  1. Yes. Its actually a claim for my son so is in his name. I dont expect they will speak to me so will have to wait for him to come home. Will advise later. thanks!

  3. I have a Cap 1 claim which I took as far as county court in May 2007 . I have corres as far as they had filed a defence and I think it was stayed (in error) but cant find the letters. I had personal problems at the time and didn't take it further and have only now been able to get back to it. Can I still pursue it? Whats the best way ? shall I recalculate it all and start again?
  4. I got a notice of stay from Lloyds but thy sent me an offer about 3 weeks ago which I accepted and returned. Can they now stay this or can I oppose the stay because they have made me an offer which I accepted and they have had acceptance, although I haven't had any money yet.
  5. I have 14th August date in Cardiff with 2 claims of my own (barclays and tsb/lloyds) and one for a friend I am helping. I am going to phone them this week and say i've got a court date and see if they settle

  8. 1. You have to pay fees up front - you will get them bck from A & L when you win - they should pay these with final amount. 2. Monthly overdraft charge - I understand from reseaching the site that the standard fees(shown as monthly OD charge) are not reclaimable. If you have an agreed overdraft you are actually borrowing money from the bank and they are entitled to charge you interest on it. You can claim for unauthorised overdraft fees, returned debit and Standing Orders etc
  9. I have just discovered a whole batch of charges I didn't claim for cos I didn't know I could. Do you recommend I amend current claim? currently in court waiting directions hearing in August.
  10. depends on how much the claim is. I had to pay £120 for mine (over £3000) but its less for smaller claims.

  12. had a letter from Cardiff County Court yesterday. totally ignored my new strategy AQ. It says- Upon the Courts own motion. The Court has made this Order of its own initiative without a hearing. If you obect to this order you can apply to have it set aside or stayed within 7 days... Before judge etc............ IT IS ORDERED THAT 1. Directions will be given in his case by the Designated Civil Judge , His Honour Judge G Hickinbottom, on the 14th August 2007:( at 10.30 am etc..... 2. The parties may appear in person or make written representations as to how the case should proceed provided a copy of the representation is sent to the Court at least 7 days prior to the hearing. Is this the date I have to send my court bundle off for?

  15. no you cant claim normally claim the monthly overdraft fee or the overdraft interest - they are authorised charges by the bank for you having use of an overdraft. You can claim returned direct debit/cheques etc. suggest you start your own thread. Non-one will find you attached to mine. Go to the bank charges front page, scroll down to whichever bank you're claiming against, click on it and start new thread. good luck!!
