  2. you could be in for a long wait then. My settlement letter from the bank arrived 3 weeks after settling my claim in full with cobbets. The letter From RBS was an offer to settle in full minus the interest. hope this has cleared it up for you. good luck with your claim
  3. update on my claim i have sent LBA today so Mr udy will have it tomorrow. i gave him an extra week cos of the settlement offer arriving tow days before the deadline and i wanted to give him time to respond to the rejection letter. i have sent the insulting cheque back with the LBA to. Just thinking ahead here but dose the POC for a credit card follow the same lines as the POC for a bank claim?? if not could some one point me in the direction of a good POC for a credit card. any advice would be gratefully received.

  5. hi if you don't get that letter just send your SAR request and just put in it your name,Address, D.O.B, and some proof of ID. i did this with cap one and had no probs getting my statments from them. godd luck with your claim.

  7. this is the rejection letter i sent to cap one. have heard nothing back from them so LBA is on it's way tomorrow a long with the cheque they sent me. Dear Mr R Udy Thank you for your letter dated 14/03/2007 I respectfully decline your offer of settlement and request, once again, that you return to me all charges imposed on this account, totalling £1447.99. In addition to this I require the default notice to be removed from my credit record. As you know I only had a £200 credit limit on my account and did not have the facility to spend over that limit. The only reason my account went over this amount is purely because of unlawful penalty charges levied onto the account by Capital One Bank. My letter previously indicates that you have 14 days to comply fully before I commence a claim against you for the full amount, plus interest and cost. You are reminded that there will be no extension to this timescale. I trust this clarifies my position.
  8. no you will be ok. it took me two weeks to file my claim against RBS cos of money issues and still won the full lot
  9. thanks tideturner i will look in to it more. one question i do have is is it best to use the inforamtion commissioner or go throught the courts or even do both.

  13. Hi everyone I’m helping out my mother-in-low with her claim but HSBC have decided not to play ball with her. She has sent an SAR request which they have not complied to they are now out of the 40 days and we have sent the non-compliance letter giving them 7 more days but still nothing. we are going to submit a complaint to the Information commissioner. And all so go to court in order to got the statements, the thing I need help with is the POC for the court as I’m unsure what I need to put in it so could anyone that has dealt with anything likes please give me some advice.

  16. RBS have made me anther offer even tho i won on the 26th Feb, they really don't know what they are doing. I wish i could take it but i can't.

  18. hi curlyben when you send your SAR letter you need to include your name, Address of where you were living at the time, your D.O.B and some proof of ID. you should find that you get the info you need. i have done this my self with cap one and got all my statements with out any problems. hope this has helped and good luck with your claim
  19. Well a bit of an up date. Got this letter today. Dear Mr mbdiss Thank you for taking the time to write to us about the fee we’ve added to your account. I understand you think theses fees are unlawful and I’m sorry you feel we’ve treated you unfairly. To explain, we automatically add late payment fees if your payment is missed, arrives late or isn’t enough to cover your minimum payment. We’ll add overlimit fees if your balance goes over your agreed credit limit. When we opened your account, we sent you a credit card agreement which stated theses fees. By signing and returning this to us, you agreed to the terms and conditions for the account, including the fees. As you’re probably aware the Office of Fair Trading, OFT, haven’t challenged the right of the banks to charge default fees, but merely the level of those fees. Although we feel £20 is a just fee (yeah I bet you do cos it makes you the most profit), we’ve reduced our fees to £12 so that we’re in line with our competitors. I appreciate that you’ve incurred previous fees at the higher rate, and would like to address this. (hhhuuummm what insult of an offer can we give) I’ve reviewed your account and, as a matter of goodwill, I’d like to reduce the fees we’ve added to your account to £12 each. So I’ve refunded £204 and sent you a cheque for this amount. (Thanks but no thanks you can have the cheque back and send me one that has £1447.99 written on it, but that would be to ease and where’s the goodwill in that offer.) You also asked me to remove the default notice from your credit file. We have to record accurate information with the credit reference agencies, and as the default was recorded correctly I can’t remove this. (If it was recorded correctly then it would say we have do this cos we charged to much and this person was not able to keep payments up because we made it impossible to do so) I hope I’ve explained things clearly, but if you do have any other questions, please write to me again. (Thanks for that cos you will be hearing from me again) You’ll find my address in the leaflet I’ve included, which also explains our complaints procedure. If I don’t hear from you within four weeks I’ll consider this matter closed. Please accept my apologies for the inconvenience this has caused and I’m sure we’ll be able to put this experience behind us (lol isn’t that sweet he wants to be friends again. Well I don’t want to until you remove the default and give my back the money you took from me.)   24. Right i finally got round to posting my prelim letter today so here goes with cap one. roll on the next 14 days. total claim £1447.99 including interest at 18% (note to me 21st is LBA day)
