  1. received SAR back from Satans Bank and have a list of £25 charges mainly 2013/4 comes to about £250+ thoughts on HP Charge claims? are these recoverable/ the account has now been closed as paid in full?
  2. Hi there I am 41 months into a 48 month standard HP agreement. I paid by DD on the nose every month until around the 30 month time, when I became unemployed (no PPI by the way). Since then I have failed to make some payments on time, but NEVER have been more than 30 days late. I'm no angel this I realise but as I type this at least i'm up to date. Every time I fail to make a payment a DN comes out etc etc but I always pay up. As I have 7 months left to pay and my payments are £400 (but the last payment is £550) I should have 6 x 400 plus 1 x 550 or £2950 left to pay. But my credit file which was updated in April says I owe over £5000? The HP company have said this is because of charges incurred for late payments and a home visit which was £75? I checked the date and time on my CCTV and not one person visited my house that day. Are they having a laugh? I advised them that the payments under a HP agreement are fixed and that in October on my final payment they should remove my vehicle from the HPI register - but they said they will not until the full amount on the account is clear. I expect to pay something for my late payments, like I said I'm no angel in this matter, but this is ridiculous; could someone tell me where I stand please?
  3. Hi all I have applied for all my information from Swift Advances, but I think the broker does not trade anymore, so will have to go to FCSC for PPI reclaim I think?. I am not sure how to go about the spreadsheet that is talked about. ...is there a step by step guide, and a copy of the spread sheet? I want to try to reclaim extortionate charges from Swift.
  4. Good afternoon. I owe a trade supplier £200 for goods I have received. I have returned stock to the value of £139 which they have agreed to credit me with. Therefore I owe the supplier £60. However they have got a DCA to chase me and the DCA are claiming £566 presumably made up of some jumped up charges. I have asked the DCA to confirm what I owe for Goods supplied but was wondering what else I should do? Thanks in advance
  5. Hi, my 19 year old son who has recently been diagnosed with depression got himself into a muddle with his banking due to inexperience and the ease of contactless payments. He was paying charges of £80 per month for the majority of a year and was unable to get himself out of the financial mess he had got himself in. Once I became aware I advised him to speak to the bank HSBC and ask them to give him an authorised overdraft so he could limit his charges and get himself out if the situation he found himself in. He contacted HSBC and as he failed a credit score (no surprise there, he has never had credit) they refused to give him an authorised overdraft. He buried his head the sand a little longer and then finally took my advice to contact the Financial Ombudsman. HSBC initially denied to the FOS that he had made a call to them explaining his financial situation and asking for help but after we supplied a telephone bill detailing the date and the fact that he was on the phone for in excess of an hour they agreed that he had made contact. The FOS requested the conversation. However HSBC did not submit a recording of the phone call they supplied hand written notes. These notes failed to mention that he was experiencing financial hardship. Therefore the FOS said that he had no case. He stressed that he did state this in the phone call but the FOS decided that as it was not mentioned in the notes submitted by HSBC then that was the end of the matter. My son has paid in excess of £800 in charges on a paultry income and it feels that he has no redress against HSBC. Can they not be forced to submit the original recording?
  6. Wifes car was run into last week so rang Hastings to register claim which is going through ok as they admitted liability. However realised today due to a big phone bill the call was charged at 41.75+vat. I am completely shocked at this especially as it wasnt our fault. I've registeted a complaint with Hastings to try and sort this out as this seems totally unacceptable to me. Has anyone else had similar issues? Who is the best ones to turn too if no luck with Hastings?
  7. On holiday in Thailand, I kept my phone in flight mode throughout my holiday, or used hotel wi-fi... . Except for one inadvertent internet session in a restaurant three doors from my hotel lasting, at a guess, approximately 30 mins (thought I was still connected to hotel wi-fi, nothing on the phone to tell me otherwise until a text message arrived to tell me the cap of 50 euros had been applied, for which I was grateful). Annoyed that I'd spent £40 unintentionally, and cursing myself for a fool, I put the phone back into flight mode. Needless to say, when the bill arrived (from Utility Warehouse, but I suppose it could be anybody) it wasn't £40...it was £754! I put in a complaint and the response is to reduce the charges to £300, which I actually think is quite reasonable... But I thought I'd see what others think before I accept - any ideas?

  9. Just a brief overview.. I received a PCN from ES Parking Enforcement about 10 days ago. I attempted to make the payment a couple of days ago now, both by calling the number provided and on their website. It is saying that the number I have entered isn't recognised. They don't seem to make it easy to contact them, as they provide no email address (just an online form, which stated for business correspondence only. . and directs you elsewhere if you want to dispute the ticket - IAS? - but I don't want to appeal it I want the correct reference number!) I don't know how to go forward with this. I have no 'proof' I have attempted payment, so if it did go further it would be my word against theirs. I was thinking of writing a letter requesting the correct PCN reference number from them, but how much information should I include on this letter? Should I put my car registration number and date and time of issue, or just the original number they've issued me and let them deal with it. I know that sounds awkward, but they don't seem to make it easy for you, and the more I have read about them the more anxious I am getting about their response, as I don't imagine they'll still 'honour' the £60 'discounted' charge as by the time I've written to them and received a response it'll be outside the 14 days. Do I have a right to refuse to pay the 'full' amount of £100 based on the fact they have (presumably) written the wrong number on the ticket? Any advice would be greatly appreciated. Thanks
  10. 2007 stepdaughter and her husband took a secured loan (against house) for £10k. They subsequently separated and daughter was left high and dry to pay mortgage, loan and bills etc. Inevitably she fell into arrears but managed in 2014 to pay off all the arrears and has continued to pay monthly. The loan term ends in April 2017 and she has now been told she must pay £32k in further interest and legal charges. If she doesn't pay they will repossess. This would bring the total cost of the loan to over £50k as she has already paid them in excess of £23k. Ombudsman has investigated but says her claim against them is out of time according the paperwork she has seen from Swift. I was thinking of writing to the company and asking them to extend the term and freeze the charges and perhaps to offer to pay a lump sum to reduce the cost - but we can only afford a couple of thousand. Would they be obliged to accept an offer to continue payment? We fear the only alternative would be for her to sell the house but she has three children of 17, 13 & 12. Would paying a debt solicitor for legal advice/intervention be likely to help in any way? Finally although permanently separated she and her husband are still legally married but has not even contributed child maintenance. Would it be reasonable to give Swift his contact details and ask them to serve proceedings on him also? As you can tell - we are in turmoil and need advice urgently on what steps we can take to prevent my stepdaughter and her children being made homeless.
  11. I took out a Blemain finance loan back in 2005 for £16.913.00 , secured against my property (it was actually a refinancing of a previous loan with First National Home Finance) . I sold my property in Jan 2012, both the mortgage and the Blemain loan were paid off. The interest on the loan was 12.2% The final redemption payment to Blemain was for £23,253.36 in Jan 2016 and this was paid in full. I got the SAR from them i have a break down off all the charges. Through out the loan I did have money problems, looking at the breakdown of my account there is quite a number of late payments. There's just a few things I could do with help on:- Over the period of the loan I've been charged for: Letters = £30 - £35 Visit = £100 telephone charge = £30 - £35 Monthly charge - arrears = £33 - £46 Dishonoured Receipt = £30 - £35 Default Notice = £50 Buildings Insurance = £85 - £184 Buildings Insurance Block policy Charge = £16 legal costs = £282 application to suspend legal action = £13 settlement figure fee sent to 3rd Party= £30 Court preperation fee = £53 court hearing fee = £13 land registry copies =£4 online issue fee = £100 Issue warrant for possession = £18 collections instruction = £176.25 Legal fees to HMCS = £150 Post - Legal monthly Charge 2 = £130 - £215 I did get close to getting the house repossessed twice, which is why i had to sell it quickly and under the market value. Some of the above were charged multiple of times, others just a few, All in all the total charges come to £5,865.50 plus there was a Broker fee at the start for £1,500 (this is not included in the £5,865.50) 1) I can't remember who I approach to get the loan, It could have been Blemain directly. £1500 seems an awful lot, do I need to speak to Blemain about that as it seems excessive. 2) Which of the above charges can I try to claim back for? bearing in mind they did attempt to take me to court a few times fir monies owed, this was during the time I was trying to sell my house as i couldn't afford to live. 3) I have downloaded the CIsheet (compoundinterest calculator) and entered all the charges. Bearing in mind the loan interest rate was 12.2% APR what % do I put in the interest rate (Apr) column, is it the APR of the loan which was 12.2%? I take it the sheet automatically works out the 8£ compound interest rate in the final column. 4) Is there a letter template to try to claim back these unfair charges from Blemain Any advice would be grateful Regards
  12. I owed hmrc £400 income tax (self employed) and was late paying it Paid £200 last week and the rest today. Today I also got a text message from ccs asking me to call them and quote a reference number. A friend of mine had a similar text and ended up paying ccs their tax plus ccs charges for collecting the tax! As I've now paid hmrc directly, can ccs still chase me for their charges? I have not replied to their text message What is the best way to deal with ccs
  13. Hi, In Dec 2013 i took out a two year mobile phone contract with Vodaphone. In Dec 2015 the contract was up and i called Vodaphone to end the contract and get a code from them so i could transfer the mobile number to a Virgin Mobile handset. This all went well until i got a letter saying i was being charged £171 for early cancellation of my contract? I installed a call recording app on my mobile and then I called Vodaphone on December 17th 2015 The lady i spoke with found that someone had written a date on my contract in the U.S. style (switching the month and day from how we write it in the UK. aparrently my contract was due to end on the 19th month lol She agree'd it was a mistake, apologised and said they would fix it. I never heard from Vodaphone again. Today, fifteen months later i got a letter from Vodafone telling me that i owed £158.60 for "outstanding call charges/line rental" and that my "debt" has been assigned to Lowell Portfolio LTD. This may be my forst post here but i have read the forums plenty so i was very suspicious and decided not to contact Lowell Financial (who aparently are the debt collectors for my alleged debt) but to instead call Vodafone (and record them of course) I ended up speaking to a nervous sounding indian chap who i can only guess was on his forst day of work, he told me there had been a charge added to my account AFTER i cancelled it??? I did lead him to confirm that it was Vodafones mistake too which he agreed and said they where having problems... So, i have the recorded conversation from dec 2015 and today which both confirm my account ended in good standing but i somehow have these financial leeches latched onto me also? Do i contact them or ignor them? also, if i do contact Lowells do i tip my hand about the recorded vodafone calls and that i am also recording them? Thanks for any advice
  14. I have a problem with E-Mex/Nationwide. I sent them a letter (template from this site) asking for unfair charges to be refunded. Took the mortgage out 10 years ago (interest only) and have now just sold. a few years into the mortgage i got into difficulties and they served a possession on me which I managed to get suspended. Since then the account has been up to date arrears paid up etc The charges on the account however, total nearly £5000 all of which consist of DD charges and solicitors fees of £2000. I received a letter from Nationwide saying that they had reviewed these charges and would be refunding £800 to my account. I called them and they try to side track you saying that Emex levied these charges etc but they have made a gesture and think thats fair. When I challenged them on the £2000 solicitors fees from as they put it third party companies, I was told that I could not see them as this was a transaction between Emex and their own third party solicitors! One of the issues that created these charges were caused by the fact my wife paid it every month by way of Bank Transfer and although the money hit their account instantly, they said it could take up to 7 days to find its way to our account. Which meant we would be in arrears. I dont know really where to go with this? any help greatly appreciated
  15. Good news. Swift have been ordered to pay back all charges plus interest in a county court judgment. The judge ruled that their standard terms between 2002 to 2009 were unfair. Regards
  16. Hi please can someone help me. I was awarded a suspended eviction order on 9th November 2009. Whereby the judge ordered if I had to go again I had to go before him and He would basically chuck us out (due to me being there previously) That was dated until November 2010 - Will this be relevent now. Mortgage is with Santander. I have fell behind a few times since just before xmas, but ALWAYS made it up. I am up to date with my payments. And dont owe anything til end of September. My arrears currently stand at £856.71 I have been away on holiday, and come back to a Warrent for the possession of property. Eviction will take place at 28th August at 10.20am. Santander, phoned me in on 20th July - My payments where up to date. Requested I went through a income expenditure with them - right there and then on the phone. I was at work and requested they put the forms in the post. I promptly filled them in and posted them back. Santander say today that because they didnt get them & I defaulted on court agreement they either want the Full £856.71 or the House. Please help me Please help 1 small child and a pretend teenager. Reading through some of the other threads, people have been evicted for being up to date. Really starting to panic Forgot to say I do work, and can pay the mortgage. Just messed my money up a few times this year. But It was payed as soon as, And I am up to date

Hi, just after a bit of advice really, I received a claim form last week for a debt of £300 or so that has resulted from bank charges and interest on a Nationwide account, the account was in credit when a charge took it overdrawn, further charges and interest then grew the negative balance to around £300 until the account was closed/suspended in 2011. As the basis of the debt is from charges that may/may not be illegal? (probably for missing a direct debit) - would there be any point in contesting the claim? I know its not alot of money but I am trying to deal with my historic debts so any that I can avoid will allow me to do this sooner! Regards Gary

  19. Hi All. I'd like to share my experience to date with this: On 13 Dec 2016 I parked at Battle rail station and paid using my mobile phone. I successfully paid but my phone would not reply to the 68680 SMS I was sent and had to reply to with my vehicle reg. When I returned I found a Penalty Notice quoting Rail Byelaw 14 for £100. My appeal with Indigo through their web based appeal system was rejected and I am now in the process of appealing through POPLA. I have been investigating why my phone would not reply to the 68680 SMS. I only had 7p credit on my phone and the 68680 SMS short code is classified as a premium rate number by O2, and is therefore excluded from my pre-paid phone bundle. The cost was more than 7p (I believe it to be 10p) so it would not send. The car park placard with payment instructions states that there is a 20p charge for using the service, which is added to the parking fee and is paid when you call the 0345 number. No where does it mention an additional fee for replying to the SMS. O2 have 68680 as operated by Mirada and listed as a premium rate gaming number. I have also spoken to OFCOM and they say because the charge is no more than 10p it is not classified as a premium rate number, and is therefore unregulated. This looks like an operator exploiting a loophole to me. The number is listed as premium rate, so is excluded from pre-paid packages, and because the charge is 10p, OFCOM say it is unregulated, therefore there is no need to display charges. If I had had more than 10p credit the SMS would have gone and I would most likely never have noticed the additional charge. To rub salt in the wound Indigo make a big play on their web site that there are no hidden charges. I have informed trading standards through the consumer advice phone line.
  20. I returned my partner's account to zero early last year. Unfortunately there was a pending charge, and my partner didn't use her account or check the balance again until late last year. It had ballooned into a large amount of overdraft from that one pending charge. Barclays were unwilling to generously be sensible about it, and my partner wouldn't accept the terms of my offer of help, which was that I'd return it to zero (for the nth time) if she closes her account, as Barclays don't deserve our blood to suck on, and she doesn't need a spare account. Since then I imagine it's continued to balloon. I imagine DCAs and court action have happened or will happen soon. My options are: 1) Cave in and pay. 2) Refuse to cave in. Tell her to point out she has no income of her own, and they should accept the one charge with say a staggering 100% annual APR added, which is still a lot less than they want but they're still accepting something that sounds eye watering. I have no idea about implications to credit ratings, so I think that will influence the decision. Thank you very much for any advice.
  21. Hi, I (stupidly) have a Vanquis credit card. Had it for a few years and everything was fine although I am always close to my limit. I do everything online and last month the access to my account was denied for some reason. I know I wasn't over my card limit and I always watch this very closely to avoid charges. This meant I couldn't make a payment online and they didn't send me a paper statement. I've now received a paper statement for this month which shows that due to missing last months payment I am now over the limit. As a result they charged me a late payment charge and an over limit charge totalling £24 . Can I just tell them I'm not paying the charges and ask them to recalculate my interest as I assume that will be higher (albeit by not much) because of the charges? Thanks in advance for any advice.

I Sent my car back on VT and received a bill for excess mileage, however it is not clear in my contract if I pay the charge as it says in termination your rights if you have paid half the value of the agreement and the car condition is acceptable the answer is yes and yes. I have heard that the phrase in termination my rights quote "you will have nothing else to pay". Does anybody have dealings with this I have started proceedings with the Onbudsman but heard this is probably not the best way. I have heard of people getting the charge removed and invoices being cancelled Any help would be appreciated
  24. Hi guys, I signed myself and my fiance up with a 12month exercise4less contract last year, and the first DD (2 x £9.99, for both of us) was taken on the 1st April, last year. Ironic, now that I think about it. when I signed up, I was told that the DD would be monthly, taken at the end of the month. However, that hasn't always been the case - in May, i was actually charged twice (3rd May, and also 31st May). It wasn't long until the DD came out too early (I get paid on the last working day of the month) and I was charged by Harlands in September (2 x £34.99, on top of the normal 2 x £9.99). However, they have now done it again; the DD is due to be paid 30th Jan, but I get paid 31st Jan, i'm sure Harlands is going to be rubbing their hands with glee again. Is there anything I can do about this? Sadly I'm stuck with the contract until April, but they keep pulling stuff like this. Thanks.
  25. Hi all, I am after some thought and hopefully some pointers on my late payment charges with Studio. After getting myself in a pickle I am on reduced payments for a few things and most have frozen interest and waive any fees. Due to a zero hours contract I often have to pay my priority bills first. My payment to Studio is £5 a month and no interest is being added. As of today the Debt stand at £120. However i have noted that if I am late with a payment I get charged £12 which means that the debt doesn't go down and another 2 months is added to the payment plan. Say for example over the course of a year I am late with just 3 payment that's £36 which increases the plan by 7 months which I feel is a bit harsh. More so that if it got passed over to a debt collector the amount is frozen. I have read other studio threads but not sure if it is still relevant as they are from a few years back. I am not sure how to proceed, Is it worth doing? is it similar to claiming from the banks? can anyone help with a template?
