Hi Ive been helping my friend claim ESA since he had a stroke and had to give up work. His original medical assesment appointment was at the start of july but when he turned up he was told sorry theres been a mistake your medical must be with a doctor not a nurse and was given a new appointment for today. He's just rang me to say he had his medical with the doctor and it was very thorough indeed, the doctor did an eye test, tested his blood pressure, tested his reflexes, went through all his medical history since a child, he said he was in there for well over an hour Does anyone know the reason for the more thorough test and having to see a proper doctor? ive never heard of this before for ESA? Just to clarify he isnt claiming anything else.

Thanks, I will do, I it is madness, when I won my I.B appeal it took them 4 months to implement the decision! That kept saying they didnt know how to do it!

I was getting £101 before they changed it, I think that is made up of £71.00 basic income support and £30 disability premium to top it up to roughly the long term I.B payment. Ill ring up on monday but not holding my breath, the tel advisors seen to know even less than I do! Feel very frustrated that they can just cut the amount without so much of an explanation!

Hi No explanation given Ive claimed incapacity benefit since 2004 My last I.B medical was in 2009 which I received 0 points I appealed and the appeal process took 2 years (lost original tribunal and appealed to upper tribunal and won at rehearing) in october 2011 my incapacity benefit was reinstated and I received backpay, since then ive been paid £101 odd a week since then Havent heared anything since then apart from the recent review form. It may be that the large hap in my I.B due to ongoing appeal has confused the matter I did claim ESA during the 2 year appeal but that lapsed once my I.B was reinstated

So how do I work out what I should be paid? Is it the same as incapacity benefit? or is it income support? If it is income support then surely I should get the basic plus the disbaility premium? I was getting £101 odd which thinking about it does work out as £71.00 basic plus £30.35 disability premium

Hi I need some help Ive claimed income based incapacity benefit for the last few years, recently I received a A! income support review from the benefit integrity department and it referred to my 'income support' Now a few weeks later Ive received a letter saying there has been a change to my 'income support' and the amount has been reduced to £71.00 which is the basic rate income support. What I dont understand is why do they keep referring to my incapacity benefit claim as income support? it seems they have mixed up the 2? I should be getting the full rate incapacity benefit like I have for the last few years David

Hi I have a 4 year old Focus Cabriolet, its very lightly used and only done 17K miles. 6 weeks ago when I put the folding roof back up there was a horrible noise, the mechanism had gone faulty and as a result the roof crunched into itself and the car of that a plastic trim was broke. I took it to a Dagenham Motors who simply replaced the trim, I asked when the roof was ok and then said theyve taken it off, lubed it up and its fine which to be honest didnt fill me with confidence but I accepted it 2 weeks later and only the 2nd time having the roof down after the repair the mechanism went again and this time theres loads and loads of damages to several panels, scratches on the interior etc, basically it caused a real mess and will cost a small fortune to repair. I took it back to Dagenham Motors and after a few hours I received a call and they said the bushes in the mechanism were heavilly worn and needed replacing, its out of warranty but they would have a word with ford. Ford so far have just messed me about, everytime I chase it up they just keep asking me more questions like how many ford cars Ive bought etc etc they said they were looking at it from a goodwill standpoint. My question is, do I have any come back on dagenham motors for the repair? they should have spotted the heavilly worn bush in the first place when they had the roof off, it only took them 2 hours to find them the next time, I spent £300 for them to replace a plastic trim, they told me it was fine to use and now because it wasnt fixed the faulty mechanism has caused a hell of alot of damage including the trim they replaced? OR Have I got any comeback on the sales of good act and that the roof isnt fit for purpose? the car has got 17K miles, I must have had the roof down less than 100 times during that time, also Ive checked the service schedules and there is absolutely no mention of inspection on the roof mechanism so I assume it shouldnt be heavilly worn after a few years. Right well im confused again now because ive printed out the decision makers guide from the rights net link and as far as I can tell its up to an esa decision maker to superceed the decision to award me ESA after I wont the I.B tribunal. -

Hi yes thats exactly right, while this long incapacity benefit appeal was going on I claimed ESA. I have already sent back the A2 form a few weeks ago so thats ok. Thats exactly what theyve told me after 3months of chasing, I still dont understand why they cant just switch it over themselves, I mean when you get switched from I.B to ESA they do it automatically. -
I really need some help. I wont my incapacity benefit tribunal dating back from a medical in 2009 (i had the first tribunal decision set aside) and still havent had my back pay or been put back on i.b At first they didnt know what the appeal result was all about as asfar as they knew I lost the tribunal so had to send in upper judges decision. Then after another month of chasing the said I had to fill out an A2 form which basically includes all your details for their system. Now after another month of chasing they now say I need to stop my ESA before they can process the arrears?? It doesnt make sense to me, i told them to liase with esa and sort it out between themselves and that I didnt feel comfortable withdrawing my esa claim and my benefit helper agreed by they are adament they will not process this tribunal win until I stop my esa claim. Its so frustrating, they are all in the same building, why cant they sort it out!!! I wrote a letter of complaint 3 weeks ago but ive never had an acknowledgement what should I do?
