  2. Big white envelope landed on my doorstep today and inside as requested are my statements 1995-1999 !! Time to re-check my calculations, give them one more chance to pay up (ha ha) issue a final letter for payment, before filing my N1. First time of asking, dont know what Dar£n was playing at with his SEVEN envelopes, maybe he was running out of wallpaper !! TCOM

  4. ** Update ** My claim is as two stages. 1. I have my charges from 95-99 on a spreadsheet but no longer have the statements so requesting new ones. 2. Also have requested refund of charges whilst still waiting for statements. So, After a patient 6 weeks I decided to contact B's on 0800 282390 to enquire where my statements were. Spoke to a very nice lady called Maureen (not 118 118 before the jokes start) who apologised for the delay and promised she has logged my complaint and passed it on, (complaint ref. provided) I stressed to her I only require statements 93-99 and she said they were already aware of that and that I would not received any others...should have them in 2-3 weeks she stated. Think I will issue them a one week later for refund (he he) then proceed to MCOL and leave my claim there for the forceeable future !! Regards TCOM

Hi, Returned from my jollies to find a nice standard letter from B's stating that in light of OFT case B's have placed my "complaint" on hold (to gather dust) until the outcome of the case is known. If I continue they will apply for a stay.........no problem, LBA to be sent today. Time to research SoLA even more thoroughly !! TCOM
  6. Sounds like the standard fob off letter volks. I would personally send a further letter stating that you are disappointed that they have not responded positively and maybe allow then a further 7 days to review their stance otherwise its court proceedings. TCOM
  7. Hi Welshcakes, I totally agree, it would be beneficial for us (you, Daren, Volks, Oneofakind and others) to pool all our resources together, to reach our common goal. I am probabaly the least informed on the legal side so I will do a bit of swatting just in case. Thanks for the advice, looking forward to this in a sick way !! TCOM;)
  8. Request for payment sent off to B's. By the time I get my actual statements thru I will probabaly be at court stage ! I suppose it like making an estimated claims but with the true facts. My LBA is already typed and raring to go (thanks to welshcakes for the excellent letter supplied on volks thread) in 14 days time. TCOM TCOM
  9. Hi Daren, Thanks for the advice, its appreciated. I am in the process of reading up on things now. My account was opened in 1993 therefore, am I right in thinking I have more to rely on than just the UTCCR 1999? As you say, we need to understand the basis for our claims pre 6 years. All help and guidance is welcomed !! TCOM
  10. Already there saint. I have copied the letter provided by Welshcakes and doctored it to suit my needs. Its an excellent letter and will be sent off to them in place of the standard LBA. I will be sending it in 14 days OR as soon as I receive my fob-off letter from B's. This is moving quicker than I thought.....ha ha. Thanks again for your help. TCOM

  12. If you look at the bottom of the spreadsheet you will have three headings. Notes Charges and Interest 8% Interest. You complete the "charges and interet" one first. You include your charges from your statements and what "overdraft interest" you were charged (this is usually stated at the end of each month) also on your bank statements. Once inputted this will automatically trasfer to the 8% interest spreadsheet which will show... CHARGES INTEREST CHARGES 8% STAT INTEREST TCOM
  13. Hi Volks, Ive just sent off my SAR for my statements from 1995-99. They hold my data for only 12 yrs per a letter I received from them in Feb. By chance I found a spreadsheet I had done in Feb which held a list of my charges form that period. Im sending my Request for Payment letter today and no doubt will get something back like you have. I don't care if they wont look at charges from more than 6 yrs ago.....they never offered my anything during my first claim. 20% of my charges in my first claim were from 1999 (over 6 years) and they paid me in full. If they are not prepared to look at it, Im sure The Litigation Team will and maybe a nice judge. Stick to your timescales and read up on the Lim Act, I am. Section 32b should be enough to keep them quiet for now !! Keep an eye on my thread and I will yours. TCOM;)

If you have completed your spreadsheet and included what interest you were charged (this would be on your bank statements) then the spreadsheet automatically calculates the exact amount you can claim. So: On your spreadsheet you should have a column with charges and a column with the TOTAL intested charged for the month and a seperate column calculated automatically with the amount you can actually claim. Added on to that total of charged and interest will be the 8% statutory interest you can claim. Dont forget to include court fees etc. Trust this explains it for you. TCOM
  15. Result...... This should be fun. What are the major stumbling blocks saintly with a claim of this nature, is it the Limitation Act? Surely B's won't refer to this act again. They did in their defence for my first claim but after I sent them Section 32b I never heard a word and they settled in full. Anything else I should be reading up on? PS. How's yours going? TCOM
