  1. I'm sorry but IMHO there's absolutely no point in contacting Ofcom regarding nuisance calls from Cap One or other such companies. Ofcom exists as the regulatory body for the telecommunications industry within the UK, members being telecom providers such as BT, Virgin, Thus, C&W, ITV, Sky and so on. Cap One is merely a customer of one of these member companies - not a member itself and therefore Ofcom has no jurisdiction over it. Ofcom's site has the following to say about nuisance calls - and I'm sorry about this because I'm sure you've all already read it... Ofcom CAN help with unwanted sales and marketing calls but I'm sure Cap One would argue that their calls aren't in this catagory! Whatever you do keep a diary of the dates and times you were phoned together with a brief note of what was said on each occasion - you'll be asked for this info by the malicious calls team! Good Luck and tip the scales if you appreciate the typing - it took forever! Going to rest my aching fingers now! Cheers, C PS I know nothong of the law aside from what I've learnt here - but have worked in Telecoms for some 28 years, take advice on it, but I believe that what I've said is correct - honest!!
  2. Hi All, Lloyds' statements turned out to be an A4 list of charges with a letter inviting me to prepare my preliminary request from it and get this back to them ASAP! This sheet shows several charges of £7... anyone know if this is the monthly account charge please? Don't want to charge them for a real service! Thanks! C
  3. yikes!! MORE statements! seem to be copies of all 400 sheets though.... hmmmm.... wonder if I could swing another batch, I'd have 3 complete sets for the bundles then!
  4. Thanks Gary... but get yet another different set of answers from this sheet! Think I'll stick with Vamp's #13 and amend to give a couple of rates - just to show the judge I've thought about things! Cheers, C 8)
  5. Crikey!! I've turned psychic! lol Statement of charges arrived today with an invitation for me to proceed with my claim! What nice people!
  6. Ahhh... another letter from Ellie Renshaw... I think I'm falling in love! Ellie's final offer is still open to me - but is her final response as she wants to save the court's valuable time... yeah, right lol Can someone please help me out by checking the CCI element of my claim? I want to check the amount of interest on a £20 fee levied on 28/08/03 at 30.9%... I make it £46.40... any advances/help please?! Thanks! C
  7. STILL only 33 days!! Maybe the information will come tomorrow!! C the Optimist
  8. Hi All! Should have sent Cap One an LBA a week ago but first came the postal strike and then the printer's cartridge ran out... grrrrrrrr! Could somebody be kind enough as to check an interest calculation for me? I've been reading Electric Lemon's thread and want to check if I'm charging CCI or not before I pur printer to paper as it were... Think I'd only need one transaction checked to prove the rest... Thanks! C
  9. Hi All! Request for Payment was received by NatWest on July 10 and this morning I've received the usual 'sorry, we're looking, but it'll take us a month of sundays' letter... What's the best thing to do now, let them have an LBA or write and tell them I'm prepared to wait for x weeks as I'm mindful of the additional load placed upon the courts by similar claims, but feel that I cannot extend my timescale beyond this... Thought the court might take kindly to that when they eventually see it is there a similar letter anywhere around? Anyone spotted one.. or something similarly ingratiating?? lol C
  10. Many congrats on your win!! Have just sent a refusal, was going to combine it with an LBA but it was too late last night to think.... and this way, even though it'll cost a little extra in postage, it'll stop me getting confused! Don't know if they were offering it in 'full and final' settlement (not that it makes much odds!), as they forgot to enclose the acceptance form which I assume had all the details on... doh... Thanks for keeping an eye on this - makes me feel as if I've a lot less chance of screwing up! C
  11. A letter from Ellie Renshaw! Ellie confirms that Cap One "automatically add late payment fees if your payment is missed, arrives late or doesn't cover the minimum payment"... odd, I thought that was all done by hand, hence the high fees! lol Rest of letter looks pretty standard, £20 fee is just, OFT haven't challenged the right of banks to charge default fees, yada, yada, yada.... Goodwill offer of £350... lolol the claim with CCI was for £2,500 so that'll be a refusal sent first thing tomorrow and an LBA on Wednesday And Ellie didn't even sign the letter personally - I was hoping for something for e-bay!
  12. ahhh.. only found the 'Log Out' button tonight so think I've been logged in for a month or more! It threw me out while I was running through other threads looking for an amended template.. (same error message as you) but wierdly did let me back into my own thread.. most odd... :-| C
  13. awful's the word.. had just found the template I'd been searching for!! :o
