Hi there, after several months I have finally decided to take the plunge and was wondering if I am correct in sending the letter to my local branch as I though I may get a faster/ less educated response from them. Also in my initial request I am asking for 16% as this is what they have been charging me on my unauthorised overdraft. This now totals just over £2,700 Does everyone think this is acceptable or have any pearls of wisdom or experience to offer me? From what I understand you normally leave the 8% interest until court but if I apply the 16% now I will not be entitled to claim the 8% when it reaches this stage. I have already printed off the letter and spreadsheet to post by recorded delivery tomorrow so if I haven't heard any reason why I should not send it by lunchtime I will be racing round to the post office - finally! Thanks for reading - fingers crossed all will go to plan. I think if this works out as I hope I will need to change my name to just 'lil' fagashlil

Forgive me if I am wrong but if you put without prejudice at the top of the letter sent by yourself this means they cannot present your sent letter in a court of law as evidence? Does this allow you to produce your own copies/ produce the originals as evidence of letters you have sent to them if you need to? Also how would you go about proving you have sent such a letter? i.e. get post office worker to confirm & sign on a separate sheet held by yourself the contents of that sent by R/D (& give their details) prior to posting by recorded delivery

Hi Laiste, good to hear from you. I am just about to begin the process myself and hope I don't encounter any of the problems that you and your husband have so far. However I know where to come if I do:) With so much going on at the moment I can imagine it is hard to stay focused. As someone else has already said keep your chin up. I have to say this is an amazing site and we are so lucky to be able to come here for information/ support and fight those institutions who have contributed to much worry and misery for people.
