Hi I haven't posted on CAG for some time; due to some excellent advice received from Caggers I managed to make reduced payment agreements with the majority of my creditors and have been paying them for the last two years. My mortage did cause me some problems and after an initial 12 months of interest free payments (all they would agree to) I paid the mortage in full for another 8 months and asked that the arrears be capitalised; I had to pay three more consecutive payments before they would agree to add the arrrears as capital on my mortgage unfortunately I missed a small amount (by mistake) on the last payment. Since I have equity on my flat I resolved to sell it move somewhere less central and be mortgage free;hopefully having enough to pay off the bulk of my most pressing creditors. Barclays indicated if I sent in the details of sale and gave consent for them to contact the estate agents they could stop action on the arrears pending the sale; I sent them the documentation and have now received a letter advising me that as a result of the previous 'concessions' they have given me they will not suspend action on the arrears pending the sale and the matter is now being referred to their solicitors. It just seems pointless to me, I have offers on the property coming in and in 6 to 8 weeks they get their money back in full, plus all of the charges. I hope this will not stop the sale of the flat and my plans to be freed from this financial nightmare thats dragged on for the last three years. If anyone can advise or help I would appreciate it; getting desperate now and no idea where to turn to.
  2. Hi All, I am new to this forum and would like to know if I have a possibility of redress against Barlays or Woolwich. I have pasted my recent letter below that I posted to Barclays today. I'm sure others have encountered similar issues, any observations would be very welcome Argoed Lad Letter follows Dear Sir Please accept this letter as a formal notification to cancel all of my bank accounts with Barclays. I have been a good customer of Barclays since I first started work in 1964. Over the past five years in particular I have become so disillusioned with your organisation that I have no alternative but to take this action. It was unfortunate in 2005 that my business went into voluntary liquidation due to unforeseen very large debtors. This was one year after I purchased a new property, the address above. My mortgage at that time was with Standard Life and I was able to rearrange my mortgage as interest only with a term to expire in January 2015. I struggled to make my mortgage payments, but never defaulted once with ANY payment due to ANY organisation. This has always been my moral compass. Fortunately, after 9 months being unemployed I secured new employment in August 2006 but with a relatively low net salary of £1600 per calendar month. In 2008 I tried to negotiate a better interest rate with Standard Life (at this time in negotiation with Barclays). I was “not eligible” due to my low salary and less than the required equity on the property. This small amount of equity I have is due, as you realise to the crash in the housing and financial markets caused by the financial institutions and therefore in part by Barclays. There were no alternatives available to me even though the base rate had been at its lowest ever rate since December 2007. I continued paying this relatively exorbitant amount each month equivalent to 56% of my income. Over the past three years it appears as if some options would have been available to me to reduce my mortgage payments now with Woolwich, however as seems usual, YOU DID NOT TELL ME ABOUT THEM. Last month I looked for any other options that The Woolwich could offer me, there was one that would have reduced my payments by £513 per month. Since only 21 months remained on my term I was informed I was not eligible. Your complete lack of customer service has cost me approximately £30,000 in the past 5 years alone, while fat cats within the banking fraternity still pocket obscenely huge bonuses. This £30,000 would have reduced my mortgage to a manageable sum that may have allowed me to keep my home. The current position has forced me to put my home up for sale. To say I am annoyed would be a gross understatement.
  3. My wife and I am on pension credit of £217 a week. We live in private accommodation and our rent is £575 a month. The council pay £81.02 per week + £20 a week Discretionary Housing Payment. Barclays Bank have put a reserve on our account of £150 and I have been charged reserve charge's by Barclays Bank of up to £22 a time, which were unaffordable to me and have been trapped in a cycle of incurring charges which only added to my financial hardship. On Monday the 18 Mar 2013 I cancelled my reserve and today my wife received a texed saying we were being charged anther £44 pound and we do not no what for. This is eating away our rent for the 14 Apr 2013 and now there is only £24 pound left in our account. Are Banks allowed to make these charge's on some one on pension credit?

Can anyone help..... i have a small claims court date of 26th july 2013 against BPF, I have been through the FOS and they partly upheld my case. it was for a training course through HIT/PROPERTY PROFESSIONALS which went into administration in 2010. I cant afford legal representation and am seriously concerned about my ability to produce a satisfactory bundle. My claim is on the grounds of misrepresentation, section 75, and possibly " non- est factum. Could anyone help as the more i try and produce this bundle the harder it becomes thanks in advance
  5. Hi all, i am new to this site and would just like some advice. I have been trying to claim my ppi back since the beginning of April. This was for personal loans dating back to 1998. It was for three separate loans one paying off another. I received a letter yesterday saying they uphold my complaint, but are offering an alternative redress rather than paying back all premiums paid. I have received bank statements from them but i find them very unclear as to exactly how much i have paid in premiums, they also say that the final loan did not have any pii added. I have had lots of mis-information from then since the beginning of this whole saga so was just keen to know from yourselves if they can do this. I did not want any of the policies but was told it was compulsory to have the loan. Also the statement shows on one of them that nine hundred pounds was deducted as single premium then refunded ten days later which is strange as i didnt cancel it as i thought it was compulsory, im just a little confused and any help/advice would be greatly appreciated.   6. Hello Cag, I got a letter today in the post from Equidebt requesting payment for a old credit card i had from Barclaycard. They say i owe them £963.05. I believe my last payment into this account was 2005 / 2006. T hey are threatning with a doorstep agent coming around. So far as I read i believe this should be statued barred. They give 14 to respond to this letter. There's nothing in my Credit Report relating to this. What should I do? Thank you.

I opened a Business account with Barclays and was also placed in their Sales Financing Scheme [Factoring] back in 2007 It was never explained to me properly and in my mind as mis sold as PPI I have struggled since being stuck between a Rock and a hard place, and my charges have been approx £8K a year! It has also lost me 2 high value customers who were sick of constantly being harassed by Barclays to check statements etc. They did noit like this and are no longer using our services. At long last I am now in a position to end my nightmare with this sales finance, but on asking to close my account they now tell me I have to give 6 months notice, and that means I will have to pay about £400 a month service charge for them to do absolutely nothing. I would appreciate any help as I just can't afford to just throw away nearly £2.5K
  8. I claimed bank charges to Barclays 2007, small claims I received a Court date but it was stayed. What do you do with this, I have had no communication regarding this with Barclays or the Court .
  9. Hi All, below is brief summary of current issue: 1. BW legal issued statutory demand for lowell (ex barclays (OC), Morgan Stanley) 2. I applied for set aside 3. Court wrote and set hearing for BW to provide original signed agreement, statements, notice of assignment(NOA) and letters they had sent 4. BW turned up without the agreement but had statements and NOA, Court adjourned hearing till 13th June so they could get original agreement from the OC. Court gave them till 1st May to file and serve written evidence so that I can file and serve by 24th May - they haven't sent anything 5. Hearing on 13th June is non attendance pre-trial review. 6. Today I received letter from BW serving me with statement of account (again?) no mention of agreement or any witness statement. My question is what is best way to proceed? 1. Write to Court telling them that BW have not complied (again) with one of their orders? 2. Wait and file my witness statement as ordered By the way statements show late charges or £12, also account quoted in NOA is not same as in statements. Thanks for any responses!
  10. Hi everyone, This is my first time on any forum, and I would appreciate any advice regarding my position with Barclays. I have a business account with them but the company, which is Ltd ceased trading at the end of Feb, All the direct debits were cancelled via online banking and the remaining balance was transferred into another account. Once the accountant had completed the final accounts the company was to be removed from companies house, however Barclays paid a £2500.00 bill (which had previously been set up on variable dir deb (but did not show on the list of dir debits) The account has never been overdrawn and no overdraft facility was ever agreed, (as it is a ltd company any overdraft facility would have to be signed personally) So even though no money had been paid into the account for several months, the balance transferred and no overdraft in place they still made this payment,does it have to be paid back to them?
  11. Hi all, I have a bank account where I have a substantial overdraft that I live in and have done for some time. Although I have never been unemployed, I have had "overdraft protection" which within the last year changed its name on my statements to "payment protection". I decided (long overdue) that I would call Barclays Complaints Dept and discuss this protection with them, explaining that I didn't really know why I had it and that during the time I have had it (since 1998) I couldn't ever remember actively asking for it although it is possible of course that maybe I did?. In addition, during the past few years when my account was upgraded to a Premier account, I asked if I could cancel it and was led to believe that i needed to keep it and when i really pushed they said they couldn't cancel it and that I'd need to write in (I never did). The complaints department guided me through some very basic questions (didn't ask me if I thought it was missold to me for example) and then said yes I had PPi since 1998 did I now want to cancel which has now magically been done on the phone and then gave me a complaints ref saying it will be fast tracked. It all seemed very wishy washy so I am after some advice as to: - a) if my history seems right for a PPI claim particularly as I can't really remember whether I was mis-sold or not and that I "live" in my overdraft (albeit I've never been out of work) b) whether this telephone call seems normal Of possible further note: I have asthma and at no stage have I been told that this is excluded from a claim on a PPI policy but nor was I asked if I had any medical conditions. I obviously hope my claim is successful but would like ANY opinion and/or advice in the light of my circumstances. Thanks
  12. I'm new to this and don't know if I have posted in the right place. Last year I had new doors and windows from Safestyle UK. The salesman persuaded me to take 12 months interest free credit arranged through Barclays Partner Finance with the advice to "pay it off or get a cheaper loan". There was no discussion about affordability and no income/expenditure assessment. My (then) partner assured me that he would pay the full amount before it came due. The payments are due to start in August. My "partner" has gone missing (with 20k of my money). I have tried to get another loan but because of my income I can't. Even adding it to my mortgage has been refused as I only have 5 years left so to add 7500 to it would be too expensive. I am now faced with paying 20% APR and my windows are going to cost me over 20K in the next 10 years. I can't afford the repayments and I'm thinking that I might have to sell the home I have worked so hard to keep.
  13. Hi All, I recently put in a PPI claim from Barclaycard as they sold me a PPI policy on a university campus in 1996. I was under the impression that this was too long ago to claim. I basically told them that the girl who sold it advised me to take it out as it would mean I would have a better chance of getting the card. I had the card for about 10 years and for a long time had a balance of around 11k. So I put the claim in with the following reason in Section E of the form "The sale took place on the campus of Leeds University. It wassuggested verbally that if I took the insurance then the application wouldhave more chance of being successful. At the time I did not know this would nothave been the case and am horrified to think I was misled in this way" A couple of weeks later I got a call from Barclays who said that they just wanted to confirm some details about who I worked for when I had the card. I mistakenly gave them different details to the ones on the form as I was going back to Uni as a mature student and changed jobs around that time. I didn't realise I had given them the wrong details until I just reviewed the form now. Last week I got a letter from them stating they were refusing my claim on the basis of the following. This is an exact copy of what they have written - ~I don't even understand it as it seems to make no sense: First bit does make sense but is factually wrong. "In your complaint you feel you were: given misleading or inaccurate information about the policy" The second bit which is confusing: "We have identified that your application for PPI was submitted post. At this point of applying for PPI, as no advice was given the process required you to select the specific type of cover required. In addition we conducted a review of the documentation you viewed during the sale. We are satisfied that the documentation presented accurately described the scope of the policy, and was sufficient to provide you with all of the information necessary to inform you of the terms and conditions of the policy. As a result we are unable to uphold your complaint" So - I didn't fill in the form. The girl that stopped me on campus filled in the form - I signed it and that's all I remember. Is it likely they are just fobbing me off ? Should I take it further with them, SAR them or just go to them ombudsman ? Any pointers ? Thanks Hamish.
  14. I have decided to get these running as my barclaycard claim is hopefully coming to the end. First thing im wondering, is should i ask for both account info on the same SAR? And can i ask them to just take the £10 fee from my account?
  15. Hello Everyone. I had a £3000 loan with Barclays that I took out in December 1996. I have the Barclayloan statement that says I also had Barclayloan Protection which cost £720.48 (15.01 per month x 48). I think I was late with payments but no more than twice however they issued a CCJ against me in March 1998 for £3412.91 + Costs + Solicitors fees so a total of £3545.66. This was dealt with on their behalf by Elizabeth Handforth Solicitors and I agreed to repay £68.00 per month and repayed the outstanding by April 2003 and have the confirmation letter. My question is do I have a chance of a claim or is it too late? Also would the fact that they took out a CCJ against me go against me? Thanks for reading.
  16. Hi, I am not sure how to post in specific forums, so hoping I will get some replies and advice? My husband has had a Business Account with Barclays for well over 10 yrs and we are wondering if we can claim back any of the many charges he has incurred over the years. My husband has a v small business and also has a loan with Barclays. Barclays attempted to take the loan from his Business account but could not as there were insufficient funds in the account due to a cheque that my husband had put into the account not being cleared (on its 4th clearing day). Barclays have now issued my husband with a £35 charge and my husband phoned to complain asking the manager how Barclays could charge my husband £35 when there were no funds to cover it as the cheque my hubby put in needed another day to clear? The manager did not want to know and hubby is fuming as he feels he has been ripped for years, any advice would be appreciated, sorry for the rattling on
  17. Hi, I've had a number of unfortunate circumstances where i'v had to contact Barclays regarding a Select account and 2 loans. I've not been able to keep up with the payments and have defaulted. I thought i'd done the right thing and contacted them and after going through endless letters back and forth (mainly where they threatened things and I offered solutions) - Its ended up that I offered a monthly payment I could handle and in the end they have accepted this. This all sounds good except for the following things which I hope someone could shed some light on please: 1. The offer for payment was accepted last September/October however I haven't heard anything from them since. I have chased them and they just tell me that i'm in the pile of people who are doing the same and I will be contacted when its my turn! Does this mean they are still adding interest to these loans and Select account? 2. I noted that some people have been talking about PPI on their Select accounts, is this something thats automatically been added? Can I find out if this is on my Select account and can I claim back this? Thanks in advance
  18. HI could some one please have a look at my stat sheet and see if I worked it out right. the loan was for £3000 over 24 months with ppi of £16.87 a month. I paid £165 a month for 15 months and a final payment on month 16 for £1404.81 as a settlement figure. the apr was 17.9% total amount payable was £3952.32 and i paid £3879.81 thanks for your help
  19. Hi, Barclays Partner Finance have been calling me almost every day for a month and a half now asking to speak to someone I don't know and have never heard of in my life. From what I gather, they are trying to reclaim unpaid debt on some kind of credit card. I have asked them several times to take my number off their records because it's the wrong number, and I have also tried blocking their number, but they either keep calling or change to a new number and keep calling from there. So far they have used 3 different phone numbers to call me: 08458787153 08453007021 08453007024 I don't know what my rights are or who I can complain to about this, I'd just like them to stop contacting me. Can anyone shed any light on this? Thank you!
  20. Hi all, I'm at my wits end with Barclays and Verified by Visa right now. It all started over Christmas, my mother had someone try to buy some stuff online with her card, but they failed because they were trying the wrong security code which caused her card to get blocked by VBV (Error code ECI5) and she eventually got a new card after being put through to the fraud department. Good, right? Except.. Not really. Since she's got the new card she's probably had it blocked by VBV when entering correct details around ten times since. What's worse is that it's not just her card that's getting blocked, it's also mine, my Dad's and even my boyfriends (We all live in the same household). It's always ECI5.. We have to ring them up to get it sorted, but we're sick to death of it happening on every second transaction or so. We've explained over and over that it's a hassle and while we appreciate that the fraud system worked initially, when we're inputting the correct details it doesn't seem fair for it to consistently knock us back, especially those of us whose only link to the other person is the fact that we live in the same house. It's also independent of computer, browser, etc. Mine is blocked right now and instead of phoning them immediately (because I'll end up being put in a holding queue for the next thirty minutes ....) I'm here ranting, because it seems that despite filing complaints, despite telling them that this is completely out of order it still happens without fail (to the point I see the VBV page come up and I cross my fingers in the vague hope that my transaction might go through). Sorry. I'm frustrated. Anyone got any suggestions? Thanks in advance.
  21. new to this, i have a business acc sole trader with barclays. due to current climate and financial hardship, i want to know best way of trying to get my ridiculous unfair charges back, i only have this acc and have a few direct debits come out which most of time dont have funds in there to cover them , which means they pay them and charge me £30 per item, what can i do.thankyou:|
  22. For Eight years Barclays has abused my mortgage account. Following a dispute in which Barclays alleged that I have not paid two monthly instalments of about £1100 each, I decided to pay the monthly instalments in CASH. However, Barclays enforced on me fines of £40 monthly for arrears based on that dispute and other charges totalling about £4000. since I was ill, I accepted too pay the penalties and the alleged arrears which made my monthly payment jump to about £1200. I continued paying all that time but when I received my annual mortgage statement I was surprised that the dates when my CASH monthly payments were credited to my mortgage account were always days, up to 9 days, after my actual payment of the cash. This, of course, makes towards more interest added to my account. I complained to Barclays who said that was the time needed for my CASH to reach their mortgage arm WOOLWICH- which is a load of rubbish. In took the matter to the financial Ombudsman who, as usual, sided by Powerful Barclays. Now I intend to take Barclays to court hoping to be compensated not only for the money Barclays robbed me of but also for 8 years of suffering and stress which led to my wife being diagnosed with Cancer. I wrote to Barclays that I'm taking it to court about a month ago and now I will writre to them again letter of starting action in court. Any advice? Thank you
  23. I have a cash card account with Barclays which is overdrawn to the tune of £687. I have tried a few times to set up a repayment plan and agreed repayments. I have found these repayments hard due to Barclays' rigid repayment schedule which they state that the overdraft has to be paid back within 6 months. I agreed the repayment plan with the best intentions but have found it hard to keep up with their repayment schedule. The original overdrawn amount was £711. Talking to Barclays on the phone is a frustrating affair so I've decided to communicate with them via letter. I want to repay back what I owe but I am finding it hard to deal with Barclays even after explaining my difficulties. The "unauthorized" overdraft came about due to Guaranteed Card Payments to various Payday loan lenders which have now all been paid off bar one final repayment at the end of this month. I am in full time employment at the moment and working to pay off all my debts. I currently have £3258.28 of debt to pay off of varying amounts to Woolworths, Littlewoods, Very, Barclays, Capital One, Vanquis and Natwest. I have made headway with Natwest who agreed to let me pay £25.00/month over a year and with Vanquis. The others are being a bit more difficult to deal with at present. Could anyone advise with how to deal with Barclays? I will tackle the other ones after. Many thanks
  24. Hello everyone. This is my first post on here . Since 2005 I have been in financial difficulty and at the time had an account with Barclays (which the eventually closed in 2010). I had an overdraft of £2000 but although emploed , was regularly over my overdraft limit and getting loads of charges which took me even more into the red. This continued until 2010, when Barclays eventually closed the account. I notified Barclays numerous times since 2005 of my financial hardship, however they contnue to charge me the fees for unpaid items, over-limit charges, etc. Before I could clear past charges, new ones were added, and the cycle continued. In 2010, I had family problems,i was not able to manage my financial affairs. My question is, as a result of all the charges barclays applied to my account, my financial hardship was made worse as priority payments were eate up by barclays charges, so i had little money to pay mortgage or priority debts. I am now unemployed on JSA, still have priority debts that need paying and living on only £70/week. I have read the "financial Hardship" criteria on FOS website, and think i meet the criteria. Can anyone give me some advice as to whether i have any chance of reclaiming back the charges under financial hardship or is it not worth it. The reason i did not do earlier was the issue family problems above. Any advice would be really appreciated. Thanks
  25. I took Barclays to court for bank charges before the Abbey–OFT case and I was offered and accepted a Tomlin order and it was approved by the court. I wanted judgement but I felt brow-beaten into conceding for a Tomlin order. Barclays never paid it and I gave up after that, it was for about £3500. I have a court appearance with Welcome finance, for £5800 PPI on Friday and I have received an 11th hour offer of a Tomlin order. They already tried to get me to back down but I want to ask the Judge for everything I have lost and everything that court rules says I can ask for.' If I accept this so-called Tomlin order with welcome, what if they don't pay?
