  1. Hi All, Thanks for taking the time to read my problems. Hopefully someone will come along and offer some advice. I had an accident in DEC 2011. It was snowing, i indicated and started to turn right into a side street. The car behind me wasnt paying attention and slid into the right hand side of my car damaging both doors and writing the vehicle off. the defendants car suffered damage to the oassenger front wing and wheel. At the scene we exchanged details and the defendants passenger signed to say that there car was at fault. I have been dealing with the most incompetant insurance company EVER. for the last 18 months I have been hitting a brick wall trying to sort this mess out. The defendant has said that they are not at fault and said that we were traveling the other way and i pulled out infront of her. Her solicitor have disputed the evidence that her passenger signed at the side of the road because it took my solicitor and insurance company 13 months to send it to them. The defendants witness statements have major differences in them. (at a quick read i have counted 8- ranging from the reason of travel, the damage to my car, the damage to her car, the weather conditions etc) I have pointed these differences out to my insurance company who refuse to ask the defendants solicitors why they are different. I originaly complained about the poor service and fact they had not sent the signed admission of liability to the third party in Jan of this year. The complaint was closed because 'it was unjustified' The county court trial date is set for Monday the 17th. I live 300 miles away from the county court where its at and have been told that i cant claim expenses etc for attending. I think the hearing is for 10am. It would take me 5 hours to drive down for the hearing and cost upwards of £300 for the total journey. im so frustrated because I know that this should have been a simple case with the 3rd party signing and accepting liability. but the errors by my insurance company have made it complicated. What Can I do? my legal advisor doesnt want to know, and i think to be honest she couldnt care less what the result is on monday because i have given her a hard time. Any help would be greatly appreciated. I cant sleep on a night from worrying about whats going to come of the hearing and how much my insurance will go up as a result of there incompetance. Thanks
  2. Hello to everyone this is my first posting, although I have used this forum as a resource. Santander (ex Alliance and Leicester) have offered me a nice sum for miss sold overdraft cover, a version of PPI but only going back six years. Although I have had an account there for at least twenty years! Is this correct? They state that they only hold six years statements (very convenient) and can go back no further, I am sure I read somewhere that they can estimate the redress due even though no statements are available. I might have one or two old statement in my shed but nowhere near over fourteen years worth… Will I have to accept the very generous offer or can I push harder and get proper redress?

Hi Guys, Went into Brighthouse today and managed to get myself a lovely TV being delivered next Wednesday Sure the price is a little high, it seems like a brilliant birthday present though However, Am i right in assuming the products listed in the Title are optional and i have a right to cancel them ? While it being a Hire Purchase Agreement, I'm sure that there is something about me not having to have these products and i've scanned the T & Cs thoroughly... Also if i pay it off early, what would i potentially save?
  4. well my car went into local bodyshop last wednesday for some dings to be removed via a pdr tech coming in from dent devil the dings were on the rear passenger door, since then I haven’t cleaned my car and dirt has built up over it so today today is the first time I have cleaned the car since bodyshop. The car has accumulated quite a bit of dirt and as a result I noticed a donut like ring in dirt on passenger door front. I cleaned the car then examined further and noticed that either the bodyshop or dentdevil have dented my car and tried to cover it up. Firstly you can see the the crease slightly , second tap marks of the tools used to remove dent then wet sand marks which I guess they didn’t have time to clean up because I surprised them early by popping in as they finishing work on it. Well annoyed trying to contact dent devil rep to confirm what work he had done on my car , he conveniently cant remember what work hes done and told me to contact body shop , im guessing the ring like mark I noticed in dirt was his line board stuck my front passenger door , ive spoken to the bodyshop owner who i showed the car to today and he informed me that he can see a repair has been carried out but that they did not think it could have been the dent devil guy as he wasent there long enough and they use him loads but he admitted he could not explain why there was a donut like like ring in dirt where the dent was and told me 9/10s of his customers wouldn’t have noticed it, however my car was at the bodyshop all day. I know they or the dent devil guy they got in has damaged and repaired another area the proof is there for me to see clearly but im having a hard time getting to the bottem of this , is there anything further i can do ?
  5. Hi Took out Scottish Power Platinum cover September 2012. First cover taken. Was going to go with British Gas but as Scottish Power tailored my new energy plan to incorporate this cover for just an additional £6 per month on my monthly direct debit I was not going to query. They explained about the radiator cover as well and told me they would arrange for an engineer to come and do the service check. Due to the bad weather it was not until January that they eventually got out to look at the boiler. Just before that the display panel on the boiler (ideal boiler) was not showing anything even though the boiler was working fine. I rang up and even though someone had not been to service the boiler they did send someone out to fix it. Good service as sorted within 2 days and the panel was working fine. Inspection a couple of weeks after that About 3 weeks ago the display went again. Finally arranged for someone to come out and look and it seems that there is a leak in the boiler that is leaking on to the display panel that is why it was going off. The sub contractor said he would price up and inform Home 3 Assistance who rang me a couple of days abot and said would need a new heat exchanger for around £750 and plus other parts so totally £1,409 and as my cover is only for up to £1,000 they cannot do. I was horrified as I did not know there was a limit on the cover. I was never informed of this when I took out the policy as previously spoken with British Gas and they were offering unlimited cover when they explained to me so most likely assumed that this cover was unlimited as well as I was never told. The home assistance guy said that there was nothing he could do but if I rang British Gas customer services and inform them that I was mis-sold the policy as they were the only ones who could overturn this decision. Rang them today on the number he gave me who then told me I needed to ring another number from which the lady then new I was getting the run around so actually put me throught to a lady called Jan in the customer complaints. She took the details and rang me back about half hour later to inform me the the terms and conditions highlighted the maximum amount that they would pay. I told her that I was unaware of this but she just kept going on about the terms and conditions. I understand this but I told her I would never have purchased the policy if I had know that as pointless. Come on when things go wrong with a boiler it is more often going to cost over £1,000 as labour is just as much as the flipping parts!!!! She is escalating and getting some other person to ring me back on Monday although she was adamant that they would tell me exactly the same as what she has I just wondered if I had a 'leg to stand on'. I am furious as wasted the last 6 months on a policy that is useless. If I had gone with British Gas I would have been covered. If I go with them now my boiler is not going to get fixed. It has now this evening started making a noise like a crying sound and the pressure gauge is starting to vibrate back and forth. This only happens when powering up. Please help Many thanks Lisa
  6. Hello, Just after some advice really on how to go about cancelling the cover plus on my perfect home items, along with their insurance. I did not have home insurance at the time of signing my agreement but I do now, am I therefore able to cancel Perfect Home's? I have searched for a letter template but am unable to find one if anybody could please point me in the right direction? Best wishes and Thank you Dp x
  7. Hi All, We broke-down in France last week and have been flown home by the AA. We then got a call to say it was the clutch and it would cost 800 Euro's. I've checked and it seems this is a lot of money and in the UK for example it would only cost about £300. It does appear it would cost more in france but still not as much as the quote. Do I have any rights to dispute this amount? Thanks
  8. Hi, I'm after some advice regarding the selling of an HSBC commercial mortgage with the bank insisting that life cover was also taken out with them. I'm wondering if there is any case for a claim of mis-selling of the life cover? The business was a partnership between 4 family members, parents (of retirement age) and two sons of working age. The commercial property had sufficient equity in it to cover the repayment of the mortage upon death/inability to work. Key man insurance was already in place elsewhere for the two sons. HSBC were clear (this was in 2002) that the mortgage would only be provided if life cover was taken out through them for the two sons. Sadly there is no written documentation to illustrate this insistance. Thanks for any help or advice. P
  9. I have a question about an issue that my employer is proposing to enforce on myself and my colleagues. Due to a recent situation where staffing levels fell short the management are proposing to enforce a contact change whereby employees may be compelled to provide shift cover with little or no notice. This would impact on the personal lives of myself (as a single parent) and my colleagues in similar ways. Is this proposed change to our contracts legal and is it something that can be imposed upon us considering the problems it will inevitably cause to all our personal lives?
  10. If in the wrong forum please move to the appropriate forum. Thanks. In May 2011 we purchased a front towing cover for our caravan. This prevents stone chips on the front of the caravan from stones being thrown up when travelling. We had to supply them with details of the caravan etc indicating that the cover was made especially for our type of caravan. On arrival and before fitting the first thing I noticed that there were no see through panels for the front lights and reflectors. I contacted them immediately to complain and was given a story that the lights could be seen through the material. At the time I did not think of the reflectors which I now believe are a legal requirement on a trailer. I told the company that we were unhappy with our purchase and that as it was within the 7 days under the DSR I wanted to cancel. I was told that as per their terms and conditions we could not as the cover was made specially for the caravan. Unfortunately I foolishly accepted this and it was only later I found out that the front towing cover was a universal fit. During the summer we were towing in the daylight and had no issues, however now that the days are short and murky, we have discovered that on a murky day the lights are not really visible and of course the reflectors cannot be seen. At light the lights are a subdued glow, but again no reflectors visible. We are of the opinion that the front towing cover is not fit for purpose under SOGA as it doesn't comply with the laws of the land as a trailer should have the front lights clearly visible along with the front reflectors. The cover was purchased using a debit card. What sort of action can we take now? Thanks.

Hi there - i took out a public liability & general construction insurance policy last November for me as I was self employed and have been paying monthly eversince but I recently took a full time job. I now no longer need the insurance. I have emailed the broker about 5 times and asked them if it is possible for me to cancel the policy and if there was a cancellation charge but i still have no reply. The policy was financed by 'PRemium Credit'. Im quite happy to pay for the policy if this is what i need to do I am not trying to get out of it in any way but i have read through the contract and it does not mention anything about cancellation and Im just wondering if legally I should be able to pay a cancellation fee and end the contract early, or do I just have to see it through to the end of the contract. Thank you for any advice here Cheers!
  13. Hi there can anyone insurance minded help? My mum is terminally ill at the moment and my dad has a pre-booked golfing holiday in Turkey to get insurance cover for. Please don't judge my dad has been a rock during my mums illness and we all feel he does need this break. The problem is my Dad is 60, working and fit and healthy however my mum is not as I have said. We need cover that will allow him to come home at short notice if needed at no extra cost to himself or should it be that due to my mums condition he really can't go he is covered financially for a refund. I know this is a hard one as most people don't want to touch us but if you can help that would be fab!
