Certainly not going to let them get away with that response. Not sure i have heard of Francovitch though?! Perhaps you could direct to where i can read about that?

I have no idea why they are quoting CPUTR regs either. probably just trying to do a 'cabot' and through various quotes from regs into the mix to try to get the respondee off balance or confused.

I also sent a letter to RMA (NCO) although i didn't mention securitisation as i feel i want to save those sorts of questions for the OC. Rightly or wrongly, it was just my thought process at the time. Also sent a similar letter to Westminsters LLP (no reply from them as yet.) "I do not acknowledge any debt to your company or it’s agents Account in Dispute Formal request for information (CPR) Dear Sirs, In reference to your recent communications: This alleged account is in reasonable and lawful dispute and as such you are unable to demand p

Further to Post 195 and RMAs 'calling Card' i sent the following to Torbay TS. and now i have a reply: " Dear Sir/Madam, I wish to make a complaint regarding contact by a debt collection agency of which i have no previous knowledge of. On the 13th June 2009 i received a calling card (copy enclosed) from NCO Europe Ltd trading as RMA. This card gives the impression RMA will be ‘calling’ but as i am ex directory and have not given my telephone number to them or anyone else i assumed it was a personal visit. No call was obviously received on the date stated and nobody called at my pr
  9. The information watchdog without any teeth | Martin Sixsmith - Times Online "At ICO headquarters in Wilmslow, Cheshire, I found an understaffed, cowed and demoralised organisation with nothing like the clout and resources the job demands. Staff members told me that they were stressed, overworked and scared of challenging the Government (which pays their wages)."
  10. Credit Today online "The debt collection agency targeted by a forthcoming undercover Dispatches programme is Marlin Financial Services, Credit Today can reveal."
  11. Thanks for all the info Gary68.. appreciate you putting the time in to post all that. Too true postggj! Got to stick at it until the fat lady sings (sorry fat ladies everywhere.)
  12. Standard practice then.. had the same.. 1 letter from green and Co.. bogoff reply sent and never heard from them again.
  13. I think it would be helpful to post them up minus personal details if you could. Helps to gauge exactly what format they are in and compare them to others that have been posted up. Along with application date and type of account (credit card or Loan etc). Sounds like you have a lot of info on them that could make them compliant but im sure others will be by to offer opinions once they can be seen...
  14. I would say you'd be in trouble IMO. If the bailiff had a right to enter, you'd left the door open and knew they were turning up on that day then i would imagine a Court would probably agree that you left the dog out purposefully to injure the bailiff. Worst case scenario is the bailiff prosecutes you and the dog is put to sleep by order of the Court! I wouldn't risk that happening to my dog.
  15. I really don't believe there is a genuine 'stuffing envelopes' job out there. I often browse.. looking for opportunities and ideas. Trying to sift through the 98% scams to find useful info. There's only 3 ways i know how to make money that works: Property Selling plants grown from seed Busking (Don't suppose you can play the piano?)
  16. All quiet on my RBS thread too. Last communication from Regal Credit DCA 26th May. (Now i have said that i will get something in tomorrow's post lol)
  17. Slick244.. i would also complain about debt collection practices to your local Trading Standards and the OFT. And any futures letters to DCAs you could include the following sentence: " I suggest you take OFT debt collection guidance more seriously after the recent action taken against other unprofessional DCAs, namely, 1st Credit and Mackenzie Hall, as the OFT are cracking down on unfair and misleading debt collection practices and your organisation could be next."
  18. Didn't i read at the beginning your DN could be invalid? That should be a defence to any Court action although if your 'agreement' is a 2002 application form with no prescribed terms the likelihood of BOS taking this to a Court room is VERY slim if not non-existent.
  19. Fredrickson always send the '7 day' letter m12345.. you may get another but i found them to give up pretty easily especially when your position is strong. They rely on scare tactics for the most part: http://i157.photobucket.com/albums/t42/davey77_2007/Fredrickson1feb08.jpg http://i157.photobucket.com/albums/t42/davey77_2007/PreviewofFredrickson.jpg http://i157.photobucket.com/albums/t42/davey77_2007/Mint2Oct2008FRed.jpg http://i157.photobucket.com/albums/t42/davey77_2007/3copy.jpg After that account was put on hold i never heard from them again.
  20. This (of course) came direct from Halifax. Did you have any dealings with Blair, Oliver and Scott?
  21. Gary68.. Perhaps you could give us a breakdown of the steps you took to achieve this.. letters sent, over what time frame, responses received etc. (When you have time.) I would find that very helpful.
