Hi folks Had most of my money back from nationwide after court action, but they refused to pay it all, so I went for judgement, and have now had the warrant for the bailiffs issued. however I now have a court date for the last couple of hundred that they want to defend. Apparrently the bailiffs will still go in can't wait! Also sent in first letter re my other account with Nationwide, as I now have a parachute account, and they wrote back saying couldn't do anything because of this test case, so called the court and they told me to just continue, as even if the cases are stayed, it will still be in action when the final outcome is known, so go for it, don't hold back, you have nothing to lose.

  4. MBNA dealt me a very srious blow. After massive charges, and a redundancy we made a plan for payment, and then we had to pass our affairs to a debt counselling service, where we arranged to paya smaller amount each month, and eventually they managed to get MBNA to stop adding interest. This continued for several years, and then out of the blue after they had sold the debt, they must have found out that we were struggling and had put our house up for sale. They went to court (without our prior knowledge) and we were served with a CCJ. Despite the fact that we had been paying for several years the judgement was for £2k more than the original debt + charges, charges, charges. Unfortunately they got their money when we sold the house. On discovering this site I decided to go for them. I sent an SAR for information on the whole history of the account. Along with £10 fee. I received back a statement which only covered a couple of years (with the extra charges omitted) and no mention of the huge charges added on when they went to court. I call them today, and asked for the whole history of the account and they insisted that they don''t have it they can only go back 6 years and they don't have to give me anything after I put the account with the debt counsellors , and that is all they are required to do in law. Can anyone offer me advice on this. blidge

  6. Darling, thanks I will find out from the court and do as you suggest, then I will go for my other account with them, and maybe even go back with both pre six years. All these charge really screwed my life, and eventually cost us our house, so I am on the war path now!

Hi My account Nationwide did the same to me, and the final day for them to register their defence is in abut three days time, yesterday they paid money into my accoun, and I received a letter saying they were not paying the full amount, and sent their schedule of charges, and they had calculated from April 2001, as it was six years from the date of their notification from the court, although I am claiming from end Jan 2001 as I first wrote to them in Feb 2007. Today I rceived a copy of their defence from the court, which states they are not paying me anything as I am not entitled to it, duh! they have paid me some of the money, so I will be going for the rest of the money. Tnhey appear to always respond at the 12th hour, so hang on in there you will get your money.
  8. Hi Darling 1 thank you for your advice, interestingly enough I received an allocation questionnaire in the post today from the court, which I have to rely to by 30th May. I have found one charge for £31.00 which they did repay, which I hadn't noticed before. I have gone through their list of charges, and although £81.81 of them they haven't included because of the date difference. It still doesn't add up! their amount of 8% interest is different as well! Would you now advise that I reply to their letter, and suggest that they repay the rest (minus the £31) or I wil continue, or complete the allocation questionaire(fee £100) They have entered a defence saying that I am not entited to anything, and then paid me!!! how odd is that. blidge

Just read your thread, as I receied lettr from Nationwide today telling me that they have paid, and as it is not the amount I calimed I must prove it, however, I notice that I started the claim from Jan 2001 to Dec 2004 and they have started their list of charges from April 2001 to March 2005!!. Also the account went to collections in Jan 05, after they put on loads of charges, and then most of them were refunded. However in their schedule they have put these refunds against my figures to make the total less, even though it was not within the dates I was claiming. I am also guessing that as they haven't replied until April after the court action, they are only taking the six years backto April 2001. How should I proceed to claim the remaining £435.13?

    Fron what I have read on this site, they all say that, but if they wish to put a defence in court, surely they must have a way of checking back further?

  12. We had to sell our house last year, to avoid having it repossessed due to horrendous debts. We had been paying MBNA for four years after puttoig ur debts with DCM, when they discovered we were selling their debt collectors decided to go for a charge on the property, and it all happened without our knowledge. There was a delay in us finding out as they didn't sdupply the correct information, and wrote not to us, but to a girl in the office at DCM (who had no idea what it was all about!) so we only discovered it when the court wrote to us to inform of the forthcoming judgement. The original debt was some two thousand less than the amount of the charge (despite the four years of payments) However the charge was satisfied a few months later whenthe house was sold, and we out it down to bad experience. However when we tried to open a parachute account, because of our current fight with Nationwide, we were refused, and having our dredit file from Experian we couldn't understand why, as there was nothing untoward about it. We then discovered that MBNA had not recorded the CCJ satisfied, and that the record only appears on the property registry. I have contacted our solicitor who paid them, and he says this is completely out of order, and is writing to their solicitor to demand the satisfied CCJ is recorded. In the meantime, I do not have any statements, as they were all forwarded to DCM who don't have the anymore. How far back can I request statments from MBNA, and how likely am I to be able to get the unfair charges back, as this extortionate debt is now settled?
  13. Yeah I'm up for that, when we nearlky lost our house last year to repossession (due to omgoing charges from everyone) and had to sell, they got £10K from us for nothing!
  14. Nationwide didn't reond to initial letter, or to LBA, filed paers with court, and wednesday is the final day for their response, so anxious. Tell me did you get any resonse from before the final date after filing at court? Blidge
  15. Hi Jamorgan Still watching with bated breath. We had to sell our house, as I told you before, to avoid repossession, but if we hadn't had to pay the ERC we might have had something to put down on something else, Good luck Blidge
