  1. Hi all I have received a letter from this company stating that I did not display a valid permit in a college car park whilst attending an event. I did have a parking ticket from the machine which was clearly displayed on my dashboard. The letter includes a photograph of my car but from a distance and simply showing that my car was parked in the car park. I have written the following. Before I send it, is this OK? ******* I write to appeal against the parking charge notice as detailed above. I attach a copy of the parking ticket I purchased and clearly displayed on my dashboard. The photographic evidence you have supplied does not show the dashboard clearly and so does not show whether the ticket was or was not clearly displayed. I was attending a event at the college and was not advised that I needed anything other than a valid parking ticket in order to park my car, which I have provided to you. ******
  2. Friend built up congestion charge debt as (stupidly) he didn't change the address for his van when he split from his wife - she just threw any correspondence for him in the bin. Bailiffs called to enforce debt. Only real asset was work van that had finance outstanding. Bailiffs said that they were taking control of van, finance company were called and said they could not. He kept the van. Problem is the van will be paid off in a couple of months and he is worried that the Bailiffs will then return to take control. What is the situation around this. Don't have any paperwork to hand as friend works away during the week so will not be able to see anything until the weekend.

Same rate to judgement or (sooner) payment. Daily rate to judgement £0.03 Total debt and interest £154.94 What is the value of the claim? £229.94 Has the claim been issued by the original creditor or was the account assigned and it is the Debt purchaser who has issued the claim ? Parking Control Management, Were you aware the account had been assigned – did you receive a Notice of Assignment? I later received a letter from DRP ( Debt Recovery Plus) who said that the unpaid charges had been sent to them for collection, but there is no mention in the letter of the account being assigned to them. I have registered and completed the acknowledgment of service form online as was advised on this site, so now I suppose that I should be preparing my defence. I hope that I have followed the guideline set out correctly so far. I received a claim form today, below are the details from it which I am supposed to include in this thread. Please could anyone give an further insight or advice about the pitfalls to avoid. Thanks
  4. Hello, So long story short earlier this year I found myself unemployed and survived off credit. I owe £26k to various companies. I was advised a few months ago to declare bankrupt and am in the process of raising the funds (should have all paid by 13th Jan). I had a CCJ awarded against me for ~6000 by a credit union. This was a loan. Monday I received a Notice of Enforcement from Harrison (Marston) stating that a High Court Writ of Control had been gained and I needed to pay by 23rd Dec. I have been reading and would appreciate some advice. I own nothing of value, I sold most of it to feed the kids earlier this year. My first question is can this be enforced by a HCEO? I have read that they don't deal with debts regulated by the Consumer Credit Regulations 1974. Second question is if they can enforce it what would be the best way to stall them until bankruptcy? I was told that if I paid any debts off now then the court would reverse them as I cannot be preferential to paying a particular debt. To complicate things further my wife is currently in hospital so I am looking after 3 young kids whilst trying to sort this. I understand that bankruptcy is where I need to be but don't think I could deal with the stress of having bailiffs at the door! Any help appreciated. Thanks
  5. Today I have received a Issue of warrant of control for debt to lowell from the courts ,it states a baliff will to remove goods call unless full payment is made by 22nd jan . I admit I have left this spiral out of control , but need advise please . I am a full time carer for my wife who has severe mental health problems/suicidal thoughts and multiple physical disabilities . Also my son who has severe autism has been having fits and I have been so worried about both my wife and my son and also suffering dizziness and anxiety myself have left this go , I did receive a claim form back in april , then in july was ordered to pay instalments of £50 a month , however my financial situation is that my wife claims employment support Allowance and is in the support group , she claims Personal Independence payment , the mobility payment being paid for her motability car ) the only income in my own name is £62 a week carers allowance, also back in January last year a budget sheet was compiled when contacting the national debt helpline of our finaces and we had more outgoings than income . The £50 a week set by the court has not been paid and I have buried my head in the sand so to speak due to all going on with my wife's mental health , and my sons fits ,now Ive made matters worse receiving the Warrant of Control . I havnt got the money to pay , and I cant allow balliffs in and this would cause my wife distress , and as she is prone to suicide attempts . Also severe anxiety disorder .ongoing depression and is on a lot of medication. , constant tremors Any advise please , I have alot of documented evidence of my wifes mental health from health care professionals . kind regards
  6. I would be grateful for some advice. I occasionally get some eatables and pickles from India using Fedex courier services. My father paid the charges for the courier services in India and declared the item value which was 15£. I have received the parcel without any issues. After 3 weeks time i got an Invoice letter from Fedex for the payment of 30£ for Duty and Tax. In the Invoice its clearly mentioned that the total value of the goods was 19£ and Fedex was asking me to pay the Duty and Tax of 30£. I have attached the Invoice. I have called Fedex and queried them about the invoice, they said some miscalculation will send another one, but again they have sent the same Invoice of 30£. After few weeks later i got a call and a Message from Controlaccount saying ' Please contact Controlaccount quoting reference number **** in relation to Fedral Express Europe Inc'for which i did not reply. I have called Fedex again and queried them about the invoice, this time they have asked me to send an email to customerservice explaining the situation. I have sent them an email and got a reply from them saying 'Having investigated the matter in more detail, the invoice on this occasion has been issued correctly. The charges have been levied by the local Customs authorities in the destination Country. Please find attached a breakdown to show how the charges have been calculated (Breakdown attached). In the breakdown the value of the goods was showing as 76$, i am not sure how they got this number. The initial Goods value as per the invoice is not matching the breakdown which they have send me through an email. Please advice. Thank you Krish Fedex Breakdown.pdf

Earlier today I received a Notice of Issue of Warrant of Control from the County Court Business Centre, it reads; Urgent To the Debtor You have not made payment under the judgement as you were ordered. The creditor has therefore asked for a warrant to be issued to the bailiff to seize and sell your goods. Unless you pay the amount due to the court before 02 December 2016 the bailiff will call and may remove your goods for sale at public auction. This may mean that you will have to pay further costs. Total to Pay £179.25 Balance Outstanding £1,392.38 Dated 25th November 2016. ==== I have registered at MCOL and have my MCOL account details and Password but am unsure how to go ahead as I seem to be missing some information, MCOL asks for Claim Number and Defence Pack Passwords but these are not on the Warrant, just Case Number, Warrant Number, Local Number & Creditor's Ref. === At no point have I ever acknowledged the debt with Lowell Portfolio either by phone / letter or email. The name on the warrant is also slightly incorrect, it has my title as Miss whereas I am a man in my late 40's. I don't know if this is relevant or not but thought best to mention it. === I am in no way capable of paying any of the outstanding amount. Following a serious illness I am now long term disabled, my only income is ESA ( support group ) and High Rate DLA. A little other information that may or may not be relevant, my home belongs to my Mother but I live here alone, I have no proof of ownership of any of the goods in the house and so understand that these can be / may be taken by the bailiffs.   8. I'm assuming there is a precedent to this. I have a debt to the Council for back Council Tax which I have been paying back as and when I can afford it. Today Bristow and Sutor sent an enforcement agent (who told them he was a bailiff) while I was out and luckily they did not let him in. Nothing, apart from a few items such as my bed and an old stereo which is worth pretty much nothing, on these premises belongs to me as I am just a lodger here and the room is furnished by the landlords. I have never denied that I owe something but the amount is in dispute I have told B&S this previously but they have ignored all my letters. The bloke cleared off when it became clear he wasn't being allowed in but I suspect he will be back. Apparently he was eyeing up their car and I would obviously hate for them to become involved when it is nothing of their doing. Do these people have any claim to anything on the premises and where do we stand if they return in the future? I have spoken to the Council but they say it's out of their hands now although I suspect they could do something about it if they wanted to. Thanks in advance for any help and advice
  9. Hi, yesterday I was issued with a PCN for parking in a disabled space without clearly displaying a disabled badge. I have a disabled badge but it had slid from the dashboard to down the side of the dashboard. I was distracted when parking and had realised it had slid down the side. I have read lots of threads on here and am totally confused. Should I hold my hands up and admit it wsnt displayed clearly or defend the claim. My nissan note has a small side window that would have shown the badge had slipped down the side but I doubt this is clearly displayed. The disabled bat was clearly marked with signage etc. This was at Faraday Retail Park Coatbridge ML5 3SQ. Many thanks for your advise
  10. Hi, I've had a read through previous posts and was hoping for some advice on our current situation. We entered debt management plan in Jan 2013 (70k credit cards & bank loans). Never missed on mortgage payments (1 residential & 2 buy to let) and these are currently up to date. We have a couple of properties which have finally increased in value and are hoping to sell this summer and get back on track. Our DMP has always been up to date. We were wondering what our chances were of obtaining a mortgage in future once we come out of the plan. Both of us have good jobs and stable employment. Also - if we went for part/full settlement of our debts does this pose an increased risk? We were hoping that if we went for part/full settlement we would be able to save and get another residential mortgage in a year or two - not sure if mortgage company would look at us - any thoughts? Really appreciate any help and advice as this DMP is a weight round our necks that we really want to get rid of as soon as feasible (never paid a bill late until we entered into this but was unavoidable due to significant change in circumstances). Please be gentle as I am not overly familiar with protocol on forums. Thank you for reading
  11. Hi, Over the last few months I have received a CCJ, then a notice of enforcement now an e mail threatening that a HCE are going to enforce a Writ of Control. I do not have a car or any belongings that are valuable. I know not to allow entry to bailiffs. I am just wondering how long the HCEs will keep trying to obtain the money which I just do not have??? Also, might they try to escalate the matter to making me bankrupt? If so, do they have to serve a writ by hand? I will be moving soon so this may alleviate some of the pressure! Lots of questions I know - and any advice would be most appreciated, thanks!: BAE
  12. CAG... I write this with good intentions but its becoming more and more apparent that ignoring DCAs is becoming a bad idea. Just like the case of Harlands / Zinc and Court, It appears Control Account are issuing claims. I attach the following example... The debtor of another site, which i will not mention was told to ignore Control Account PLC and is now being advised to try and get unequivocal proof of who the legal manager is, statements etc... Its becoming apparent that DCAs that are normally dont even consider legal action are now attempting it. There is a way to deal with these types of claim and using the below advice will steer you in the wrong direction. Please remember that just because an account is with a particular DCA, it doesnt mean you will beable to second guess them.
  13. This happened at the back of the Exeter Arms in Derby, 2015. I went round the back of this pub to park and unload my equipment in to the pub but all the parking bays owned by the pub were taken, s I did pull up near the rear entrance to the pub unload my equipment and then take my car round the front to park on the street which by that time was free parking. Some weeks later I received a letter from VCS with a fine for parking there. I was going to ignore it but my wife talked me into sending an appeal letter, which of course was rejected. Now I'm receiving lots of correspondence from CVS and now bwlegal. Up to now I've had a couple of letters from bwlegal threatening to take me to court if I don't pay up, even quoting a successful court case of ParkingEye Ltd v Beavis [2015] UKSC 67. I guess what I'm asking is, should I continue to ignore these letters or is there something I could do?
  14. Back in September, I parked in a private car park, and paid for four hours parking, between 11:30 and 15:30. Following the instructions on the ticket, I firmly attached the ticket to the windscreen. When I returned to the car at about 14:30 (early as I was not feeling well), the ticket has peeled off the windscreen, and there was a PCN attached to the passenger window. I appealed the PCN on the grounds that I had actually paid, so there had been no loss of income, in a half empty car park. It was an extremely hot day, and the ticket had obviously remained in place for some time, as the PCN was not issued until 13.44 in a regularly inspected city car park. Other people had the same issue, but unfortunately I did not think to take their details. This appeal was rejected, I then appealed to IPC, who also rejected my claim on the grounds that T&C's are clearly display - which I do not dispute - I had no intention of breaching them! I have ignored the threatening letters from BW Legal, and had hoped it would get dropped - but the claim form via CC Business Centre says otherwise! I will send off the Acknowledgement of Service within the specified 14 days, but am beginning to doubt myself... is it worth fighting? Any and all advice appreciated! Thanks! DETAILS FROM CLAIM FORM Name of the Claimant: Vehicle Control Services Ltd Date of issue: 26/05/16 '1.The Claimants claim is for the sum of £100 being monies due from the Defendant in respect of a PCN issued on 27/09/15 at 13.44.53 at the Percy Car Park Hanro Group Hanro Group. The PCN relates to (car & reg). 2.The terms of the PCN allowed the Defendant 28 days from the issue date to pay the PCN, but the Defendant failed to do so.. Despite the demand being made, the Defendant has failed to settle their outstanding liability. 3.The claim also includes statutory interest pursuant to section 69 of the County Courts Act 1984 at a rate of 8% per annum a daily rate of 0.02 from 27/09/15 to 25/05/2016 being an amount of £4.84. The Claimant also claims £54.00 contractual costs pursuant to PCN T&Cs' Amount Claimed- £158.84 Court Fee- £25.00 Legal Representatives Costs- 50.00 TOTAL AMOUNT- 233.84
  15. Hello, I am writing on behalf of my granddaughter who received a PCN from a management company as above subject (PCM) for not displaying her permit. Her car had been in for repairs and the permit on the floor of the car. She wrote to the company and explained; but she received a refusal back. They do not dispute she holds a valid permit but the "operative was unable to determine whether the car was allowed to park there" . They say in the letter she has a number of options:- Pay the £60 charge within 14 days, if not it increases to £100. If she believes the decision is incorrect she can use www.theIAS.org to appeal. If she uses this service the offer of a discount would be withdrawn! She is 19 and gets the minimum wage. Her mother purchased 3 of these parking permits when she moved in last year. Does my granddaughter have a leg to stand on. Any help would be gratefully received. The letter from them is dated 23 March so the 14 days has gone by because she said she didn't think she could do anything about it but I said I would get some advice from you.
  16. Hello. Earlier this week I went to Iceland (Sheffield) to do an emergency last minute Christmas shop. I parked in a sensible position (in line with other vehicles, not causing an obstruction). To be fair, there were no marked parking spaces, but I (foolishly) assumed that it was simply because the area had been re-surfaced. 30 mins later I emerged to find that myself (and everyone else parked equally sensibly in the same area) had received a ticket from Vehicle Control Services, Sheffield. The fine is for £60 if paid within 14 days, or £100 or court action thereafter. I surveyed the area. It being a few days before Christmas, the whole car-park was bursting at the seams with cars queueing for spaces. To make it worse; the rain was lashing down, and so it was difficult to see the "parking restricted areas" signs in the area where I parked. (Nice small font, and no chance of me reading them from any distance). It says there were four of them, and I have no reason to disbelieve this. On the ticket it says that my car is filmed, but that the driver was not present. However; the Vehicle Control Services car was there when I returned to my vehicle; so it's feasible that they could have actually filmed me as the driver too. What do I do? £60 is a huge amount of money for a struggling single mum, especially at this time of year. But I'm nervous about ignoring it - because, to be fair, in hindsight I shouldn't have parked there. I can see 'old' forum threads advising to ignore the fine and all further correspondence; but maybe the law has changed since then??? I don't want to risk at greater fine, or court action. Any up-to-date advice would be greatly appreciated. Thank you.

  18. Hi all, Just a little advice needed please. I received a Private Parking Invoice on July 22 in Manchester from Vehicle Control Solutions. I looked on a couple of forums and the advice seemed to be to ignore it and don't make contact until the 'Notice to Registered Keeper' arrives. BTW, the parking ticket states that 'The driver is liable for this PCN'. This morning, I received a letter from Rossendale Collects, dated October 10, giving me 7 days to pay a balance (no mention of fine or invoice) of £130.00. This is the original invoice of £100.00 plus an administration fee of £30.00. The letter is, grammatically, terrible. One line reads 'You have ignored previous request for payment' They also seem to have an aversion to the use of a comma too! Also, there is no mention of the date the invoice was given or the address of the car park. I heard that if the the parking company don't write to the registered keeper within 56 days, that is reason enough to cancel the invoice. Has anybody had any experiences with these companies? Shall I just ignore this letter and future ones? Many thanks in advance!
  19. Hi, It's been a long time since I needed to come onto this site but it looks like I'm back again. I need help but really don't know if helps going to be possible now. Ok here is what's going on so far. background info For the last five weeks I have been at my mums house, I'm diagnosed with bipolar and things have been pretty bad. I've been back and forwards to the doctor to get help, their mental health clinic and 9 days ago things hit critical mass and the doctor called in the mental health crisis team who have been visiting me daily and will be for the foreseeable future. I live alone and after a massive problem with new meds given to me by the doctor I moved back to mums for my safety. I'm on yet another set of meds that at least has started to let me focus on things hence being back on here for help. My problem Arriving home I have found two letters, the first a notice of issue of warrant of control. Dated 15th March 2016. It states that I owe Marlin Europe I £804. To be paid by the 29th March 2016. Posted on the 18th March. The second letter was hand delivered I have no idea when and this is a notice of first visit, talking to neighbours there was somebody at my door earlier today but the date on the letter is the 1/4/2016. My daughter went to check the house on Saturday and said she didn't see any mail so I don't think it was delivered on Friday of Saturday. The letter also stated I have until 10am on the 6th of April to pay the amount owed. Now the bit I need help with I haven't to my knowledge had anything to do with Marlin Europe, I have no idea who they are, I also have no idea when all of this was started and have had no paperwork from the courts. I have been through everything I've received since Christmas to check to make sure I haven't missed anything. I really don't know if I have any options or do I just roll over accept it and try to come to some agreement with them, but since my income is esa at the moment they can't have a lot. I would be very grateful for any help, this has come out of the blue
  20. Hi all, Wondered if you could give me some advice. I was in Grahame Park in Hendon today and needed to pop to the Sainsbury's local store. There was a lay by to the side of the store which had cars parked in it already and I pulled in, was just about to get out of the car and a bloke walking past said "Don't park here mate, its a loading bay and they are taking pictures of the cars". I thanked him and got back in the car but as I was pulling out into the traffic, a woman appeared and took a picture of my car and the registration plate. I went back there later (without the car!) and fair enough, there are 4 signs up but they are at least 10ft in the air and the wording of them is tiny, there's no way anyone could read them without getting on top of them. They say the usual about agreeing to pay consideration in the form of a parking charge, £100 and £60 if paid within a time period etc. I must have only been there for about 3 minutes at the most and there was no ticket put on the car but what do you reckon I should do? To make matters more complicated I've only just moved and the car still registered to my old address! Any advice would be much appreciated, Thanks
  21. Hello all I went on holiday in my car to Wales last Easter with my Friend and her Grandkids one of who is disabled. Had a lovely time but I got A demand for a parking fine in October for 80 pounds. It included a photo of my car in two different positions. It said I had parked for two hours. It looks to me as if I had parked there earlier to pop in the shop and then later to pop in the shop on my way back and they are saying I was there the whole time. I can remember the days we went to the beach and we paid any parking charge. Otherwise i had stopped for 2 minutes at different places to pop in shops. I cannot remember seeing any signage OR PARKING machine Looking at threads on different websites they all seemed to advise not to reply and not to pay. One site lists the different letters which they send and I have reieved eactly those letters so far. We have got to the letter where the bogus debt recovery firm is threatening to advise the VCS to take me to court. I notice that more recent advice is not to ignore but not necessarily to pay. I dont want to lose my credit rating its taken me a long time to get it back up. but I think it is unfair that they send me a charge six months after the fact when I cannot remember where i was or what I was doing. Also I will not have receipts to show I was in the shop. The charge rose to £200 and has now dropped to £140 if I pay in a certain time frame. They threaten I will get bad credit. What is the latest advice it seems unfdair to treat people like this Its very worrying should I pay? take them to court? what if I lose? will I get bad credit for fighting it in court? Advice would be appreciated Thanks Seany
  22. hi, i made a purchase online for a set of dust filter for my computer from south africa to the UK, i made the payment and payid for shipping for £21, i assumed this was to take care of the import fees, i received the package, a couple of days later i got a letter from DHC saying i owe them VAT of £17, i emailed asking how they came to £17 and they replied saying that i was being charge £7 VAT and a £10 administration charge cause they paid the VAT when they picked up the package, this is the first time i've made a purchase abroad i was a bit peeved they were making me £10 pounds when i already paid for shipping i understand they wanted me to pay the VAT which i would of done, but because of the administration charge i felt cheated. i decided to ignore the payment, weeks later i got a new letter from a company called control account PLC saying they now own the debt and have added their admin fees to the payment of £10 and said i should no longer contact DHC. the new charge was £25. i received this letter late so i missed the window to make they payment, and then received a letter this week saying "that i must pay the sum of £25 within 14 days or this matter will be passed on to our legal department, At this time litigation may commence with a County Court Judgment sought, the cost of these proceedings would increase your current liability with judgment in place, would allow enforcement action to be taken. This is your final oppprtynity to remedy this matter prior to further action being taken" what should i do?, its already to late to pay it back, whats the worse that could happen?, what is likely to happen. any advice would be really appreciated, i'm really worried Thanks
  23. http://www.bbc.co.uk/news/uk-england-lincolnshire-34402322 A car park operator has been disciplined after some of its employees altered photographic evidence to unfairly impose parking charges. UK Parking Control, which operates more than 1,400 car parks, previously admitted some timestamps were changed to make it appear cars had overstayed. The company has been given eight sanction points by the British Parking Association (BPA). It could be expelled from the scheme if it gets more points. If this happens it will not be able to get vehicle keeper details from the DVLA, meaning it cannot pursue drivers for money. However, the matter is not being sent to a police force for investigation. An Action Fraud spokesperson said: "Contact has been made by the National Fraud Intelligence Bureau with UKPC who have implemented their own internal measures to resolve the situation." The DVLA is still investigating UKPC and has stopped providing vehicle keeper details to the company while its inquiry is under way. A DVLA spokesperson said: "I can confirm that UK Parking Control has been suspended while we carry out our investigation. "We take our responsibility to protect information seriously. If it is brought to our attention that a company requesting vehicle keeper information may not be meeting the necessary standards, we will investigate."
  24. Good morning. Unfortunately, on 03/10/2015 i was issued a Parking Charge Notice by Parking Control Management (UK) Limited for the sum of £60.00 whilst I was parked on a private car park. I had appealed on the grounds that the signs had been vandalised which of course was rejected by PCM and decided to follow it through with another appeal to The Independent Appeals Service and also this was dismissed. I have left it whilst seeking advice but PCM have now referred it over to Debt Recovery Plus Limited who are chasing me for the amount of £160.00 I'm not the best when it comes to this sort of stuff, and hope someone would be able to advise me further about the whole situation and where I stand.   25. It's all new to me and today went up a level I need advice I was taking my missus from airport while driving my phone were ringing few times + texts. Stopped just before airport gate on blind roundabout exit (road to nowhere). Wasn't long 5min tops and then I went in. No signs about not parking anywhere... Paid for parking on exit (chucked ticket away when i got home) Got pcn from vcs. 60£ if paid within 2 weeks. Looked for advice on internet. Ignored it as advised Another letter 100£. Ignored Now its that "professional debt collectors" company asking for 130£. What can/should I do??????? Please HELP!!!!!!!!!
