  3. Yesterday I phone the C&G mortgage company on 0845 603 1637. This is a customer service number. I gave my mortgage number and within 1 minute I was told that I would get a refund of £125. This could be either deposited into my account or a cheque would be mailed to me within 15 days. That was it no hassle, I did not even have to justify my position.   7. When I last spoke to Keith Jeremaih he admitied that he was very unlikely to turn up at my local county court, a 4hr drive from London. I spoke to him twice in two days and stressed how settling my rather modest claim would reduce three cases from his workload. He has said that he would write to me with an answer asap, not willing to make an offer over the phone. I stressed that I am anxious not to delay and will send in my allocation forms on monday if i have not heard from him. I am now feeling that I should not call him again. he seemed OK but he is a solicitor and he is on
  8. Called Keith Jeremaih today. Stressed that I was not intimidated and would welcome sitting down in court with him, myself and the judge and discussing the legalities ! When i suggested that i felt that it was unlikely that he would travel over 200 miles to my local court he agreed. Admitted that thay can't chase individual cases round the country ! Has promised to call tomorrow with his response to my ask for full payment including fees and interest. I will be sending the 3 allocation questionaires in if no positive result !   9. text of my letter sent to Paul at customer relations offering chance to settle. [Dear Paul Summerfield, Thank you for your letter dated 11th May offering me a full refund of MY money. The sum of £216.00 for the charges. Unfortunately you took a too long to respond to my letter before action dated 20th April.   11. As you know barclaycard offered me a full refund as response to my LBA. However it arrived 1 week after I had filed in court. I have just recieved an Acknowledgement of Service showing that Barclaycard intend to defend the claim. What makes me smile is that it is signed by Nicholas Hartigan, his position is a Trainee Solicitor ! He is going to learn fast !! My dillema is what to do now.   12. Offered full refund after i filed ! Sucess. Barclaycard have offreed me a full refund of the charges £216.00 without any conditions such as confidentiality etc. My dillema is that I have already filed with the court, so i have incurred a fee of £30.00. Should I accept the offer and absorb the court fee myself, continue with the court action or write back asking for the extra £30.00 ?   13. Recieved reply from barclays 3 days after my LBA deadline. A very weak response pleading for more time. I am filing today with moneyclaim. Letter read: From Karl Voller, Customer relations manager. " I apologise for the delay in replying and thanks for your patience whilst we continue our investigations. Unfortunately we remain unable to respond fully to your concerns at present, however we will contact you again as soon as possible and certainly no later than 7th June."   14. Noite this extract from my calaim letter to barclaycard, especially clause 3:17 & 3:18 talking about double charging. No-one seems to have picked up on this very powerful argument. That is that the credit card companies are charging HIGHER interest rates to people they believe will be a higher risk and incurr charges for default. Then charging those same people penalty fees for default in addition to the risk premium on the interest !
