  1. Hi I have been issued with a CCJ for an amount I owed a solicitor. The solicitor didn't complete the work and didn't do as they promised me when the property sale fell through I didn't receive a bill from them so just never thought about it. I live at an address that was unknown to the solicitor but used to live with a relative. The relative received a letter from the solicitor saying they wanted money. I said, fine, but send it back with my new address. I received a letter then at my new address which I have responded to via email, offering to pay a token amount each month until I am back on my feet financially. A CCJ has arrived at my previous address (post is seldom opened hence this problem with unseen letters). I might be moving back there but not sure yet, but if i do or don't I still want to avoid bailiffs at the door as I believe they can force their way in when doing CC enforcement?? Would anyone please be able to offer any advice in the event that the solicitor does not accept my offer - I only offered a few pound a month but happy to have review after a few months. thanks
  2. I wanted to keep this as subtle as possible so I won't put any terms in here that will trigger any alarm bells. Not sure how to go about this but here it goes! September 2016 I begin working (sorry, I mean, self-employed 'sub-contracting') as a courier for a firm who provided its services to a Fortune 500 company, 12th on the 2017 list to be precise, you know, the one recently famous for its dealings with shoddy courier companies? ....Now your getting the picture After a few months we heard said F500 company was taking "tips" from customers by default via the online checkout, these tips were suppose to be paid to drivers. We of course were never informed about this and never saw a dime. The reason why tips where offered by customers is, we were forced daily to carry up over hundreds of kilo's of shopping purchased to flats with no lifts. Mostly being boxes of water IN THE DOZENS! (like that wasn’t bad enough, all of the weight was put into paper bags. No handles, no trays or trolley's provided to carry them up. All done by hand.) The customers obviously did this on purpose, so they won't have to. And I’m guessing in exchange for their guilt, would tip us a few quid for the back killing pain we where left in. Now I, along with the rest of us working (sorry, ‘contracting’) for this firm where not aware this was happening until one day a driver brought it to our attention that other contracting firms are paying their drivers tips. When we queried this, our firm said that the F500 company did not provide them with any tips. After a few months, we started asking other companies drivers to show us their invoices, and they were all earning over £100 a week in tips alone! (50-70 hour weeks however) This became even more apparent when customers where asking us if we received our tips or not, for which we had to lie and say we did so they won’t get upset. Furious, over 20 drivers mounted pressure on our firm and demanded an explanation. When a few drivers were “dismissed” for doing this, we went and complained to managers at the F500 company directly. We got a straight up “you don’t work for us, you work for them, so deal with them. You are not our problem.” Essentially, the F500 company knew that this firm was taking the tips that was suppose to be for us, and pocketing it for themselves. This went on for almost a year. If the maths is correct, that is £100 x 100 drivers x 52 weeks = thats over HALF A MILLION !!! The point is the F500 company knew the tips would never arrive to the drivers yet took it by default from the customers at checkout. (the customer had to opt-out of paying manually.) This is deceptive and borderline fraud. They turned a blind eye for almost a year. After all the noise we began making, the F500 company knew they were in deep sh!t when the word got out, so they decided to cancel the contract with our firm, and within 24 hours we had all lost our jobs... just like that. Conveniently, our firm dissolved shortly after. Broke, with no income, and nothing else to do a few of us decided to file a Subject Access Request from said F500 company. We followed all procedures down to the letter and also paid the £10 for them to give us details of all the tips that was paid by customers, intended for us. However, even now, after 80 days, we have not heard anything back. The letters where sent recorded delivery to the compliance department, so we know they received them. Question is, where do we go from here? Do we even have a case?
  3. Cold calls offering exotic investment opportunities to people cashing in their pension pots will be banned under government plans. Ministers estimate eight [problem] calls are made every second to UK residents, leading to an annual loss of £19m. Advice services and legitimate companies said such calls had "plagued" the pensions world for years. The ban, which could be enforced with fines of up to £500,000, would not cover texts and emails. However, the government will gather views on extending the proposed ban to all electronic communications. http://www.bbc.co.uk/news/business-38029133
  4. Hey, I currently have a DRO in place. The conditions say that I have to notify any creditor that I have a DRO if it's for more than £500. My phone contract is coming to an end, and I want to upgrade my handset. I can either stay with my current provider, or go with another. But my question is - do I need to tell them about my DRO? Either if I stay with my current provider or move to a new one. I can get a phone for about £30 per month, on a 24 month contract. So that means I'd spend £720 over 2 years. Does this count as a £720 loan? I don't want to jeopardise my DRO, that's more important than a new handset. So just wanted to get some advice, thanks.
  5. Company directors could be fined up to £500,000 if their business is behind nuisance phone calls, under government moves to clamp down on the problem. The law is to be changed in Spring 2017 to make directors personally liable for breaches of regulations. At the moment only firms can be fined for ignoring rules on cold calling, but many declare bankruptcy - only to open up again under a different name. The change will mean the Information Commissioner's Office (ICO) would be able to impose combined penalties of up to £1m on company directors and their businesses for breaches of the Privacy and Electronic Communications Regulations. http://www.bbc.co.uk/news/uk-37743001
  6. (I'm not exactly sure what forum this should go in, so I'm posting it here, but Mods please feel free to move it.) I'm going to charge Anglian Home Improvements £500 each time they continue to harass/phone me I have reached the Samuel L. Jackson Fury Event Horizion - "Enough is Enough! I have had it up to here with these [edit] Double-glazing salesmen on this [edit] phoneline":-x I'd appreciate some advice on the specific OFCOM guidline and law acts I can use against them. Dear Anglian, I have, over the last 6 months, received dozens of phone call from you, some silent and putting the phone down immediately I answer, and some asking to speak to a "Mrs Gardner", presumably the person that had this phone number (REMOVED) before me. I know the calls are from you due to the caller number display. Every single time I request, as is my legal right, that you stop calling me immediately and that you remove my phone number and all other information from your system and never call me again, your phone operator always agrees to do this. Despite this request, you continue to phone me at all hours of the day and night, and even when I inform you that I am not the person you are looking for you still try to sell me something. Let me inform you of some facts: (1) I have NEVER contacted you, requested a quote, had business dealing with you or otherwise made any contact with you previously (2) I am extremely ill, severely disabled and bedbound due to an incurable illness. I often have to rest or sleep during the day or evening. (3) The phone number you keep ringing (REMOVED) is for EMERGENCY use only, and hence each time I hear it ring, I can only assume it is an emergency. This stresses me, and my illness is one that, if I am stressed, my illness gets worse. Hence your insistent calls are causing me actual harm. (4) You have ignored my request to remove my number from your records on EVERY SINGLE OCCASION, thus breaking the OFCOM GUIDELINES ???? and the LAW ACT ???? Protection from Harassment Act 1997 (5) From this date onwards I am applying a schedule of fees for every phone call I receive from you to compensate me for my time and for the damage to my health, and for restitution for the HARASSMENT from you. The fees are as follows; Receiving phone call from yourselves = £500 Receiving SILENT phone call from yourselves = £750 answering email from yourselves = £250 answering unsolicited letter from yourselves = £250 personal visit from yourselves = £1500 Writing letter to yourselves = £77.34p Continued phone contact or extended other communication from yourselves shall be consider acceptance of this schedule of fees. All communication may be recorded and made public. Continued ingnoring of my requests will lead to legal action. Yours sincerely Mr Mongoose

  8. This morning I had a phone call from an Enforcement Agency who had been to my old address. They want almost £500 for a traffic ticket where they said I went into a bus lane last May. Obviously I cant remember and they said they are going to post me some papers out as I live in a different town now. I did give DVLA my new address and its on two MOT's since but apparently its not updated on the system. I know its on my credit report. Can anyone please tell me how I can fight this as I dont have the money to pay and they say it has been to court and finalised and now I have to pay and they are talking about taking my car away if I dont. Worse thing is I am disabled and cant get around without the car. Really stressed and worried now as never had to deal with anything like this before?

  10. We had a hire car for three days last week, Monday 18th August until Thursday 21st August. They delivered to our house, and picked up on Thursday 21st. Today we get a letter claiming a "£500 damage surcharge" - and an admin fee. The car was absolutely not damaged when their driver picked it up. I am also annoyed that they did not tell us for over a week. What can we do?
  11. I'm thinking of taking a small loan for this amount maximum, and would even settle for just £300 if I could get a reasonable repayment schedule and rate of interest. The thing is, I want to avoid Wonga like the plague, considering the horror stories I've heard about them, I don't need an interest rate with 4 decimal places and I'm willing to repay within 2 years at most. The thing is, technically, I could save up, but it would take a few months at least, but I'm wondering if that is my best bet. What is the best advice you can give?
  12. I couldnt believe I was seeing this when I was watching the news !! http://www.dailymail.co.uk/news/article-2432593/Gang-deliberately-crashed-bus-500-000-cash-crash-[problem]-guilty-fraud.html
  13. Its a long story. But basically I need to remove the phone number I have on my Orange contract and put it on another phone on a different contract. BUT, I have another 12 months left on my contract, and they wont give me my PAC code unless I pay a £535 contract cancellation fee. I am happy to continue paying the orange contract with a new phone number. But they say this is impossible. What I don't understand is that they are more than happy to give me a new number, but cant give me the PAC code for the current number before they do. Where do I stand? What are my options? Thank you in advance
  14. Hi I am £500 overdrawn and all of it is charges. There was an original £36 charge which i got because my account was overdrawn by £30 for a few days the previous month. I couldnt afford the £36 charge that month therefore my account was overdrawn by the £36 charge for a whole month. This then resulted in them adding another £180 in charges for being overdrawn. Obviously i cannot afford this either so the same thing has happened again and the current state of affairs is that i am £500 overdrawn - all of it is made up of the charges. Surely this is unfair that they add charges as a result of the charges. its just a horrible way of them being able to charge and charge and very quickly it becomes un manageable. I barely now have the £36 let alone the £500. Any advice on what i should do? Thanks
  15. I had a text yesterday morning from Lloyds TSB, as normal, stating that I was overdrawn and yadda yadda... Then the Monday Text came which gives me my last 5 transactions... Which were not recognised. I had a loan with PayDayExpress back in July, now being dealt with by the CCCS and being paid as far as I know... And they've taken the following; 25.00 25.00 50.00 200.70 25.00 100.70 These have been taken from a variety of cards which I have owned, none of which were my payment cards for PDE. Lloyds have opened a fraud case as this simply not right. I was half way to calling the police too, seeing as they've phished around for my old card details from Moneyshop (who they work with). My account is now £542.44 overdrawn and they've actually taken a hell of a lot more than what was owed (£325 all in all, they've taken £426.40). What do I do? Lloyds were talking about collections and my account has been frozen with them due to my minor overdraft of £117... Now it's stirred the indian call centre right up and they're ringing me every waking hour now too... Payday Express really are the lowest of the low, theiving ****.
  16. Hi, so basically... my car is a e61 bmw 520d and it has air suspension which is controlled by a pump. The pump failed first time around and i had contacted the trader i bought it off and as it was under warranty i took it to a specialist and they diagnosed the pump had failed. even though the pump had failed he never replaced it and instead he replaced the complete wrong part! he replaced the offside air spring and not the pump. But supprisingly the fault dissapeard for 3 months and has now come back, i checked the paperwork and found that he replaced the wrong part! So is there anything i can do to sort this out. If it helps, i bought this car from a trader on finance so could the finance be affected (cancelled) seeing as the car was faulty when i bought it? as the 3 month warranty supplied by the trader has run out, i have to fork out £500 to the garage to get the pump fixed when he should have done it in the first place!!! Please help guys!! Thank You
