  11. Thanks - i'll sit tight, just double checked all the account statements Lowells sent me and defo no payment since Jan 2009. Hopefully they'll work out i can drag this beyond the default coming off and they clearly wouldn't have a leg to stand on.
  12. do you reckon i should send the SB letter or just chill out and see if they issue proceedings? Surely they must write another letter before issuing proceedings? They can't do it after just one letter. I can see this all being just one huge hassle i could do without, although i'll probably enjoy the challenge !
  13. definitely January 2009 - I got all the statements from Lowells to be sure. I believe it's up to them to prove i've paid anything since and i most certain haven't.
  14. Evening guys, long story short, had cap one card and not paid since January 2009 so as far as i'm concerned it's statute barred. Default on credit file July 2009 so due to come off in a couple of months. Late last year it was purchased by Lowell who i strung along until it was SB and they've since passed it to Fredricksons and now Bryan Carter who've just sent me a letter advising me to pay (not a chance) or they'll issue proceedings in 14 days without further notice to myself. I've seen on here that they try to bend the rules on SB and say it's from the date of default etc. which we know isn't true, even if they took me to court i think the time will have passed for both SB and the default will be gone. Is there anything i need to do in respect of this letter do you think? Their letter is dated 30/4 and has conveniently just arrived today saying i need to pay by 14/5. Thanks
  15. Hi, I'm struggling a bit with this concept. I understand what can make an agrement unenforceable (prescribed terms) but I can't get the following things despite spending ages trying to research it a bit: 1. Is there a process to follow for me to challenge these agreements in course. I have already asked for a few CCA's but no company has provided them to me, they've sent me the copy of t&c's (one company admits they canot locate the agreement) 2. If there is a process to follow, and the agreement is unenforceable then surely any record of the agreement must be removed from my credit record? 3. The case of Wilson Vs First county (also sec of state) allowed the lady to keep her goods and the loan was written off, this is law so surely that can't be challenged? 4. What about these companies who offer to clear all of these debts, what are they doing that I can't do myself? Or, wuold I be better going to a solicitor on a no win no fee basis and let him charge all his costs to the banks? 5. What risks are there in challenging the banks/credit card companies etc. This has all been genuinely been puzzling me for weeks so any help, advice or information would greatly appreciated. In fact, templates of letters to send/copies of court summons would be ideal as I'm ready to take on these companies now. Once I start I will do a thread for each company in the relevant part of the forum for each company. Many thanks. ss
  16. hello all, crikey it's been a while. Really took my eye off the ball here with this bunch of clowns. Anyway, i've been so busy with other things but I haven't finished with this lot yet. I still owe them money, unsurprisingly but I'm ready to go back at them. I just want to be really awkward with them as theymade my life a misery for so long. I'm back and ready for action - Watch this space !

  19. write to them under the consumer credit act and ask for s signed copy of the agreement and see what they say. they only have 12 days to respond to the request so could be interesting. After 30 days of not providing it they have committed a criminal offence as far a i am aware so my advice owuld be to play it by ear and see how you get on.

  22. jusr deduct the £400 from your spreadsheet, as you don't know what it's for then just deduct it from the most recent charges and this way you'll still et the most out of the old charges

    As they have refunded £240 but not actually told you what it was for, deduct the interest from your most recent charges and remove the most recent charges. This way you maximise your refund from them
  25. give him a call. he will more than likely agree to refund the charges plus interest so it would save you the hassle of issuing a summons. I personally would give him a call before the weekend
