  1. Recieved Notice of Transfer of Proceedings. They are dispensing with AQ. The defence is attached but nowt else, just wanted to check that I don't actually need to do anything yet? i.e. send stuff? Also, will there be a fee? My claim is just under £900. All I've seen mentioned is a £100 fee for claims over £1500 so not too clear on this. Thanks
  2. I've just found this whilst searching for info: Can anyone confirm if it is correct? I'm currently composing an email informing the company that they may collect or pay for me to return it, but want to be sure of my rights before sending. Also, do I have any right to claim the original postage cost of the item, or is that gone for good? Seems unfair that any way this turns out I lose money, but I can understand postage costs being unclaimable.
  3. You can claim back overdraft interest that is incurred by charges. I think there is a spreadsheet to work this out?
  4. Recently tried to switch my direct debit with specsavers to my new natwest account. The computers were playing up when I tried to do this, so I left some details and was told they'd send me the DD agreement to sign and return. I recieved it in the mail a few weeks later. I still have not returned this form yet specsavers have tried taking the money out of my account, resulting in 2 bounced DD's costing me £38 each Now, can specsavers do this as I gave them my details, or are they in the wrong for taking money before I agreed to it (i.e. signed the agreement)? I was under the impression they wouldn't set up the DD till I signed this. If they are wrong should I go after them for the charges they caused or just go straight into the claim process with Natwest? Thanks

Can't help but notice that no one has answered my question yet I want to write a letter to include with the returned item that will give the clear impression I will not back down if they don't refund me. But I don't want to be abrasive about it, I would like to keep it polite. If theres something to throw in about them being legally obliged to cover the return postage that would be great, but not entirely neccessary. Not looking for a full letter, just some guidelines to help me
  8. I did try to claim a refund from paypal, they ruled in the seller's favour. It cannot have been a small firm as they sell large items of equipment and a lot of them. they said I was responsible for all postage costs and that they would not refund them.

  10. They used their 'terms and conditions' as a get out clause and flat out refused. I did file a dispute with paypal (even stating I'd be happy that they refund me enough to send it back and the rest later) to no avail.
  11. I contacted the seller immediately. They took ages to reply to each message and eventually sent me a returns form. They knew I could not afford to send it back and would not help any further.
  12. I bought an exercise bike off ebay a few months ago that turned up in unuseable condition. Couldn't afford to have it returned at the time and the seller is rather difficult, so I'm not sure how likely they are to accept it back at this time. I'm under the impression that they have some legal requirement to cough up a refund as the bike turned up damaged? They are most definitely a business trader. Is this right, and if so, what could I include in a letter accompanying my return to make sure they comply? Thankyou

As an update, I recieved a £40 cheque in january (I think? can check this later) with no note etc (and the cheque was ripped, shoddy work) which is fine, except I paid them £80 and have since been ignored by everyone I've tried to contact. I have no mail address or telephone number, only email addresses. I have just sent an email to the chairman explaining the situation and politely asking for the remaining refund amount by the end of the month. If he's not interested I would like to take this further, does anyone have any suggestions? I cannot get hold of the terms and conditions, I have asked 2 people running the convention via email who ignored me on the matter. I added it in to my email to the chairman just now, what do I do if he doesn't send them?

    I had the issue with my account. Wouldn't let me submit for days. Started a new account, works perfectly. It was my first claim on either account. Also, I recieved an email back from their customer services asking for my password... this seems dodgy to me? Ignored it as my new account works fine.
  15. I have a basic natwest account with a solo card. Works great for the internet. I especially like it as it won't let me use paypal or amazon with it unless the money is already in the account (no chance of going overdrawn!!). Most transactions show up on my internet banking within a day too. Makes it much easier to keep track of than with my visa debit card, which is useful as most of my shopping is done online Confused me when I first got it though as you need to activate it via cashpoint before it works online. Took me a week to figure that out, doh!!
  16. Prelim sent, standard fob off recieved, LBA sent, no reply, filed with MCOL last night Just waiting for a working printer so I can send my schedule of charges to MCOL... I'm sure someone said to me I should send 2 copies in, is this right? Also, by what time should I get it in by? Obviously I'm trying to get it done asap, but it'd be nice to know the deadline.
  17. Well that sounds rather petty. I'm currently working on setting up something similar (selling handmade jewellery) so I'd be interested to hear how this works out. You seem to be on the right track, but I have no expertise in this area, so good luck!!
  18. I think this might be true. Tried to claim for an exercise bike that turned up damaged (could not have happened in transit and feedback weeks later suggested mine was not the only case). I was quite happy to return the bike - once they refunded me enough to do so, but paypal found in favour of the seller.
  19. If it were money he were after he would have accepted the offer already. He is trying to expose the banks and their unfair charges - basically force them to admit they are wrong. He's putting his career on the line to do this which is why people here are so thankful and willing to help
  20. Good luck to you Tom Brennan. I'd sure help out if this guy lost, but hoping for the best p.s. Does anyone have a solution to watching/listening to the programmes? All the current links crash both firefox and IE for me.
  21. Was the product an avocado based one? If so it's probably that. I just recently discovered my avocado allergy in the story described above and in researching found it's not uncommon. Especially if you have previously had allergic reactions to latex. Probably unhelpful, but just in case
