  1. I took out a 10year secured loan from Ge money ten years ago this was transferred to prestige finance in November 2015 . The loan is at an end but I still owe 3800 . There are charges and interest on charges on this account approx 2000 without any interest etc . Can I claim these back I believe if I could it would clear the balance left . Also I've got to still pay this and cannot pay the whole amount . Do I offer to pay the same amount as I have been 600 per month ? Will they charge me more interest ? Also if I can claim who do I claim off Ge or prestige ?
  2. Hi Quick question. I was looking to buy some parts via a retailers online store. When I went to pay it showed the 2nd class postage charge, at the point of putting in my postcode (Scotland) it went from £1.95 to £3.95. Being as bit surprised it changed I put in a Nottingham postcode and it dropped back to £1.95, so was sure it was a location charge. I emailed the store and they have said Royal mail charge by both size/weight and location. I accept that is true for parcels, but I thought 1st & 2nd class post was by weight/size only? Thanks
  3. hello am I correct that late mortgage payment fees/field agent visit fees can be reclaimed via the small claims courts?
  4. hopefully someone may be able to help re: above applying for exemption via low income scheme nhsbs have told me over phone that they will only accept accounts as proof of self employed earnings. don't have any as I don't earn enough, I receive housing benefir council tax reduction and working tax credits have offered them the last 3 years certificates along side the income form, they say that's not good enough. any one got an idea what I should do now got treatment coming up for level 3 cant afford it.
  5. Hi there, I'm new to this site. I received a parking charge notice of £90 for parking there on the 27th April 2018. I only received it today, and it says I need to pay this by 28th May 2018. I'm not sure what to do about this as I think its quite excessive, and from what I have read elsewhere, they are not the council so can not "fine" me. However, I would like some advice from here as to what I should do about something like this? the penalty is under my mum's name, but it was me who had taken the car to Exeter. I've attached the letter they sent me. Any advice would be greatly appreciated. Thanks Amit 5ddc3f5a-069d-4325-ac70-b1bbd62a24a2.pdf
  6. Hi A few years ago we took out a bridging loan with Lancashire Mortgage Corporation/now Together. In the documents sent to us was an "Offer Letter" which confirmed the amount to be borrowed ,rates of interest etc but NO mention of any renewal fees of 5% of the total loan. In fact in the letter it states "Exit Fee-£0". Very misleading. It was however mentioned in the Bridging Loan Agreement and this was missed by us, solicitors and broker (allegedly) !!!! We are taking legal action against the solicitors and broker but this company Together are completely out of control with their charges and it has cost us a very large 6 figure sum. We have placed numerous complaints to their Internal Complaints team but each time they hide behind the fact that the loan was not a regulated product. Has anyone else suffered as a consequence of this dreadful company ???
  7. A friend has been charged £27.56 in service/ call charges when applying for PIP over the telephone. I am aware that Esther McVey had been challenged regarding call charges with 08 numbers and I see that the government website has been changed to 0800 numbers now. However, I cannot see when the website was updated. Is there any chance of claiming these charges back from DWP/PIP as they are extortionate for vulnerable people who do not understand the implications of service charges on top of call charges?
  8. Today I received a large pile of documents from Prestige Finance, with whom I have a second mortgage. I have identified 10 unlawful charges of £35 each. But this account was previously held by lenders GE Money. Either they went into administration and "became" Prestige Finance, or GE Money simply sold my account to Prestige Finance. I have identified seven unlawful "administration charges" of £40 each while the account was with GE Money, before I found my account being handled by Prestige Finance. So my question is in two parts. 1. Am I entitled to recover the £280 unlawfully charged to me by GE Money before Prestige Finance aquired the account (and if so, who do I get the money from? Prestige? Or GE, who may no longer exist?) I had always assumed that if a going concern such as a lender was aquired by another going concern then the buyer going concern would also be buying the seller's liabilities as well as its assets (in which case Prestige would be liable to refund me the money that GE had stolen from me). But I may be wrong in this case. 2. How do I get my money back from Prestige Finance? Do I just ask for it back or do I need to take them to court? Can I charge interest at the statutory 8% and how can I calculate that? Can I add on anything else such as the time it has cost me and also the stress? Thanks in advance.
  9. Hi all , Been reading the forums for a while now , just about to try and reclaim better halfs catalogue and store cards charges. I believe the route to go is SAR each catalogue and store card. It seems over the years she has had two old Littlewood accounts and one current one and a current Very account , she phoned shop direct earlier this week to verify account numbers and to check address for correspondence they gave her a Chelmsford address which seems to contradict other addresses I have found whilst browsing these forums those being the innovation centre park lane netherton bootle l30 1sl and Shop Direct Limited 1st Floor Skyways House Speke Road Speke Liverpool L70 1AB. Also we will be sending SAR's to Topshop, Dorothy Perkins and Outfit , the address we have been told is Newday ltd PO Box 700 Leeds LS99 2BD. She also has an old Next account which is closed , they have provided us with a letter stating the account number and that there was never any PPI on the account this was received after a phone call requesting the account number. which are the correct addresses to go with and also do we need to individually SAR each account and store card or one SAR to shop direct and one to Newday and one to Next ? Is there any specific requests needed for each SAR and over the last twenty years we have only lived at two addresses so do we include both addresses in each SAR. Some of the account/cards are pre 2007 and some post 2007. Thanks for your time , Andy.
  10. Hi, I am a bit confused about what I should receive as an NHS patient at a dentist. My OH and I have always gone private and paid lots of the years, but neither of us have a check up in over six years. I always felt I had good teeth and have flossed since my teens. Anyway, I broke a tooth last week and rang around to see if any local dentists were taking on NHS patients locally. I found one and booked the earliest appointment they had, which was last Friday. The dentist took about 4 x-rays and told me I had severe gum disease and no teeth could be replaced until this was treated, but said I would probably need this treated privately at over £1,000. I know it is not a huge amount for dental work, but it is for me. I said I would speak to my husband before agreeing to anything, to which she responded "THEY ARE YOUR TEETH!" My husband emailed them as to why the work was not covered on the NHS and he just received back a reply saying: "She was informed that she has advanced periodontal disease. She informed us that she had not had a dental check up for several years which is perhaps why it had not been identified earlier. She also presented with 2 broken teeth which we have had a look at and advised that they are broken down to a level where they cannot be fixed and removal is indicated. Removal of teeth can be done any time and it was not said to her that she needed to have gum disease treatment before this could be carried out. However, no advanced restorative work (if indicated) can be carried out until her periodontal disease is stabilised which can take several months. Three options were given to her for treatment of this, in order of level of success rates: 1) Private referral to an external periodontist (specialist in gum disease treatment)-best option for someone with advanced gum disease 2) Private referral to the hygienist (in house)-second best option for someone with advanced gum disease; reassess and consider a referral to a specialist if no response to treatment 3) NHS band 2 treatment as an initial course of treatment-this would be standard treatment with the dentist; reassess and consider a referral to a specialist if no response to treatment Please let us know which way Maggie would like to proceed." The tone of the email seems going for Option 3 would almost certainly lead to a referral to a specialist. Should I look for another dentist? Any advice, based on experiences, would be greatly appreciated. Thanks, Maggie
  11. Hi, I know it's very likely me being a complete idiot but I have spent the last hour looking for a template letter to help me with credit card charges. Can anyone be so kind as to direct me? Many thanks
  12. Took out a secured £12k loan in October 2007 over a 10 year period. Please note I didn't want to take out the loan but had no choice if I wanted a quiet life as at the time I was in a controlled marriage ..mostly mental with some physical abuse resulting depression, anxiety and panic attacks . The 10 year loan gives 120 months worth of payments out of these 120 months I made 107 payments on time and 13 missed payments these were down to my so called husband taking the money out of my wages in the bank to pay loan and saying would put back to pay but never did ... with my depression and my husband controlling my money I worked but had to ask him if I needed money all debts he ran up were in my name and l developed a serious problem with opening letters as they were always for his debt and I didn't have the money to pay them as all my wages had to stay in bank... I have unopened letters hidden around my home going back at least 15 years ... Getting back to the lovely swift advances due to not opening letters I found out that swift had taken me to court for the missed payments and because I had no idea they had been given the repossession order . . My daughter for whatever reason as she never ever had before opened a letter last Tuesday 3rd April from a company called R & K and it said they would be coming to our home on the 11th April which was yesterday to remove us and change locks ... I immediately contacted this company and they told me I needed to contact swift as they were only ones who could tell them not to come out on the 11th ... on contacting swift they said my loan had came to it's 10 year end on October last year but I had the 13 missed payments as arrears which when I add them up come to £2,600, when swift add them up it comes to £18k and they wanted that as a one off payment to stop taking my home ... in the past few days I asked them to consider me paying £300 A month to clear the ridiculous amount and I also asked if they would reduce the amount to a more reasonable amount and I would see if I could get the funds from family and friends and make a one off payment they said they would have to ask management/directors the following morning and get back to me later that day which was Monday this week ... I spoke to them after work on Monday and they advised I had been turned down on both of my requests and only option was paying the full £18k .. .they also informed me that they had postponed the date to take the house from 11th April to the 14th May to give me time to try and sort out the payment ... I also found out that they had actually turned up at my house in February to take house but my dog was in house barking so they cancelled it and charged me over a £100 for that ... my daughter was home that day she also has mental health problems worse than mine having had a mental breakdown at age 13 due to her father's behaviour ... the day they came out bearing in mind I didn't know anything about this happening due to unopened letters my daughter rang me frantic at work saying a van was outside house and men in garden outside our home... I asked her for name on van and googled it but it didn't give me any idea what it was about ... I am now taking on the fight of my life to save our home as my daughter sees this as her safe place since her breakdown and she is now starting to show signs of shutting down again and I can't let that happen to her... any advice woukd be most appreciated .. . Thank you in advance
  13. Just a brief outline regarding my experience dealing with Swift Advances regarding a excessive charges complaint of which involved Fos. 2005 I took out a regulated loan for £10000 to be paid over 5 years.. Regular monthly payments were made inline with the agreed amount, sometimes a day or so late. This triggers charges on the account of which also incur the same interest rate as the loan. as you can see the charges are relentless. Late 2008 i was in severe financial difficulty as i was elf employed my business was struggling. Realising the depth of debt especially with Swift following a redemption figure request i conceded that there was noway i was going to be able to repay this debt with the spiralling charges being added to the account. 2009 i lost my family home to Swift as i foolishly at the time gave up and did not fight my case in court and just assumed that no matter what i did they would take it anyway. 2012 Following media report about ppi scandal i started to look into the Swift charges and noticed i had ppi added, as i was self employed the ppi was invalid and i successfully reclaimed ppi from FSCS as the original broker had gone bust. Then i started looking more closer to the charges added to my account following a SAR request to Swift. Firstly i filed a complaint regarding excessive charges added to the account with Swift of which they dismissed with a Final response so i took my complaint to FOS. After a lengthy battle it was deemed that Swift acted appropriately in managing the account "I have not seen evidence to show that swift was not transparent about the charges or that you have been treated unfairly" is whats stated from FOS in their summing up letter. However as Swift had changed the amount they charge for some of the admin costs they agreed to refund the difference so i received a cheque for approx £900 in 2013. So it seems that despite all the complaining we do not even FOS agree that how Swift conduct their business is unlawful or done in a manner where the consumer is set to fail from the outset. For anyone wishing to know what the letter codes mean then here is an attached document. Im not sure the pdf file loaded properly in previous post. merged.pdf
  14. Hi fellow caggers, looking a bit of advice for my partner She opened a Halifax Rewards account in 2002 with her Ex husband They separated in 2011 and there was an OD on the account He sub sequentially left all the debt to her, he managed to remove himself from the account by paying a small amount, I will say he was a Halifax employee. The last payment into the account was feb 13 by my partner and the account was defaulted on her credit report in Dec 13 It was sold onto Hoist and is being managed by Wescot, we have not acknowledged the debt and sent them a prove it in January which they still havent complied with and the account is on hold My partner never received a termination notice and we have sub sequentially SAR'd Halifax and received a mountain of paperwork today. I can upload any thing that you need to see Looking through it there is no reference to a termination notice and have noticed from an initial balance of ~£300 the debt stands at ~£800 which is all charges Can she challenge Halifax to remove the default? Also can she reclaim the charges under BCOBS?
  15. Hi All if any one can help , i am looking to claim credit card charges ,late payment and over limit fee . SAR done to capital one and received every thing account was opened in 2005 january . charges in total is £200 interest rate was 34.9% i have done the spread at the interest rate of 34.9% so total amount is coming nearly £9000. should i charge 34.9% or lower ? I have been to court few times on hearing with lowell and won (its was mobile phone contracts) this claim is for my survival and i am willing to go to hearing (if its comes to that point ) but first time taking someone to court if any one can guide me with my claim . My reason for same interest as on card is that go for higher amount and then settle for bit lower reasonable amount any chance of success at that rate? thanks in advance
  16. We had a property agent managing our property I asked for a quote for some repairs to a fridge freezer but given the costs I never went ahead with the work A year later and after a years battle to get the property agent to authorise the tenants holding deposit to be paid back to me for other damage to my property the agents have now deducted the cost of repairs to the fridge freezer. This is the first time that they have stated that there is an outstanding amount and I have never authorised for the works to go ahead. They state that I had a telephone conversation with someone who has now left and I agreed to the work. I know full well that the work never happened. I have since had the fridge replaced as it was cheaper to get a new one than to repair it. What information can I insist that the property management company provide me with to show that I authorised the repairs? For example invoice from supplier any others? Also, are the allowed to deduct the money from the deposit money?
  17. Can I claim charges for a account I closed down due to lots of charges
  18. Hello, I am starting a new thread here after discovering some things on my credit record. The story is: In 2013 whilst I was a Vodafone UK mobile phone customer, a Vodafone phone agent advised me that if I purchased a call package which gave a discount to Intl calls made outwith the UK, this package would cover Russia, which was the country I was going to make calls from. When I returned from that trip in October 2013, I found a bill of £122, increased to £203.70 by Dec 2013. I even offered to pay some portion of the £122 in instalments and paid ~£15 per month as a goodwill gesture. But I still disputed the Russian call charges and said this constantly. I disputed this constantly from Oct 2013 by email and phone; I spoke with them over the phone several times from the end of 2013, emailed up until Feb 2014 and spoke with an agent called Jeff Phoenix from Vodafone UK by Dec 2013 and still no resolution from then. J Phoenix tried to bully me over the phone to accept everything. I emailed Vodafone and Fredrickson International, a debt collection agency hired by Vodafone UK, that this occurred a few days later after this phone discussion. I also exchanged email in Jan and Feb 2014 with Fredrickson International and Vodafone UK after the phone call as Vodafone did not respond to my communication. I told both Vodafone UK and Fredrickson I was going to contact Ofcom about this problem. Subsequently, I lost interest and did not contact Ofcom but I never heard anything back from either Vodafone UK of Fredrickson. And now looking through my credit record I see a default of £200 dated from 01 Jan 2014 even though I had email communication with Vodafone UK and Fredrickson from 10 Feb 2014. My questions are: 1) Is there some sort of redress I can get from Ofcom for the damage to my credit record? 2) What can be done with regards to the conduct of Jeff Phoenix? 3) Can I get these phone charges removed and my credit record cleaned, backdated to the time of the dispute? Thank you for your help in advance.
  19. Afternoon All, I hope everyone has having a lovely bank holiday. When someone has a moment, I would very much appreciate some advice and direction with a credit card complaint. I've genuinely looked for a similar thread/question, as to not to waste anyone's time, but there doesn't appear to be anything (which is surprising). at a high-level, over the course of 2 years or so, I raised a couple of Section 75 claims with my credit card company; both for the same issue. On the first occasion, I submitted my claim via e-mail as per their direction of the CC, I got a confirmation response and they sent a declaration form in the post, which I signed and returned accordingly. Weeks and months went by and I hear nothing. I made several phone calls where they promised to investigate but did nothing. A YEAR goes by and still they fail to act. I submit another claim for the same issue. I get another e-mail confirmation but no declaration form to sign. Again weeks and months go past but I hear nothing. On this I refused to pay any further monthly minimum charges as they weren't looking into my dispute. Long story short, my account is in default (however they didn't raise the default correctly). Can they do that when he account is in dispute? The FCA handbook page is down but I'm certain it says that whilst there is a dispute a debt should be set aside? Thank you in advance for any help or advice.

  23. Hello to you all I have been reading and digging out numerous threads on RBS and how I can request for a overdraft charge sheet from years back. I was wondering what exactly should be the wording of the letter and what I should be looking out for in the details of the sheets they send me, this is regarding what I can and can't claim back. Many thanks.
  24. Hi, I have accumulated some relatively large charges from HSBC Business over the last few years, mainly for unauthorised overdrafts. Is it possible to have any of these refunded? I am in quite a bit of financial difficulty at the minute. I dont have any lending on this business account. I would also like to keep the account open, so dont want to do anything to harm that if possible. Thanks for reading! Jamie
  25. Hi all, I am writing a SAR letter to Barclaycard as the first step towards reclaiming over limit and late payment charges. I've spent a couple of weeks reading various threads here that have been very helpful. I am trying to find the best address to send my SAR but am confused by conflicting information, some of which may or may not be out of date. London? Northampton? Knutsford? If someone could point me in the right direction I'd be most grateful - I don't want to stumble at the first hurdle! Thanks, John.
