  1. MBNA sold debts that belonged to both me and my husband. Idem bought mine, Moorcroft bought my husbands. I emailed Idem regarding reduced payments that I would make, and eventually they responded agreeing to my reduced amount. However, Moorcroft ignore emails (sent day after day) and they will not reply despite my husband requesting that they not call, but put in writing instead. They call anyway, and to whomever called, I asked them not to call, but to respond to my husband's emails - however, the chap then called my husband's mobile immediately! I got a statement from Idem, and in exactly the same marked envelope (same return address, same statement format) my husband had one from Moorcroft. Does anyone know if this is the same company??? It's really cheesing me off that Moorcroft ignore all the emails. Also, they're sneaky so-and-so's: they are based hundreds of miles away from us, and yet they call the landline using a local number that they must buy to use, to look like they're someone local calling us - idiots! It doesn't take long for me to recognise the number and ignore it. But, they're making me so mad!!! I think I'm wasting my time re-sending the same emails but at least it proves the point that they're ignoring us, dispite contacting them on a daily basis!
  2. Recent High Court PIP Judgement Affecting those with Psychological Distress High Court. RF v Secretary of State for Work and Pensions: http://www.bailii.org/ew/cases/EWHC/Admin/2017/3375.html The High Court Judge: - quashed the new regulations because they discriminate against those with disabilities in breach of Human Rights Act 1998 obligations. - declared that the Secretary of State did not have lawful power to make the regulations (i.e. they were ‘ultra vires’) and should have consulted before making them. Yes the Government is going to appeal this Judgement at the Court of Appeal so we will have to wait and see the outcome of that Appeal.
  3. Where to start! We have had our car insurance with GoGirl. Someone made a fraudulent claim against us saying we'd hit them with our car, when we hadn't. Their investigators came out to inspect the car, found nothing and left. That was the last we heard of it. Until last month. Our car insurance is due for renewal, and to cut an horrendously long story short, we can't renew our insurance with our 2 years no claims bonus because of this claim. I've told GoGirl the claim was fraudulent, but they just said that because the claim wasn't followed up it was 'settled as no-fault'. However, the claim should not have existed in the first place, and they don't seem interested in following up the fraud. No insurance company will take our no claims bonus into consideration and say the onus is on us to prove that the incident didn't happen! We have 5 days to renew our insurance, but the cheapest we can get is almost £800 instead of the £350 we were quoted online, all because of this so-called claim. I was just wondering whether we had any options, apart from paying a premium for our insurance!
  4. http://www.bbc.co.uk/news/business-36845617 This Supreme court ruling will affect how Insurers deal with claims where Policyholders have been found to have told lies. " Lying on an insurance claim should not necessarily invalidate it, the Supreme Court has said, in a judgement likely to affect all household policies. It said collateral lies - which are untrue, but do not affect the validity of the claim - can be acceptable. The judges voted by four to one to change one of the important principles behind current insurance law. The insurance industry called it a "blow for honest customers", and warned that the price of policies could rise. The precise case involved a Dutch cargo ship, which ran into difficulty after its engine room was flooded. The owners deliberately lied, by saying the crew couldn't investigate an alarm, because the ship was rolling in heavy seas. In fact the accident was caused by bad weather, so the lie was irrelevant, the court ruled. The judge in the original court case said the lie amounted to a "fraudulent device", which invalidated the claim. The Court of Appeal upheld that judgement, but the Supreme Court has now overturned it."
  5. I am a fan of TV comedies from 70's, 80's and 90's. Programmes such as Are you being served, Only fools and horses, Allo Allo, Yes Prime Minister, Benny Hill. When you watch them now, you realise that some of the content would be considered too risky to be shown before 9pm now to a family audience. As the world has become more PC, some of the jokes would be considered racist or sexist or too adult for a family audience. Meanwhile people can watch some really offensive stuff 24 hours a day on the internet. The same applies to art work in galleries and museums, where there have been paintings and sculptues of nude people, roman orgies etc for hundreds of years. If these are shown now, the galleries and museums receive complaints from the PC brigade. Has the world gone mad, where a minority of people who are so politically correct, control what art is available to the majority of people ? Art of all types are partly meant to provoke a reaction, so there is a discussion. There is so much inconsistency in regard to censorship, that some people feel they can complain about anything. Some even complain about seaside gift shops selling the slightly saucy postcards.
  6. Hi all Ive finally managed to clear all my debts, however I still can't get 'normal' credit, having checked my file the only negative info is from barclaycard who last updated December 2011 and for the 26 months prior to that they have reported a status code 6 every month. I think they did this retrospectively when they transferred the debt to Cabot in December 2011. My question is am i able to ask them to remove the status updates as I was on a DMP which during Dec 2009 and December 2011 i was making the agreed payments. During may 2009 & Nov 2009 i was making token £1 payments but still on DMP. Or do I have to live with the status 6 as the payments weren't actually the amount agreed in the original credit terms ? Your help would be appreciated I am trying to prepare myself ready for mortgage applications next year. Thanks
  7. Hi All, I was hoping to get some advice on the best way to handle a dispute I have with Virgin Media, which is probably something I should have done a long time ago. About a year and a half ago I switched from Virgin to Sky and informed them in writing (as is their policy) but it they deny receiving this letter. I wrote to the most local office to me and addressed it to Customer Services. Two or three months went by and I noticed that Virgin were still charging me by Direct Debit. I canceled it through my bank and called Virgin up, informing them of the situation. This is when they told me they'd not received my letter and considered my cancellation date to be from that time. Their policy is to be informed a month in advance so they told me they're going to charge me for another month. I told them I wasn't going to pay that, we had a little to and fro in writing and over the phone - I told them if they felt they had a case to take me to court. I heard nothing from them since. Over the last few days I have looked into my credit status using Experian (who have been great) and it turns out that this has really damaged my credit rating. Currently it is ranked as "poor" and I can't seem to get credit from anyone. Experian tell me that this is one of the main reasons but there are a few other very old things that they are disputing on my behalf. I made my point clear to Virgin at the time that I didn't feel this was owed and if they felt otherwise, to forward me some kind of legal case. It turns out that they just decided to hurt my credit rating and never contact me again. Am I in the wrong here? I don't want to call Virgin up at this time because I will only be making the same points again and as far as my credit rating goes, seems like they have all the power. There's nothing new I can say to them aside from please stop hurting me. Will I have to bite the bullet on this and make a repayment offer. It's only over £88 but money's a really serious issue for me right now. What do you think? Am I going to have to pay them to improve my credit rating? Any input would really be appreciated.
  8. Hi All Wondering if I could get some advice from people who have possibly be successful with a query with Tesco affecting their credit file? The long and short of it - plus from what I can remember it was a while ago! I had a mobile phone contract with Tesco in 2012 and cancelled during the 30 day period, I returned the phone to store (where I had taken the phone out) as it was freezing a lot and I wasn't getting on with it. I had to pay the first month upfront so when I returned it the guy in the store the guy helped me transfer numbers across and said 'that's it - nothing more for you to do'. As it was over the Christmas period I forgot about the money owed back to me and rang up to Tesco, they told me it would be with me within 30 days normally and I didn't think twice about it until a few weeks later I hadn't heard anything and rang up to query where the money was. I spoke to C/Services who told me I actually owed them money! I explained that I was advised I could cancel within the 30 day period with no commitments however was told by this person on the phone I owed them for internet usage and wasn't going to be getting the money back either!! I hadn't had any letters up until this point. Over the next few weeks I had several heated discussions with the customer services team and the in store staff but no-one helped. In the end, I lost my rag decided to speak to a manager who agreed that if I paid the money, they would issue it back to me as a refund immediately because of the wrong information given to me and that they had listened to some calls of mine and their call centres. I have now gone to apply for a new mortgage in line with moving home and have now been advised that I have a poor credit rating so cannot benefit from a good rate - checking Equifax it appears Tesco have put me down a 'serious default' - I am so angry as this is the only thing on my credit record affecting it and is has caused me to go from a 10% mortgage to a 20% which is 18k! Any help much appreciated on the next steps to try and challenge this! Thanks K
  9. Hi Guys New to the forum, so hello! Currently looking to source a new purchase mortgage, and had narrowed the choice of with HSBC and Leeds BS. Just to be sure there were no issues with the applications I signed up to Experian and Equifax to take a look. Experian 940 Good / Equifax 463 Good - so naturally didn't think I would have any problems moving forward. Went to see HSBC on sat, they did a very quick check and gave us an AIP - then spoke to Leeds this morning who said they would run a check for an AIP. They called back to say I had been declined due to adverse credit on my Equifax report, she couldn't go into detail over the phone, but I explained about my scores and she asked me to send them through and she would take a look, I also asked for some feedback to point to what she thought was the problem. Now I can't see anything untoward except for an AP on my NatWest Current account from 2012 - the circumstances are NatWest was my main current account and I always had an authorised overdraft of £500 - In early 2012 my partner and I decided to use her account as a joint account (HSBC) so all my salary went there. I didn't automatically close the NatWest account as I thought you never know! I was still being charged for the advantage gold fee and interest on the authorised borrowing, then I received a letter from them asking me to get in touch about unauthorized lending, turns out the account had gone over the £500 limit and charges were being added. I got in touch with NatWest and they took me off advantage gold, and refunded the charges and then I set up a direct debit to clear the account. So the question is, how likely is that the actual issue, and how do I get that corrected, also will HSBC look at that too with a full application and think it's an issue also. Any help or advice would be hugely appreciated Neil
  10. Hi i had a debt with 3 g for £111.14 about 8 years ago. i hadnt really heard anything further and at the time 8 years ago i had lost my job and was in a pickle in everything. my current credit history after much hard hard work is completely clear and i have been doing everything to increase my credit score as i would like to buy a house. However, upon leaving for work this morning, good old postman delivers a letter that has left me panicked and worried all day. it was from provident personal credit and says the following;- "we are writing to you in connection with the above debt. Please be advised that we have taken the decision not to pursue this debt any further. We can confirm this mean we will take no further action against you in relation to the outstanding balance and also that we will not take any steps to sell it on to any third party. Because we have reported information about your debt to a credit reference agency, we can confirm that any records will be updated to show that this debt has been partially satisfied. this means that no further action is required to be undertaken by you and that no further action will be taken by us. Other lenders may look at your credit reference file when deciding to lend to you. you do no need to reply to this letter r take any further action but may cal if you have any concerns or questions" up till now my credit file is completly clean. im really worried that this has messed it up now as it was never on there before and it is clear as we speak. this is such an old debt how ca this be allowed to now be on my credit file? i have also not had any contact with them. been worrying all day. anyone please?
  11. Hi all I had a nationwide account for years to which I added my husband about 6 years ago - this was for ease of use but tbh I managed (mismanaged) the account. There was an overdraft on the account which kept being suspended as due to a variety of reasons we occasionally went over - then I started on a plan to reduce the overdraft each month - again at various times I forgot the date that it was due to reduce and went over - each time it was set up again the date changed so this kept happening. Eventually due to charges etc which they added I got cross and fell out with them! - long and short they demanded full payment - I could not do this so they stopped account and sent debt letters. Husband recently applied for credit and was refused - have checked his credit file and there is a nationwide default on there - this is the only blemish on his credit file. I have a number on mine so not especially worried as I am 4 years into 6yrs when defaults will fall off. However I want to sort him out as this is really my fault. I now could pay this amount but had a brief conversation with Nationwide - said I did not remember a default notice and could this be sorted - not surprisingly they said no. My question is that I would like to try the template for not having received a default notice - in an effort to get this removed. Should I be successful I will happily pay debt as presumably they could write a letter and put it back on again. I have had a look at some of the template letters but remain a little unclear as to whether they have to be able to prove a default notice was sent - if they cannot do this within a time period do we then write to credit agencies asking for it to be removed with copies of letters sent to Nationwide and they will remove it (and I then pay the debt) This seems too simple?? thanks in advance for any advice.
  12. I'm hoping you can help me with this issue. Vodafone have posted an outstanding amount of £21 to my credit file from over 2 years ago. The mobile number the bill appertains to is still in service as it was transferred over to my employers and they currently pay the bill. Having just applied for a new mortgage (which was refused due to my credit file as apparently I owe Vodafone £21 !!) this has only just become apparent. I've tried to speak to Vodafone on numerous occasions (dialing 191 from mobile) without success. I want to pay the £21 and get it cleared from my file, but no-body seems to be able to help me. First and foremost they ask to speak to the current account holder (my employers) to go through security which I find odd as it's nothing to do with them ? Trying any which way I can to get this resolved I got my boss to speak to Vodafone on my behalf and they told him that I need to go into The Carphone Warehouse as it was them that I started my phone deal with. I find this hard to believe, as it's Vodafone that have put the £21 unpaid amount onto my account, and therefore it should be them that remove it. Please can you help me in any way with this, I just don't know which way to turn next. Thanks in advance Zoe
  13. Hi all, I am currently in the process of trying to obtain a mortgage but I am having serious problems because of three late payments posted on my credit file by Vodafone. last March I cancelled my contract with Vodafone and settled with a small bill for the final month's line rental etc. I also moved house and so you move on without any concern. Then in November last year - 2012 - when visiting mortgage brokers / advisors I was made aware there was a default notice on my account due to three late payments not being made to Vodafone from April to June last year. Although shocked and confused as to how and why I would have any outstanding balance as I had paid up I knew the sensible action to take would be to immediately contact Vodafone, pay any arrears and set in place a motion to have the default removed. Vodafone were extremely helpful and via a succession of emails, lasting approximately two months I managed to have the default notice removed. It was made clear from my end that I had seen (or received) no correspondance to the outstanding amount which turned out to be £29, I'd had no post from Vodafone forwarded onto myself regarding any outstanding amount and with the removal of the default I think it can be safely said Vodafone made the correct decision. Fast forward to now and I have had my mortgage application stalled due to the three late payments posted on my credit file by Vodafone and simply put I must seek to have these removed so I can progress with my application. This is having a detrimental affect on my wellbeing, causing unwarranted stress and the obvious ramifications are devastating. While I do not wish to appear flippant, for the sum of £29 that at first I was unaware even existed, and the fact the default was removed, it seems the affect this is having is disproportionate to the amount that was outstanding. I keep my finances very well in order, have and have had no debt, pay on time etc, and made extra effort to make sure I am a viable proposition for a mortgage application. Please can anyone help as I'm really in need of a solution. Thank you Chris
  14. Hi guys, Great site....it has helped give me the confidence to confront and repair by financial issues. I am in the process of compiling a letter to the credit card company I owe 6,500. I have been struggling for the last 3 years to make the minimum payments each month (sometimes having to borrow from family & friends) and have finally faced the fact that I can not continue like this. The last 18 months has participially been a challenge with the reduction of my working hours. So much so I rented out my flat and moved in with my brother and his wife to prevent the loss of my home. I've tried to borrow against my home to pay off the card as well as applying for a personal loans, all were denied (thankfully so, now that I am a bit more educated by the advice I've read on this site) I've read that by writing to the company I am in debt to asking for them to freeze interest and accept a monthly payment that I can afford could damage my credit rating. My concern is that I don't wish this to have a detrimental affect on the credit rating of my brothers household possibly causing them to have issues gaining credit in the future. Is there anyway around this? Thanking you in advance for your replies.

  16. One person has been late for work 12 times in the last month. The same person is late for work at least twice a week every week. When this person is late i am landed with a less favourable role to carry out as a direct result. When this person is late they do not "sign in" at all. I have frequently brought this up in supervision (for nearly a year) but nothing appears to be getting done. What can i do? I'm never late for work and this is getting me down.
