I guess I have been a bit of a camel over the last cople of years and have totally buried my head in the sand and hoped that eveything bad would disappear. Not anymore.   2. Hi all, I have been advised on my thread Thereshope! v NatWest to have a look on here for some help. I have recently applied for S.A.R - (Subject Access Request) and have been sent my six years of statements. I was totally shocked to see that Natwest have been charging me interest on a debt that is now a CCJ. I pay £25 pm on a DMP through the CCCS which is applied to the CCJ . Natwest applied for the CCJ in feb this year. I was really upset at the time as the CCJ instalments were set at the rate I was already paying,and had been paying since nov04 through the CCCS. Why did they have to apply for the CCJ,I had paid them the agreed instalments every month without fail ? Oh,and they also applied to have CCJ made into a Charging Order which was refused in april. Anyway,sorry for waffling ! What I need to know is this, Are Natwest allowed to continue to add interest to the amount that they say I owe when a ccj is in place ? My original o/d was for £3150 in nov 04. Due to NW continually adding charges and interst the balance is now £7474.57. I kept NW informed of my situation from the outset and asked to have all d/d etc cancelled so as not to incur return fees etc but they didnt cancel them. As a result the fees snowballed I dont know what my rights are . It just seems a contradiction to pay a CCJ to address what i originally owed, when the balance is now higher than what it was in feb. Should I contact NW and ask them to stop applying interest as I am in the process of reclaiming my bank charges,and as such the amount they say I owe is in dispute. This is the route that was suggested to me by another poster,but I want to be sure when I contact them of what my 'rights' are. So,in a nutshell is it bad practice for NW to continue adding interest and what can I do about it ? PHEW !! Thanks guys:D Regards Hope xx

I keep on reading posts but they just dont seem to 'gel' in my head.I think I must be a bit challenged in the grey matter department lol !! Would you mind if I pm you with details of a real statement and you (pretty please !) could run through it with me ?   5. Hi all I have just read through ALL the thread . Taken me hours lol ! Still not sure what to do go for ,stat or contractual interest. I have read threads on MSE aswell and keep getting different views on the way to go. I am sooooo confused. OK. Please can someone shed a little light ? I have pm a few different posters re various questions about my situation and they have all been so helpful. I feel that i'm nearly ready to do prelim and charges etc. My questions are,if anyone can help 1) Has anyone actually won the full amount they were claiming when they included the contractual interest from the outset ? 2) can someone please clarify. My arranged o/d was for £3150. In nov 2004 my account went over that limit and has remained that way ever since. I notified Natwest of my situation ,cancelled all d/d and s/o etc and transferred my wages to another bank. I began paying Natwest through a DMP, happy in the knowledge that my debt was being reduced. Only it hasnt. I found out when I received my statments that what was an o/d for £3150 is now an o/d for £7474.57. So my question is, if i decided to go for contractual interest, do i charge Natwests rate of 29.5% for the whole of the overdraft, or do i charge it for the amount over the agreed limit ? 3) I have never used a spreadsheet before. Would it be simple enough to use for someone who hasnt filled one in before ? WOW ! Think thats about it. Any replies would be very gratefully received ! Thanks guys Hope
  6. Hi all, Back from checking out other threads. Not sure i'm totally right on this but here goes... judgement was made against me in Feb 06 for £19000 + court costs. I have been paying £25 pm since then. I read on another thread that once ccj made, interest charges cease to be added on. Can anyone confirm or deny the validity of this Thanks in advance C
  7. Congratulations and well done Orfoster !! So it can be done. Think i'm in a similar posistion as you were. Credit zone £3150 in 2004. Now stands at £7475.57. I havent used this account since nov 04 so NW have put £4325.27 in interest and charges onto this account. Keeping my fingers crossed x

  11. Hi all. OMG.!!!!:grin: Scrap what I have been waffling and stessing over. No charging order !!!!!!!! sorry for the misinformation Karnevil. Nice but a little dim,me ! I have just got off the phone to CCCS who advised me to contact the court that was dealing with my case ,basically to find out what stage im at. Big big shock ! Natwest/shoosmiths did have a CCJ found against me,then applied for a charging order in April ,and were refused !! I dont know a lot about judicial system but think this is a positive thing ? Am I right in thinking that as long as I pay my monthly instalment theres not a lot that they can do ? The thing that annoys me though,is that the amount owed is going up because of charges. Is it worth asking Natwest to stop interest being added so that I might actually begin to make a dent in what I originally owed them ? Or will they laugh at me ? What do I do now then ? Who do I contact re CCJ amount being unfair as quite a portion of the debt is down to interest and charges being added on ? Im also waiting for a hearing date for 1st Credit . They have an Interim order on me and are waiting to slap the final order on. Again,the balance has snowballed due to late/missed payment charges on MBNA cc.They are claiming £3782 + stat int .I have been paying a monthly instalment through CCCS ,never missed one,but they arent happy with the amount I pay.Think i should open a new thread in 1st credit forum to see if anyone at the same place im at ? Sorry ,went off Natwest topic a bit there ! Right,im off to have a look at some other threads to see if I can get any info. Bye for now C xxx

  13. Hi cheddar, I have looked around the site and cant find anyone in the same boat as me. Maybe i'm not looking in the right place.Not very good with posting in right place/checking as bit of a newbie ? How pathetic do I sound ?. Sorry. I havent mentioned anything to CCCS about going for my reclaim because not sure what they can do ? They didnt really manage to advise me when Natwest informed me that thay were applying for charging order. They just said that here wasnt anything I could really do .Just said to ensure that I never miss a payment because Natwest can apply for an order of sale. Feel like giving up before ive even started which must sound really sad to you. Ive read your thread and you did fantasic,and im really happy for you. It must take huge amounts of determination to see it through. Sorry for sounding sorry for myself ! Just been on mse site aswell looking for answers and feel a bit alone and despondant. Had a reply back from OP re claiming interest back on what ive been charged on unarranged o/d(took me over my o/d limit because of charges snowballing) and they say it will be too complicated to sort out .The interest is over £1000 on that alone . Any tips cheddar ? Maybe just talking to you will bring me good luck lol Thanks Mac
  14. IS ANYONE IN THE SAME POSISTION AS ME ? Hi . Natwest have a charging order on my home for £19500. A large portion of this debt is made up of charges and interest that has been added on over the past 2 yrs to a loan and o/d. I've had a quick look at my statements today and the charges add up to about £3800 not incl interest.,just on my current account. I was just wondering if anyone else is in the same situation as me ,really,and if they are,does it make any difference to reclaiming your charges ? My loan was basically forced on me when my current account was in a bad way and my lending manager said that it was the only way to get my o/d down. My OH had just been declared Bankrupt and I didnt know what to do.So I consolidated my debt on the advise of the lending manager. I have a DMP through CCCS but my debt is going UP because of all the charges that Natwest are adding on.I wasnt aware that they could continue to add charges on once a charging order had been agreed. If anyone has any answers ,please can you post here or pm me ? Thanks in advance. There's Hope.
  15. Set the ball in motion and sent off my cheque and S.A.R - (Subject Access Request). According to mail tracking ,NatWest have received my letter and signed for it. 40 day countdown begins .... I'll keep eveyone informed of my progress !

I was talking to my very grown up 14 yr old daughter about what we were doing and how i'd been on the MSE and CAG sites and she likened the CAG and the MSE founders to modern day Robin Hoods - taking back from the big greedy corporations and giving back the power to fight for whats rightfully joe publics ! Quite a statement from a 14 yr old !!!! I'm sure that I will be a regular visitor over the coming months,and you can count on my donation when I win ! CHEERS XX
  18. Hi all, Not very good at this . Just previewed my first thread on this forum and it seems to have disappeared ? Anyway,just wanted to tell you all that I have written out my S.A.R - (Subject Access Request) ,enclosed the chq and am now waiting for the post office to open monday morning so I can send it recorded:D Im going to see how it goes with NatWest,and if all goes well,then I shall follow suit with the rest ! Thought I'd start with NatWest as they were the first of the banks to go for a charging order.Then I'm trying 1st credit.mbna and quite a few others.My worry is tho,what if the banks that I currently pay instalments to (through my DMP with the CCCS) get uppity and take revenge by applying for charging orders ? Must admit that I am worried by all this. Still considering Bankruptcy. My O/H did in april 04 and has never looked back. I'll keep you all posted as to how it goes with NatWest Cheers and bye for now xx
  19. thanks nona, been on this site all day and havent even had chance to get dressed ! yep,will start a new thread for each action i start. gonna be a lot... my hubby has decided to go for it too,so going to sort his S.A.R to barclays this evening. working my way through FAQ and some of it not 'sticking' to well in my head,but i expect it will be simpler when i have a response letter back from nat west and i can work my way through the jargon.? thanks and bye for now xx:)
  20. hi all, new to this site today and want to say how fantastic it is !! now down to business....my fella had a business account with barclays at the time he went bankrupt and due to his financial situation the previous year,had loads of transactions that bounced/took him over his agreed lending limit. can he still go through the reclaim process ? we dont have any account details for any of his creditors.they were all handed over to the OR who sent them onto the appointed trustee,who then lost them ! any info would be muchly appreciated. just done S.A.R for my claim against NatWest too ! feel damn invinceable !!!!!!   21. Hi all, just wanted to say a big hello to everyone,really ! I havent felt as positivwe as I do right now since way back in 2001,which was prior to our debt problems. in a nutshell,my OH declared himself bankrupt after being burgaled 6 times at his business premises.we couldnt get insurance cos of being burgaled the year before and the final burgarly left us down 14K in stock.so he had no choice. i took out loan on loan,upped my o/d with NatWest and maxxed my ccs so we could stay afloat. basically ,when he went BR ,all his debt was cleared and mine obviously wasnt.as a result i couldnt afford to pay my loans or ccs and the buggers kept on adding charges and interest.I have a DMP through CCCS at £146 pm which i pay religiously.but i got thinking when i stumbled upon the MSE site.alot of my debt which currently stands at about £70000 is down to charges.my original NatWest o/d was £3000. it now stands at about £6000 plus i also had a loan through NatWest which was originally for £10000.it now stands at about £14000. NatWest applied for a charging order and my other creditors are following suit. i have never wanted to be in the situation i am now in,who would ? and im not trying to get away with paying what i owe.but it really makes me so angry that these huge financial institutions just keep on making the plight of people who are struggling finacially,even worse. thankyou so so much for this wonderful site.i feel like i can take on these giants,and maybe even win. im starting with NatWest,but im going to try mbna(who have just applied for a charging order,hearing on 5th feb)and then the rest!
