  1. Long story short Aktiv bought MBNA credit card debt which had been incurred by my son. Unfortunately card was in my name. Son made payments to MBNA for years (his monthly payments to MBNA were more than my income) until he incurred mental health problems and b*ggered off leaving me with the mess. I've written to AK advising of situation, got copy CCA from them (it's an old combined application form/CCA from 1999 WITHOUT full T&C's), used template letter asking Aktiv to write off debt, explained about my son and said all I could offer was nominal £1 a month (also sent AK budget sheet showing I have no spare income as I'm disabled and on benefit). AK wrote back saying "Having reviewed the details and based on the information that you have provided, I can confirm that AK can not agree to writing off the balance and closing this account. This decision has been based on your income and expenditure and the severity of your health issues. I do wish to be constructive in this matter and sympathise with your situation. In an effort to assist you AK is prepared to accept nominal payments of £1 per month towards your outstanding balance. This decision has been taken in view of your current situation and will be reviewed in 6 months unless we are advised of a change in your circumstances." I almost sent them £1 right away but something made me suspicious. Why were they so ready to accept £1 a month plus why the 6 month review when they know my financial situation won't change? Nothing has been paid to the account since October 2012. Am I right to be suspicious? Debt is just over £10K and AK offered just over £1K discount in the second letter they wrote me after they bought the debt in November last year and before I've even replied to them. Maybe I'm too cynical but something just doesn't seem to sit right with me.
  2. I sent a CCA request to Aktiv Kapital and when they didn't provide the agreement I told them I wouldn't be paying them. They've now asked when I left an address I was last at about 15 years ago. Any idea why they want this or what it has to do with a CCA request
  3. Ladies/Gents I would like to share my success against Aktiv Kapital. AK has been bullying and harassing me since 2009 for debt that didn't exist. I bough a fridge with a comet edge card in 2006 and shortly after it was delivered I changed my mind and sent it back. I didn't hear anything from them until AK started calling me day and night and threatening me with court action and subsequently registered a default against my credit file. I also discovered that AK had illegally changed the default date by 20 months. Fast forward June/ July. I sent Aktiv Kapital a letter stating I did not owe the alleged debt and also this debt is statute barred anyway. They ignored my first letter, then I sent them DPA notice to stop processing my data and gave them 21 days to comply. Again they did not comply and letter before action was sent. Then I issued a claim online for damages and notes as per above. They filed a defence within 2-3 days of issuing the claim online and said they would defend. For the past 2 months they have tried to bully me into submission saying they had strong case and they would defend vigorously. I stood my ground through out and ordered them to remove the default immediately and pay me compensation for all the things they had put me through for many years. Finally once the hearing date had been confirmed and clock started ticking they offered £105 and to mark the alleged debt as settled. I refused straight away. Then finally they say they would settle and pay me full amount claimed and remove the default within 72 hours. I again refused as I had now prepared all the bundles and incurred further costs and I ask them to pay for them and surprise surprise they agreed and further paid for preparing the bundle. Aktiv Kapital are bunch of cow boys and I would advise all of you good people out there to stand your ground when you had been violated by DCA's and AK are B*****s for making up debt when there was none. Bytheway; before I issue the claim I tried the OFT and they were not helpful and infact very rude to me over the phone so from now on Her Majesty Court are way forward for me. cheers all
  4. Hi everyone. This is my first post so I apologise if it is in the wrong place. I am currently in a DMP with Step Change. I had a MBNA credit card which went to Thames Credit and eventually to Aktiv Kapital. The debt now stands at approx. £5200.00. The original debt with MBNA was approx. £2300.00 before it was passed on. Aktiv Kapital keep adding interest to this debt on an annual basis so I end up paying less than the interest that is added so the debt keeps going up. Is there any way I can get them to freeze this and put the debt back to the original amount. They keep sending me letters offering a discount if I pay the debt in full. Any help would be appreciated. Thank you.
  5. Hello, This is my first post so apologies if it's not to the right place. I've spent a bit of time trying to look at other posts and in the library, but am still struggling to get my head around what I am meant to do. I used to have a Nationwide bank account which was about £300 overdrawn. This was closed about 7/8 years ago and I made repayments (or so I thought). Then out of the blue I get a letter from Nationwide saying that they have sold a debt of £440.07 to Aktiv Kapital Portfolio AS, Oslo, Zug Branch. I was surprised by this firstly because I thought I had paid it back and secondly this is more than the debt was to start with. Shortly after I get a letter from Aktiv Kapital demanding repayment, followed by many more letters. In my confusion I paid a one off £10 through their website which I probably shouldn't have done but just did it to put off the letters. I've now been receiving lots of letters and phone calls from Credit Security Limited on their behalf. So what should I be doing next? I'm not entirely sure that I owe anything , and if I do I don't see how it can be that much. I had a look in the library. Am I meant to send a CCA letter like this one? Or the general debt letter? Or something else entirely?? My mind is boggled so any help would be much appreciated!

Ok hi everyone been a while since I have been on here, so here's what has happened I got a letter back in April from Aktiv Kapital about a debt from Nationwide which I have not made a payment according to my credit report since April 2008..... The account is now 9 months from being statute barred.I have heard nothing from Nationwide since 2008 and now I have this letter from Aktiv Kapital saying the account had gone into default in 2009. As I was moving I sent the letter back saying no longer at this address and I have not had any further correspondence, I did put a redirection on our mail. I checked my credit file this morning and there plain as day is a default from Aktiv Kapital. What should I do? If I send them a CCA and they send me the argeement then the counter will go back to zero won't it? Please help I need some advice on what to do next. Tnx
  7. Hi Has anyone dealt with these idiots before ? They think they can chase debts up that are over 15 years old ! Think it is time to inform the Ombudsmen - What else should be done to stop these fools ?
  8. Hi All I received a letter from Equidebt, who are chasing a debt bought by Aktiv Kapital from Nationwide. This debt consists entirely of bank charges. I would like your advice on, 1. Reclaiming the charges 2. Scraping Equidebt and Aktiv off my back. 3. Getting the default removed from my Credit file. Thanks in advance. Shystar

Hello to everybody, apologies but this is my first post on this forum and I need some advise regarding a debt that has been passed onto aktiv kapital, in 2009 I lost my job and was unable to make my credit card payments to nationwide. I received this letter back in june 2009 Current balance: £782.64 Credit limit: £1100.00 Past due: £523.47 'Our records show that your account is currently three months in arrears. In line with the terms and conditions of your account, the payment protection insurance cover has now been cancelled and no further periums will be collected' On the 10th of this month (april) I received a settlement offer from aktiv kapitol for an outstanding balance of £782.64 Over the past week whilst I have been at work (9-5) my parents home in which I reside has received numourous calls each day. Today alone they have received 7 calls. Each time they have informed the caller that I am unavailable until after 5 I have been concerned about calling ativ kapital due to previous problems with a previous firm I am looking for any advice as how to proceed. I have v.limited funds and do not want to be pressured into a high monthly payment. Any help would greatly be appreciated
  10. Hi All Just a quickie!! Today I received a Doorstep Threatogram from UMS on behalf of BCW collecting a debt owed to Aktiv Kapital. I'm not worried, as I know that all debts I had are now Statute Barred, so I will fire off the SB letter from the library on Monday. I can't remember who the debt was owed to originally, but it's for about £400. I was just wondering if anyone else has dealt with UMS? Thanks QB
  11. I am going to be served shortly (within a week) with a bankruptcy petition from Aktiv Kapital for fees arising from an Appeal Court case from a Set Aside Application hearing. History In 2012 I received a Statutory Demand ("SD") from Aktiv, I applied to Set Aside. Aktiv responded by Witness Statement and represented a copy of the signed application form and a set of 2007 T & C's (account was MBNA credit card taken out in 2002) exhibited by Aktiv as a true copy of the 2002 original agreement. At initial set aside court hearing I made representations that the T & C's were not a true copy of the original, but the Judge made a judgment that Aktiv's represented application form and T & C's were the documents making the original contract a valid one! I appealed that decision of that court, and again failed at the Appeal court, and fees were awarded to Aktiv. Aktiv issued a bankruptcy petition against me for the outstanding balance of the SD, of which I inadvertently paid to stop bankruptcy. I issued a claim against Aktiv of unlawful enforcement of the agreement, the Judge being presented with many corroborative facts showing the T & C documents were false, and Aktiv had engaged Fraud, struck out my claim as I had not used the word fraud in my Particulars of Claim ("PoC") (only in my Witness Statement and skeleton argument), but had only alleged unlawful enforcement in the PoC, and he also stated the claim was without merit. Aktiv issued a SD for the fees awarded at the Appeal hearing, I applied to set those fees aside as they were founded solely on the false documents (T & C's) represented by Aktiv as the original, of which Aktiv admitted in their Witness Statement for this case that, "it now transpires that the T & C's were not those at time of inception." The Judge of this case (application to set aside) again struck out my application, and without merit, also afterwards immediately made an application to the Designated Civil Judge to have a Civil Restraint Order against me. I now have an Extended Civil Restraint order against me! From two without merits cases, which I had evidenced Aktiv's represented T & C's were false! I made a formal complaint to the Police alleging Fraud, Perjury and Perverting the Course of Justice on Aktiv's part, as they had made conflicting statements within their Witness Statements regarding their representation of the T & C's, their admissions, misleading of the court and their gains against me to my detriment, the Police wrote me a two page letter of reasons why they refuse to investigate. Request Given that two judges on three separate occasions have been given information which evidences beyond reasonable doubt (only need balance of probability in civil court) that the represented documents exhibited by Aktiv were false, and they engaged Fraud, but did not listen, the Police will not investigate, what then can I do about the Bankruptcy petition, as I do not have the money to pay for the petition? Aktiv's bankruptcy petition is founded on the fees arising from the Appeal hearing from the original set aside hearing where Aktiv misled the court into believing the represented T & C's were a true copy of the 2002 set when they were a 2007 set. Any help, advice or suggestions would be appreciated, thank you very much.
  12. iHave received from Equidebt acting for Aktiv Kapital re a debt for £1629.54 first national tricity finance I sent letter telling them don't know of any debt to them and asked for a copy of the original credit agreement they have sent letter back saying they have requested the details from the vendor, they are saying that as they are the 3rd party they are not required to supply the details in the 12 + 2 days request is this so as they have stated that this could be sometime. Also i had the same about 12 months ago where it was mackenzie hall on behalf of aktiv kapital first national tricity finance for the same amount, s ent mackenzie hall the same request and got letter back saying thay had returned it to aktiv kapital. should i do anything or just sit tight there is nothing on my credit file re first national tricity finance.
  13. Received a few letters from Buchanan Clark and Wells who say they are acting on behalf of Aktiv Kapital. This is for a debt from New Look which was defaulted over 6 years ago. It was at a different address than my current one, don't how they got my present address. I've been ignoring the letters but the latest one is a 'notice of impending further action'. I figure they're unlikely to take court action as I presume this would have been done before now. I don't want to go back to receiving threatening letters constantly, only just got myself sorted out and my credit rating is starting to improve again. Question is should I send a CCA request or a statute barred letter to them? I'm in Scotland so the time limit is 5 yrs, I'm pretty sure but not absolutely positive its been 5 years since I had any contact regarding this debt. I have absolutely no paperwork for it. And can they put this back on my credit file? Thanks
  14. Hi I had a virgin credit card which I stopped payiing last autumn2012 due to financial difficulties. They sent me a letter around xmas time to say they had passed my debt on to Aktiv Capital. Around a month later I started getting frequent calls from Aktiv Capital, but just kept fobbing them off, saying they had phoned at an inconvenient time. After reading one of your blogs I refused to give them information over the phone. That very day I received a letter from them asking for the full amount. Activ phoned me again that afternoon saying they had sent at least two letters, and that I had to deal with them over the phone as that it is how they always deal with customers. They suggested (even though I wouldn't comment) that I pay the amount in full, or if not over 3 monthly payments. I did comment that if I had been able to then I would have paid Virgin, but I wanted to see comunication in writing before agreeing to comment further ! HELP !! what should i do now please. many thanks Jamga
  15. Hi all I wasn't sure if I should start a new thread, as I posted a few days ago Re: Aktiv Capital sending a £300 pay-us-half-and-we'll-sod-off letter with no details of the debt. I was advised to ignore and thats just what I have done. This is a completely seperate 'debt' by the looks of it, however if I should have added to the existing thread, then could a member of the site team please move it I received the attached letter from Equidebt (Who?!) this morning. It states the creditor as Aktiv Capital and that I owe £3926.53. The only thing I've ever had in my life with that amount of credit was a credit card with HSBC that was paid off donkeys years ago so I really don't know where this is from. Again, it's not on my Experian credit file and I haven't got a clue what the original debt was or who the OC is. Now the kind hearted ladies and gentleman of Equidebt are offering a monumental discount - pay £785.31 over 12 months. A discount of £3,141.22 Going by past advice this usually means that they know their so called debt is unenforceable. The thing that annoys me, is now they are giving me 20 days to contact them or they will recommend court action etc etc. What would be the best thing to do to get these cretins off my back? Has anybody heard of Equidebt and dealt with them before? And as a quick side question, would anybody recommend Visa Vanquis credit cards to repair or build a credit score? Hello again good people, I received a letter yesterday from Aktiv Capital regarding a "New Deal" asking my to pay off a certain percentage of a debt in final settlement or set up a payment plan with them to pay it off. The total debt is apparently just over £300. Now, the letter doesn't state what the debt is for or who the original creditor was. In fact, it says nothing. Just along the lines of "pay us this now." This is about the 6th letter I have received from them in about 3 months, but none threaten further action etc. I checked my experian credit report about a week ago, and there is nothing from Aktiv Capital on there, just two defaults with Lowell, one of which is settled. I'm assuming that it could be Statute Barred, but not sure how to go about it, as I have no details of the debt? Could anybody put forward some advice please? Many Thanks.
  17. Dear sir/madam, My husband and I had quite large debts with mbna, we choose (stupidly) to borrow on 0% credit cards instead of borrowing on a loan with a fixed rate and an end date. (we all live and learn). We ran into difficulties reducing the balance because the cards went form charging 0% - 29.9%, paying £700.00 per month and reducing balance by about £30.00 per month, you probably don't need me to tell you that we could not keep this up, we wrote to mbna who were quite helpful and put the accounts on 0% and reduced payments, we were paying £460.00 per month and made great strides in reducing the debt. Then out of the blue, we got a letter saying that the debt was being transfered. This is where the real troubles started. (by the way we have experienced cards being transfered before and nothing has changed with regards to paying). People have been ringing us night and day for huge amounts of money. Plus sending the odd letter. Now my husband has received a claim form for an CCJ. I have filled out the request for more time on moneyclaim site. I have been getting advise from payplan who are really saying we need an IVA. This is not what we want. Surely there is another way. We are in our late 40's and have always paid back what we have borrowed plus interest. Really don't know where to go with this? We have all the paperwork etc. hope someone can help or point us in the right direction? Many thanks for your time regards
  18. hi im new here and would like some advice please last year in November 2011 I was made redundant after 25 years I found myself with debt building up under so much pressure and the unemployment was really no help at all But to get to my point, is that I had a credit card with mbna which I couldn't afford the payments mbna made me make a payment of £1 per month 6 months later the debt had been sold to aktiv capital we had the harassing phone calls and letters I never admitted the debt to aktiv in anyway and told them I only deal with letters on the 6th of December I sent them the letter as advised by cga ,I sent the credit agreement act 1974 sent with a postal order requesting the credit agreement , with no signature from me etc iv now received 2 letters from aktiv kapital one on the 14th January 2013 stating that they cant supply the agreement at this time and the account is on hold the second letter dated the 17th January 2013 from aktiv it states they cant supply the information I requested ,and they await my proposal ? im really confused as to what I do next please help hope iv posted in the correct forum forgive me if not thank you den
  19. For the last couple of weeks I have been receiving calls from 01865 525980 to my mobile phone. This is a local number to me, but as they've called during work hours so I haven't picked up, and they haven't left any messages, however having googled the number it appears it is Aktiv Kapital. Is this a new trick from AK, calling alleged debtors from a local number in the hope they'll answer the phone, or have they genuinely moved from Bromley to Oxford - their website suggests not!
  20. I received a letter from AK informing that an amount was owed to them for a credit card debt. I was not sure of the contents and sent a no knowledge letter. A few weeks later I received a further letter with a copy of a A5 card application and they asked for my comments. As this is not any terms and conditions should I send the CCA request letter however any any cr cards I had are well over 5 years old since any payment or acknowledgement so would it be better to send the statute bared letter. Thanks for any advise.
  21. Firstly happy new year to one and all on the forum. I have had ten phone calls from these people in the last 2 days from 02084609778,I do not answer these calls but they are becoming a bit of a pain.I have no idea as to what debt they may be chasing as I have not had any correspondance of any kind from them.Do I continue to ignore these calls or do I write to them sending the harrasment letter.
  22. Hello Everyone Please can somenone advise, perhaps from a legal point of view, on this weird letter I had today from Aktiv Kapital. They are chasing a debt from 1997-1998. No CCJ obtained, No contact made, No payment made so Staute Barred. They have used various DCA's over the years to try collect on it despite being SB. I just send the SB letter and then wait another year until they try their luck again. Now in Jan 2012 I went bankrupt. All straight forward. In fact the court said I didn't need to include any Time Barred debts on the petition. received a letter this morning from Aktiv Capital saying- " We have reason to believe that you are subject to Insolvency Proceedings, however we are struggling to read the public Insolvency Register despite our best efforts. Please ring us to discuss or send to us in the post details of your current affairs....etc...blah...blah. It took me 20 seconds to log on to the insolvency website and view my BR details which is public info. Is this a wind up? First question- should I send yet another SB letter or a copy of my BR order or can I bin this letter and forget??? Second question - Can I ring them and tell them to go away or will this reset the clock on the debt and then I'll be liable even though I am bankrupt? Thanks Honeypot
  23. Evening all I keep getting letters from AK stating I owe them various amounts to different companies. They also write offering a reduction in the amount I could pay, such as sending me a "gift voucher" today for £3,000 off a 'debt' and stating I should pay them £300. I am also getting daily text messages from BCW asking me, by name to contact them urgently, quoting a unique ref number. I am aware any debt that I have is statue barred, as they are over 6 years and if my memory serves me right ar eover 10 years. I havent made any contact with either company although I want to call them to tell them to get lost and I will send each company the statue barred letter. If I should be sending a different letter please let me know. My question is, can these companies continue to complete credit searches of my credit file without any recourse?? They are accessing my credit file on a monthly basis and I think this is impacting on my credit scoring. Any advice, as always gratefully received. Keep up the fight y'all!!
  24. Long story - short. ... got myself into a financial pickle with various credit cards etc. Due to dwindling income over the last 12 months I have now crashed. I have received default notices on my CC's as I have not made any payments to them over the last 3/4 months. I was just about to contact them [along with some of my other creditors] to advise them of this change in finances etc; with a payment proposal of £1 and statement of Inc and Exp., as now no income. Additionally I was considering the querying the validity of the contracts with the CC companies as others on this forum have done. Concentrating on MBNAeurope for the present: today I have received a letter from AKTIC KAPITAL Portfolio AS, Zug Branch - stating that they have purchased my outstanding balance with MBNA - and they can help get my finances back on track it then goes on to say that they are Aktic Kapital UK Ltd who will be collecting the balance of £xxxx.xx that I owe on behalf of Aktic Kapital Portfolio AS, Zug Branch. they want me to cancel and DD/SO's [there are none; otherwise i wouldnt have gone into default!!] as paying mbna would cause a delay in them being able to reduce my balance. small print:... aktiv kapital uk ltd is part of the aktiv kapital ASA [norway] group of companies. CCA licence 510166. registered office, wells house, elmfield road, bromley, kent, br1 1lt. 'under the terms of this assignment and as defined in the data protection act 1998, Aktic Kapial portfolio AS, zug branch is now the data controller of your personal data...' so my questions are: do i acknowledge their letter? do i deal with mbna at all now? do i ask Aktiv Kapital for original contract/proof of debt? any other pointers would be great please [especially if any more letters 'assignments or purchases' of my other credit card debts start arriving]. thanks in advance.
