What you want to do is send them a sar and then wait. If they do not reply to the sar then issue a n1 claim form for the whole of the amount collected including the original amount owed to the inland revenue. Then sit back and let nature take its course. As bailiff companies do not want to explain to a county court judge how their charges were worked out. As this would be a fly telling the swatter why not to swat it.

I must admit edf are the slowest of slowest t******* about in doing their work. Reported a fault yeterday that i have no powere came out and then left. Still have not comback keep on amking up poxy excuses. Best part 2 under fives involved. Sleeping in the dark/no heating/hot water. What shall we do ? Edf can not come out till midday tmmorrow. All i di was is switch to the complete ars*w****.

Pete sorry for hijacking your thread for a post. If anybody has had a problem with a bailiff acting unlawfully etc i am willing to take the case on but before i do i need all the paperwork that you have. You should have phoned the county court to tell them you are stuck in traffic. After all this is what the major companies use as a excuse and always get away with the bloody thing !!!!!

As i am dealing with various debts/bailiff cases at the moment i have just stumbled accross something that may intreset everybody. I was told that if my client did not stick to the monthly payment plan then the account would be closed and sold to a debt recovery company. I asked why the same offer is not being made to the clinet. The person from tsb said" we can only offer to sell you your debt if you have the money to pay for it in which case you would need to clear all of your arrears. However is the account was to default we would sell it for 20% of the value and write the rest off. He said because of industry rules this offer is not made to the customer themselves but said if your client reduces the debt by 25% then he can make a straight and immediate offer. Which would be accepted. The debt we are talking about is £25000

This is for only 1 If there are 30 That means there are18 million quid tobe made profit wise and if theres 100 that is £60 million quid to be made. If this is one company what about the others out there ? Nobody works for free do they ?

A new law will leave vulnerable people at risk from 'rogue enforcers', according to Citizens Advice. The charity has revealed nearly two thirds of bailiffs are guilty of harassment or intimidation, while 40% misrepresent their powers of entry. Under the Tribunals, Courts and Enforcement Bill, which is being debated in the House of Commons, all bailiffs will be given the power to enter domestic premises and enforce consumer credit debts, including credit card bills. At present, only certain enforcement officers - notably those enforcing magistrates court fines - have these powers. And bailiffs can only break in to homes if they have a court order. David Harker, chief executive of Citizens Advice, said: "Our evidence over many years shows that bailiffs have an appalling track record of abusing their existing powers against vulnerable people. "They are often abusive and aggressive and use threats of violence and prison to pressurise people into paying lump sums they cannot afford." The charity is also pressing for independent regulation of bailiffs to be included in the proposed legislation. Citizens Advice said evidence from its network of bureaux revealed that many private debt enforcers act almost as a law unto themselves. Checks on 500 bailiff cases revealed intimidation, harassment and excessive fee-charging were commonplace. Citizens Advice is calling on the Government to include in the Bill clear safeguards to ensure that forced entry is only used as a last resort
