days, with 24 hours between emails from them caused a disaster and I have lost at least £350 worth of fish (I have photographic evidence). I emailed the MD with my complaint and asked for a reply within 7 days, he ignored my email, so I sent a letter registered post and received a reply today. There is no mention of my new damaged flooring which has swollen and lifted, but generally says... ***I would like to offer my personal and sincerest of apologies for the inconvenience. There is a trouble shooting process which is used to resolve product issues effectively. He is truly regretful that this experience was not a positive one for me and to compensate for my livestock loss (fish) he would like to give me £60 store credit to spend with them*** I have to email the customer service manager to spend this credit... Im not very happy at all, I dont expect the earth, and I never complain about anything, but this was my Christmas present and I had always wanted to keep Discus fish. Due to them not letting me explain the issue on the Monday morning, and making me wait 6 days for replacements, my fish died, and it wasn't my fault, I did everything possible to keep them alive, as I said I am experienced and know what I am doing, so their delay in helping me caused the entire problem. The implications for LA's if everyone effected appeals is that they will have to inspect every property to ascertain the amount of actual bedrooms there are, rather than relying on info supplied by landlords or tenancy agreements, something LA's have not got the resources to do. It will be interesting to see how HM Gov react to this.

I am continually getting letters from Rossendales for some alleged debt my late husband had. My husband has been dead for 2 1/2 years. I have been returning said letters marked "Deceased" for some time (without saying who I am) - written on the envelope. That doesn't seem to penetrate their amoeba like brain cells. Yet another "begging letter" as I like to call them arrived from Rossendales today. This time I have been a little ruder, asking them what they don't understand about dead and that I will sue them if one more letter comes to this address. This latest letter states that Arrow Global have onpassed the "debt" to them (sure they said the same thing a year ago...) Nothing I would like better than to sue the **** off these parasites for harrassment. Can someone point me in the right direction too do just that please?

I bought a car on March 4th 2013 from a car dealer who trades from home. I paid £1700 for the car (2002 Focus ST170). It was up for £1995, i knocked him down to £1700. When i took the car for a test drive there was a random light on the dash, the dealer said it was the traction control. I trusted him, as he obviously knew about the car...or so i thought. This light turned itself off a day later. So i wasn't too concerned. It turns out it was a coolant warning light. It never returned after about 3 days of having the car. Within a week the Engine Management Light came on, i bought a OBD2 scanner to see what the issue was. It picked up 2 codes, one for a Lambda sensor (£100 not fitted), and one for a dodgy CAT (£600) i assume the CAT fault shows because of the sensor. I thought this wasnt a major problem, so bought a sensor off of a friend, but didnt fit it as i never had the time. I thought changing the sensor would clear both codes, i dont know though? It is something i could do, so i wasn't too worried, minor fault in my eyes. Things kept going wrong, the passenger door wouldn't open from the outside, the rear window washer sprayed water into the car not the window, the washer reservoir empties itself after a day or so. Then, on 7th May i was driving home and the engine died. I got the car towed home by Green Flag. I plugged the scanner in and it revealed a timing issue (P1383)...or so i thought. I got the timing belt cover off to discover the belt was missing most of the teeth. This has probably trashed the engine as the valves would have hit the pistons. I specifically asked the guy if the belt was changed, to which he replied, yea i think it was. Its a £500 job to do as its a weird engine, and there is no room, the engine needs lifting out pretty much to change it. What can i do? Ive done less than 1000 miles since having it, and now it is destined for the scrap yard. I will be £1700 out of pocket! Im very frustrated, i cant afford to lose that sort of money. I can sell it for spares or repairs for....£500! But i don't think this is right given what i paid for it. £200 car, yea fair enough, you expect problems. Am i right in assuming he, as a dealer has to provide a 3 month warranty? He is on holiday until 20th May. I tried ringing him and there was a message explaining this. He has pulled his website, im not sure because he is on holiday, or for other reasons. What are my rights? Can i get my money back as it was not fit for purpose? It can be repaired but will cost over £1000 to have it done. Is he responsible for this? Hi there, Can someone help point me in the right direction regarding what rights someone has when buying as a business?? The reason i ask is because my friend was instructed to purchase a laptop as a business buyer even though the laptop was mainly for home use and not work. The laptop has died at 13 months, she went to the store to see if they would maybe repair as gesture of goodwill with it only being 13 months old and basically got told to go away/nothing will be done. Because she bought as a business user they will not honor SOGA 1979 due to it being a business purchase?, while this may be the case is there some other protection that she could fall back on because of this?? Is there another 'act' that may cover her for help with this at all. More annoyed than anything as she now realise's why they were keen for her to buy as a business when she mentioned she was a physio, as she now has a £350 paperweight !!!! Hi everyone, My father got an invoice from UKPC for allegedly parking in a disabled space (in a free carpark), I read through some of the posts here and told him to ignore them, he has since died. My mother rang them and explained the situation, they told her to appeal and send them an original death certificate. My mother has now suggested that she send them the usual letter denying any liability and a photocopy of a certificate, is this a good idea? I'm not an expert but I would assume that trying to take a dead person to court would take a lot of effort. Thanks in advance.

Hi, I have a Halfords battery that I bought brand new in late 2009. I remember I paid cash for it and put the receipt aside in what I thought was a safe place. I now can't seem to find the receipt as I need it to return the battery as it is completely DEAD. It came with a 5 year warrenty as it says so on the side of the battery. I have two cars, one a Golf TDI which I use for daily commute and the other a Volvo for which this battery was in. I would only use the Volvo a few times a month but I wouldn't have expected the battery to die after a year or so of using it on and off. I've tried everything to get it going. I even put it into my Golf and kick started it down a hill then did a 40 mile motorway commute but when I tried to start the car, nothing. A little bit a crank which was all it gained in a 40 mile journey, so the battery in my book is toast. The battery died around 6 months ago and it has been a doorstomp ever since as I can't find the receipt and figured they won't accept it back as I paid cash which means no proof like a bank statement etc. Any advice? Can I still bring it back under the SOGA even though I don't have a receipt? Thanks!

I,or rather my wife got this letter in April. According to Apex, I'm dead and they are asking for a copy of my death certificate! Sorry it's taken so long to post this here but coming back from the dead is a very difficult and time consuming process. The amount of paperwork involved is unbelievable. I can reassure you all I am very much alive and have at no time been deceased. I bought A Blackberry Playbook at the end of January this year. It was the top 64gb model. I bought it online from PC World website. When I received it, it would not boot it just hung on blackberry logo. I contacted blackberry as was going to return it to PC World. But after blackberry told me to connect it to computer and do a update it finally started working. And has been working fine until a week ago when started having problems charging it. Now the Blackberry Playbook won't charge at all, it is completely dead. When you plug charger in to it no lights come on and it won't switch on. I have tried another charger to make sure its not the charger and it makes no difference. I have contacted rim blackberry but so far they have not been very helpful. I have my receipt from purchasing it online. Can I return it to a PC world store. Its still in warranty I have had it under 5 months. Or will PC world just tell me to contact black berry. Or as bought online can I not return it, will I have to send it back to PC world. I paid £250 for this tablet and its useless. Whats the best thing to do and what are my rights. I have read alot online in different forums about people having real problems returning BlackBerry Playbooks to PC World. And PC world not wanting to do any thing or telling them to contact manufacture. Any advice would be much appreciated Thanks in Advance
