  1. Hi All, Well I've received a reply from my pre-lim. using the standard letter everyone seems to get about part payment. When issuing the letter stating I will accept as part payment of outstanding fee's do I need to send this before the LBA or at the same time.
  2. Having spoken to the council again I have been informed they will notify Phoenix Commercial Collections to say the payment has been made. I contacted Phoenix to state that I am disputing the fee's and have been informed I still have to pay the outstanding amount and then dispute. Is this correct.
  3. Hope someone can help me please. I have just received a Notice Before Removal letter from a baliff to do with outstanding Council Tax. Unfortunatley I was not aware of my rights previously and set up a walking possesion. I was a few days late on 1 payment and now the baliff is saying that he will arrive tomorrow with a locksmith and police to gain entry. I have contacted the council to see how much is outstanding and the baliff is requesting £140 more than what is owed. I asked if I could pay the council direct and the person I spoke to said as it was out with the Collection company I had to deal with them. Can I just make payment to the council and then put the account with baliff in dispute as I try to accertain what fee's have been levied on to my account. Any help today would be very muvh appreciated.

  5. Success within 8 days of T-Mobile receiving pre-lim letter. Have just spoken to Customer relations who have advised me that although the charges are written in their Ts & Cs which I've signed they are more than willing to remove the charges from my outstanding balance. Is only nominal charges but its the principal. 1 down only 4 more to go.
  6. Received letter acknowledging S.A.R yesterday. Usually thing stating they have 40 days, statements have been ordered for me. Nothing trying to fob me off yet though, that'll come with the prelim.......
  7. Thanks for the info. One other quick question. The loan/debt is in my partners name but the house is in joint names. Now I know its not going to happen but in the unlikely event that we split up would that mean the CO would still be logged on the property. I feel its unfair that I get punished for something someone else has done. Naturally the debt is going to be paid off ASAP and will also be looking at unlawful charges etc to reduce the debt down further.
  8. No - didn't attend court. A letter had been sent with an offer of payment and were awaiting reply but have recieved this instead literally 5 wks after ccj registered.
  9. So even though it was an unsecured loan they can still register a charge against the land. That strikes at being a tad unfair to me. The ccj was only registered in Nov so they haven't really given much time to arrange payment. If I were to start an unlawful charges claim aginst A&L am I right in thinking this would put the account into dispute and therefore they can not persue any further. Obviously I want to look into this further but as we have only ben given 2 weeks to object if we want to and provide reasons why I need help in finding out the legalities of it all.
  10. Hi All, Hope you can help - My partner ran up a debt with A&L. It ended up with a CCJ being registered. Have just received a letter today stating that an application to register a restriction against the land has been put forward by Shoosmiths of Bedford Road. Can someone please explain what this is. It appears to be a charge put against the property. How can this be done if the loan was unsecured.

  13. Can anyone tell me how long it was before they received acknowledgement of the SAR. Its been almost a week now and I've not had the standard letter back that everyone else seems to have had.

  15. Afternoon All, Having already started with my claim against Nationwide I thought I'd look through my other credit agreements and start tackling them. Sending off preliminary letter to T-Mobile today. It's only for a small amount but its the prinicpal of the matter.
  16. Hi Kitkat35, Have you requested a CCA from the DCA, if not then send a letter to them containing the following: I do not acknowledge ANY debt to your company. I require you to supply the following documentation before I will correspond further on this matter. 1. You must supply me with a true copy of the alleged agreement you refer to. This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit) - your obligation also extends to providing a statement of account. I enclose a £1 postal order in payment of the statutory fee, PO Serial Number xxxxx. 2. A signed true copy of the deed of assignment of the above referenced agreement that you allege exists. 3. You are notified that you are obliged to supply these documents, whether you are the original creditor or not under S189 of the CCA 1974. Non-compliance with my request is a criminal offence under the above Act and will result in a report being submitted to the relevant statutory authorities. As you are aware, a credit agreement that is not properly documented and signed by the customer is totally unenforceable under the CCA and therefore is a complete defence to any court claim that is issued. Take note at this stage, that any legal action you may contemplate will be both vigorously defended and contested. You will need to ensure that you include a postal order for £1 and also send the letter Recorded Delivery. As soon as the letter has been received the account will be in dispute and therefore the DCA can not a) ask for payment or b) pass the account to the solicitors. You will probably find they do not have the CCA and therefore can not legally claim the debt from you. It will then be passed back to Cr*pital 1 who in turn will sell on to another DCA. Repeat the process until such time that you are ready to pay/made your claim. Hope this helps. If you find the info useful please click on my scales

  18. Hi All, Had a few problems financially over the past year. As such Council Tax was not paid. Have had a visit from Baliff with regards payment. Foolishly (I've now founfd out by reading some threads) we let him into the house and signed an agreement for payment. This we have stuck to and I make the final payment end of month. I have seen on a few threads people have been asking if the baliff was let into the house. Can you inform me as to why this is such an important question. I'm worried about the consequences of letting him in now. Also I signed something about the car we have. Paniced at the time but realise I may have signed to say the car could be used as colatteral. The car is now kept on the drive.
  19. Thanks Buzby, Slightly confused as op stated they sent letter to Moorcroft regarding CCA and account was passed back to NTL. I am in the same situation. Can you explain what a CCA is pls.
  20. Thanks Guys/Gals. Shall be getting my SAR ready and cracking on with Cr*pital 1 as well as Nationwide. Hmmmmmmm think I'll be checking out all of mine & wifeys cc's, sc's, cu's etc. Could be on my way to being a millionaire before I know it......... :D
  21. Sorry to hijack your thread. I to have had problems with NTL and had my account passed on to Moorcroft. I have tried to find the CCA letter you mentioned and can not find it on site anywhere. Can you please post a link to the template.

  23. Morning All, Having just started my claim against Nationwide I thought I'd look into other establishments that have made crazy charges against accounts I've held with them. I used to have a Cr*pital 1 card but due to financial difficulties (and extra charges) I defaulted and the card was cancelled. It was then passed onto a DCA. Can I still go ahead and make a claim to get the charges back from them
