Hi all Just looking for a little advice please Basically, a catering van we owned for 6 months we have just sold on ebay, the van was described exactly as it was how we knew it, listing any faults. We had a couple of people come and view before bidding but decided not to buy for various reasons, and eventually someone put in an offer or £2000, which we accepted. The people came to pick up the van and he claimed one of them was a mechanic, whiles testing and looking at the van is started to overheat, we we explained it did previously overheat but that issue was fixed by taking to a mechanic and having a thermostat replaced. He was given a receipt of this at the time along with an MOT cert from 1//10/13 So knowing it overheated that day and it wasn't mentioned on the ebay as we didnt know of any current overheating probems he bartered with us on price, after some negotiating we agreed due to the overheating he'd pay £1800 instead of asking price to allow him to get fixed and not be out of pocket He emailed us that same night, saying it overheated twice on the way home and didnt consider it fair he bought it and it wasn't fit for use for a business straight away So, my points are: 1.The ad was listed on ebay and as the ad was put up before the van was overheating - it was as described 2. when the buyer and his friend identified a problem at the time and sale they negotiated on price and a new price was set 3. He paid cash in hand and drove the vehicle away He is threatening to contact police and come to our house ect, but as far as i am aware it is, Caveat Emptor? am I wrong? Im not convinced he's not trying it on to be honest. Thanks all!

Hi All I just made this account to shout out to all that I can about a company in Coventry called (Longford Cars). also uses the name barbar cars and a few others im sure, I took my 04 plate Focus in to trade for a Y Reg Ford Mondeo. Little did I know but the car that was sold to me was not safe for the road WHAT SO EVER!.... First off it runs on 3 cylinders most of the time This alone makes the car impossible to drive!.... the front left strut has gone, all the Doors lock on there own when they want and will not open until it wants to, sometimes takes half a day to unlock... my wife could not get out the car! had to climb over to the drivers seat!!... if we had a crash?????..... Engine light came on the day I got it, Drivers seat is stuck in the fully raised position and will not budge... makes alarming noise from steering rack when turning.. tail pipe blowing.. the list is endless!. I rang the guy (Gurdip Virdi) and he told me to bring the car back for him to look.. so I did last sunday. and he was not there... just a bald guy and a pakistan mechanic who spoke 100 mph I was taken to some dodgy site where he stores he's cars.. I was not allowed to drive myself I was told I had to get in one of there cars?????..anyhow I was taken and shown a MGF a car with rust and a tear in the roof. the intakes had just been welded on with no paint so from the look of that it had water left inside for yrs.... Oh and he couldn't get it to start..lol!!! after that I was made to wait in the rain while he tried to get a old Volvo started.. after 45 - 60 mins of trying and being soaking WET! he got it started and then crashed it into a merc... at this point I could not believe my eyes..!! I was then told to go home and wait... someone will contact me Wednesday but all I got was Nothing!. so called him last night and he said " sorri m8 go back in the morning and he will sort you out ". So I went today and the same 2 guys was on site, looked at my car. took it for a run and agreed it has problems but was then told to " F*ck off and don't come back you brought it sold as seen so its not our problem get lost "....??.. I was upset by this so again I called Gurdip Virdi on he's mobile number he re responded " you piece of Sh*t you are full of crap. you lie and your a waste of time, your a looser and at the bottem end that will never mount to anything If you call again we will TURN UP AT YOUR HOUSE!!!!!!!!!!!!!"... there was other words said but I don't rly need to say it all.. Now this is a Warning to anyone who tries to buy a car from this guy.... he is also on ebay as barbarcars Longford cars and other names after looking online.... Wish I would of done this sooner!!!.. I will contact Vosa in the morning and get them check the car over. Trading Standards and other regulators , media ect will be informed.. This guy needs to be Shut down!.
  4. Hi, I operate a shop on eBay (pretty much my sole means on income). I recently sold an item. Buyer complained that item was not as described and opened a case in resolution centre. I agreed that the item could be returned for a full refund (buyer has acknowledged that the information in the listing described the item accurately but that isn't the main issue ATM). Buyer then has to enter tracking details for the returned parcel. They buyer enters 'returned in person to seller address.' This categorically did not happen. The buyer actually lives nearly 200 miles away. When I called Ebay customer services they advised me to speak to a different department and have the case 'escalated' I Was told that as the buyer had not entered valid tracking information for the return that the case would be decided in my favour. So I spoke to the relevant department. They decided the case in the buyers favour. I called eBay customer services again. This time I was told that since I can't prove that the buyer didn't return the item the buyer's payment would be refunded. So now I am stuck with a breach of policy report (arising from losing the resolution centre case), the buyers negative feedback and will most likely be out of pocket for the cost of the item without even having it returned to me. I have spoken to the police who put me through to 'Action Fraud.' They stated that although they have many reports of this exact issue their policy is that it is a civil matter. I'm open to any suggestions to get this resolved!

Hi, I recently sold a mobile phone on ebay for £200, I listed in the article twice that the phone had a defect and I had numerous emails from buyers asking about it which I gave full information on, some of them bidded. It was then sold and the money paid - i sent the item out, a few days later the buyer puts in a dispute saying that the item doesnt match description as it has a defect (yes the same one i listed in the article). After a few back and forward emails ebay stepped in and yesterday I got an email saying they have decided in buyers favour - immediately i contacted ebay who informed me this wasn't the case and it was an automated email but they have asked buyer to send item back and i should check it when it comes back for any faults. Now if they would of read his complaint to me they would of realised it was the same thing i mentioned in the article and looking at ebays OWN terms and conditions it does state that they will not decide the buyer is right if the defect is mentioned fully in the article... but obviously it seems they have ignored this and are trying to push for a refund anyways... as far i'm concerned they are now in breach of there own contractual agreements with me and anyone else who has a similar issue. I am pushing the complaints every day and seeing if I can get anywhere but keep getting conflicting emails off different members of ebay staff all the time. Some saying when I get item then I should appeal and say it does match description, others saying it will auto refund when it is returned. I have closed my paypal account (can they still push a refund?) and will be closing my ebay account after this, I am totally unwilling to give a refund based on what the buyer has said (he has simply changed his mind). Does anyone know where I stand on this as I am totally willing to push a small claim against ebay for breaching the contract and going against there own buyers/sellers protection guidelines. As you can imagine, this locked my paypal account for like 2 weeks and caused loads of issues with shops I use paypal to pay - and it looks like this is going to continue for a while yet.   6. Hello All, I have a problem with ebay. A buyer opened up a case with ebay saying the item I sent him was damaged - in the resolution process I asked for video or even just a picture of the damage so I could email it to the courier company so they could go to his address and inspect the damage.Once the couriers have confirmed it was dmaged I was going to refund the buyer and not require him to return the item as the couriers would have refunded me and paid for the item...BUT the buyer wouldnt even take a picture nor let me have his phone number etc which is strange! After being away for a week I checked my ebay account and the buyer has esculated the case to ebay and they've ruled in his favour - they havent told him to return the item and they have said they will be taking the refund from my 'reimbursement payment method' in 10 days time which is actually now only 7 days time. I have opened an appeal but dont hold much hope as ebay can do what they like and everyone is at the mercy of them Does anyone have any ideas what to do incase they still take the money without returning my item. Thanks.
  7. Hello I've been ripped off by a seller form China, and up to today i still have not received my goods. I did open a PayPal case, and PayPal closed case the same day. I was half a day over the 45 day PayPal Buyer Protection cut off point. I have contacted PayPal. PayPal reply, sorry over the 45 day cannot do anything. It's just half a day over. I have sent a letter to the Managing Director Paypal (Europe) Ltd Surrey. If the letter don't work, could small claims be worth a try? Thanks in advance for your assistance.
  8. I felt the need to share this information with all buyers from eBay. I recently bought an item that cost £160 from a seller with a good feedback score. I read that the item would be sent by tracked parcel with Royal Mail so I went ahead with the purchase. After a week and the item still not arriving I checked the provided tracking number to find to my surprise that it was reported to have been delivered. I contacted the seller who was very unhelpful and stated that as far as eBay and they were concerned it had been delivered and that was that! He or she did say I should make a claim at my local post office for the lost item. I first went to our local sorting office to see if it had been returned undelivered but it had not. I asked the clerk if he had any forms for me to make a claim but he said that only the poster can make the claim as they took out the insurance when they purchased the postage. He also stated that if it was signed for the sender could get evidence of the signature used to sign for it. I emailed the seller again when I got home and asked if they could start a claim on the advice that the post office gave me and if they could request the signature card. Sadly the seller just stated back to me the tracking number and would not give me any of the information I requested or help in getting a copy of the signature card. It is only myself and my family that live at my address and I don't share a post box or anything like that so I thought if I had the signature I could look up the surname and see if I could match it to anyone in my street who may have had my item delivered to them in error. Because the seller declined to help me I was left with no options and had to start a dispute. I also decided to leave negative feedback stating that the seller would not help me with the information I needed to recover my parcel or my £160. To my shock eBay removed the feedback when the seller requested them to. When I asked eBay what was the justification in doing so I was told that it was likely an automated removal due to 'key words' being used. Just to clarify I used no bad or insulting language in the text whatsoever. Several days later and after no response from the seller other than to gloat how they had the negative feedback removed I escalated the dispute to a claim. The dispute was quickly awarded in favour of the seller as providing a tracking number is all they need to do to cover themselves according to the eBay decision maker. I have since found out that a tracking number can be bought for just £1.00 and the parcel doesn't need insurance or indeed to be signed for in order to have a tracking number attached to it. I am quite sure my seller did not insure the goods nor had them to be signed for which is why they were avoiding answering any of my questions. So there you go, when you're thinking you have eBay's 'buyer protection', think again! It just cost me £160 and I feel like eBay have not even considered a single effort that I have made or that the seller was in any way negligent for sending high value goods through (most likely) a standard postal service with no cover. I have appealed the decision but it looks pretty hopeless. I may very well take this to small claims just out of principle.
  9. I sold my MacBook on Gumtree for £200, after already reducing it £50 to the man I sold it too. I told and showed him there was a problem when tilting the screen it sometimes goes black, in which you just tilt it back to a different position and it's fine. I also told him the MacBook sometimes gets a grey screen and fails to load up, I've always just taken the battery out and put it back in and it's fine and works normally. He said that was fine and bought the MacBook I showed it working and everything, and he was happy. A few hours later he rings me saying he can't get the MacBook to load, and I explained already it does this and I just take out the battery. He was not satisfied as he claims it doesn't work and is saying he wants a refund. I said no, as I sold you it as seen working fine. He then started saying if not he wants money for repairs. I said no as I explained the problems the MacBook had and was completely honest. He said this is now a civil matter and is gonna take action. I am wondering what to do now, can anyone help me?   10. Is it legal to take a mate along with you and get him to bid against some one who is buying your property at auction ? Just a question ? Also if this happens on a regular basis ?
  11. I sold my car last week and now the buyer is troubling me telling me that the clutch needs replacing. I hardly used the car and she test drove the car before she bought it! i have always used the clutch like that! And dont see a problem with the clutch! also gave her service and mot from last summer! She said its my responsibility and that any solicitor would stand by that The buyer says they are going to garage to see what the mechanic says but if they say it needs replacing then its my responsibilty! i dont think so! where do i stand?
  12. Although this firm probably aren't acting unlawfully they're certainly using some very dubious tactics in order to shift their products! I applied online for what I *thought* were some free samples of facial moisturiser ... but what I was really applying for was a free trial of these products. (Spot the subtle difference? Well I didn't notice it at the time.) I was asked for £3.95 to cover postage ... and (silly me) used my credit card to pay for it. In due course the samples arrived ... 3 little tiny pots of 'goo'. I thought no more about it until I received my credit card statement. Not only had Deadseakit.com*LONDON taken the £3.95 for p&p, but they'd also taken £59.95 just 10 days later! Apparently the £59.95 charge was levied because I had decided to keep the product AFTER my free trial had ended! (My free trial, it appears, lasted for just 14 days ... this info is buried amongst the 'small print' at the bottom of their website). I contacted my credit card provider immediately ... but it appears that as I voluntarily supplied my credit card details to this firm there is no way that I can recoup the payment. To make matters worse ... having now read and digested their t&cs it seems that I have also entered into an 'autorefill' agreement with Deadseakit.com*LONDON ... apparently they'll send me a little pot of goo every month at £59.95 a time! (Or so they think ... but needless to say I'll be cancelling my credit card!) Ask yourselves ... what sort of firm has so little faith in its products that it has to resort to duping its customers in order to make a sale? If they truly believe that their product is worth £59.95 then why do they try to hide the price behind the 'free trial' incentive? Bah!
