  1. Hi there I have a fine with Staffordshire county council which has escalated to £398 and now at the stage where bailiffs are due back tomorrow (with the addition of another £110). I had an agreement which I broke. I was paying weekly but fell behind. I am guilty of burying my head in the sand. I have a few mental health issues and claim ESA at the moment. I have 4 kids and am a single mum. I sometimes get anxious about opening my mail and ignore and forget things. I know it's the wrong thing to do, but sometimes I can barely leave the house or get out of bed. Just a few years ago I was working as a full time teacher. Everything has changed since my divorce and now my life is out of control. I have called Jacobs and the council today and nothing can be done but for me to pay the full balance or he'll be back tomorrow. I offered to pay £50 today and rest in instalments, but the bailiff said the best he can do is 50% today and the rest in 10 days. I'm sitting here feeling so anxious and worried. It's my son's 9th birthday in 2 days and christmas around the corner. What a mess!! I have no idea what to do next... I know he has no right of entry and so will ignore the door tomorrow, but then the 110 will be added and so on.... there seems no way out. Any advice will be much appreciated.
  2. I recived a pretty unpleasant visit from Mr Sxxx on Saturday saying he was here to take control of my goods! Id been away for a few days and he'd already left me a letter saying he'd been so I was expecting him. Sure enough at 7am someones banging on the front door I figured it would be him. I opened the bedroom window and spoke to him from there. At one point he made out he could break in I called the police and got them to attend, he then insisted that wasnt the case. This all started on the 4th of April, I received a letter which was a notice of enforcement saying I hadn't paid for 2 outstanding parking tickets that were issued last year. I immediately rang the council that had issued them and explained that I was unaware of one of the fines and the other one I had paid for the parking I sent the ticket back to them with the paid reciept and thought that was the end of that . They advised me that I would need to file an out of time witness statement which they emailed me. I completed the form and sent it straight off. On the 26th of April I recived a letter from HMCTS saying my application had been refused, they dont have to give me any explanation and if I want to appeal it will cost me £255! Fantastic! I emailed Marsrons on the 27th of April with my complete finacial circumstances and offered to start repaying the fines (the origanal fine was £82 each although one had somehow now come to £112) Marstons had by now added £75 compliance stage fee to each fine i had one fine of £187 and one at £157. I heard nothing from them until the bailiff turned up this Saturday (21/5/16, three weeks later). I explained to him that I had tried contacting Marstons to resolve the matter and had made an offer but he said he hadnt been made aware of this I rang Marstons myself, they also say they had no record even though they did admit at one point that they could see an automated response had gone out to my email address. I also showed the email to the bailiff through the window. Their argument now was that on the back of the Notice of Enforcement it says a payment plan must be set up by the 18/4/16 and because it hadnt it had now gone to enforecment stage which meant another fee off £235 had been added, im not sure if thats to both fines or just an overall fee. I had a right going on with Marstons on the phone, the guy I spoke with was hopeless and knew nothing, he just said I had to deal ewith Mr .......now. Eventually I got put through to a supervisor who said all I could do was file a complaint. Ive spoken to National Debt helpline today and their advice is to just start making my payment offer to them through the website but they say I cant get out of the fee's. Im just wondering if anyone has any other thoughts or informaion on this as it seems highly unjust to me! Dont think I have much more to loose, as far as Im aware they cant add anymore fee's unless they get in to my house which isnt going to happen. I have no vehicles or possessions to speak of and am on a low income. Any advice happily received. Thanks
  3. I am hoping someone can help me please, today I had a visit from a JBW Bayliff,, who was pursuing me for a council tax debt from 2011 from a previous property, In all honesty I thought this had been dealt with, he told me the LO order was put in place on the 24/10/2012 and that he was here today to take my goods, I explained that i thought it had been dealt with and I explained that I was going to phone the local council to get clarification as I already had a earnings attachment order on my wages, and had a previous attachment that had now been cleared, he said he would give me 5 minutes to sort it out, i locked my door and phoned the council, the council explained that the money was still outstanding, and that they couldnt find the attachment of earnings that i had already paid off, then the bayliff came back banging on the doors and windows, i was still on the phone at that point to the council, i opened the door and told him i was still on the phone, he went back to his car, he never provided me with any paperwork etc. turns out the debt was still owed despite me thinking it was paid, he wouldnt leave and kept on returning to my door, now normally i wouldnt of ever opened the door, and with me just recovering from an operation i was highly emotional, he wouldnt except a payment plan or give me 14 days to sort it because, he said 3 letters had already been left and that he had no choice but to take goods from the house, i told him he wasnt setting foot in my property and he said he would take the campervan parked on my driveway which wasnt mine, i went into full panic mode and phoned my mum in a distressed state, who just paid the amount via her card to him over the phone, now the debt is cleared, however now that i have calmed down and thought about it, i am still unsure of the charges. I am hoping someone can help me please, today I had a visit from a JBW Bailiff,, who was pursuing me for a council tax debt from 2011 from a previous property, In all honesty I thought this had been dealt with, he told me the LO order was put in place on the 24/10/2012 and that he was here today to take my goods, I explained that i thought it had been dealt with and I explained that I was going to phone the local council to get clarification as I already had a earnings attachment order on my wages, and had a previous attachment that had now been cleared, he said he would give me 5 minutes to sort it out, i locked my door and phoned the council, the council explained that the money was still outstanding, and that they couldn’t find the attachment of earnings that i had already paid off, then the bailiff came back banging on the doors and windows, i was still on the phone at that point to the council, i opened the door and told him i was still on the phone, he went back to his car, he never provided me with any paperwork etc. turns out the debt was still owed despite me thinking it was paid, he wouldn’t leave and kept on returning to my door, now normally i wouldn’t of ever opened the door, and with me just recovering from an operation i was highly emotional, he wouldn’t except a payment plan or give me 14 days to sort it because, he said 3 letters had already been left and that he had no choice but to take goods from the house, i told him he wasn’t setting foot in my property and he said he would take the campervan parked on my driveway which wasn’t mine, i went into full panic mode and phoned my mum in a distressed state, who just paid the amount via her card to him over the phone, now the debt is cleared, however now that i have calmed down and thought about it, i am still unsure of the charges. My original debt with the council tax was for £287.54 and in total £597.54 was charged? I only received a receipt, no other paperwork provided and i don’t think he was certificated, i really could kick myself for not being on the ball, as im currently with step change looking at bankruptcy due to a messy divorce and the ex declaring bankruptcy leaving me with huge debts. Are these charges correct?
  4. Hi, I'm new to this site and am not very good with Forums. I was wondering if you could give me some advice on the following please:- On Thursday morning I had a hand delivered letter stating 'Bayliff Removal, payment required within 24 hours'. I phoned the number on the letter and spoke to the Bayliff who was very rude and intimidating. I asked how much I owed and he said £1,440.00. After checking with the Council, the outstanding amount is £1,117.00 (which is owed for the whole of this year until April 2014). I said I didn't have it and could i pay in installments and he said that he would accept £200.00 per month but he would have to come to my premises the next day to issue a 'Walking Possession' I agreed but after reading many posts decided to phone him and tell him I wasn't prepared to let him in my home and there was no need for him to call. He then told me that without this I would need to pay the full amount by Monday (tomorrow). I phoned Equita direct and complained about this Bayliff concerned asking if i could set up a payment plan with them direct to be told that they are only a call centre and I had to only deal with the Bayliff. I am prepared to pay this but do not want the Bayliff entering my home. Is there anything I can do and if so what do you advise. I look forward to hearing from you soon.
