i am just worried she could say she did not want to pay my uncle was very good to her after they split he volutery gave over £200 child maintance and paid the morgage also school uniforms ect... she never delared any of this. i have the documents to prove this. his youngest children are 15 and nearly 17 and understand the situation as the eldest sons have explain they will put money into a trust for them. so they have something for later life. my uncle would have wanted to provide for all his children if they had a rainy day. he loved his family which is why he happily paid for these things to the point he lived with me and my family. sleeping in a box bedroom.as he could not afford a place of his own. he was not a well of man i just wanted to be sure she would still have to pay because all we have heard from her is that she does not feel it fair to pay due to the fact my uncle died. she has remorgaged her house and part of the condition with the morgage company was my uncle signed his name off the deeds. which he did. she has confirmed in writting she has the funds both to the solicitors and to my uncle. i guess all i am looking for is reasurance that my uncle will not be walked on from beyond the grave. thanks for reading

hi thanks for taking the time to read this. my uncle passed away last month. he was divorced ( clean brake with neither party having a claim on the others estate should one pass away) unfortunatly my uncle passed away his ex wife owes £19,000 to his estate from his share of the house. it was agread as a full and final settlment to be given in 56 days. that was months ago. it has be proven via her solicitor and my late uncle that she has the funds to pay. and agreed to pay once his name was off the deeds to the house. which my uncle did so. he has four children two from his ex wife and two other children from a marrage many years ago. his eldest son has just applied for probate. which he intends to settle depts my uncle owed and then divide equally to all my uncles children. his ex wife now says she does not feel its fair to pay the money due to the fact my uncle has passed away. please please advise me HELP

yes please because we just dont know what to do and if the court rules in this chaps favour my parther could lose his job because he collects cash on his delivery round and thus a ccj claim saying he stole money would not go down well. we are at our wits end

my partner has not acknowledged this dept the first we knew of it was in january when we had a nasty letter from the man. the chap then aplied to get an enforcememt order which he got. so my partner aplied to get it set aside. we now have a notice of adjourned hearing which will take place in april. it says this hearing will take 1 hour. i dont know if this is still part of the set aside thing or not. it asks that my partner get witness statements which we intend to use to support the application.. do these have to be done on normal paper or is it to be done on a court form?? sorrt to ask so many questions but this is a nightmare for us we would have never got this far without all your help x what is staue barred?

ccj was awarded on this mans say so alone that he gave my partner £300 for cheep tvs!!!!! based on his word alone the set aside hearing was based on the fact that my partner was 16/17 at the point of hearing and the address where papers were sent my partner has never lived. the first we knew about it was a threatening letter from this man in january this year followed by two phone calls

the chap in question went to court and got an enforcment order we went to court for a set aside hearing then we now have another hearing what do we have to do? the papers were served at an address my partner never lived at and the whole case is based on a lie. do witness statements for defence have to be done on court papers?

hi all i am back to pick your brains lol. had a letter today for a hearing which it says will last for 1 hour. the letter says *application adjourned *then says claimant to file at court and serve on the defendant by 4pm march ** witness statements that he intends to rely upon in opposition to the application, such as statments to be endorsed with a statement of truth *defendant to file at court and serve on claimant by 4pm april * witness statements that he intends to rely upon in support of his application the letters say notice of adjourned hearing what does all this mean and what do we need to do now because we have not got a clue. i am sorry to keep asking so many questions but we just do not know and we need to stand a chance to prove my partner did not do this. please help

hi all i wanted to let you know that the ccj has been set aside. it has now gone back to the start so it can be heard again what happens with this and what do we need to do? also we wanted to say thanks very much for all your help and suport you have all been a rock of strength for us at such a difficult time

hello everyone my partner went to the hearing today and it went well the man in question kept on at the judge to allow witnesses into the court but the judge told him no. my partner answered all the questions so hopefully all will be ok. the judge said we will get a decision in the post. i dont know what happens next? what does everyone think?

the set aside hearing is very soon what happens at this? also we have managed to find out the whys to the case. it turns out its my partners step fathers friend. they had a big fall out years ago because my partner wanted to know the biological family. as sisters were raised with biological dad. the step father now claims to be a witness 11 years later this is clearly some sort of revenge having had nasty phone calls in the past week will the court take this into account? help someone x

hi all got a letter today from the court to say that it had been transfered to my local court and that they would be in touch is this a good thing what happens next?

does that rule aply to ccys that are 6 years old with no contact?

so as the dept has not had any money paid off it in 6 years nor has there been any contact i just send this letter to them and add on it i do not acknowlege the dept. then what will happen next . this site is great i would not have a clue about things like this

i checked with royal mail today and the court got the papers, what do you think will happen now i have never had anything like this before nor my partner its all a mine field

hi thank you everyone for all your help. the chap has got a warrant of execution. so i have been to my local court today and filled in a form to set it aside and also another form to wave the £65 fee as we get working tax and child tax and fall into the right catogries. my partner put on the form that he did not get the court paper because the address they were sending the papers to was wrong and he had never lived at the address also he put that when the claim was filled he was 17 for the arbritration he was 17 when the judgement was made he was then 18. so his point was that the case against his started when he was 17. also he added that the chap in question was not telling the truth about speaking to me on the phone and that he was very abusive we called the police i encluded the log number. he also said that this chap had not told the truth when he said my partner admited to him that he stole this money. my partner wrote he never took the money nor did he ever admit to taking the said money my partner added that if he had got the papers he would have gone to court and defended himself but did not have the chance as he never got the papers. so he could not have deffended himself. therefor the judgement was awarded on this chaps say so. its his word against my partners what does everyone think did we do it all ok. any help would be great thanks everyone you have all made this a little more bearable x

i phoned the court and they said i can pay £65 to get it set aside then provide details as to why my partner thinks he should not pay. the courts said they dont have the file anymore as its to long ago. i told the courts there has been no contact for 11 years. but i was told to pay the fee and give my side as my partner has never given his side apparently. oh this is a nightmare
