  1. My son had a unauthorized overdraft with Lloyds Bank since last year and the interest is mounting up and now he owns £417 from £287 original. He is no longer using the account. We have written several letters (recorded) explaining that he has lost his job and has no income. He has gone back to college full time and his parents are supporting him. He is not getting any benefits and therefore has no means of repaying. We asked for the account to be frozen and also sent a cashflow statement from National Deptline stating that he had no income and offered a settlement payment of £250. They have ignored all letters and now we have a letter from SCM threatening with court action. They also saying that interest is still charged daily. Not sure now what to do next!
  2. Hi, I seem to be having some real issues with Lloyd’s. I used to working in England through a limited company, two years ago, the job market ran dry, I managed to find a software contract in Brussels. I get back to England every 2-3 weeks. I have been using the wages from that job to settle a large tax debt and an outstanding company overdraft. I managed to get the tax debt paid off. I then started on the company overdraft. I managed to pick in Brussels about the rumours off pip misspelling. I knew I had a ppi policy on the overdraft. I requested a copy of the policy document since they had never sent me a copy. When read it I discovered I not covered, if I do not have a job in England I asked to repaid the premiums charged while I was working in Brussels, at their request I supplied with documents indicating that I was working in Brussels. Their normal response has been to ignore everything unless I chase them. Their complains section has paid out 200 GBP when I complained about this. As this claim progressed it Lloyd’s classed this as claim for the entire PPI policy(I have been paying PPI on the business overdraft for 8 years). They offered a refund for 3700, I was not going to complain, I just wanted the money to pay down the overdraft. I received a letter to the effect make a payment on your overdraft, I response by saying I have made a claim about ppi mis selling, you have agree to repay me 3700. I understand from the popular press that there have been some issues with banks paying out on time. Would you like me to 1. Use a factoring company to cover this debt, I would expect you to cover the costs as you owe me 3700, which is more than enough to repay 66% off the overdraft. 2. I could sue Lloyd’s bank in court for rapid payment 3. You could extend the overdraft until this payment has been made Please get back to me. I enclosed a copy of the offer from their ppi processing section. I sent it registered mail. I also requested a callback from my business manager, this did not happen. I got back on 30/3/2012 to discover 1. They have cancelled the overdraft. 2. They want to charge me 26% interest 3, They want full repayment. I did phone them up, I wanted to point out that they owed me 3700, these facts where not in dispute, that was enough to settle a large part of the overdraft. If anybody was the upset party it should be me because they had been charging for a financial product off dubious value. When phone call when on for about an hour, they would not budge. I raised every issue that I could think off mainly being. 1. If they had paid out when I accept their ppi mis-selling offer we would not be in this position. 2. If they had not offered their ppi policy in the first places, my account would have an extra 3000 GBP in it. 3. I had been told that the only way I could have an overdraft in the first place was if I accept their ppi policy Their main arguments were "The ppi offer is nothing to do with us, now about your account" "we can not wait for your ppi offer" When I describe their PPI as a financial product off dubious value, I was told "you should not believe everything you read in the newspapers" During the conversation the person making the phone call put the phone on hold several time while he referred to somebody else. I did phone up the ppi processing section and was told it would another 8 days on the 30/3. Q. Do I have any come back? 1. I think I am being treated unfairly. 2. They are demanding payment when they owe me a large sum of money. 3. They are charging an large interest rate when they only offer an 8% interest rate on a sum of money hey have taken from me. It some what stressful working in Brussels when this ticking time bomb is waiting for me. I have told them that they are welcome to send letters to my Brussels address but unless you send it airmail it will take about two weeks to reach me. Since I am normally back in England twice a month and they will not send things airmail its faster for me just to pick up the letters in England. I have made a request on 31/3/ for my relationship manager to call me back, despite 6 reminders for her to call me, I have heard nothing. I have kept a mobile phone with a UK number so that I can be contacted by anybody. Since December my wife no longer has a job. The only way that I can afford the sums that they are demanding is dip in to the money that I have saved for the Tax, which would be illegal. Any advice grateful accepted.
  3. Hii, Although a newbie, I have been viewing for a while, just no need to post until now. With the changes over the past couple of years with new judgements etc, re validity of DNs, reconstructed CA's I do not feel sure of what I should do. My history : approx 5 years ago, I had to take control of spiralling CC's and 2 loans, as I was unable to meet repayments. I called one of the free DMP's and I have been repaying, at a reasonable amount for the past 5 years. Some CC's accepted payment plans, Lloyds have never accepted and have always sent arrears notices. To be honest, I contacted them at first but was so fed up with the call centres who could not speak 'off script', I gave up calling. I sent several letters which went unanswered by LTSB. This CC was taken out in approx 2002. There were charges on the account about 5-6 years ago, and I have so far, not requested a SAR as I know it's unlikely to get the relevant info from LTSB when requesting it. I have kept every document ever received, but this is currently in storage due to recent house move and not accessible for the next few weeks. I can therefore, in a few weeks time gather the info to reclaim late payment, over limit charges etc - but I fear it is too late to prevent a default on my credit file. LTSB have continued to add interest, and I have recieved statements each month. I last 2 were dated 21/2/12 and 21/03/12. I have now recieved a letter from SCM, dated 28/03/12 (sent 1st class!) which is 'a formal demand of account balance', threatening court action, referencing a DN which was not rectified. Also noting that 'interest continues to accrue on a daily basis'. Also if client does 'not recieve a satisfactory response', then credit agencies will be updated. I have not recieved any DN for this CC, and I don't think there is an issue with the post as I have clearly recieved two recent statements and this letter. I have however changed address during this time, with the FEB statements being sent to my old address, which is on a redirection - so I assume all post is being redirected correctly. The MAR statement to the new address, as is the letter. As my debts were defaulted many years ago, my girlfriend has said she would help clear any that are now demanded, to assist in the clearing of my credit file. To received a default this far along the line would be very disappointing. This amount is around £1k. (I assumed, maybe incorrectly, all CC's were defaulted, but now my girlfriend is helping me, we can see that some CC's are still charging interest - which I think indicates they are not defaulted?) I would like to ask for advice on how to approach this. When I viewed the site before, there were recommendations of 'unlawful rescission'. Would this be an option, as they have clearly terminated the account without issuing a default notice? If they have defaulted the account, can they add interest daily? What is the best thing to do, considering I would like to prevent a default? Thanks
  4. Hey Will keep it short, I complained about the mis-selling of the loan, Got a refund of the interest credit back to the loan account in January 2012, and agreement a payment plan. Got the letter from Consumer debt recovery confirming the payment and that the account was closed. The payment book that was meant to have been issued never arrived, See Picture one of the letter 2 days ago got a phone call and today this arrived Lloyds TSB say the first letter was sent in error and told me to bin it (as if i will do that) but say i still need to pay the balance requested by Iqore. I have made a complaint with LLoyds TSB Leeds for the consumer debt recovery complaints just looking for advice on what i should be doing if anything Any advice ?
  5. I opened a Lloyds bank account in 1995 and have held the account ever since. It has never been subject to any of my credit searches and has never appears on any file. Suddenly I received notification from Equifax that it had been added to my credit file. I haven't signed, deviated or agreed to any changes. Could someone clarify if this is normal procedure and companies are allowed to add to a credit file after such a length of time not appearing on the file? I still have the account, have no intention to stop using it or closing it. The holding branch has lost the original signed agreement as I did enquire for this 3 years ago.
  6. Hi, everyone I wonder if you could help. My wife’s phone was stolen from the secured locker in the female changing room in Virgin Active two week ago. We had informed the police and the airtime provider straight away and had obtained the crime reference number. We hence tried to make a claim from our mobile phone insurance with Lloyds TSB (premier account holder), unfortunately, we received the letter today saying the claim was reject on the basis of exclusion clause hiding in the T&Cs states that “Theft of the phone and accessories from any unattended building or premises unless evidenced damage was caused in gaining entry to, or exit from, the premises”. I am wondering if they are allowed to reject my claim on the basis of "unattended building or premises" even though the locker was secured locked with combination lock although there was no sign of force entry? I know there are few instances that the management of the gym can gain access to the locker if someone left the locker locked more than 24 hours period Thanks
  7. Hi all Lloyds has defaulted an account that without ever issuing a default notice. The default date was 9/2/12 and the last statement was sent on 2/2/12. I have never received any letters from DCAs or solicitors concerning the account and the next thing I know I'm defaulted. Has anyone else had this happen to them? What can I do about it to get this sorted. Any help appreciated please. I think they're just getting back at me for the charges I claimed back years ago. Just to add, at the end of the last statement it says that fees for period 4/2/12 to 1/2/12 will be debited at close of business on 1/3/12. Would they have said this if they intended to default the account? Thank you.
  8. Hi all. This is probably a very very stupid question but I would truly appreciate some clarification on it! I had a credit card with lloyds TSB a long time ago on which I was missold PPI. I put in a claim. Since putting in the claim I have gone into an IVA and no longer have access to that card or my ltsb current account. I recieved a letter from lloyds some months back saying they owed me £129.03 pence and would pay it directly into my account to settle the complaint. I assumed this would just come off my IVA or my balance and thats that. I heard nothing more. and no reduction in my balance occured. However today I got a letter "further to our letter to you dated 05 December 2012, in which we made you an offer to settle your complaint about your payment protection policy I am pleased to enclose the cheque payment as detailed in our earlier letter" I have torn this slip off the bottom of the letter. Here comes the stupid part. Is this slip a cheque I can now take into my new bank "halifax" and pay the money in? Or just some kind of confirmation? It looks like a cheque but ive got myself confused!
  9. Ive just filled out an allocation Questionaire for the Courts for my bank charges case. I'm not sure how long it will take Lloyds to reply. Are they now defending in the courts? Looks like i may have to prepare for court?
  10. Hi, ive just put my ppi claim on my credit card. Inrelation to charges on my credit card, ill send the s.a.r and do the legwork to recover My general questions are.. Has anyone had much joy with there credit card charges? also in relation to bank charges..is it really not worth the effot? 11. I have been a customer with Lloyds TSB for over 15 years. My primary account is with another bank. I only have a basic account with Lloyds. I recently checked my credit reference file and it showed 1 x late payment/ arrears for this account. I was quite surprised as I had not used the debit card associated with this account for approximately 1 year and have no direct debits or standing orders with Lloyds TSB. I have subsequently found out that 3 x continuous payment authorities brought the account into the red, then bank charges and interest brought it over the limit. Whilst over the limit a further continuous payment authority was honoured by the bank and then further charges lead to the account being approximately £200 overdrawn although the amount of money debited from the account is £70 all of which is due to continuous payment authorities which I have to say I was not aware of. I have written to Lloyds TSB asking them for the late payment to be removed from my credit file however they advise me that a default notice was sent to the credit agency. Lloyds TSB has never reported any information to the credit agency previously and although they say that a default notice was served the only information recorded by the agencies is 1 x late payement My issues are- this is a basic account and I did not authorise an overdraft or sign documents to consent to an overdraft. I did not agree to the debits being made whilst I was overdrawn The charges are excessive I do not understand how I can default on an agreement I have not signed or verbally agreed to The information reported to the credit agencies is inaccurate both in terms of the default being issued in the first place and also in terms of historical data (there is no other information recorded) If anyone can help it would be greatly appreciated. I can pay the money owed but I am very worried about the adverse information. I have read the BCOB guidelines but dot know of any templates I can use to write to the bank.
  12. Hi all Question : with charges reclaims can we claim beyond 6 years ? 13. When I first became a freelancer, I met with my bank manager and he really worked his magic on me - sold me loans with ppi (currently chasing), and income protection, critical illness (or health cover) and accident protection insurance policies all in one sitting. I was young, daft and foolishly trusted him to be honest with me in that meeting. About 3 years later during a hiatus in my work I read the paperwork for the income protection insurance and realised that even though the bank manager at that time was aware i would be freelance, and NOT working regularly 16hrs + a week, he had sold me cover that I could never claim on. I immediately cancelled it, but it has always nagged at me that they got all that money off me for useless cover. I was so hacked off I chucked the paperwork. (Argh!) I've done a SAR with Lloyds, but they've said they hold no info on the policies, and that I'll need to locate the insurer's themselves to get copies of the plan details. (I spent 30 mins on the phone to Scottish Widows searching for a policy on the basis of a Direct Debit reference with no luck.) Lloyds have provided me with the names of the 3 insurance types and the date taken out, but that's it. One of the policies was in excess of £25pm, and the other 2 were £6+ each per month. I have details of each on bank statements. The 3 are: Accident Protection 5 Star Healthcover 5 star Lloyds Bank HIP (Consolidated Financial) All started 23/09/1999. It's only in the last couple of years with all the PPI chat I've started to think it might be worth following up on these policies with lloyds. It was Lloyds who missold me these policies so I do see them as responsible for them - not the insurer. What can I do? Is it worth chasing? Lloyds are NO help. Thanks.
  14. Hi everyone, I thought I would tell you about my daughters treatment by Lloydstsb. 3 Years ago she was with this 'dead head' boyfriend, she was working but got pregnant so her work sacked her, (I know they cannot do that, but they did) of course they did not say it was that but it was, anyway she had a baby boy early he died after 5 weeks, (hospital treatment or lack but that is another story) anyway her boyfriend got her to get a loan from her bank Lloyds we and she had always been with them and had a good relationship, she got a £1000 loan, she also got him a mobile phone on contract, she then got pregnant again, then he left! She was really struggling with the money as she was on benefits, so a few days before the £50 loan payment was due she asked the bank if she could pay 2 days late, they refused, when she put the £50 in 2 days late they had already charged her £120, then they took her, housing benefit, her child benefit and her income support, the bill is now over £3,000 the phone company want £600 and obviously there are others so she is having to go bankrupt! I wrote to the bank and the ombudsman but the bank would not help and the ombudsman would not help, she was advised to pay £1 a week I paid it but they refused and closed her account!

  16. Dear All, I am ever so grateful for CAG for providing such a valuable service. I hope to find help related to my query. I had taken a personal loan from LLoyds in around 2003/2004 for £15k and paid half of it through installments until I was hit with redundancy and could not pay the rest, around £7000. But since then I have never been in touch with Lloyds until last December, where I requested for SAR after Robway had suddenly started to chase me. I requested for SAR for four things, Firstly to determine whether i was sold PPI secondly, to see whether my loan was statued barred. thirdly, whether Robway were the actual owners of this Loan. Fourthly, Amount owed has now jumped up to £9040, I wanted to see how. My enlocsed cheque payment of £10 was withdrawn on 25th of Jan 2012 which was around a week after I had sent the request. I have received no reply from Robway in return to my SAR request but I have received the attached letter from their in-house solicitors instead. As I am new to this, I would be greatly obliged if any help is provided. What should be my next step from now onwards? I would ideally want to check whether this loan has been statued barred if not then what is the best course of action for me? Thank you in advance for doing the needful. Their letter is attached herewith without acknowledging any SAR request. AKI
  17. hya i really need advice..bank charges have resulted in me losing my bank account and have now got debt collectors hasseling me on Lloyds behalf..i want too reclaim bank charges and ppi..but also need to stop debt collectors moving things on..i.e.baliffs ect...what should i do??? please help my head is spinning..:???:
  18. I got into bother when I broke up with my partner 7 years ago and accumulated a number of debts of which two were Lloyds credit cards. All the other debts defaulted me therefore have dropped off my credit file but the Lloyds one's did not default me. I paid both accounts off, the last one in December 2010. I recently obtained a copy of my credit file and the Equifax file is still showing the two Lloyds accounts as being open, with credit limits and as being at nil balance. I never receive any statements or correspondence from Lloyds TSB to suggest to me that the accounts are still open on their systems. The trouble is that the file also shows that I paid off over the previous 5 years by way of an arrangement. Can I get these accounts removed from my credit file as any potential lender will see that I have had "previous" and may decline any application? Many thanks for any advise...
  19. Hello Can anyone advise me how I can obtain transcripts for; Recorded conversations between myself and Lloyd's insurance for past claims. I have been told that I need to contact the 'data-controller'... But which one?... as I was informed that, although the names are identical, in fact, Lloyd's Insurance are totally separate and independent of Lloyd's TSB Banking. Any help regards this matter would be gratefully accepted.
  20. Hi, I have an account with LLoyds TSB which since 2009 I've received DLA for my 6 year old son & Carers Allowance into. I am a stay at home mum & have no other income except for Child Benefit which goes into this account also. I read on another site that if you receive benefits into an account then the bank are unlawful in making charges on the account if you become overdrawn. I only very occasionaly am overdrawn & when I am I now put enough money into this account the same day to ensure i don't receive any charges. There was 1 day last week though that I went overdrawn by .56p & I received a letter on Saturday morning to advise me that they'd provide me with an unplanned overdraft for this. There was no mention of charges being applied. I handed a letter into the bank yesterday for the Managers attention telling them that I receive benefits into my account & that they should not make any charges to it & if they had in the past, since 2009 then I'd like those charges refunded. I had a phonecall from them while I was out yesterday asking me to ring them back as they need to discuss my letter with me. I've found out from another customer of theirs that she sent a letter in about the same thing & was told that they'd close her account if she persued her request. I'm assuming they'll tell me the same thing when I speak to them & want to know what I should do next please. Any advice would be gratefully received.
  21. I just interested in where the 8% interest limit comes from, in my case the have offered my a repayment off my PPI + 8%.interest They have not detailed how the figure has been calculated, they have offered about 4000GBP My PPI was on an overdraft product, it has been going for more than 6 years Its my understanding that Lloyds would charge interest of 24% if I wanted to borrow 3000 over 6 years. If I go over an agreed overdraft limit they want to charge me 15 per day, by talking out this PPI product Lloyds have had in effect a free overdraft from myself. Q. Do I have to accept their offer of 8% interest when they would want so much more? Q. Can I charge them the same 15GBP per day? Q. I have been told that it will take 28 days to transfere cash to my account, how long does it actually take?

  23. here is my siyuation with my lloyd credit card which im going to SAR along with my lloyd loan and current accounts with overdrafts on other threads. dont know what if anything i can get back but am sure they have done something wrong any advice appreciated. im going to bullet point my journey to make it easier.(hopefully) lol x - feb 2009 started missing pments -jul 2009 letter from lloyds chasing arrears - aug 2009 dmp started lower paments begin - aug 2009 letter from dmp stating lloyds accepted dmp lower pments - oct 2009 DCA letter from MHA chasing arrears - oct 2009 cc sment showing pment from dmp all added interest onto bal - oct 2009 letter from MHA stating client accepting lower pments for the next 6 months to be reviewed after this time - Nov 2009 Letter from MHA offering a lower settlement offer for me to pay to clear debt - nov 2009 Arrears notive from lloyds - nov cc statement showing pments made interest still added onto bal - nov2009 letter MHA stating client accepting lower pments for 6 months (again) THEN NO CORRESPONDANCE AT ALL UNTIL: Dec 2011 Letter from lloyds listing payments made since jan 2011 and balance stating that no interest payments or charges are being applied to account. just some advice if i could claim anything back or if they have done anything wrong i am paying them back every month but did add lots of charges previous to my dmp.
  24. Not sure if this is the place to post this but here goes. My wife has an account with Lloyds TSB and the new charges are crippling her account. I am wondering though if she has a case for disputing them. Here's my reasoning: she has a current account with no overdraft facility. This means that all payments from her account have to authorised against her balance. Surely if Lloyds authorise a payment and this makes her overdrawn this overdraft must be considered authorised - in the current charge structure Lloyds have every reason to authorise payments that cause an account to go over the overdraft limit as they then make a fortune from the fees? Any thoughts anyone?
  25. hello there first i apologise if this thread is in the wrong place please remove if it is. i have used this site before and got 3 catalogue debts written off due to cca the help was amazing and now require help again. i am looking at claiming some charges back here is my situation: i have got 3 lloyds accounts all with charges and a credit card with them. all have charges going back as far as i can remember as i have been with the bank for nearly 20 years. about 3 years ago i entered into a debt management programme and stopped using all bank account and got myself a basic acount with an unrelated bank, since then they have continued to add od interest and charges which i believe to be unfair also on the run up to the debt management i got lots of late payment fees they are putting me in more debt and cant pay off what i owe cause the interest is more than my repayments. i know i have to send a SAR but do i put all accounts in the one request as i cant afford £40 for all 4 a step by step guide with template letters would be great as i would like to get everything ready in a folder ready for the long battle ahead that i have read on here about. any help would be appreciated and i know you members will be with me all the way. i just want to have everything at hand ready to send and know what im doing before i begin .
