  1. Got the statements today, just entering on s/sheet. In July 04 alone they charged her £460.00!!!! From 16.1.01 to end of july 04 the charges are £2698.00, Plus the £3,000 odd for 05-06. Absolutley disgraceful! Dotty's going to have a well good time when she gets this back!!

  4. OOh sounds a bit creepy! Seriously though, thanks one and all for your support, I'm sure I am going to need it. ( Hopes theres a bottle of red in there somewhere for moi when it's finished ) It's just a waiting game now, I expect the bank will wait the full 40 days!
  5. Whilst I remember, I had a lot of sheets of labels with 75 small labels on them. I printed this on them 'Reclaim Unfair bank charges www.consumeractiongroup.co.uk' I have stuck about 40 up to now on ATM machines where I live Wonder how long they will stay there.

  7. Hi Sarah, Those are just the charges from the dates above. I have not got the full set of statements yet. The 3418 + 412.91 is just the charges from the only statements Dotty had, I assume there will be a lot more when the full set arrive. Today, she asked me if I would go and see her friend as she banks with the Nat west and thinks she has over £4000 of charges! Looks like I'll be the darling of the local WI. I will have to stop at this though, I've put my claim on hold for now. As much as I'd love to help, I am going to have to say no to any more.
  8. Hi Willow, I think it would be settled much quicker if it was, but I have to take Dottys health into account, she has suffered under these thugs. But her time will come. When she receives her cheque, I am going to photocopy it onto an A4 paper with her story and stand outside the RBS bank handing them out.
  9. Quick update. Dotty asked for her statements from december last year just up until the account was closed in June 06. ( sigh) Not to worry, my S.A.R - (Subject Access Request) is in their hands! BUT............... It looks like they are still adding interest on each month as follows July £45.07 Aug £30.24 Sept 35.25 Oct £ 35.23 Nov £ 34.95 Total £ 180.74 !!! I have statements now from Dec 05 to Dec 06 and the charges are............. £ 3418.00 + £ 412.91 interest!!!!!!!!!! This bank wants closing down. I have never come accross a case like this before. Poor Dots is a 78 yr old disabled woman. I am bloody furious.
  10. Except of course it is a Ltd company, then the DPA does not come into it.

Which do you think is the best option? 1) Asking the judge to strike out the defence ( as in the Lincoln cases) or 2) Submitting the new order for the bank to supply the info in 14 days as in BF's thread - New strategy for Allocation Questionaires They are both good tactics, which one do you feel is the best way??

  13. Ian, did you get sorted? That was some complicated defence. I have a claim for an old lady going through, hope I don't get that reply, I wouldn't have a clue what to do. Best of luck Destiny
  14. You have issued a N1 claim and posted it. The next day you find that 25% of the total claim ( before the 8%) has been put into your account without a word? Do you have to a) Stop the court process and redo the claim taking off the money b) Leave it as it is c) Write a cheque out for the money and send it back to the bank and continue with the claim d) None of the above? Thanks o wise ones!
  15. Thank you all. BBC thank you for bringing this to my attention. However, my dear old friend is now a nervous wreck after being dealt with by the DCO and the bank and this would probably take her over the edge! However, I do feel that when this is over, she may consider making this public, but for now, I do not want to cast her into the media spotlight at this sensitive moment in time.
  16. The DPA does not cover a ltd company, as the company is then an 'entity' in its own right. If the company is a sole trader or unincorporated partnership then it is covered by the DPA. You can ask for statements but not mentioning the DPA, but banks say as it does not come under DPA regulation, they can charge £5 per statement. I was wondering if there was any other way apart from this

Sent off S.A.R - (Subject Access Request) to RBS for the 4 accounts Sent off letter to DCO telling them account is in dispute and under NO CIRCUMSTANCES should you contact her direct, under the OFT guidelines, you must now deal with me. Waiting .............................
  19. For a Ltd company from a bank? As it doesn't come under the DPA, they are going to charge £5 per statement. Any other way of getting them?
  20. When you win (and you will win) your claim then you ask for it in the form of a cheque (Cobbetts, RBSs sols usually do this anyway), make sure that Cobbetts are certain of this. Can they refuse to do this? If they pay it direct into the account to pay off the balance, they will argue that it has been paid and there is little the poor lady can do about it.
