  1. Nothing heard from HFC or any further DCAs on this one. Have a letter in the post to them that will either be ignored or get this sorted. Either way, i am getting very bored and looking at starting Court Action as a way to resolve this before the year is out.

    That's a good point CB. I will wait and see if i get anything back and use that point next time (although that will probably be to TS and the OFT as i am not sure i will even bother with RMA/NCO after this one due to lots happening this end.)

    Can only come to the conclusion that it's because they are morons CB. Surely if someone was vulnerable or didn't have access to advice such as here then that person may be confused and think those Regs are to their detriment or something but it's a odd thing to quote for sure.
  9. I'm impressed. Well done. Don't want to pour water on a fire but just keep an eye on TS. I have read before that sometimes start to out all fired up and proactive then all of a sudden they start to back track and wiggle out once they realise they will have to go up against a large powerful financial organisation. Hope that's not the case here and you are one of the lucky ones that have found a Trading Standards dept that really has got some backbone tho! Keep us up with any progress.. will be interesting!

    hmmm i see. Idea being as an argument then that EU Courts over-ride Uk bodies. (Which could have implications on the lack of positive enforcement action on the part of Trading Standards). Bit of a leap but worth a mention. I think i will merely intimate a possible legal recourse against TS for their lack of care towards me as a consumer and site EU positions and quote a couple of lines from the Francovich case to see what kind of response i get. Probably best to not play all my cards at once as i have a feeling TS will most likely put their foot in it, and in so doing help me further in g

  18. Have you sent 2 CPR 31.16 giving 21 days each which technically is the way to do it if you want to show the Court you have been fair and reasonable?   20. Hi GM, Thank you...Pleased if my posts have been useful to you. In answer to your question no.. didn't get anywhere with a refund. All i got was a write off. To be honest many said i could have had more out of them but for various reasons, including it being my first win after a long couple of years dealing with these problems, and with it being the end of the year when the 'case' came to an end. i was happy to call it a day without pushing for more.     So .. looking at the Francovich case would i be right in the following interpretation: Member states of the EU have a legal duty to enforce consumer rights laws/legistlation Failure to do so would be to put consumers at a risk of unfair/unlawful/illegal practices and.. in doing so, the regulatory body whose remit it is to enforce those consumer rights would/could be found liable and therefore that would entitle the consumer to damages for distress So.. i could write back to TS along the lines of: Failure to investigate my complaint puts me at an unfair disadvantage and th
