  2. There have been some interesting changes in relation to the Civil Procedure Rules 2016. I am very interested in Part 89 in particular. >> https://www.justice.gov.uk/courts/procedure-rules/civil/rules/art-89-attachment-of-earnings Are these changes going to be of use and can they be used for all attachment of earnings? Your thoughts please.... For the full changes see here >> https://www.justice.gov.uk/courts/procedure-rules/civil
  3. Received an email from BT confirming that my contract will be increasing by £3.50pm from July 2016. I understand that even though I am in contract I can still refuse this increase and leave the contract early, can anyone confirm? Their email states "if you're within your minimum term and want to cancel, you'll need to give us a call within 30 days of getting this email to avoid paying a charge for leaving early.". I assume if I call they will offer to remove the £3.50pm, does anyone know if I can still reject this and leave? I am looking for a way out of this contract so this seems like a golden opportunity. Thanks, J
  4. I hope this is in the right place, please would any mod kindly move if not. I would appreciate any guidance along the way from pple more versed in the small claims court. Lowell Solicitors have lodged a claim with Northampton, particulars as follows. Issue Date: 18-1-2016 Amount approx: under £600 Claimant: Lowell Portfolio 1 LTD Solicitor: Lowell Solicitors Limited Original Credit: Shopacheck Particulars of Claim: 1) The defendant entered into a Consumer Credit Act 1974 regulated agreement with Shopacheck under account reference ******** ("the agreement"). 2) The defendant failed to maintain the required payments and a default notice was served and not complied with. 3) The agreement was later assigned to the claimant on **/**/2012 and notice given to the defendant. 4) Despite repeated requests for payment, the sum of *** remains due and outstanding. And the claimant claims a) The said sum of *** b) Interest pursuant to s69 County Courts Act 1984 at the rate of 8% per annum from the date of assignment to the date of issue, acrruing at a daily rate of *** but limited to one year, being ***. c) Costs What I have done so far: 1) Acknowledgement of service - Online MCOL Website (20/01/2016) 2) Sent CCA REQUEST - £1 postal order - Signed For Post (21/01/2016) - Lowell Portfolio I Ltd 3) Sent CPR 31.14 - Requesting Default Notice, CCA Agreement and assignment - Signed For Post (21/01/2016) - Lowell Solicitors I Cannot for the life of me remember having shopacheck, but then again in 2012 my head was up my proverbial **** as my mother died that year. I have never received any default notice from Shopacheck or Lowells, I am very good with paperwork/documents/post, everything that comes that is official if filed in ring binder boxes... If I had received any default notice I would have acted. Also, I never received any letter from Shopacheck / Lowells to inform me that the debt has been re-assigned. I am not denying the loan but also am not accepting it as I just do not know, what I do know is I have had 20 + loans from shopacheck in the past since circa 2000 , so do have a financial history with the company I have looked through any/all paper work kept from previous loans but cannot find details of the one they are referring to with the reference number they gave me in the Particulars of Claim. So, as of 15/02/2016, Lowell Portfolio I Ltd have not replied to the CCA, Lowell Solicitors did reply to the CPR stating they are requesting the documents but that is as far as it went, they refused to answer my question asking for an agreement to extend the time for filing defence. Last night I filed my defence in time for the 15/02/2016 defence deadline. the defence was along the lines of this link Thanks to anyone who can help with guidance along the way
  5. Hello. I have a Santander 123 account and have been paid interest, less tax, on it over the last tax year. I was surprised last week when all the tax I'd paid on the interest was returned to my account. Has anybody else on the forum received the tax back and does anybody here know why? Thanks

  8. Evening all I hope you are all well, it has been a long time since I have beenon apart from an odd few replies and this time I need some help understanding the wonderful world of HMRC etc! OK, as you may know I started work in October 2015 (great news and still happy and away from the DWP!) I am in receipt of WTC (single, no children etc) of £207.08p/m from 2015-2016 financial year (new financial year upon us!) This is based on me starting work end of October 15 to March 31st this year on a salary of £17,031 so in effect only working for 6 months in claim year. I get paid monthly and thought I would call to see what my position was in the next financial year and after a 25 minute call wait and a lengthy discussion I am still none the wiser. They said I would need to declare my earnings for April 16 to April 17 which of course would be the full year, so £17,031 and would have a £2,500 disregard so a figure of £14,531. Based on that my WTC payments seem to be £0.00pm (great!) What I was also told is taxable benefits (signed off 25/10/2015) would be included as well. Now, they said my payment for April 27th would be around £80.00 based on my earnings Oct15-Mar16 of around £7,305.00 but even though I get a renewal pack between April and June 2016 I would need to call them to update my circumstances around 8th April but Iam still unsure what information I need to give. Will WTC payments be based on my income from Oct15-Mar16 or Apr16-Apr17? If the latter then I get £0.00pm as I guess I had a full years WTC in financial year 2015-2016. What I am worried about more than anything is if I continue to get payments, even at £80.00pm and I misinform them with info due to my lack of understanding I could be met with a horrid situation of trying to deceive HMRC and a request for repayment of funds. I am very confused on what I should get, even if nothing and how I should go about doing a renewal - i.e. wait for pack which could be June (deadline for renewals is 31/07) and get say 4 months payments I am not allowed (overpayments) or call and update straight away and get a letter stating I get nothing. Obviously loss of WTC will be a hit but I am still earning more than on benefits so would adjust accordingly. Any help appreciated.

  11. Well today is the day. George Osborne has just left Downing Street with his little red box, full of secrets. What time is the Budget 2016? How to watch, predictions and more on George Osborne's spending announcement News UK News The Budget What time is the Budget 2016? How to watch, predictions and more on George Osborne's spending announcement George Osborne is set to unveil yet more cuts in his 2016 UK budget speech. Here's everything you need to know What will be in store when George Osborne unveils his 2016 budget? Will it be all doom and gloom? Or has he, once again, got an unexpected rabbit hidden in his hat? Gloomy economic forecasts, bleak export figures and the promise of a Budget surplus of £10billion by March 2019 will fuel the Chancellor’s latest attack on Britain’s public services when he delivers his financial statement. The national debt has ballooned to almost £1.6trillion on his watch - about £24,000 for every man, woman and child in the country. You can also expect plenty of the Chancellor's favourite catchphrases to make an appearance. References to a "long term economic plan" and "fixing the roof while the sun is shining" are near certainties. The excitement is building. I can hardly wait, can you.Have your say now or as things develop or afterwards.Leave it to you. Are you going to watch PMQ time.Anticipating a little excitement.Hope the bar is stocked.Such a thirsty lot. http://www.mirror.co.uk/news/uk-news/budget-everything-you-need-know-7563257

  14. im posting this on behalf of my sister inlaw . she and i have both tried talking to hmrc what a nasty we dont care attitude they have . she recently (few weeks ago )saw a £24.80 per week drop in tax credits , phoned them and they said wait for a letter to arrive and then phone the number onit and they will explain . letter comes and low and behold ,same number idiots. any she rand them yesterday and they are calculating that by 05/04/2016 her earning will be £10700 £6.79 ph on a constant 30 hour week . her last wage slip dated 28/02/2016 states her total earnings to be £8002.54 to that date for the year . so out came the calculator and a rough estimate to the date they gave 05/04/2016 adds upto £9198.54 total earnings for the year . so how can they start taking an over payment for 05/04/2015 to 05/04/2016 of over £700 ? they said they base it on earning from previous years of 2013 to 2014 . the system sucks . so now she is £24.80 worse off a week. reducing her tax credits to £44.64 per week until 10/06/2016. she is a single parent who works ,pays full council rent ,gets no discount, full council tax -25% single person discount and has a 13year old child . some how i couldnt get it throiugh to the lady that how can you take an overpayment that hasn't actually occured yet ? based on the fact that in 2013-2014 she use to work 40 hrs per week . is there some way to appeal against this ? as she struggles as it is now . i see her point , whats the use in working if single parents etc are better off on benefits . go to work get punished . is there any help she can get either in tax credits ,appealing againt housing costs to offset an overpayment that has not happened yet .
  15. If you're a dog owner , 2016 marks a change in how you register your pet. It becomes the law this year for ALL dogs to be microchipped under Government plans announced three years ago. From April 2016, every dog in England and Scotland will have to be microchipped in a move which the Government says will help reunite people with lost or stolen pets and track down the owners of vicious or illegal dogs. http://www.mirror.co.uk/news/uk-news/dog-microchipping-laws-what-changes-7113932 Free microchipping Free microchipping is available throughout the year at all Dogs Trust rehoming centres (by appointment) as well as at their free chipping roadshows, as well as participating vets http://www.chipmydog.org.uk/have-your-dog-chipped-for-free/

  18. Psychoactive Substances Act 2016 your thoughts? This can be found here >> http://www.legislation.gov.uk/ukpga/2016/2/pdfs/ukpga_20160002_en.pdf It has Royal Assent now I believe? Introductory 1 Overview (1) This Act contains provision about psychoactive substances. (2) Section 2 defines what is meant by a “psychoactive substance”. (3) Sections 4 to 10 contain provision about offences relating to psychoactive substances. (4) Section 11 provides for exceptions to those offences. (5) Sections 12 to 35 contain powers for dealing with prohibited activities in respect of psychoactive substances, in particular powers to give prohibition notices and make prohibition orders. 21. I was kicked off ESA the end of 2014, successfully won my appeal March 2015, scoring 27 points from the original 0 that ATOS gave me, the letter I received from the appeal court, states review after 2016, but to my surprise the other day I received a letter with the ESA50 questionnaire that I need to send back by 5 February, This as seriously stressed me out, as I didn't think I would be called so soon especially after the appeal court letter stating review after 2016.

  24. Hi all. I have been reading up on the proposed pension changes in 2015/16 and am slightly concerned about my parents. They are both 68 years old and my Father gets £190.00p/w pension which is including pension credits and my Mother gets £26.00p/w as she never paid any contributions and worked cash in hand (regrets it now) Will they be affected as in my Fathers will drop to the new rate of £148.80 (I think) meaning a drop of £41.00ish and £164.00p/m?! Although they get carers, DLA and housing benefit they just about get by so a significant drop like this will put them right in the mire, or, will it balance out so they do not lose out as a couple? I really am quite concerned about this so any pensions people that understand this more than I do I would appreciate any input. Thanks
