Thanks for the Help Buzby, after nagging the CRA they have nagged 3UK to provide information, 3UK have finally responded by saying they have lost my file/paper work and will remove the default (no paper work as there was no debt more like!) Experian have just confirmed over the phone that it will be removed in the next day or two,

I was referring to the accuracy of the adverts placed, trades description was around back then it isn't a new thing, yes if you’re a trader then the trades’ description act applies. I should have separated the two items more clearly I apologize. The definition of a trader is not as clear as people like to make out selling a couple of cars doesn’t make you a trader. Not that any of this is of any use to the OP as I think it’s fairly clear that the seller is trading.

Sorry but 10 cars over 2-3 years would not be classed by either the Inland Rev or DVLA as a trader, a year like this guy then yes pretty sure they will class him as trading. Have you worked out the tax on the price of cars he’s selling? Hardly a big fish at the moment for the tax man to chase. The OP has a far better bet dealing with the TS to get his problem resolved, if he can get them interested in the fake clothes too then that’s all the better . As for me like I said I’m no expert (I know far more than ordinary Joe about cars, but no expert) I actually contacted my local council many moons ago as my parents were worried about the change of use of their home address, I was assured at the time that unless I sold over 6 a year they would not class me as a trader. All adverts had to be accurate (obviously this one on eBay wasn’t) and were subject to the trades description act back then as well.

Application for a Charging Order to late?

Can he still apply to get it set aside as I though it had to be within in 7 days of the CCJ which by the looks was the 1st of June? Dont think he responded, keep his head well burried in the sand, which is soooooooo frustrating. Going to do some reading thanks for the pointers. -

I think it does have a CCJ as the second page reads “on 1 of June 2007 A District Judge considered the application of the claimant…..” it then goes on to list 3 points. It was a Halifax credit card that must have incurred fee’s as he didn’t think it was anywhere near the figure they have quoted as being. Thanks for the prompt reply. -
Not sure if it’s too late, but any advice would help, a family member has been given an Interim Order and an Application for a Charging Order from a DCA from an original debt owed to the Halifax, the application is to be heard on the 27th of July, the sum owed is £2267.54 is there anything that can be done (other than paying in full, which he can’t do right now) he has buried his head about this one as he wasn’t sure how much the debt was originally. Am I right in thinking that the Application of a charging order is to place a second charge on his house, however they can’t force him to sell (which the DCA keep threatening) as the mortgage company have the first charge on the house. Is there anything I can do to, delay even stop this charging order, he isn’t trying to dodge paying his debt (even though he’s not sure how much it was originally) but I fear he has left thing to late.

I will have your charges verified with Customer Relations today and will send a you a settlement letter in the next day or so. If you have any enquiries then please feel free to give me a ring on 0207-116-1943. Kind Regards Dino Papaevripides Letter arrived next day, total claim was around the £3.5k intotal.

Wife got hers back a couple of weeks ago, she emailed them got a reply in the post the following day, claim was settled in full, plus intrest plus the daily rate was addedcorrectly (more than I added it up to be ) went into her account about 5 days later.

Why is it his responsibility to prove he isnt, and to whom? were the 10 cars sold in the same year? also the reg no's would be tracable to previous owners, but if he hasn’t registered them, just allowed people to sell through his eBay account then this would be of little use. Not wishing to be a trouble maker but I’m very interested as I always wondered what if something was wrong with one of my cars I sold, thankfully I was always truthful and received no come back, but I don’t know everything about cars so could have easily missed points. I hope the TS will do a thorough job on him as I think you’re in the right.

Dont the people that scrap the vehicle have to inform the DVLA aswell, my father has had the same thing happen DVLA Swansea sent a letter saying thanks for informing us blah blah, then a fine from some other office of the DVLA arrives. :?

Not wanting to stir it up, but you have far more faith in your TS than I do. Can you prove he is a trader and how many cars has he sold, and not sold through his account for friends or family (do eBay prohibit this?). Many years ago I used to buy and sell from auction and would limit myself to 6 cars a year and I would always register them with the DVLA , but if he isn’t registering them how can you/TS prove he has been trading and selling them on? Sorry for all the questions and I hope you get a satisfying outcome as sadly this happens all too often with private sales.

My wife fell for this too, at no point whatsoever did they say the contract would be renewed, they offer was supposedly as she was a loyal Orange customer and she was entitled to a free upgrade, she took this on its face value as she has been loyal to Orange for the last 6 years plus the person on the phone also said they were from Orange, I can confirm this as I’m only 3 months in to my contract and I got the same call from “Orange” yet I’m totally un-loyal and go to which ever network offer the best phone or gift, it is very unfair and very misleading and becoming increasingly annoying, some of the companies do tell you they are a 3rd party acting for Orange but many don’t.

Still ongoing, Experian have at least placed a comment on my CR, what use that will be I’m unsure, however they still haven’t had a reply from 3, when I asked what they can do next as I was told that no response after 28 days they can remove the default, the lady I spoke to now stated that there is nothing until they reply! They can’t remove a default without the companies’ permission and I was wrongly informed!!! That’s 3 months they have had. Starting again fresh and sending my S.A.R however I don’t have my original account number as I shredded all my old phone bills about a year after closing the account, will this matter, can and will they accept my address as enough information to retrieve my account details? Looking back on it this could be why 3UK haven’t replied? Thanks James.

Thanks, I phoned up to find out who was dealing with the case (Dino) then sent a polite but to the point email, within the hour he emailed back saying he would look into it and confirm the charges, in the post this morning is a offer letter with £40 more than I thought my claim plus intrest would be , very happy with them just wish their employer would change their policy and settle alot sooner.

Doesn’t take much but I’m a bit confused, just got back off holidays, to find the I too have a hearing on the 14th, just printed out the letters to send to the court and Barclays but on the order of direction it gives 14 days to submit the relevant details (statements etc) is this correct? Also has anyone else had Adrian StJohn deal with their claim?

you dont want them to enter a defense (and they wont) just enter your claim for judgment on the day and the Halifax will have to pay.

Sadly I don’t have any documentation from 3 as it was several months if not a year before I was made aware of the default and I had shredded the phone bills, a default notice would have been dealt with asap as we were repairing our credit rating to start our buy to let properties. The original amount they say I defaulted on was marked as settled after my first complaint to the CRA’s which confuses me as I had never paid anything after my final bill. Would a SAR be of any use to me, this should tell me where they think the money is owed from? To be honest I have been concentrating on removing the default as opposed to finding out why they think I owed them in the first place. One of my main reasons on leaving 3 was their poor customer service.

I agree, but 3 do not respond to my letters or phone calls so my other option was to ask the CRA’s to question it, however obviously they don’t have to have proof of the default just a response from 3 which is more than I seem able to do. I suppose it was in hope that 3 responded to them as efficiently as they do with me that would be one way of removing the default.

Well I have a reply from Equifax, pretty much the same as I received last time with them, my big issue with 3 is that I didn’t owe them the £82 in the first place so I don’t want it shown as settled I want the default removed, the response I received was so typical of “the computer says no” attitude large companies are taking. “I have conducted a full review of your 3 account and I can now confirm that your Credit file has been amended to show outstanding balance has been paid and account is now settled. The payment history will remain on the credit file as a true reflection of how the account was managed. Please note this can take up to 30 days to take effect. Regards, 3, Credit Referrals” Word perfect answer to my last complaint to Equifax, another thing that has annoyed me with this is the way Equifax close the issue with the statement “solved”! It’s far from that. My only hope now is the nice guy at Experian doesn’t receive the same cut and pasted email.
