  2. HI. I have returned to my home but this is because I am on high grounds (ie upstairs). Many in my area are relocating and over a thousand people are leaving within the small area i live in. I have problems with dampness which i think is caused by water in the loft but can not get up there. We have been told this is a 1 in 100 year event which may or may not happen again in the next month. However there is no plans to introduce better flood measures. I was told that the council are considering introducing a total ban on removeing a lawn in gardens within the flood plain and asking the locals who have a flat ground to reintroduce a lawn. suggestions were even made to have the lawn cut using public money. By the council if i can add. With a lot of homes empty and people leaving property outside for insurance inspections police have found it hard to stop looting. (ive been in regular contact with them or should I say they have with us) with living near to the river we got contaminated drain water and river water that was mixed togehter and this came into our houses. And as a result in stinks to high heavens. It is not just our homes that were afected most of the council offices (library ambulances and the ambulace buidling were writen off my local health centre. Lots of business were affected to.) Its putting two and two together and evryone is coming asking me questions cus they sore me on the news. There is a lot of hosuing insurnce issues where no one has been able to claim it as there on benefits. The recovery is set to go on for over 12 months. This is when we are due to see some sort of normality getting together. So this is with us for some time to come as you can probably apreciate. We do have a river defence wall where i live. However it designed with wholes in. It dose not protect water form coming into the house it is suposed to protect the house from falling down. we have pumping stations here which were on and they could not handle the volume of water that was released from a broken bank up stream. Not to certain as to what we can do.
  3. Hi Caro Just to bump this thread. I am currently living in a disaster area and work continues to go on after the 2008 floods in my home town. My landlord reports they have Had over 168 homes flooded worth in excess of 6 million pound dammage. I was asked to not go back to my house by police officers who when I tied to cross a safety line said if i crossed it would be arrested. I asked where i should go and theys aid home. I says youve just said I cnat cross that line thats where im trying to get to. Theys aid to me that they are sending evacuees to a school and that is where i wwent and spent the saturday night when most would have been out drinking in complete fear. I was interviewd by The BBC ITV and SKY News the following morning and I made BBC News 24 healdines for 72 hours. In the aftermath of this total devistation we are told to prepare for the next floods. There has been help from many local agencys however no one is telling us what they are doing to prevent a further il use the word drenchin. i did not get to much of my property damaged and I am attemtping to get support form as many people as possible to research means of preventing floods. In an area I used to live they did have flood drains and these were flooded which shows you how much rain we got over a space of a fortnight. I was in one of the most badly affected areas of the country however just next door you can say my neigbours had lost even more than just there right to ocupy there own home. being on the ground floor they lossed there lifely possesions. One of my freinds lost there first sons photos. Un replaceable objects that insurance companys can not replace even if they wanted to. We are at a loss of who to blame and look for answers to prevent the next flood from causing further dammage. I did email cag for advice however non was forthcoming now I find your post which covers some of the things I wanted to do and have not for various reaosns. I hope you dont mind me postin in your thread and youve earned a freind today for what its worth.

I use this post to do one thing and one thing only and thats to rally united support to opose those that do the things we dont want them to do.
  5. Is there grounds in sueing for profesional negligence when the court date is due and the defendant dont show. The judge said the case stands as satisified but this is because i did not include any case law of cag at all. I basically under a court of law challenged the bank to atend court. I wrote letters to them that was about it. It was a very straight forward case this time around. However I will not be so nice the next time round as I will be aiming to make my case law more atractive. The defendant even sent me a letter saying that I am not a hardship case. I would devise from this they are trying to access my personal files. As a court of law lifted the stay on my case. (or is this profesional negligence?) I hope the site owners dont mind me grilling the bank.
  6. I made an aplication to the court after going in a few times a week. I had on my poc's as follows. Under the grounds of the FSA waiver i would like to submit the following evidence to court to lift the current stay on my claim.
  7. It was based on hardship grounds. I submited evidence of my incomings and showed that they quite simply did not cover my outgoings.
  8. Cheers Guildo The claim was made as a hardship claim . Is it possible to get it transferd into another account possibly with the same bank. or another (ive a parcute account opend.) I am rather stretched for the money
  9. I won I won I won. The court said claim sattisfied. But the defendant has only paid the dosh into to my overdraft. So what is my grounds on asking for the dosh i mean money in the form of a cheque. cheers peeps for the help.
  10. Well the day has come folks. Either there in for a moral grilling or im in for a long off to the ballifs office eventually. I am asking the judge today to lift this idiotic stay Lloyds have inplace on my claim. I have a list of incomings and outgoings I will present to the Judge and I will be raising concern to the fact I will have to do this and Lloyds do not have to produce anything. (if i get the chance)
  11. Hi All. I have a deposit protected with the Dpeosit Portection Service under the DPS. Apparently citizens advice say It si reasonable for the Landlord to ask the tennant to take a deposit and have the landlord use it for Rent. Not sure on the Law behind this one and I would really much like some help on this. I applied to get the deposit back as the landord had not made nay attempt before hand to do so. Now that I have applied to get it back the Landlord has declined. I then recived a request through the DPS from the landlord/agent to allow them to recive the deposit. I delcined this also. Dose any one no if the deposit is specifically for dammage to the home and items. Or is the Landlord/agent able to retain the deposit for the rent? Is any one aware of any regulations that cover this?

  14. My point exactly we need to stop playing the banks game. We need to get the stays lifted we no they (the banks) arent gona show up. Or if they do in my opinion we'd have strong grounds to question them as to why they havent shown up before. If they had the CCA agreements then they would enforce them. They never think twice about takeing us on so why should we? After all if there simply playing the rules of the law which i seriouls doubt they are then thid would have been sorted by now. Questions I have for the Banks. 1. How much do they make from the account being in default? 2. How much do they make from selling my account? 3 . After the account has been sold how much do the debt collection companys make from the account. 4. Are the debt collectioncompanys in house comapnys or are the banks contracted to get the money from the DCA's or debt purchasers (whom ever they may be). 5. At what point were they aware there was a problem with the CCA agreements? 6. At what point did they attempt to contact the consumer to inform them they were wipeing the debt off to comply with regulations instead of wasteing court time? 7. Why do they look on every case individually and why arent they accepting all hardship cases that apear before them.
  15. Whats the point of following proceedings if the bank is going to apeal evry one of them? Take your own advice and dont play into there hands.
  16. The judge most likely agrees with you that they are unlawful. And like me wish the banks would roll over and die but is afraid of losing his sallary or afraid of it going into someone elses account.

  18. Ive got a court date for a stay on Lloyds tsb. I want to claim on hardship and dissability but dont really want to put my details into the forum.
