  2. Small claims limit in NIre is £2000.00, so you will have to issue a Civil Bill. You will not need a solicitor, but since I am not too au fait with this procedure, others will hopefully help

If you want to put it up here, when you havethis done then we can all have our tuppence worth on it. Dont worry too much about it.I can also get you a copy of the tand c which refer to these as penalty charges. It might be worth adding a statement such as "Indeed First Trust Bank, prior to 29/05/2007 referred to such fees as "penalty Fees", a copy of which is enclosed for your perusal"
  4. Well I am going to give this a go.Apparently the FOS have not had to adjudiacte on any cases yer.As sson as a formal investigation is launched (the stage mine is at) the banks then pay up. They have asked First Trust for quite detailed information regarding how they have come up with £13.00 for referral charge. If the FOS are unable to get my penalty charges back I will take it to court. Oh and by the way I'm not from Ballymena.lol.

  6. No and as part of the tand c of the loan there is often a term which states that you must have an a current account set up to service the loan. Why are they closing the account?
  7. Yes but The CompetitionCommission also made a big hooha about the main 4 banks in Northern Ireland paying little or no interest on current accounts. When you are in overdraft they also charge you overdraft interest, whi is wherre they should be making their money from. Current accounts do not need interests.Banks have realised that most of the younger generation are not in a position to save and as succh they tried to tantalise them with interest on the current account. These accounts normally have very strict terms and conditions and their penalties are generally worse than normal non interest paying current accounts.
  8. Princes trust has age limits.Also the government have a small business loan scheme which might help regarding interest payments. There should also be someone in local council to support new business, and they may be able to access sources of funding and training
  9. Hi Mary (no relation of duke are ye?) I received that letter from adjudicator yesterday, so am hoping that FT wil respond favourably and that I should get an offer within the next few days. I complained about my wee firms business account last Monday to Northern and will get offer today (unless its 95% or above) he can clear off. Just goes to show the difference in the ways that Northern Irish Banks are treating this! Good luck with it all, and perservere.Be thran
  10. Aye Mary, I think thhat their reasoning is that if ypouu have waited until their imposed time limits, that you are not really serious. I went down the FOS route, and my case is now with adjudiicator, and will be in touch by 12/07/07. It will be my flippin luck to be the first person where the Fos has had to actually make a decision on penalty charges. Up to you what way ye go with it, The court system now seems to be prestty bunged up as well. My letter went of to Ombudsman at the beginning of May, so am quite surprised at acutually jhow quick it haas reached this stage. Hopefully this will be a positive result and I can start to do some work needed on y house to make life more pleasant for myd disabled daughter!!!!!!!! The way in which First Rust have handled their complaints procedures, has really opened my eyes !!!

  14. I agree that it is awfully bad practice to include Bank Holidays as part of the holidays And that is why it will be changing soon!!! Ive temped, and run a non-profit taking recruitment agency and ensure that all my wee temps are fully awaqre of whta they are entitled too. Often it is the comapny they are temping for that makes them think they have no rights! GRRRRRRRRRRRRRRRR
  15. Aye, First Trust have noe changed their "penalty fees "in their t&c to read "unauthorised borrowing fee" from 29/05/2007. So though I would ask them via e-mail how this differs from their old (and yes published) "penalty fees" HEE HEE HEE

  18. Yes but within fiduciary arrangement, banks on behalf of all their customers invest in companies, something which they do take the iniative on. Say for their bonds etc, they decide who to invest in , that cannot be dicated by customers therefore on their own iniative to apparently benefit customers. Also they allegedly offer free banking to customers in credit means that they have taken thei niative to charge the rest of us to benefit them. lol

  20. The Bank is only liable, if he did not share password etc with anyone else.He bears a responsibilty to look after these. That is why I asked.You do not know the fine details of the case. I am sorry People on this forum , as intelligent human beings will make assumptions. We do not know your brother-in-law' nor you for that matter.Therefore, we will be naturally suspicious. Hand on heart time. Are you COMPLETELY CONVINCED that he is not culpable in any way for what has happened? Also if you throw scenarios like this onto an open anonymous forum , please expect differing opinions from your own. No one here was being deliberately antagonistic towards you, just trying to establish what happened. I suggest that if you do not understand the above, please do not try to find advice from CAG

  22. Cheques are not normally destroyed.They are returned to the customer. Not having that one. If they could not trace you (ahem , I assume they still had your phone number), and should have tried tracing you on their system (your accounts should also have been linked). At this stage , they would have then returned checks to drawers branch, saying they are unable to trace payee. Something very wrong there.Ask them to confirm their course of action in writing, including the destruction of the cheques, and their reasons for not making other attempts to trace you. Then complain
  23. Advice, You need to establish if ANYONE else known to him had access to these details. Whilst I appreciate that you think we are pointing fingers,you have to understand that the story does sound rather suspicious. On a number of occasions (when I worked for banks), people have made complaints about ATMS , card transactions etc, only to find out that they have given passwor, pin numbers etc to other family members who have then abused that trust.
