  1. Apologies if this is in the wrong place. I recently purchased an item off Ebay. The item cost £4.99 plus postage. The seller gave me a tracking number for Yodel. A courier for an item that costs £4.99? Strange! After ten days the item had not arrived. I went onto Yodels website and input the tracking number; it was delivered on 10/4/14. No it wasn't! I rang Yodel and gave them the tracking number and my details. "Sorry that tracking number is not for your address and we are unable to give you details of where the item was delivered due to data protection". Went back to seller: gave him the information as above. After many days of toing and froing the seller kept saying item delivered even though I explained the tracking number did not relate to me . Having lost my patience I escalated it to Ebay Customer Care(laugh!). The email: I have been involved in a dispute over non-delivery of an item. The item number is xxxxxxxxxx. The tracking number given to me does not correspond with my name, address or postcode. It is the wrong tracking number and the seller refuses to budge. Please help.   2. We are going to have a bad ladlord reference, not saying we are bad tenants but that we do not pay on time. This is due to their being a gas leak over christmas, us not being able to use the stove due to only a temporary fix. Holes in the windows where the frame is too heavy for the window. Our bills were high so we struggled with the last fifty or so rent. added to which our tenancy deposit is not protected, the ll also never calls always just comes round. Already threatening we may lose our reputation. we rented one year before and paid rent on time (abroad) and then stayed in a pub where we paid rent after check out and we were fine. I worry about our limited references in this country and any credit file trouble before our bills settled down. we are due to pay 330 for a deposit but it is worrying as we know this will be easier to be on time but they dont know that.
  3. We have various debts that have been in different states of long-term default, being paid under small monthly arrangement payments to DCAs. We now have a sum of money available, nothing like the totals owed, but I have heard you can good discounts off bad debts to settle and it would presumably help my credit file somewhat in the long run to have them declared satisfied. My question is this - what are the best ways to approach DCAs (or the original lenders) in this situation? What should one say? I've thought of some ruses like saying "oh, I'm facing bankruptcy anyway and you won't get much at all", or "we're going to live in Africa - this is only a formality for us", but I'm not sure if those will cut much ice. What has worked for you? What percentage can I get away with in making offers - how low do people go? Thanks for any input!
  4. Hi all, ive managed to get an excellent credit rating after years of hell, debt ccjs, which have all now disappeared off my credit file (3 years ago). Myself and my partner are wanting to purchase a property and have recently been approved for a mortgage via a mortgage broker. However Im worried now that when we complete the application form this Friday i will be asked about historical credit problems. Do I have to declare these, including the voluntary repossession of my house in 2005? What would happen if I did? What would happen if I didn't? Thanks

  6. Hello I realise might have gone in employment forum but I would like remained in general consumer forum please. It's basically on the onset I suffered a work issue which cannot be resolved on here but matters from bad advice from it. I have been informed some other solicitors have been confirmed suffered professional negligence in terms of personal injury but wondered if other people agree their views on my occupational employment claim In October 2010 I took out an employment claim for bullying, disability discrimination. On the onset, I was not advised of appropriate limitation with regards to the minus one day in employment law, the care letter said month to month but did not say exactly when it should have been done, on the other hand there was lack of medical evidence apart from support from family members, there was no attempt to get my medical records. Aside from this I had nothing on my GP file, except being on NHS waiting lists at the time and could not be prescribed anti depressents till referral's opinion I had to wait till after my pre hearing review to see a counseller. I had the pre hearing review and the claim was struck out, as passed three months, but sought advice for a three month extension given the previous solicitors I sought ceased trading but have found out they've changed names I was very ill at the time and could not cope, no advice was given to me on what to do after the pre hearing, it has limited my job prospects, despite the fact, I've seen a physiologist and was agreed I had 80-90 percent of a work related depressive disorder. I paid a £750 plus VAT for that representation and even though it ended I have not been given further advice on whether to pursue a Prevention From Harrassment Act Claim; to obtain five figure sum in loss of earnings from former employer; in addition regardless of a report which said 80-90 percent of bullying. The limitation was missed for that extra claim. In short, should I be complaining to the employment solicitors for the trauma of having to go through the employment pre hearing review, having never been to court before; and not coping; then a report followed two years later supporting work stress; their actions limited me to take this further, their negligence failing to advise me of the correct limitation and the five figure sum lossed due to their result - (two years work related depressive disorder) The personal injury soliciors who obtained the physiologists report say loss of earnings do not fall part of a personal injury claim they say it would have been an employment matter; they failed to tell me no loss of earnings to be obtained at beginning; the personal injury limitation date was missed etc
  7. with the growing popularity of the new sheriffs tv show and the fact that often people who have been screwed over have no one else to turn other than the bailiffs and the sheriffs, My question is are the bailiffs and sheriffs always the bad guys? For instance you win a judgement and a sheriff operates for you. or youve been a victim of crime and the bailiff goes out to get your compensation that youre rightly entitled to. Is every bailiff and sheriff in the wrong from the outset?
  8. Hi guys My first post so I will try to be brief, but bear with me. I bought a car from a trader on ebayicon in November for £1500 cash. The trader delivered the car and I paid, I did not test drive the car myself as I was not insured to do so, but did go for a short drive with the trader driving a week before bidding. As soon as I drove the car it was obvious the rear brakes were badly binding. Short version: I told the trader immediately. He offered to have his mechanic take a look, but as the trader is 25 miles away I was not happy to drive with brakes binding. He offered no alternatives. As I am a qualified mechanic, I checked the brakes myself and found the rear hand brake return springs were missing, both rear caliper pistons were extended to maximum and the seals were leaking. Both rear discs were badly scored, one cracked. All 4 brake pads were worn to excess, two were metal to metal. I replaced both rear calipers, both rear discs, all 4 brake pads with brand new. Car is perfect now (in that respect anyway). I asked the trader to reimburse me for the cost of the parts only, no labour charge by me. He has refused as I did the work myself and he has seen no evidence of them being fauty. I retained all parts and photographed all the work as I went, anticipating legal action. The trader told me he was moving at the time of the demo drive by him (next street) but I have not got his current address. I sent recorded delivery lbaicon which has not been signed for (nobody home card left by Royal Mail). So, my question is - any suggestions? I will be issuing a summons in any event. On me winning, he will get a CCJ at very least, which will affect him in future. If he choses to challenge later, he would effectiovely hang himself IMHO. So, what do you guys think? He is still trading from the same address, of that I am sure as he sold another car from that address last week - recognised house in photos. Ebay have refused to tell me his registered address now or even to confirm if it is the same/different to what I already have, quoting the data protection act. I tried using section 35, part 2 (a) as legal proceedings are pending, but they dug their heels in. Turn out Ebay are not even registered under the DPA so are wrong to quote that in any case! (Not a UK based company, so cannot register). Any help or advise very welcome. Thanks

  10. I am selling my vw and had a very small surface scratch on my drivers door. I had to look to find, it but as I am selling it I wanted to paintwork to be perfect. I took it to a vw specialist (although not authorised dealer) on the basis that they were professional looking outfit and a family run business with good reviews. When I dropped it off I was told the guy wasn't in yet but I would get a call including an estimate before any work was done. I mentioned that there was some touch up paint in the glove box if they needed it from when an authorised dealer touched up some much worse scratches a couple of years ago (leaving a perfect finish as though it was brand new and did it free of charge, although 200 miles away in Manchester where I previously lived). I naively left reassured that I would get a call, and that there was no commitment if I didn't want to go ahead, but that it was probably a cheap straightforward job as I had experienced in the past (I also walked to the tube with another customer who said they had used them for years and they were very good). I didn't receive a call so chased them and was told they hadn't looked at it yet. I finally got a call towards the end of the day to be told they had gone ahead and 'done the best they could' and as it was a ten minute job it was done on goodwill. I was a bit anxious they'd gone ahead but thought it was very kind of them to do it for free. It was dark when I picked it up but when I got home, under lamplight, it was clear that the scratch was much much worse and clearly visible. It now looks like there are in fact 2 scratches where the edges of the touch up paint are. I rang them straight away and was told that yes touch up paint tends to do that, to which I replied had they told me this before doing the work I would have said not to bother. He said to get some T-Cut and that would sort it out. This morning I took it to an authorised VW bodyshop who told me that because of the mess they made they would need to take it down to the metal and respray at a cost of around £300-400. I feel like an idiot for not going to an authorised dealer but there are none local and I needed somewhere convenient I could drop off on my way to work and have it sorted before a viewing this weekend. As I was told I would get a call before they did anything I believed that they would give me proper advice and therefore the option to go elsewhere if I didn't want to commit. I really don't know where I stand now. The original bodyshop gave me no paperwork and I didn't take a 'before' picture. I was wondering whether insurance would cover it but again I don't know whether they would cover something like this. I now face up to £400 cost to remove what was originally a barely noticeable scratch on a car I'm not even keeping. Can anyone advise what I should do? Apologies for the essay! Any advice much appreciated.
  11. Hi, This is my fist post i was hoping someone can help or advice me on my situation. My partner took out a provident loan where an agent comes by weekly to collect money, the agent didnt always turn up so my partner got behing on payments, the loan has now been settled but to our horror we were turned down for a mortgage and found a lot of late payments on his credit file for this loan. I have written to them to complain but they refused to remove the late payments. I have just read that under the Consumer Credit Act 1974 they have to send letters to confirm you are in arrears but he never received any corrospondance from them at all during this time. If i can prove they never sent these (i have requested copies) am i right in thinking they should take the late payments off his file as they have breached the CCA? Any help will be very very much appreciated! Please!

No defaults, payments made on time, have a small car loan, took out and paid off a credit card, in fact my girlfriend and I have managed to save approx 15% deposit for a house. How I would fair applying for a mortgage say In April 2014? Will there be enough distance between my bad credit rating and my new sustained one which is approx 2 years? Any help would be greatly appreciated,

  14. Bad debt charges rose for the third consecutive year at rent-to-own retailer BrightHouse, hitting £23.7m for the year ending March 2013. This was a 10% increase on the £21.5m bad debt charge the firm incurred in 2012, according to a results statement for BrightHouse Group that said bad debt fell from 8.1% to 8% of total turnover in the 12 months to March 2013. But a rise in turnover meant on that basis that bad debts stood at £23.7m for 2013 based on annual revenues of £296.9m, a rise on the £21.5m of bad debts incurred in 2012 from revenues of £266.4m. The rise could in part be attributed to increased customer numbers, which climbed to 246,800 in the last year from 227,200 in 2012. BrightHouse also opened 27 new stores during the year to take its total number of stores to 280. The company said demographic analysis had revealed the potential for up to 450 stores in the UK, though there is no timeline for this expansion. In a trading statement, the business said 2013 had been a “challenging environment” due to the pressures on customers from high inflation, low wage growth and uncertainty over employment. “In addition, the government’s much heralded changes to the welfare system have increased uncertainty for a significant portion of BrightHouse customers who are completely or partially reliant upon benefits,” the firm said. “This environment leads consumers to be cautious when purchasing large ticket items for the home and reluctant to extend themselves when signing up to a three-year credit agreement.” Despite the rising bad debt charge the firm, which sells household goods to customers with poor credit histories paid for through weekly instalments, posted rising profits and earnings before interest, tax, depreciation and amortisation (EBITDA). The Group made pre-tax profits of £8.3m for the year, down from £12.4m the previous year, while EBITDA grew by 10.8% to £49.4m in 2012/13 from £44.6m the year before. Leo McKee, chief executive of BrightHouse, said: “BrightHouse has delivered another year of growth in what has been a tough retail environment. “We have continued to focus on delivering exemplary service and meeting the evolving needs of our customers.   15. Two weeks ago, my friend and I went for a trip by rented car. We ordered an automatic mini countryman but instead they gave us a manual mini cooper which has smaller spaces. As we can't drive manual car and too small for four people's trip, we went to the desk for change. Turned out that they only have one automatic car at the moment and left us no choice but accepted it, cuz we had to go... they said otherwise we should wait for other customers to return the car which would take a few hours. so we took it, and it was a huge SUV - Volvo XC70... we didn't use to drive such a big car on a very narrow country path... then we got a big scratch on left side of the car on the way back. we didn't pay extra insurance for the car, so they charged us £2,000 for the scratch as they said calculated by the computer, which we consult the staff from Volvo store - we showed him the pictures of the scratch, and he said it would cost about £1,200 for repairing. in addition, when we were discussing with the staffs from the car rental company about the compensation fee, we ask them to consider the fact that they didn't offer the correct car for us at the beginning and gave us the one and only option which is too big, the staff there denied that she did so, she claim to have given us 3 options to choose which made us very angry. we do sent a complain letter after we paid the money, ask for refund, but no one replied.
  16. So I've recently been offered a Customer Service position with a bank as my interview was a great success. However, I was advised that they will be performing background checks on me before the offer is unconditional. These checks consist of the following: Criminal Record Check Previous Employment Reference Checks Credit Check Character References Right to work in the UK These checks will be carried out by a third party on behalf of the bank. Although I have had no previous convictions and will be able to provide strong references as well as being allowed to work in the UK; my credit rating is poor. My question is: Will having a poor credit rating stop me from securing this job? I am not bankrupt nor have I ever had any CCJ's/decree - just defaults resulting in a poor rating. This all happened when I was a student and was quite foolish with my finances and took out many payday loans which I defaulted on. I have been given a start date and contract etc. However, I'm just scared this will fall back on me and result in me being refused or withdrawn. Has anyone had any similar experiences? Your help will be appreciated.
  17. Hello Everyone, My friend has her first work programme appointment on the 24th June 2013 and was unable to attend due to being very anxious, being sick and had panic attacks! I rang Ingeus and spoke to her Employment Advisor, he was busy when I rang so I left a message that is was important he call back because it was to do with my friend's appointment and that she was unable to attend that day! He did call back and I duly answered the phone call, I told him why my friend was unable to attend and if she can have another appointment date and that I will come with her, I've explained about her anxiety and panic attacks and also told him her advisor at the Job Centre knows of her circumstances as I've had to cancel an appointment she had with her job centre advisor before, I requested that my friend will need a private room as she will not cope being in a room full of people! All what we asked was granted and I also told Ingeus advisor to send me a letter to confirm my telephone conversation with him! Today a letter arrived there was no mention of speaking to me nor mentioned about requesting for a private room all the letter says! 'We have attempted to contact you by telephone but was unable to reach you. We have therefore arranged an appointment for you on such a date etc, etc. I couldn't believe what I was reading' Good job I wrote a letter confirming my telephone conversation with him on the 24th June and mentioned everything we spoke about, I've kept a copy of course and sent the letter to him! I need to write a letter to him about the letter I've received today not mentioning anything of our telephone conversations, my brain has gone pickled at the moment and I want to be careful how I write the letter! He has lied and also not stating the fact of out conversations has anyone come across this sort of problem with Ingeus it will be good to know about them a bit! Thanks helen

  20. Hi I apologise if this has been asked before. I have defaulted on a credit card, its my own doing and I just want to make things right. I am single parent with two kids living with me, things were okay until my ex wife made some crazy allegations and took my kids off me. I then ended up spending 20k in 5 weeks on legal fees. My kids came back all was dropped. I have not had any child support help in six years while she claimed legal aid, living at her mothers house. Anyway enough of my sob story , I have paid of my 20k debt after some hard days in two years. But I had £1,500 I had a LLOYDS TSB credit which I defaulted on 28/09/2012. Now I have had a letter from SCM Solicitors is there anyway I can get this debt marked off my credit report and make a payment offer. What is the best thing to do? Funny thing is credit expert is saying the following message: Your most recent defaulted/delinquent account is now considered to be less significant. Thanks in advance.
  21. Hi All, Hope this is the right section for my question. I am currently with Kensington and can remortgage from June this year. I have never missed a payment on my mortgage, but do not have the best credit rating (hence I used Kensington) Can anybody suggest / recommend either a good and reputable company / mortgage broker that I can approach to help me find a better deal on my mortgage?   22. During the first week in February my network went down, I knew it was not my phone as the wife lost hers as well. We then discovered after a couple of days that the whole are had lost it. Numerous calls to Vodafone by myself and others in the area got zero help, as all the person on the other end kept advising was to reset our phones and other stupid ideas. They never once accepted the fault was with them and never passed on the information. After a week I went on to the Vodafone site to report the issue only to discover they don't really have an official fault reporting process other than post something on the forum and pray someone from Vodafone reads it!! We found numerous threads of people reporting the same fault on the forum and it took 10 days before any of us actually got a response, and we'd had no network for all this period. The reply stated they had noted the fault but had no idea when it would be repaired .... Do they only have one engineer? Anyway, it took 3 WEEKS before the network came back online. If I call BT about a problem as I did with a downed phone line in the are during the snow they turned up the next day. I wrote to Vodafone once the network was backup and they have so far given me a £25 credit as an apology and said they will give a further credit when it is back up, I'm still waiting for that though as our houses monthly rental is £60 and as it was down for 75% of the month that is the refund I would expect.

  24. Hi, I've got one credit card, that had about £125 on it, which I paid off in 2 payments the last one being in January. The other week, after applying for a different type of card I was told I was refused because I had a bad credit history and had £113 outstanding on my card. I phoned my bank (the credit card one) and they said, no problem it was all paid off and that the payment was just taking time to go through. I thought it was stupid, I'd paid at the beginning of January and this was middle of Feb. I was then advised to do a credit reference search, which I did. I was gobsmacked to see that it showed I owed this money and said I'd only made 1 payment of £5 over a, now, 5 month period. It also had a discrepency on the outstanding balance. One month it was over £400 (which I'd never had) and the next it was £113 despite the fact no payment was recorded. I originally complained to the FSO about the 1st payment that hadn't been recorded and the other stuff I've discovered since. The bank made a fuss, I had to screenshot all the stuff and send it to them and they are supposed to be sorting out - when, I honestly don't know. The problem is that I now have a bad credit rating and I don't even owe anyone anything. Any advice because this is driving me crazy?
  25. Our company car park is now being run by a private cark parking company. We have been given parking permits by the building's landlord, however a colleague has been "fined" today becuase his permit had been moved out of view by someone else. We believe the fine isn't enforceable but wanted confirmation that he wont get bad debt/mark on his credit rating if he doesnt pay. Can anyone confirm this please?
