  1. followed advise from this forum and Barclaycard have upheld my claim,although they admitted PPI for 8 years they never informed me about this so that's why I claimed.Five weeks later they admit my claim from 1994 to 2002,i had no credit card statements and they only have records they say for 2002. No records fro 1994 to 2001,offer made of 2260.00!!.Now the point after reading the posts here is should I go for an increased offer as they say they have used information from the BBA TO GATHER TRANSACTION HISTORY IN ORDER TO VERIFY MY CLAIM AND THEREFORE THE OFFER,CHEQUE ARRIVED YESTERDAY.
  2. Just under 2 years ago my Barclaycard went to Mercers, and I received a default notice on Mercers headed paper. The account was then transferred back to Barclaycard. I've been trying to keep up with the reduced payments (£50+ per month) they then agreed with no interest, but having been back to CCCS with my current situation they advise a £1 token payment at present. Things are due to improve once priority debts are paid off but this will take about 12 months, and I am now on a payscale ladder so things will improve next year. Barclaycard have refused this offer and their previous letter said they would send a default notice if I didn't send the £50+ payment in 7 days, and will add interest again, their current letter says they will send a default letter if I don't contact them (no timescale given, but it is strongly implied that I telephone) Can someone knowledgeable please advise the 'rules' and implications about a second default notice for the same account? Thank you in advance.

    Hi there, I wonder if anyone can help? Quick background- I have recently lost my job, therefore halfing our income into the household We do have a family member who has been very generous and offered to pay off some of our debts to help ease the current financial constraints on us and we have begun sending "full and final" offers to our creditors as well as asking for CCA's from the relevant creditors. We have received most details back inc CCA's other than one with Barclaycard. When i initially took out my Barclaycard it was with Egg bank and this changed to Barcalycard later on.... I have been sent back two sets of documents.... one for each company and they are just a copy of the terms and conditions... i have no CCA from either company, no dates or indeed any personal information at all..... i am happy to scan the letter we were sent if that helps at all? Please accept my apologies in advance... i have never used a forum before and have never had to deal with CCA's and the likes before so i have had to hit the ground running. I would like to know if this is indeed a CCA i have been sent despite the lack of a signature or any personal details on the documents. I believe my CC was taken out around 1999 if that makes any difference at all. Many thanks
  4. I recently had an offer of £700 as a full and final payment accepted by Barclaycard. This was paid and I received a letter from them stating that the account was now settled. Today I got a statement saying I had a balance of £541.38 and that includes £18.75 in interest. What should I do? Should I just ignore it or call them? Any advice greatly appreciated.
  5. Hi, I am new on here so please bear with me. I have several credit cards and due to having a much reduced income at the moment cannot make the full payment. I have managed to agree reduced payments with Halifax, Cap One & MBNA but Barclaycard will not play ball, I have 3 accounts (1 is ex Morg Stan, 1 ex Goldfish). I have made an offer in writing of £50 per month for each card which was declined, they said that they would only accept a minimum of 1% of the o/s balance and if I wanted to pay less I had to deal with them via someone like Payplan. This has been going on since May and my accounts have been passed to Mercers. This joke of an organisation phone at all hours and always ask for me by first name, if my children answer they do even say they who they are from. I have repeatedly told them, verbally and written, that I will only deal with them in writing but they continue to ring - they think that 7pm on a Sunday is acceptable - and that they will only deal by phone. After reading this site I have sent the harrassment by telephone letter but did not send recorded. The last few times they have called I have refused to answer the security questions and have told them the the letter has been sent. Today i recieved a letter from them giving me 48 hours notice as I have ignored demands for payment (I have continued to make payments of £50 per month) and that they will now pass my account to a local debt collection firm unless I phone them. I have previously asked for the executed credit agreements but did not give time frame. I have not recieved copies of the signed agreements so have written back asking for them again or an explanation why they cannot be provided. (all this to Barclaycard). They did send me terms & conditions but the dates were all after I took out the cards. Bit of a loss now so any advice will be appreciated.
  6. hi this is my first post . I have successfully claim back ppi on an old Barclaycard in May 2015 when I was going through these old statements, I found I had been charged late fees which go beyond the 6 year rule. After doing some research on here I found out about the s32 limitation act 1980. I sent a letter quoting this part of the act and how I felt it applied to me. Barclaycard did reply but didn't acknowledge this act and said the £12 charges reflect their cost and if I want to continue this complaint I should go to financial ombudsman service. However all the charges I have where over £12 but beyond the 6 year cut off. Has anyone successfully claimed late charges beyond 6 years? Any tips on my second letter and how do to calculate compound interest. or has there been any successful court cases that won that I can use in my next letter to them before I go to the small claims court? As going to the small claims court scares me any help will be much appreciated. Thank you janie
  7. hi all, i am trying to help a friend to claim his PPI on his barclaycard but i'm unsure as to which way to fight it best. I will try to keep it short and sweet and explain what i know about his situation. My friend applied for the card in 2003 and the box for PPI is not ticked, however he did tick the box asking for card protection for one year for £16. I have done a SAR but the statements are missing from 2003 to 2004 but PPI is showing through the lifetime of the account. In the data log there is no PPI or insurance products flag and is showing no insurance or PPI present on the account. In 2005 accidental death cover shows on the statements being charged at £5.95 a month, this is somthing he has never asked for along with the PPI., then in october 2008 these payments suddenly stop and in november they refund all the payments back into the account?. In their data log it say's customer changed his mind. In the same month the PPI is now showing on the statements as optional payment protection. I dont know how best to try and reclaim this because if i say that the box was not ticked they will more than likely say that it was agreed to over the phone and it was a non advised sale etc. Any help would be great thanks.
  8. Hi, First time posting/reading the forums here and I'm in need of some advice. I have an outstanding balance with Barclaycard for around £2,500 (credit card - no ppi). Due to loss of job back in 2013 I went in to a debt management program, since then I've been making payments for the last 18 months or so but at a rate under the minimum amount (agreed with my Debt Management Company). In my first year of debt management I made a very small payment £100 or so to my DMC and they paid my creditors. This year my financial situation had improved somewhat (new job etc) so I increased my payment up to around £200 a month, Barclaycard accepted the new offer from my DMC but that last month I've received two letters (one saying if I don't pay all amounts owed in full they will issue a Formal Demand, and then 3-4 weeks later the Formal Demand). I'm a little unsure what to do next, I simply can't pay the money, I can't pay more a month as the £200 I'm paying now is a struggle (I only earn £1000 p/m and bills, rent, car, etc etc plus the £200 to my DMC leave me very little to live on). I still have a total outstanding amount of debt to the total of around £10,000 (including the Barclaycard money). What do I do next as I have until August to resolve this or Barclaycard will issue my debt over to a collection agency to recover the money, again I don't have any thing for them to recover and since I've had to move back in with my parents I'd rather that I didn't get someone just knocking at my door.... Any advice or help would be appreciated, additionally it might be worth mentioning that I suffer from a condition called "telephonophobia" so find it a real struggle to make any correspondence via this method.... Hope you guys can help
  9. Hello all, I'm completely new to this so please excuse any ignorant mistakes I may make I'd be so grateful for any advice/suggestions you kind people may have. Out of the blue I received a Claim from MKDP LLP (wow I've read some bad things about them and Sarah Lambert on some forums!) on 29th August. I received a letter from Raven Recoveries in November 2013 about the debt, but had no idea who they were. I'd never received a letter of transfer of ownership. I contacted them via post but never heard back from them and then never received any warning of legal action. I get lots of nuisance calls which I'm assuming is this company, but they never leave voicemails (even though they claimed they have when I spoke with them two days ago) and I don't believe I ever provided them with my mobile number. They were incredibly rude on the phone and unwilling to co-operate. Firstly, I'd like to contest the claim as I never received any notice of legal action and they have previously failed to respond to my correspondence. Secondly, this was a credit card I had initially with Morgan Stanley some time before 2006 (I don't have paperwork from that long ago where I'm currently living). This was then taken over by Goldfish (which I was never notified of) and then on to Barclaycard. The account number assigned to Barclaycard is different from the original one with Morgan Stanley - I'm not sure if this matters or not. I know my next step is to acknowledge the claim and then I believe I should send a CCA request and a CPR 31.14 request to Sarah Lambert who is the claimant so I can have all the appropriate documents to support my defence. I'm not disputing the debt, but I'm disputing their conduct - which option do I tick of the following? 1. I intend to defend all of this claim. 2. I intend to defend part of this claim. 3. I intend to contest jurisdiction. Should my communication be only with MKDP LLP? I don't have any paperwork proving they legally own the debt, should I also be writing to Barclaycard? I've never experienced anything like this before, so once again please excuse my ignorance to the situation. If anyone has any advice for me, it really would be most appreciated. Thank you so much.
  10. We have 2 barclaycards both we have had for many years, 1 was originally an Egg Card. Both cards in my wifes name. Current Balances: 5311.19 8405.12 We have received a default notice for both cards as we have paid very little in the last 6 months. I have just written to them asking to freeze interest and charges and give us 2 months to respond back with a payment offer. Is there anything else I should be doing yet?

Dear friends, I have checked my Equifax and Callcredit report’s in the last few days as I know I have some pretty bad looking marks relating to a Barclaycard I had a good number of years ago, I have learnt from the error of my past and have had a clean credit file for the past 5 or so years. The Barclaycard was not managed well by me (I moved address in 2008 after graduating, got a new job and got married all simultaneously and did not inform Barclaycard during this busy period until 2010), although I never defaulted just had a large number of late payments, I am really upset about not being more proactive at the time as now I would like to get a mortgage and this is really holding me back. My main issue today is that Equifax are showing inaccurate Barclaycard data going back to 2006, and I only want it to show the most recent 6 years (going back to 2009). To get a better understanding of what actually happened I will explain my Callcredit/Noddle report first as they have reported the Barclaycard entries correctly: Jan – Jun 2009: To explain, I fell behind on payments in Jan 2009 & lots of fees were added by Barclaycard until June 2009 when they took money (minimum payment amount) from my Barclays current account to offset against the Barclaycard balance hence, a green mark in June 2009. Jul 2009– Mar 2010: Then as they added interest and more fees (from Jul –Mar 2010) this pushed me over my credit limit again until March 2010 when they again took money from my Barclays current account to pay the full balance on my Barclaycard. Apr 2010 – Mar 2012: I assume they kept the account open until March 2012 which is why I have a number of green payments for this period. Equifax Report: Right now my concern is my Equifax report. This shows a number of errors for Barclaycard, and frustratingly they are also showing inaccurate data going back to 2006: I only really want the most recent 6 years showing (from June 2009 onwards) as I don’t see why they should be holding data on record which is way older than 6 years. As they have recorded the payment markers incorrectly, if the report would show only the most recent 6 years then I wouldn’t have any late payment markers showing which is what I am hoping to do however, in reality it should show like the Noddle report with late payment markers in 2009/2010. I would like to find a way of asking Equifax to update my Barclaycard records to only show the most recent 6 years (green markers from 2009 as above) without worrying about Barclaycard reporting the correct dates (late markers) to Equifax and Equifax amending their report. Is there any way I can do this? Do Barclaycard still have the authority to ask Equifax to change the data even though it was so long ago, or do Barclaycard have to report it within a certain timeframe? Is there any way I can ask for the whole record to be removed due to the incorrect entries/dates? Should I approach Equifax or Barclaycard as I would like to try and get this done as soon as possible as I have seen a house I would like to buy? I apologise for the long post but its the only way I could explain it due to the complications, any help is really greatly appreciated x Imogen
  12. hi guys, I'm after some advise if you can please. Ive also phoned debt line twice today and received two lots of different information, and also received different information with regards a bank and a mortgage broker. so here goes. my situation: years ago i got myself into pickle with debt. i had several loans including a large one to Barclays, Barclaycard, and some minor loans. i lost my full time job and money was tight. eventually i started to pay off the loans i could, or the ones i knew about at the time. got with my ex partner who i give the money to to deal with my finances when i was away, never heard nothing back from barclays, moved address split up with my ex shortly after. (turned out she kept this money for herself). long story short. i still have a barclcaycard debt outstanding owed to MKDP. The debt was originally for £3116. and i don't low whats happened to the barclays loan it is not showing on and CRA files so I'm assuming that gone. now I'm settled with kids, i would love to have a mortgage with my partner. but the problem appears to be this barclaycard debt. the account was started 15/10/2001, it was settled 24/06/2011, and sold to mkdp 01/07/2011 for £3116. The default was registered on 27/08/2009 for £3116. this is shown on experian as that date. yet equinox don't who anything of this debt. MKDP are still registering the debt each month as not paid and as a late payment, and this was updated only a few days ago. my questions are: 1. when the default was served, 6 years would mean that it would drop of my credit file, but what would drop off, just the default or the whole account with barclaycard. even if they sold the debt and made an entry to say the debt was sold july 2011 to MKDP? 2. would the whole debt including account from Barclaycard and MKDP drop off come 6 years next summer even if no payment is made. or say if MKDP updated there file in say July 2015 a month before the default drops off, and the make a note as late payment, would this still show there for a further 6 years from next july. obvs im in a pickle, cos even if i scraped all my money together, i would doubt i could afford to cover the cost of this debt atm. the fact I've gone 5 years so far with it being there. And obis 6 year point in becomes SB, would MKDP still be able to make entries on my credit file say for OCT 2015 NOV 2015 for missed payments yet the default has cleared and the account would be SB? i was under the impression that after 6 years the whole debt and account would just be swallowed up by the system and would drop off. any advice would be appreciated, I'm kind of worried that they will serve a CCJ against me in the next year, if they do this, would i be able to say just pay it before a court hearing. I do have an additional credit card i could use but thats earmarked for our wedding atm.
  13. Hi all, My wife had a small BC balance (£250) when I lost my job back in 2009. To summarise, BC sent a Notice of Default in May 2009 so as we thought this account had defaulted we added it to our DMP which we started in August 2009. BC refused to accept DMP payments and sold the debt to Cabot in November 2011. Cabot have happily received the DMP payments since then. We have recently been trying to tidy up our Credit Reports to move on with our lives and have contacted BC to complain with regards to the fact the balance has never been recorded as diminishing (It went up to £500 with charges) on her report and that there was not a default showing from May 2009 only '6' late payment markers.... We then discovered that the BC 'Notice of Default' (From Mercers) was actually NOT a Notice of Default and that they had very cleverly worded it and mis spelt certain clauses to make us think it was a Notice.... So my wife wrote to the 3 CRA, BC and Cabot last week to complain and to back date a Default to May 2009. This is what happened next: Cabot instantly recorded a Default dated February 2015. BC came back with an offer to back date the original debt to a default on March 2010 when they say they sent the 'proper' Notice, and offered £500 compensation for the stress. They admitted the May 2009 Notice was confusing.... The 3 CRAs have confirmed they will investigate the matter. We never received a notice in March 2010. Is there anyway we can formally complain to have the default backdated to May 2009? We have the copy of that 'confusing' notice from Mercers And how on Earth can Cabot just flippantly record a default dated February 2015..? Any help greatly appreciated as we are at our wits end with this...
  14. Hi all, Wanting to try to reclaim PPI (and possibly late payment / exceeding limit charges?) for my girlfriend and confused about exactly how to do it? Have just tried to look around the forum but there are so many links and reems of information and I am not sure exactly what to do. is there a simple step by step guide relating to the below?..... Have been sat on a lot of this info since 2012 when we sent SAR requests - with the intention being to try and sort out her credit rating (due to previous defaults entered relating to the accounts below). We haven't followed up on all of this quickly as just been too confused and stressed with other financial worries - and just want to try and sort everything now. Have recently come to realise that PPI/charges may be reclaimable... .looked into it for a while and then lost all the information due to computer being stolen, and then just haven't followed up. From the paper notes/SAR info I can state the following: 3 Accounts 2 with Barclays - got SAR information August 2012. 1 - Barclayloan 2001-2002. Was paid off fully. Statement shows an "Insurance Premium" of £45 - which I've noted was "added to loan value" (via previous research on this forum?). Have noted £45 charge + circa £55 interest claimable" Must have been a spreadsheet/calculator I used? Not sure which or how to do this now? Calculate it on a spreadsheet + interest - write this into a letter and claim 2 - Barclaycard - defaulted Jan 2005. Passed to HFO services. circa £3000 balance. She ended up giving in to threatening letters and phonecalls and paid a total of around £600 to HFO services over a few months. Hence won't be stat barred until 2018. However - no CCA provided, HFO services seem to have had all sorts of issues....advised on here this is "deadlocked?" - not received letters for over a year. Statements received in SAR show PPI totalling around £170 was charged. Another £25ish was charged for some sort of "CVR accidental death" thing.. ..and then another £160 of exceeding limit and late payment charges was added - £20 per time. (All of this over about 8 months). I have made a note stating "circa "£340 charges + £250 interest recalaimable??" Assume using a calculator on here? Is this a case of calculating/adding up charges on the statement - working out interest somehow - then sending this with a letter as a claim? 3 - Natwest Credit Card. Balance defaulted Jan 2009. Last payment few months prior. Stat barred now, no contact for over a year. We wrote and asked for SAR info August 2012, but Natwest replied saying they had a different address and require proof of address and the SAR resubmitting. Did get some info back in response to S78 which shows PPI was included on the account though - but don't have full statements to see how much. Assume need to resend SAR now, get statement then.....not sure what to do next? Use a spreadsheet to calculate a £ figure and then put it into a letter? Hello-question please re CCa or lack of one, Barclaycard and Amex didn't send a proper CCA but still adding % and even late payment charge on BCard x 2 -can I send a letter telling them this is wrong whilst in dispute or are they allowed to carry on like this -I stopped payments several months ago after the terms and conditions came instead of CCA. ..can anyone help with advice on what to do next please -Thanks I have requested CCA from Barclaycard x 2 and Amex-neither sent CCA just terms and conditions. Now BCard are adding % and late payments to my account and Amex wrote saying the account is being sent to NCO for collection-help please as really worried.....
  16. Afternoon All, I thought I would share some good news with you all today and also ask for a bit of guidance. Today I took delivery of a letter from Lowell saying the following:- "We write further to recent communications regarding the account detailed to the right. After reviewing the account, we are prepared to take a commercial view in relation to this matter and as a gesture of goodwill and strictly without any admission of liability, we are prepared to close the account and write-off any outstanding balance. We trust that you will find this satisfactory and that this matter is now closed." If I am correct it relates to an account opened in 2006 and I have no idea when the last payment was made, the default drops off in a few months. My thoughts are:- Are Lowells becoming more professional and not chasing debts soon to not be enforceable via court? or do they know that it's SB? even so they still have time for a CCJ or do they fully realise from looking at my credit file I have nothing?   17. Hi everyone, this is my first post so my apologies if something similar has already been posted. I need advise on a couple of points about the dmp I'm on. I am current 5 years into a dmp with Eurodebt (I know its not great being on a paid for dmp, but it has served its purpose, also i'll get into this shortly) and have four creditors with a current total owed of around 23.5k. Of the four creditors, 3 have placed the accounts into default which are due to clear from my credit history within the next 12 to 18 months. However, after looking at my credit file properly for the first time in 4 years I have found out that the Barclaycard account I had (now managed by Link Financial) has never been defaulted but just listed as 'payment upto 6 months late' since December 2011. I really need some advice of how to move forward with this. I am in a position to make a full and final settlement to them and they are willing to accept £1300 from the £2400 that’s owed. However, I am concerned that my credit history is going to be showing the late payment markers for 4 years after the others have dropped off, even though this would be the only one I have paid off. Is there anything I can do? Secondly, I could do with some info of how to move my dmp forward without using Eurodebt, as the £45 a month fee would be better served paying my creditors, not to mention straight away taking the expected repayment date from 29 years to 18 years! I have looked at Step change, but I’m not sure whether I should use them or look at doing it on my own (although this does seam a little daunting). I can only blame myself as I should have looked into this sooner, but at least its now time to do the dmp properly. Any help will be greatly appreciated, as I finally look to get my life back on track
  18. Hi I have been chased for a while for a debt for 2 barclaycard debts. A few days ago a chap knocked on my door and handed me a statutory demand. I have sent off a CCA request by recorded delivery and am awaiting a response. Would it be advisable to apply for it to be set aside if the CCA request is not received by the time the demands 18th day has passed? BW Legal has assured me it wont go any further until the CCA request has been processed, I do not have this in writing but have been told it on the phone. I have tried to read up as much as I can but there is so much info on the site im now confused ! Thanks in advance. Derek
  19. i have had a Barclaycard for around 10 years and managed to run up big debts on it (aprox £12k). I ran into trouble after a period of being jobless and Barclaycard closed my account and agreed that they would freeze all interest on the account if i made regular repayments of £50.00 a month , at the time this seemed like a good deal overall as i wouldn't be getting charged interest and did genuinely want to clear the debt. I have just realised... (been sent a default notice by Asset Link Capital). . that payments for the last 3 months haven't left my account to Barclaycard. . am now paying £54.00 a month. . genuine oversight on my part don't often scrutinise my account. Asset Link Capital have told me by letter that i need to clear the payments they haven't received, which amounts to £162.00. Not having this amount of money to hand i rang Asset link Capital and asked them if i could just simply start up the repayment agreement with them to which they replied no, i will need to settle the late payments or am in breach of my agreed payment plan. when i asked what action they will take i was told they will apply a default to my credit record and "MAY" apply to the court to get full payment from me... currently £8000 ish... I guess my question is, why did i not receive notification from barclaycard that they were passing my debt on? they should have told me right? also... in layman terms what do their threats actually mean?   20. Hello out there to anyone who can help. I currently have a thread running in legal issues http://www.consumeractiongroup.co.uk/forum/legal-issues/192275-ccj-interest-debt.html and as the advice I've been given has made me lift my head out of the sand a little more I thought I'd try and tackle my issues with Barclaycard. I had accounts with Goldfish and Morgan Stanley(probably around 7-10 years old) which unfortunately ran into difficulty. I arranged payments with both these accounts on an interest free basis and all was running smoothly. Since last year Barclaycard have take over both the accounts and I believe they are going to try and railroad me. They've already started to charge interest on the accounts (which I have had to get refunded)despite my arrangements and are starting to prove troublesome. Is it worth trying the account(s) in dispute tactic and sending SARs etc to see what they hold on me and if they have the CA's on these accounts bearing in mind the age of them. I've never trusted Barclaycard and previous accounts I have had with them I have settled. I did not choose them as my creditors and I would love to get them off my back if I can. Any suggestions where I might start?
  21. Hi all What do I send next to Bcard - if anything? CCA requested for very old MSDW card. Received usual reconstituted application form. Dodgy DN issued by Mercers. A/c in dispute letter sent to Bcard + holding them responsible for Mercers harassment. Letter and doorstep visit (told to Foxtrot Oscar) from Resolvecall but no confirmation from either Mercers or Bcard that they are who they say they are. Today: 2 statements from Bcard. 1. Mercers are now dealing with your account...' 2. '...your card has been withdrawn. 3. 'Your card has now been canceled....' And £0 credit limit shown. 4. Interestingly no Late Payment Charge for Oct but £12 on all preceding ones. None of this overly troubles me but I wonder if I should write querying the nature of assignment to Mercers and/or does 'Your card has now been canceled.' mean that the agreement has been terminated. Or do I just let dying dogs lie for now? Any advice gratefully received. Best wishes vic

Hi, I was self employed but my business now makes very little with just a few hundred a month coming in. 9 months ago my wife and I sold our house (which had a joint mortgage) and bought a cheaper house in her name. We used the profit to pay off some debts but I'm still left with about £30k debt on credit cards and an unsecured loan. (which I haven't paid for about 7 months) After my wife has paid the mortgage she's left with about £600 a month for the other bills eg community charge, utilities etc so there's not much, if anything , left to pay my debts off. I'm 60 but hoping to develop a new business which may bring some money in. Also, my mother died last week and I'll receive a small inheritance of around £2000. Other than that I have no assets or car. I've included a more detailed breakdown below but any advice would be very welcome. 1 Is it really worth asking for the original credit card agreements? I've read elsewhere that they don't need to be original to recover the debts. Also, do I have to send letters to both Westcot and Barclaycard? 2. We no longer have any joint accounts. Will my wife be held responsible for my debt problems and do I have to declare her income if it goes to a ccj? 3 They've added late payment charges for the last 7 months or so. Can these be reclaimed and if so, how do I go about it? Lastly, I can't access the library though I registered a few years ago.   23. Hi I have been in a DMP with StepChange for about 4 months now and it seems to be going fine - the threats/chasing letters are drying up. Most of my debts were defaulted in 2011/12 and have been passed to DCAs. My account with Barclaycard was initially passed to Mercers (who I believe are part of Barclays) and I received a default notice in December 2011. The debt was then assigned to IDR Finance and is run by Link Financial. When I check my equifax report (yet to do experian), the account does not show as a default - rather a series of status '6' since April 2012 (it is showing as Link Financial, not Barclaycard). I know this isn't a good situation and need to get it changed to a default (at least then the clock is ticking towards the 6 years). Surely if a default has been issued it should be reported? What is the best way to get this rectified? Do I write to Barclaycard, Mercers, Link or Equifax or all 4? Are there any templates or is it a straightforward letter describing what has happened and requesting the status be changed to default with a date of Dec. 11? I have seen a number of other threads re: defaults and CRAs but they do not quite address my questions... Thanks
  24. Hi all. I have a problem regarding reduced payments to credit card companies and was hoping somebody may be able to help. In August 2006 I became sick and lost my job. I had three credit cards and up until then had made regular payments on all accounts. I continued with the payments until the start of 2007, which was when my savings ran out. I sought advice and offered all three companies a £1 per month payment until my circumstances changed. All three accepted with a note to review at a later date. 7 years on, I pay £30 per month to both Apex debt management and Halifax's Blair Oliver and Scott. They regularly review the accounts and occasionally increase the payments. I have paid £1 to Barclaycard since 2007 and they have never contacted me to review my account. The did send me a letter in 2010 with an offer of a settlement figure but other than that, there has been no contact by letter or telephone. I recently called them but they could not find my account. If I stopped paying this £1 per month, what would happen? Someone mentioned if there had been no contact for a certain time, then the debt could be written off? Any advice would be appreciated.   25. Hi all I have had a Barclaycard ppi claim refused after 2 attempts so have decided to issue a court claim via moneyclaim online. T he issue that I have is in regards to what interest rate I can charge for the claim. The ppi premiums were for 22 months back in 2003 and the card apr was 29.9%. Am I only able to charge 29.9% interest on the court claim for the period that the ppi premiums were deducted, i.e until the end of the 22 months or can I charge the 29.9% up until I issue the court claim. Or would it be 29.9% for the 22 months and the 8% from the start of the ppi premiums until the court issue. Many thanks for your help
