Hello have heard nothing yet - i acutally spoke to a Clerk of Court who advised me to ring Abbey and say i would be attending and intend to follow this through - that is what they have been advising their claimants re. penalty charges - she also said no solicitor has been appointed by Abbey National - i have chosen not to ring abbey National as i thought that would just be too easy and if they turn round and say no to my claim and decided to contest i would be devastated so have made no communication whatsoever - am attending 9.30 friday morning - she told me i do not need anything prepared Judge Mackay is really charming and helpful so not to worry - so i am going to take all my documentation - leading up to this point and my draft directions and nothing else - i have not prepared any bundle as firstly i have just lost my mother very recently and am in and out of hospital with little daughter who is ill and it has taken just so much energy to get to this point - any advice most gratefully received kind regards to all who have responded
  2. Hello I have just been advised of my court date as 15th June 2007 at the Royal Court of Justice, Strand (tranferred to the London Mercantile Court based within Royal Courts of Justice). I Quote from the letter " There will be a Small Claims Hearing in this case and in several others which raise the same or similar issues on 15th June. The hearing is intended to give directions for the hearing of some or all these cases in a way which saves time and expense. It is hoped all parties will attend but if this is not practicable the court will be pleased to consider the written views of any party provided that these reach the court by no later than 12th June." unquote - can anyone enlighten me as to whether i still use the basic court bundle? I have sent all schedules of charges, with dates etc of when charges applied and amounts plus statements - to court and defendant twice already. Please advise of what further to do - my claim is for a total of £6,500 approx thanks very much for your advice X

Hello everyone - just love looking at this site and hoping i will one day be able to donate - in the meantime need some feedback or help - sent all the charges etc and letter received by them 20th Dec 06 then received letter back 5th Jan to say complaints dept will be in touch around 4 wks time - then on 9th received 2 letters one saying will give you £195 and other saying sorry no refund allowed as we gave you a refund once before . I was claiming for 2 accounts all under the same claim. Am about to file claim at small claims - but in the meantime do i still send the 7 day letter rejecting the offer of £195, ignore the letter that said no refund as we've given you some money back before then wait 7 days then file for claim - my claim is with 8% over £4K. One final important factor to take into account is that many years ago when they were taking tons of money out on charges i met with them and they gave me about £200 off those particular charges - i have not idea if i signed anything which is the charges they referred to in the second letter on 9th Jan.

  7. Hello Just about to file in small claims court 2 claims for bank charges. The total amount is approximatley 7K - is there anything i need to include on the N1 form that is relevant - i also have been consulting the penalty charges website and gleaning info from that - any information would be gratefully recieved - for your interest i have just added 8% apr and nothing else as to be honest it has taken so long to get to where i am now that i am happy with that.
  8. thanks again for this info - really appreciate - haven't quite figured out how to do a new thread but will take another look and have a go. and i can split my claim as it is for 2 different bank accounts with Abbey.

Hello i have the particulars of the claims already filled in but don't know how or where to post it - could you let me know when possible how and where to do this i am just in the process of recalculating costs plus interest i am now probably looking at a total of over £6,500! yikes . Thanks again for your help.

Hello and thanks for your response - i sent the letter on 20th December the one saying "if you do not comply with refunding the costs i will then have to go to court" - they did respond to the letter saying it was passed to their complaints department then i received a further letter from Abbey saying they will respond within 4 weeks from 28th December the date of their letter. I guess now it is time to fill in the spreadsheet you sent and then file at the small claims court. If there is anything else i need to do please let me know. Thanks for your help with this i will keep people posted.

Hello I have been on and off this site for the past month trying to work out how to go about filing my claim so far i have - send the initial letter with breakdwon of penalty charges to Abbey Nat and recieved letter saying they will respond in 4 weeks while they look into it - i am currently filling in N1 to file the small claim but am stuck on the interest. The excel sheets i intially did do not have interest on them or even APR i have now read somewhere that if you don't do it properly then they will assume you do not know what you are doing and not give you your charges back. I know there are all the vampiress's fab spreadsheets but can someone actually explain how i go about applying the interest do i just add 8% APR to the total or is there some other way of doing it all help gratefully received.

Hello Very interested to see your story - i am in a similar position - have just received letter back from Abbey saying they will contact me back within 4 weeks - it has now been suggested that i now file in small claims court and then add spreadsheet with 8% interest - is this right - did you do this - i am finding it impossible to add a new thread as i can't work out where it do that from and have spent one week reading everyone else's story and am desperate to talk/email someone to get some information back. Good luck with your claim - if you have any really useful information you wish to share on how you approached the matter i would be most grateful. kind regards
