  1. I started my claim a long time ago last year and then I read lots on this site. However I am a bit rusty now and would like some info. please. My claim is against RBS for a total of 7087.05. 1506.76 being charges, 5330.29 being contractual interest and 250 court fee as I completed MCOL 30/03. Some months ago I received an offer of 1807.35 from Cobbetts on behalf of RBS. I cashed this cheque and spoke to the court as they(Cobbetts) were asking me to sign a notice of discontinuance stating that my claim for interest would be unsuccessful anyway. Courts stated that it was my choice but that unless I was going to discontinue my claim that they did not require anything from me. I have received a letter from the court dated 3/10 which encloses a pre-trial checklist(how do I complete this??) and adds that there is a listing fee of £100 and a hearing fee of £500. But I have already paid the MCOL fee 0f £250??? Cobbetts have sent me a letter stating that they will write to the court seeking an order that the rest of the claim be dismissed. When do I prepare the cort bundle and when is it sent to the court? Will I have to pay the additional £600 Help I'm in a right pickle and as I am planning to get married next year I can do without shelling out £600 which I have not got

  3. Capquest were unable to provide a copy of my CCA and therefore they are referring the debt back to the Royal Bank of Scotland. They advise me that they are going to send a cheque out to me. I should have it by tomorrow.
  4. Just to update. I have advised trading standards and they are looking in to the matter. In the meantime Capquest were unable to provide an agreement to my CCA request and they have said that they will return all monies that I have paid them. They have returned the debt to the Royal Bank of Scotland. Evidently they have no agreement either thus unenforceable debt. However as this relates to a bank account and its overdrawn balance and the fact that I am presently pursuing a claim on the account then I assume that they may settle after having taken away the debt.

The charges I am claiming are broken down as such: Parking fine 95.00 initial letter 12.00 bailiff fees 126.00 VAT 24.76 card fees 4.26 Payments received 105.00 Evidently this would have covered the initial parking ticket, however , they have sent the debt back to the council. Do I proceed with an MCOL for the payments I made or do I ask for a SAR so that this is broken down and I can see where the bailiffs attended and thus their justification for the fee.
  6. Have just spoken to someone who states that there was an incorrect trace and that they will refund my money after she has passed it to another department. I won't hold my breath!!
  7. I requested a copy of the CCA. They have been unable to provide this and within my letter I asked for clarification regarding the power of attorney they have ignored this point. They advise me that they are referring the account back to the RBS. How do I proceed now? Should I demand the payments back which I have already made to them. Who do I report them to for processing my data without the agreement and holding false information about me relating to the power of attorney.
  8. You could add contractual interest from your preliminary, some people have been successful with this. Check with Halifax what their various rates are, I used 18.5% .
  9. I sent my CCA request on the 15/12 to Debt Managers. Today I received a letter back stating that I neede to continue making payments and that they were awaiting my CCA request from their clients Aktiv Kapital. Now clearly they have defaulted on the monthly deadline and until such time as it is produced it doesn't have to be paid. However are they able to have my details if they have no written agreement in their possession ie from AK, and are they committing a data protection act offence. I have paid them £400 thus far. Shall I attempt to claim this back indicating the above information.
  10. Send a response advising that you will accept only as part settlement and that you will pursue the remainder through the Court.
  11. Today I received information relating to my SAR from GE (2 accounts). For one it seems to be in order with photocopies of statements. However for the other it is merely a sheet of paper with closing balance for each month details and solicitors fees and legal fees. Luckily I have almost a full set of statements for that account. If it gets to court it will be interesting to produce their paltry info. compared to mine. Will I be able to add the LEGAL CHARGES and SOLICITORS FEES> As far as I am aware they have their own in house team so any correspondence would have been sent from them and I'm sure they sent this debt to a DCA.
  12. What is MBNA rate? Have people been successful in claiming this?
  13. RBS have responded very quickly and efficiently to my SAR. I have clocked up my charges and I'm surprised to finf they total just over £2000. I have included their interest rate of 17.85%. Could someone clarify if we can claim the maintenance fee back, I have some charges of just £5 but they mount up and it was my £5 in the first place.
  14. I received a massive wad of paperwork from Abbey in relation to my SAR. The problem is it may as well be written in chinese. There is a lot of information on microfiche and many letters which cover the history of the account. The house was repossessed in 20003 when I was unwell. I didn't ever respond to any letters and was in hospital for a period of time. I did have payment protrection insurance but this was never initiated. I can't find a breakdown of any charges ( well items that are clearlry marked as actual charges). In summarys I have found admin fee £555, would this be a collection of charges or just a number they have decided on. If anyone has any special interest or experience I could send you a sample sheet for you to ponder. Number crunchers please help I would be forever grateful.
  15. I have 2 accounts with the Halifax. I have now received all my statements from 1 and am compiling them in the spreadsheet. I am applying for the return of my charges with contractual interest. However I went over my arranged overdraft for a couple of months, would I calculate my interest at the 29.8% interesr for unarranged or 18.9% for arranged overdrafts. Additionally on the last charge that has been applied 6 Jan the spreadsheet has not added interest ( is this because a calendar month has not passed?)
  16. I have recently received correspondence from these with a breakdown of their charges. I have written back informing them that I will be claiming these charges back, however,I did not stipulate the amount just stated 'full monies'. Do I know send them a LBA or should I break it down for them in a preliminary letter?
  17. I have resent ther cheque for £5.00 with reference to the letter I received. Would my 40 days start from when they originally had the cheque or until they receive it and cash it.

    I sent my CCA request off a couple of weeks ago. Do they have 12/14 days to comply or do I wait for a month. If they have not responded where do I go from there. Would I then send a SAR to clarify the amount they have taken and claim it back.
