  2. Good afternoon, Following my quest to see where I stand with regards to my Credit Cards been unenforceable. I have just had a response from (MBNA Europe) Abbey Credit Card, they have sent me a list of all recent statement of the account & Agreement/Terms and Conditions. The following is a paragraph from the covering letter from Abbey Quote "We are sorry we have not been able to send you a copy of photocopy of the orginal as unfortunately, Abbey were unable to provide us with a copy. We hope that you will find this copy clear to read and sufficent for your purposes." Unquote The agreement terms of Conditions look like they have been recently updated, and there is no sign of any signature from me at all. Where do I go from here please?
  3. Hello there, I have taken the first steps in going for unenforceable agreements. Done the first letter to 3 Credit Card Companies, giving them the 12 day notice, Not one of these company have reply to my request. Can someone tell me what my next step should be, does the delay mean they may not have the information that I requested or is this a time delaying ploy? All suggestions are much appreciated.   4. Sorry for been so vague. The agreement was post Dec 2004. Was downloaded & printed, No other agreement was supplied for "proper" signatures This is just one of 3 Credit Card companies I am looking at. Thanks for the info!! Whistler128:)
  5. OK, So a question for you If an application was completed online, without a written signatures by the applicant on the application form and the creditor, does this consisitute as unenforceable? Whistler128
  6. hi, Would welcome some information about going it alone with regards to unenforceable credit agreements. It seems that a lot of legal firms and agencies are making lots of money out of this. Can it be done DIY?

  8. Notice of Allocation to the small Claims Track(Hearing) Total confusion here, I am due to go to court 20th July 07, However reading various treads regarding directions from the courts. I have not recieved anything other than the above Notice, informing me that it is a premliminary hearing, lasting about 20 minutes to consider the further progress of this claim. What I want to know is: 1. Will I required the court bundle at this stage? 2. If not what would I need to take along with me to this hearing? Any help along these lines would be most appreciated!!!8)
  9. Whistler128 V Abbey Claim No: 7QZ31939 Portsmouth County Court Hi Just a heads up!! I am due to attend court 0n the 20th of July. (No sight of Abbey withdrawing at this stage)I have got all my bundles ready, however I did not recieved any directions for the courts asking for any of this. More so I was not required to complete a Allocation Questionaire. Question is what should I be aware of at this stage?
  10. Abbey National plc Solicitor did write to me asking for details of what my claim was for and how did I work out the interest. That was day 6 of the 28 days and 4 days after the issue of the claim. Acknowledgment of service from Abbey was filed on the 19/3..stating that they intend to defend all of the claim. Who is James?
  11. Just bringing things up to date since my last entry. Since the new year I have dispatched another SAR to Abbey Banking Services. 22/01/07 Finally received all my microfiche statements. ( bearing in mind the first request was made in October 2006) 26/01/06 - Received a 2ND set of microfiche statements. 26/01/06 - Dispatched 1st Action Letter with breakdown of charges which I was claiming. 02/02/07- Received response from Abbey Banking specialist that they had received my letter and was "investigating" which would take 4 weeks. 24/02/07 - 1st 7 day warning of court Action, wrote 2nd Letter with charges attached. 28/02 - Received a offer of £640.00 as a gesture of good will which was 27% of the amount I was claiming. They informed me that it will be debited to my account within 10 days. 04/03/07 - I wrote back to Abbey refusing this offer, sent it special delivery 06/03/07. 05/03/07 - in the meantime £505.00 was credited to my account that day (3 working days). 07/03/07 - Started Court proceedings via Money claim on line..cost me £120.00. On 12/3 the claim was issued to Abbey National PLC, Regent Street. They have decided to defend the claim. As for the £505.00 that has been transferred into a saving account in case the ask for this money back. Still waiting for the missing £135.00 which is still outstanding. So anyone out there hoping for Abbey to settle things quickly..they wont..they are dragging it out as much as they possibly can. Any advice on going to court, if it gets that far?..would be much appreciated!!!
  12. Time table so far in my attempt to collect my bank charges from Abbey. 4th Oct 06 - Made initinal request to Customer Services for statements for the last 6 years. They informed me that it would take upto 4 - 5 weeks. I also made the same request to HSBC. I recieved those in 10 days. 14 Oct o6 - Recieved letter dated 13th Oct confirming my request and asking me if I would like to have the £10 taken from my account. 18 Oct 06 - Dispatched the above letter. 25 Nov 06 - Still no statements..contacted Customer Services again. I was informed again 4 -5 weeks. 8 Dec 06 - Contacted Abbey in Bradford informed them thst I was still waiting. Abbey in Bradford was the orginator of the letter. I was informed that I should contact the Complaint Dept, which I duly did. Again they looked at my request this time 5 - 7 days it should arrive 18 Dec 06 - Spoke to Customer Services again...guess what? they will get the statements out to me as soon as possible. So I have now send of the SAR letter backdating the 40 days from my initial request(4th Oct )and only giving them 7 days to response, as they have already had more than the 40 days( total of 64 days to be exact). So now I wait for more delaying tactics.
  13. With regards to Cheddar's response, the only letter I have recieved from Abbey was asking permission to withdraw £10.00 from my account to provide me with bank statements for the last 6 years. As I stated previously it was a verbal request I had made. The letter from Abbey confirmed my request, however nearly 2 months later i am still waiting for those statements.
  14. Well I have finally made it into group, it took some time, but persitance paid off. Now I am here, i wish to know how to hasten the bank in getting my bank charges back. Action so far has been very muted by the Bank concern. The events so far on my part is a) End Sept/Begining of Oct:Initial contact made to bank for statements going back6 years. b) 14 Oct - Recieved Letter from Bank acknowledging the request. c) 26 Oct - Contacted bank, was informed that this would take 4 -5 weeks to process. d) 25 Nov - Contacted Bank again, was again informed that I should have the statements within one week. f)Today 8th Dec - Contacted the Complaint Dept, who has informed me that they will investigate and that I should have the requested statements with 5 -7 working working days. Question to the floor is there anything else that I can be doing whilst waiting for the bank to get they act together?
