  2. Hi everyone. I am afraid I have been a little remiss is not posting my own thread before now; probably because my head has been spinning after dealing with Nationwide for so long. Anyway here goes. First off I would like to say thanks for all the wonderful advice posted on this forum. I started trying to sort out my problems myself by contacting Nationwides complaints department in January. I then got on the Martin Lewis website and downloaded template letters from there to start the tried and tested procedure. I also got onto this forum for further information and templates. I had followed the whole procedure up until last week when I had filled in my court claim and was about to check through one more time before filing. Ironically the court fees came to £120 which I couldn't pay without going overdrawn again so I had to borrow the money to take NW to court. While that was being arranged I found a new thread on here. 'Another Win-Cuddles v Nationwide'. It made fascinating reading and I recommend it to anyone who has got to the prelim. or LBA stage. He had got fed up with the way he was being treated by NW and went to the Financial Ombudsman. He got a quick response from the NW and they had changed their tune. So I thought why not? On Thurs. I downloaded the claim form; filled it in online; printed it off and sent it the same day along with relevant correspondence between self and NW and also stated that I had held off filing my claim in court as I was aware that NW were just needlessly holding up the process with no intention of going to court. I have just rung the FOS and spoken to a very nice man called David who explained that they had received my complaint; issued me with a ref.no. and told me that he expected to see it actioned in 7-10 days if not before. I now wait to see what happens in my case and will keep you all informed. I saved myself the £120 court fee and according to a post on Cuddles thread NW get fined £500 when the FOS complain on your behalf. It has got to be worth looking into for anyone who had reached the stage I was in and to all those as frustrated by NW as I was. Good Luck All. Trickyt:cool:
  3. As you have got this far you might like to take a look at another thread. 'Another win-Cuddles v Nationwide'. I came across it and held back on filing my claim and instead logged onto the financial ombudsman service site downloaded a claim form; filled in form online; printed it off and posted it along with relevant correspondence between myself and NW and told them I was aware that Nationwide were simply delaying court proceedings with no intention of appearing at court needlessly tying up court time. This saved me £120 court fees and apparently if the FOS send a complaint on your behalf NW are fined £500. NW have acted very quickly to people using this route and become rather apologetic. May be worth a try. I sent my letter Friday and look forward to seeing how it works for me. Good luck. Trickyt.
  4. Hi Gigglemal. I have to agree with other posts that you are best to go the tried and tested way. However having got to the point of submitting my claim I came across another thread: 'another win-cuddles v nationwide.' I would recommend giving it a look. I held off on my claim and instead went to the financial ombudsman service. I went on their website; downloaded a claim form; filled it in online; printed it off and posted it along with all relevant correspondance between myself and NW and added that I had contacted FOS because I was aware of the delaying tacticts being used by the nationwide needlessly wasting court time when they had no intention of appearing in court. This saved me £120 in court fees and apparently NW are fined £500 if the FOS contact them on your behalf. Worth considering? After all your legal costs would be more than mine would have been and I imagine with so much at stake the process would involve more stress. The Cuddles thread is well worth a look. Apparently NW suddenly react a lot more promptly. I will let people know how I fare. Good luck.
  5. Hi christhesparky. Nationwide are trying every delaying tactic they can and I was about to file my claim when I read another thread on here.'another win-cuddles v nationwide'. I recommend it. I held off filing my claim and instead went to the Financial Ombudsman saving myself £120 court fees and more waiting. Apparently people going this way at the last minute are getting quick responses from NW who are apparently fined £500 every time the FOS send a letter of complaint on your behalf. I will let people know how things go with me as soon as I hear something. You may wish to consider going this way yourself. You can go onto the FOS website and download a claim form to fill in online then print it off; post this off with any relevant correspondance between yourself and NW and maybe also mention that you went to the FOS as you are aware that the NW are wasting county court time with no intent of ever appearing at court as I did.   6. Hi Paddywife. I was about to file my claim when I came across the thread 'Another win-Cuddles v Nationwide. I recommend reading it. I held fire and instead went to the Financial Ombudsman instead saving me £120 court costs. Apparently people going this way having followed the procedure as you and I have are suddenly getting very quick results from the Natiowide. Possibly because they apparently get a £500 fine when the FOS send a complaint on your behalf. Something to consider?
  7. Hi Caroline, I have been trying to get back my charges from NW since January and ended up following advice on this forum. I had filled out my court claim and just wanted to check everything was o.k before filing it when I came across a thread 'another win-cuddles v nationwide'. He had got fed up with the standard bog off letters and went to the Financial Ombudsman Service. He got a very quick response from the Nationwide and other people posting on his thread are trying the same thing. I immediately stopped my court claim and went the FOS way yesterday saving myself the £120 court costs and apparently every time the FOS send a letter of complaint on someones behalf NW get a £500 fine. Take a look at his thread. You may wish to consider this route; save yourself the court fees; save yourself the anxiety and hopefully get the same results. Good luck.

  9. Hi M.J. You can find them online, download the claim form, fill in online and print it off then post it off with relevant documents. Job done. I was just about to file my claim but went the F/O way instead yesterday saving myself £120 court costs and apparently if the F/O write to Nationwide on my behalf they also get a £500 fine. Why not give it a go.
  10. Hi Sittinpretty! I see you are in much the same situation as I am with NW. I first started ringing and mailing them around the beginning of the year to no avail. At that time I was within 6yrs. of opening my account. I then started the reclaim process following the advice on the Martin Lewis website. I sent my first request for list of charges under the Data Protection Act with cheque for £10. I sent a second letter with copy of the first having heard nothing for a few weeks. This time I received a 'thanks for contacting us but sod off these are fees you agreed to when you opened your account' letter. I immediately sent a third letter, again with a copy of the first and warned them that their time was almost up and I would go onto the next stage. Hey presto!! I received my recorded delivery package. Because of the time they took to get to this stage it was now over 6yrs since I had opened my account but fortunately my first charges started in Jan 2002. Do not let them wear you down. When I sent my preliminary letter I again received an identical sod off letter to the one I had received earlier. There was no mention of the Data Protection information that I had requested and paid for in the first Sod Off. This is all a part of their delaying tactics. With reference to their advertising, I find it hard to understand how they can say they are 'Proud to be different'. They are the same as the rest of the buggers. Are they breaking advertising standards? GOOD LUCK:(
  11. Hi Ackers. I am just about to file my claim so I am a little way behind you. I doubt very much that you will be meeting a judge. I bet your money will have started arriving by the time I get my acknowledgment. Follow the advice on this site and the Nationwide usually pay up in the end. Reassured? Good Luck;)
  12. Congratulations Whiskas!!!!!!!! I have got my claim prepared and am just dotting all the eyes and crossing the t's....Oh yes; and am looking for the £120 court fee to submit my claim. NW cancelled my long established authorised overdraft when I started asking them to pay back my £1674.77+interest. Following your rather long and detailed thread has been a great inspiration. What a great site this is:D
  13. Congratulations Julie!!!!!!! I am just about to file my claim and I hope I have similar results. However I doubt my result will be so swift having read other posts about the Nationwide. They seem to be using stalling tactics to the limit. Let's see what happens;)
  14. Hi Sarah and welcome. I had similar experiences with Nationwide and it took two letters from me to get a reply too; negative of course. Take heart! I immediately sent a third informing them time was almost out and I was preparing for the next stage. Hey Presto!! I finally got what I had asked for. And I was only asking for the full list of charges that I was legally obliged to receive. Good Luck. P.S. Nationwide: Proud to be different.
  15. Hi Everyone, I only came onto the site this morning to see what I could find out on this unexpected result in the Birmingham Court. I am chasing Nationwide for almost £1900 and had got to the point where I am waiting for a final response before going to court so I too am interested to see how this decision will affect the battle. I would expect the case to be appealed and imagine I High Court ruling to overturn the decision. My battle continues with Nationwide and I hope everyone else continues their battles too.   16. I was sorry to hear of your situation but unfortunately not surprised to hear of Kensingtons behaviour. I suffered a bad head injury in 2006 and was in no fit state to work or to contact Kensington for nearly 3mths. By the time I was recovered enough to contact them it was too late. Scandalous charges were coming in and reposession was threatened. A reposession hearing soon followed and I was able to have the order suspended for a few weeks but I had to borrow from my family to keep them at bay. I had to put my house on the market to pay my debts but even though I had a buyer Kensington delayed as much as possible. As soon as the completion date was passed they tried for eviction which I fought off with threats of court action and media coverage and they eventually allowed the sale to go through but I had enough evidence on them to know that this is standard practice for them. It is my aim to put a stop to these sharks as the Ombudsman service seem powerless against them and I will look to publicise their practises to the best of my ability. And to be recompensed for what they did to me. Anyone with information on them please contact me here. In the meantime I wish you well for the future.
  17. Hi Skeggsy, I have just had similar problems getting my list of charges despite sending three requests ( one to the Chief Exec. Mr. Williams). With the latter two requests I sent a copy of the original and made clear the 40 days was running out and to expect me to move onto the next stage; The Information Commissioners; and within days the information arrived Special Delivery.   18. Hey, Well done to the Smiths and boy have you cheered me up. I have just got off calculating my interest after going to the line (40 days)after three attempts on my data protection act information. Now the figures are worked out and being sent off tomorrow with my claim for £1871.08. I am looking forward to posting my own good news in the very near future. I still haven't managed to work out yet how the Nationwide can claim to be 'Proud to be different'. They appear to be the same as all the rest of the buggers!8-)
  19. Hi everyone! I am new to this forum so this will be my first contribution but I expect to be back quite often. I have been trying to reclaim charges from the Nationwide since the beginning of the year but with no success yet. About a month ago I sent a letter asking for a full and comprehensive list of all my default charges following a template from another source as I have not been able to locate all of my statements. I gave a maximum of 40 days as they are obliged to reply in under the Data Protection Act. Nothing was received from them and becoming impatient I sent another letter with a copy of the first to the Chief Executive. I had also sent a cheque for £10 with the first letter to provide me with this information. This morning I received a letter once again telling me that they regretted my position but I had signed an agreement when I opened my account and that they could not refund the charges. They also; very helpfully; sent me a list of advice on how to avoid further charges but failed to respond to my request for the list of charges. I had informed the CEO that I needed this list to calculate how much I would be claiming back when I go to court. Having looked at TAFFY'S posts on the forum I was somewhat surprised to see the Halifax send out very similar advice on how to avoid charges. After all; aren't the Nationwide currently running a T.V. ad where they say they are proud to be different? I wonder if this could get them into trouble with the advertising watchdog as it is clearly untrue? I; like TAFFY; don't like to let go when I get my teeth into something like this. Good luck TAFFY!!
