  1. Hi, Starting separate thread for each debt per DX's advice CCA request printed & being sent Monday, then need to get started to see if anything to reclaim....
  2. Two years ago a claim was made by Creation Finance. I offered £20 they refused and it went to court whereby the judge ordered that I pay £14 a month yippee. Been paying that ever since. I then receive a letter from Dryden Fairfax this week who have taken over from the previous idiots who represented Creation originally. The crux of the letter says as you know we originally agreed that you could pay £14 (no you didn't the court did) a month. As we told you when we took over this matter last year that we would be reviewing this on a 6 monthly basis this letter confirms that your payment plan (eer CCJ I think) is now to be reviewed. Please complete the enclosed I & E. First of all, I will certainly not be doing that. Is the only way to force me to pay any more is to go back to court. Is that correct. I am under no obligation to pay any more than what the court ordered? I feel like writing to them and saying go back to court my financial means have lessened since the original court hearing and you may be awarded £1. BTW the original idiots tried to get a charging order which was in an original thread of mine where they failed to turn up despite sending a fax to the court that day saying they did not know when the hearing was. The CO was dismissed so I know the court would not be happy if they tried this again. Drydens were (1) Unaware of the previous CO hearing and (2) still seem to think this is a payment plan and not a CCJ Thanks for your help HH
  3. Hello, Looking for some advice on a claim against an old Alders store card that Creation finance took over. My card was between about 1996 - 2005, however after sending a SAR to Creation finance they have responded with the following: "We can not provide you with a Data subject access because the account is closed and no longer active. We are no longer holding details of your client on our records. You will appreciate that documents request under section 7 of the data protection act 1998 cannot be supplied, however I can provide all available statements from March 2004 to November 2005" - Is this information correct that they are telling me as they have cashed the £10 cheque that I sent them for all records? - On the statements that they provided it only states Interest charged at 2.00% per month - does this mean that no PPI was charged to this card? Thanks for your assistance Jon
  4. Hi I have/had a credit card with Creation/sygma bank. This was done in the MK One store where I used to live as a student. Obviously being a student, and absolutely skint, I thought "ooh free money" - How stupid!! Things with the card got out of hand, and Im not even sure how much I used it, owed in total: anthing!! other than I never paid it, and a few ears later after being chased by Lowell Portfolio, I owed £736.33 After a few letters back and forth, and a lot of help from you guys, I eventually got them to stop contacting me, as Id asked for a copy of the original credit agreement, which the were unable to obtain. So in effect, the debt was written off.   5. Hi all, Just wondered whether anyone could provide any comments on a situation we're having with Creation Finance. We've been paying them a reduced payment on a DMP for a few years and whilst we don't get much hassle off any of our creditors any more, I actually read some standard post from them the other day. Looking at the recent Creation statement (was an Adams store card), we're paying £20.10 per month (and have been for nearly three years), but each month they charge £14.88 in interest, meaning it's only reducing by £5.22 each month (with appriox £3k on the account, barring a massive change in circumstances, I think we'll be paying this for a very looooong time!!!) Can anyone think of a way of getting the interest stopped? They're a lender, so hey, it's no surprise they want to charge interest, but bearing in mind we haven't used the card for years and they know we're in difficulty, presumably there should really come a point where they say "ok, we've added lots of default fees etc and charged interest for 3 years AFTER they were on a DMP, lets call it a day with the interest and just let them repay the current balance" Any ideas? I've scanned and edited the most recent statement if that would help? Cheers Bill
