As Gary suggests the hearing will more than likely for you to put forward your case for lifting the Stay....Be prepared, stay confident but do not get complacent...if the judge sees you have done your research he may allow things to swing in your favour. DO NOT expect an automatic lifting of the stay.. Good luck
  9. I hear what you are saying, and a large part is down to the individual judges. Like you say Barclays were ordered into court after saying that they would settle before any hearing and of course didnt turn up. I think a lot of this totally depends on the attitude of the judge which to a degree does show a hint of inconsistency withing the court system. If we can get together and compile a document that shows Barclays to be admitting they have no intention of attending the final hearings then we can wipe the floor with them.

The trouble here is verbal promises mean 'jack', unless we can get these comments in writing they mean nowt. barclays employees can have O/D's but they dont like it, they cant 'not' allow it as it might be seen as discrimination against an employee. Can anyone who has received written confirmation that the bank is prepared to settle out of court please post it here so others can use it in an attempt to lift a stay etc. Esp if you have an email / letter stating they have NO INTENTION of attending court. Telephone calls would be deemed as hearsay but are welcomed to be posted too. It will all help to boost the morale of claimants currently stuck in limbo. Thanks in advance for your input.
  16. To be honest with you guys, I tend to agree with Saintly [again !!!!!!] It has been common practice for banks to back down on new charges applied once confronted. but only as a 'one off basis'. It is already accepted that if your account has had no charges applied within 12 months they will waiver the first one but continual charges, not so sure. It may be that banks are authorised to issue refunds once court proceedings have been started but even then prob have a limit. Again IMHO I think this is a case of Chinese whispers that started by one person getting 'ONE CHARGE' repaid. As soon as I get a reply [from ANYONE] I will post here and put everyone out of their misery LOL

  18. What you should do if you have got internet banking is go into your details of all payments going out of your account/s. You can cancel them there on the spot and no more payments will go to the payee until you re authorise it. this is useful for mobile phone insurances etc when you get the first three months free etc. if you have cancelled it and the bank pays it, you are entitled to get it refunded and any charges incurred. Also A direct debit, once left your account, can be 'reversed' if you notify the bank within 24 hours.
  19. I agree with Slick The OFT have a figure in their heads and if the banks agrees to lower their charges to this amount then they will call off the dogs. The banks, as we know DO NOT want to go to court so more than likely will go along with the lower amount. This does NOT mean you have to accept it, after all we have been shown it costs no more than £2.50 to administer the charge so anything above that is clearly profit and according to the Code of Banking should not be allowed. It is annoying that they have applied blanket stays and there is very little we can do at the moment. Hopefully they will agree to the lower amount so the OFT mallarky will get dropped, allowing the cases to continue. In my opinion, I dont feel the OFT have helped things AT ALL, theyve just got in the way.

If a complaint is to be made to the Police, first, check out the area of the incident to see if it covered by CCTV, also check out the area the subject was 'dumped' If it is you have the right to view the footage if you were involved. If his friend was arrested by the same shift then there will be a record of the OIC [Officer in Charge]. Also there will be an OIS No. or similar to view the footage you will have to make a formal request to the Data Controller who is in charge of running the system. Usually a fee involved [£10+/-]
