  1. Hi I am a disabled person with a Company Permenant Health Insurance policy, premiums paid by the company . This is paid throgh my salary payslip, tax and nics taken at source. The polcy pays 70 percent of my salary with a reduction taken out to reflect any benefits I get. I was on IB and was transferred onto ESA support group back in April 2013. The problem is that I have been called in by the Fraud department of the DWP for alleged fraud with an interview under caution regrding my ESA a very frightening experience on Friday this week . I have not committed any fraud, filled in the forms correctly ,disclosed everything and am genuinely ill and disabled I lost the use of my right hand side due to a malignant brain tumour and am still being treated. I can only think that it is something to do with my PHI. Please help,has anyone else had this problem? This is obviously very distressing.I rely on the ESA and DLA to manage, sorry for the length of this post. Please help.
  2. I was applying for JSA Income Based with Housing Benefit on 11th of May. On saturday I received letter saying I have passed habitual residency test. So I'm hoping that I will get jsa, my question is how long will it take for a decision for housing benefit and who will notify me of council or dwp ? as I was applying for it together with jsa.
  3. My partner was finished from his workplace in July 2013 due to ill-health. When he went to claim, he was put on Contribution based ESA where he was given £71.70 a week. A few weeks ago he received a letter to say that after July 2014 he would receive £0.00. When he phoned to querry this, he was told that he won't get anything further as I earn too much. He also then found out that he should have been referred for a medical (we didn't know anything about work-related activity or support until i googled it today) so was given one last week (which i presume they will write to us with results). My questions are should his amount have increased after 13 weeks to £100.15 or £106.50 and if so, can we now claimed a backpayment as he is still on £71.70 a week? Secondly, can they still not give him any benefit even after we get the results of this medical last week (the person at medical didn't mention anything about how he should have gone to one of the 'groups')? I am annoyed that it was only after he phoned to complain about his benefit coming to an end that he was 'referred' for a medical.
  4. Hi, I have problems with Job Centre. It's a long and twisted story so I try to cut it short. My Contribution Based JSA has run out on 19/03 before has run out I've received forms for habitual residency test (as I'm from Poland) with some problems from side of jobcentre (as they didn't understand why I have received those forms and giving me 3 different information's) finally on 20/03 somebody took those forms plus other documents (included form for income based jsa) from me and scan them 2 the processing team, on the same day I've received call that everything is fine and I will get income based jsa. I've received letter last Wednesday on which is written that from 20/03 'til 9th of April I will receiving £71 pw and from 10th of April this amount will be £72.40. Today was my sign on day so I went there and my adviser asked me did I fill form for income based jsa? as there are some problems I said yes and explain steb by step everything I've done. So he told me he's gonna ring processing office then if there is a problem he's going to ring me back. As I was hurry to get to my job interview I didn't stay there. When I came back home I've decided to call jobcentre myself. One lady told me that they don't have my form for income based jsa but as I'm saying I gave all filled papers she needs to send message to other person and that person will ring me within 3hrs. So I've received another call and that guy told me suddenly that he don't understand why somebody gave me information that I have been awarded jsa as they didn't have my habitual residency papers. As I'm saying that all papers were taken and scanned from me they need to take those papers back from the storage and then they made a decision if they going to award me jsa and at the moment they are not going to pay me any money on Monday. When I ask how long will this process take, the response was couple of weeks. So now I'm suffering from somebody else's mistakes and I'm left without any income. If there is something I can do to make them look faster on my claim?
  5. Hi All I wonder if anyone can help please. I'm on a temp contract and am going to be unemployed soon, so will be signing on, to claim JSA again. I understand we are in the 2014 benefits year, so DWP will look at my contributions for the tax years 2011-2012 & 2012-2013. During 2011-2012 I was credited with 50 Credits from ESA. During 2012-2013 I was credited with 16 Credits from ESA. From my understanding, there are two conditions to be met. The first one being in either tax year, I must have earned or been credited with at least 26 weeks. So that's OK. The second one however, requires earnings of 50 x the LEL. So I'm thinking that due to only having 16 ESA credits in 2012-2013 I will fail the criteria and not be awarded any JSA. Would any one be able to confirm this for me - I'll still go ahead and apply for it, but just getting a bit nervous at the prospect of no income (my fiancee works more than 20 hours a week so no Income based JSA either).   6. New to this but hoped someone could help me. I lost my job in August and went on contribution based jsa which ended in February, since then I have had no payments at all for various reasons none of which are my fault. Firstly I had the letter saying it was coming to an end, I told my advisor and asked what I should do ...he said don't worry you will automatically switch over to income based...I didn't! I was then told I needed to fill out a form...I did...then they said because I have a mortgage and received payment protection I needed to fill out another form...I did...no word or money from them for 3 weeks ...I phoned jc+ was told they were waiting for the mi12 form back from my insurance company...I phoned insurance company...they never got it...phoned js+ back was told different story altogether! I should have had this mi12 form and filled part out and send rest to my lender (not insurer) I went to jc and asked for the form only to realise that it is an application form for mortgage interest direct scheme where government pay your interest! I don't need this as I have insurance...I just want income based jsa! I phoned js+ back and explained this and the fact I have had no money for 5 weeks now...was told someone from mortgage department would call back in 3 hours...they didn't but I got a text 4 hours later saying we cannot process your claim until we have the mi12 form!, Does anyone know why they need an application form for something I'm not applying for before they can pay me jsa...it makes no sense and I have no money to live on...I had to go to a food bank today as I haven't eaten in 4 days. And from what I have read it looks like I'm still months away from this been sorted. I just feel like ending it all.
  7. Hello Friends, I became unemployed from April this. I am on ILR visa and my wife is on Dependent visa and she was pregnant when I applied for JSA. The question is am I not eligible for the income based JSA (£112.00) as opposed to contribution based JSA(£71.59) given that my own needs are enhanced because I have to take care of a family (wife and the child). IS there any legislation which prohibits me from getting Income based JSA. Also Does anyone know why one gets lesser JSA (contribution based £71.59) when he/she has paid NI than when he/she had not paid NI (Income based £112.00). Many Thanks for your replies.
  8. Morning All, I have got into an absolute mess with my JSA from not understanding all the rules I discovered last week that I have been overpaid because of savings (£8000). This has led me to start googling and reading forums and now I have learnt that I should not go on a UK holiday without informing them which Ive done three times [bangs head on table]. Incidently Im talking about 4 day breaks. I assume if you have a night away in a hotel - that doesnt count as a holiday ?!? I had no idea about these facts - Why they dont give you a list of dos and donts when you register is beyond me. How else are you supposed to know? Its not like a 'career' where you learn about the job and research it. I signed on for help and thought that was that!!! Anyway - Whats done is done ... What is going to happen? I know I need to pay back for money they have over paid me. Could there be any other implications for these two failures? Im mainly concerned about any criminial investigations ?!?! I'm going to sign off now until the new year anyway as all this is making me ill and its just not worth it for £70 a month. But just need to get all this rubbish resolved. Any advice as always is much appreciated. James
  9. hi all im just wondering if someone get income based ESA with the SG and they are taken into hospital as an Inpatient is there a certain time frame when they have to inform the DWP if they are going to be staying in for a period of time? i know its 4 weeks for DLA im just wondering if its the similar time for ESA too? any help or advice would be appreciated thanks

Ok, so I am in the support group and i understad that as such the contrib based esa, like goes on forever and doesn't change to income based after 365 days so I have a question that's been bugging me... If this is based on the contributions I have paid over the years in work is there a limit to the number of contributions that I can use? I mean, does it sort of ''run down'' the contributions that might have been used towards my final pension or something? So will I get less pension if I stuck on ESA for the next year or so? And how do you know how long they - ATOS - has suggested you have off to recover? I was assessed in feb 2013 and haven't heard anything since and I am really beginnning to watch the postman and dread what he might bring. (and my psychiatrist says I worry too much Haha) also, and sorry to be going on so, but if I am the 'contributions' support group how do I get free dental care as my teeth are suffering and they said I have to be on' income based' ESA to get free dental...so win some lose some I guess. i know about the HS2 form but with the extra money on 'support' group do you think I'd be be able to get an HS2 on the basis of low income? Right. Done. crawling back into house.
  11. Hi all, Have had esa previously and stopped after the 12 months, was told contributions would still be paid and couldn't apply again for 12 months ..... Have reapplied as its been over a year am still not able to work and haven't been since it all started just to be told that they have paid my NI contributions and its not enough for me to claim contributions based ESA again........ I am at a total loss now as it would seem that even though your NI still gets credited even when you not getting the ESA it doesn't support any further claims for ESA on contribution based ...... Does anyone know if I am being fobbed off here or is this the case, as would seem someone wrongly placed in wrag and having benefits stopped after the 12 months wouldn't be able to claim again unless it was income based for the rest of their lives, if they were unlikely to gain in health , surely that is wrong .....? Anyway any help or direction on this would be appreciated , many thanks in advance...
  12. My husband received ESA in the WRAG group but his contributions based ended in April this year. Since then we he has received Income based ESA. He has just been reassessed and has been put into WRAG again for a further 2 years but on the advice of his JCP advisor he is going to appeal to be placed in the Support group. If he is successful, will his money go back to the amount he received previously under contributions based or is that exhausted now, regardless of group he is in? Many thanks
  13. hello after recent atos medical I went from support group to zero points taken off esa on 9th april rang dwp to ask them to look again at my case my doctor gave me a sick note and updated my medical reports which I sent in got a letter from dwp saying they will pay me £71 from 9th april and in the next paragraph says they cannot pay me from the 10th april as I have reached 365 days on contribution based esa does this mean I will not get any payments whilst in appeal I cannot get income based esa so do I still need to send in sicknotes any ideas please anyone

  15. My husband has been ill and receiving sickness benefits for nearly 2o years. He was assessed last year and put into WRAG group but wasnt well enough to appeal for a move to Support Group. Our money stayed the same in the changeover from IB to ESA but now his contributions based has ended we are £30 a week less - all I claim is Carers and CTC. So much was made of nobody losing out, and it seems although we are lucky to still be getting ESA, financially we're worse off than ever. Am I missing something somewhere?
  16. Need some info: Company is putting me on a disciplinary for 'failure to start travel' Gist of issue is. I am, according to my contract a 'home based' engineer. I have a Bybox approx 1.8 miles from my home where I have to go each morning to collect parts or use as my start point for work. It takes me approx 7 minutes to get to this location. The company states that the first 30 minutes is unpaid. My contractual hours are from 09:00 to 17:00. 30 minutes either side of those times are unpaid. Now, the company has started to insist that we 'start travel' at 08:30 precisely on the dot, no leeway. They have trackers fitted to vehicles, which they are using as ammunition for evidence of 'start' time. It has been established on numerous occasions that the tracker is not the most reliable piece of equipment and was not designed for the purpose in which they are using it. I have an engineer coming out to my own tracker as it is faulty. My real question is, can an employer stipulate when you leave your house to travel to a given place even though the place in question is only 1.8 miles, approx 7-15 minutes from home. what I do in the 30 minutes upto 09:00 is my own business sureley. as long as i'm ready to start work at 09:00 Any opinions, greatly appreciated.
  17. My situation: I'm 64 and have been ill for a few months with blood pressure problems which the Doc says are now OK. The job I had was quite a physical one working 50 hours a week. I don't think I'm capable of doing it any more so I've resigned of my own free will. I have a couple of small private pensions which will mean that if I do sign on I will only get about three quid a week JSA. My question: is it worth signing on at all? Are there any other benefits (not money but perhaps training or other facilities) that I'd get that would be worth the hassle? If I could get some interesting training out of it I'd be happy to sign on but if I'm going to get bureaucratic grief but nothing else I'd rather loll about in bed late every day

The OFT has launched an investigation into whether children are being unfairly pressured or encouraged to pay for additional content in 'free' web and app-based games, including upgraded membership or virtual currency such as coins, gems or fruit. Typically, players can access only portions of these games for free, with new levels or features, such as faster game play, costing money. As part of the investigation, the OFT has written to companies offering free web or app-based games, seeking information on in-game marketing to children. The OFT is also asking for parents and consumer groups to contact it with information about potentially misleading or commercially aggressive practices they are aware of in relation to these games. The OFT investigation is exploring whether these games are misleading, commercially aggressive or otherwise unfair. In particular, the OFT is looking into whether these games include 'direct exhortations' to children - a strong encouragement to make a purchase, or to do something that will necessitate making a purchase, or to persuade their parents or other adults to make a purchase for them. Hi I need some help Ive claimed income based incapacity benefit for the last few years, recently I received a A! income support review from the benefit integrity department and it referred to my 'income support' Now a few weeks later Ive received a letter saying there has been a change to my 'income support' and the amount has been reduced to £71.00 which is the basic rate income support. What I dont understand is why do they keep referring to my incapacity benefit claim as income support? it seems they have mixed up the 2? I should be getting the full rate incapacity benefit like I have for the last few years David
  20. I went through a light on a traffic light controlled roundabout. I was stopped by the traffic police and told that I had ran a red light because *their* light was green. They were waiting at the lights of the next junction of the roundabout. As far as I'm concerned that's an inference based on an assumption. If I'd been charged with a speeding offence they'd need to produce a calibration certificate for any equipment used to prove that charge. As far as I'm aware, traffic lights do not come with calibration certificates. Is this worth defending in court? At the moment I'm looking at 3 points & 60 pounds. I have no points on my licence. I am not able to work as i am deemed long term sick, i was put onto employment and support allowance then added to the support group. i have been in this group now for over 2 years, my wife passed away in January of this year so i had to go through all the stress off cancelling her benefits . This opened a whole new light on ESA ,as the support group is for long term sick you are put into the contributions based benefit as there is no support group for income based. This makes life difficult as you are not entitled to free prescriptions, dental , opticians, no help with community care grants , budgeting loans , warm home option and lastly i have to pay some of my housing benefit and council tax. It seems if you are signed off indefinetly through ill health you cant get any help at all. Why are they punishing people who cant work? if i was in the work group on income based i would be entitled to all the above help. i have been told i can appeal to go onto income based benefit BUT my money would be stopped while this was going on which could take 8-12 weeks and they have already told me i dont qualify to go into this group as the medication i am on disqualifies me from doing any work. What can i do ? have they got the benefit scheme wrong i think so no help for those who need it most . my meds are weekly based and cannot be changed to monthly 9 items per weel which is about £70

Dear All, My wife was made redundant in Croydon just before we got married, the company went bust and therefore two weeks before we got married and she moved to the midlands she signed onto JSA for a contribution based allowance. She received two payments of the £56(?) allowance and then got transfered to my local office. To which she was then told to fill in a lengthy form, which included some of my details, we said that this doesn't look right as all we want to do is change address and status. However JS persisted that we filled it in and we did, we notified them we would be on honeymoon for three weeks and therefore will not be actively looking for three weeks until we get back in October. Therefore freeze claim. However, JS wrote to us twice first letter saying she isn't eligible to claim due to me working (income based) and the second letter came to say she isn't entitled due to not attending the JS. When we got back we went in and told them, they realised there mistake and reapplied for contribution based scheme. We got a letter again saying she wasn't eligble to claim due to not enough NI contributions. This was bizarre so i emailed and called and wrote a letter, saying in london she was claiming and got payment and now shes married and moved here she isn't and here is the letter. I spoke to NI centre in newcastle, they confirmed she has 4 years eligble NI contributions and also supplied a letter stating so. What can my next steps be? it's odd she has been paid and now they are not moving Please help thanks Thanks

Hi I am currently an Open University student and as I am on income based JSA I get full funding for my course as well as receiving £265 in a course grant to pay for anything I need relating to my course such as travel to tutorials, stationary etc. This £265 went into my bank account last week and when I went to sign on on Thursday I was informed that my benefits had been suspended because I had received this money and they said it was money I could live on. The Open University informed me that it couldn't be considered when it comes to income for benefits. The adviser also kicked up a fuss and said my whole claim was being reviewed because I was studying with the Open University and therefore a student and not seeking work. Can anyone advise if 1. I am not able to study with the Open University and claim JSA? 2. Are they able to stop my money because of this grant> Any advice at all welcome. Thanks
  24. Good Morning I currently have debt management plan and circa 50k of unsecured debt credit cards and loans. I have been paying into this for 2 years. I do not want this to run for 15 years I have recently had a child etc blah blah blah. I have started going through an IVA adviser and I am on the cusp of proceeding. I want to put a final settlement offer to the banks now that my income and expenditure for the IVA is finalised. I have not got the full amount that they will get on the IVA over 60 months but I can get around 80% from the bank of Mum and Dad... IVA advisor charges 4.5k over the term which is also factored in to the IVA I&E. As anybody been here or can offer advice before I send? Thanks
  25. Hi there, I have recently applied for contribution based JSA but have received a letter stating that I have not paid enough NI contributions. I have checked the year in question (ye 2010) and was self-employed for part of the year and know that these class 2 contributions do not count. I was however employed for the rest of that tax year and need to work out whether my employed contributions were enough to qualify for contribution based JSA. I cannot seem to find any information on how the calculations are worked to find out whether it is worth pursuing this claim. I was told by the job centre to call a different office to explain the decision. They could not tell me how it is calculated and told me to call the NI office. They would not tell me any information over the phone and directed me back to my job centre! I would like to try and avoid the income based JSA if possible as I have a rental house and although I do not make any money on this it would be a lot easier to avoid collating all of the information that I am sure they will require. Any help would be greatly appreciated!!!
