  1. What form should I download, gonna take them to court, they not only failed to respond to two letters, but promised two call-backs that were never received...that's the last straw for me.
  2. Thanks folks for the replies, really does help and this website has been excellent at giving advice. I've followed the advice to the letter and got this far, so I'm gonna contact legal aid and find out if my court fees can be waved on grounds of being unemployed. The RBS called me back today because I'd spoken to a staff member about unhappy I was. The guy I spoke to from the Support Unit was called Lewis (seemed a helpful & sincere kinda bloke). He also said a cheque at this stage is not a possibility. I asked if I could even get £200 for myself to help finance the move to my new house, they could take the rest towards my loan; if they agreed I would not pursue the extra £100 or the 8% interest via court action, so he's gonna call me back about this. They know I'm moving because I also sent them a letter stating my new address as of the 4th April. All I want is £200 for carpets and to help with decorating costs (they can keep the rest)...fingers crossed. The good thing I have is the fact they did not respond to both my letters within the correct timescales and they did not contact me until I put in a two further complaints. I'd also like to add that I used the consumer group sticky labels, which I know helped. When they called me they knew I was serious and had a great website/backing on my side. I'd advise everyone to do this and for the price, it makes a difference...in my opinion. Unless they let me have £200 cash, then I'll hhave too go to the court and request a cheque from there. They've already broke the rules by not replying to both letters with the given timescales and I thought that by leaving out a few quid in interest might have swayed them more to help me out. Cheers folks. PS I'm also claiming against the TSB (got half my statments), but the cash from that will pay that small loan off, so I have no issues there.
  3. I've been offered £688.16, £100 short of what I asked for. They also refuse to offer me the cash in the form of a cheque or to transfer the cash too another account. My account has been frozen because I am paying their loan back through a debt managment service, who pay my loan at a lesser ammount for me, so they will take the cash and put it straight towards the debt. This would not normally be a problem, but I'm moving house on the 4th April, I am unemployed and this money would have helped me get the house in order...even £200 would be a great help. Seeing as there's no way to get the money to another account, I'm going to refuse the £688.16 and get the extra owed; if it's going to be put towards my loan I might as well get the full lot. What letter should I send the bank now? Do I need to send one that states I accept this payment of £688.16 as part payment of the £773.16. Just wanted to point out that they never replied too both letters within the two 14 day periods. I had to email & send a letter of complaint to the bank ref the 'RBOS senior Customer Relations Manager' not replying too my registered letters (in essence they've had 3 letters, 1 phone call & 1 email in total before I even got an offer). Even then they asked me if I had the letter receipts when I spoke to them on the phone (saying it would better my chances). The offer letter only came in this morning because of two separate complaints I had made, it's short of £100+, I did not ask for any interest payments, they will not pay me by cheque or transfer the cash to another bank. I'm currently unemployed and receiving job seekers allowance, this goes into a different bank. PS The letter they sent states that as a gesture of goodwill and without accepting any responsibility, they are willing to pay me £688.16 and to sign the letter accepting this ammount (which I am not going to do). I have 8 weeks to reply or they will close the complaint. You have to laugh when they say a goodwill gesture, that's something they give when you get your first bank charge refunded. I also mentioned I used to work for them (RBS Mortgage Center) and have an unfair dismissal review coming up soon...this may also go to court depending on the outcome.

  5. I have sent in a complaint online to the "Service Quality Department" advising them I have not had any replies and how disgusted I am with the level of service provided. This is in the hope that it get's the ball rolling before taking stronger action.
  6. Ok folks the second letter I sent has once again been completely ignored by the person in the address below. Both letters were sent recorded delivery, I know they got them...what's the best way to approach this because I can't believe how ignorant the RBS are. They're quick enough when taking cash off you.   8. Meant to add...I currently am dealing with a DMC (Baines & Ernest) and the RBS are not accepting the ammount we can offer them to repay my loan. I was made unemployed in August 2007 for health reasons (going to the appeal on the 2nd March). I'm wondering if the RBS are refusing the ammount we are offering and hand the account over to their debt recovery service, will this mean that when I get my bank charges back they will just take it and put it towards the loan? Reason being I want to pay off more urgent debts with this and get my life back to normal, which is why I went to a DMC in the first place. I've also started a claim against LloydsTSB and will be using that money to clear off a small loan with them.
  9. I sent my first claim letter (registered post) with a schedule of charges to the RBS on the 8th February, giving them the 14 days to reply. Is this working days or just 14 consecutive days? If it's 14 working days (Mon-Fri) then they have until the 28th of February, if not then they have well overshot the mark.   12. Right, I've sent off my 'Subject Access Request' letter with my £10 in it...the battle is on. PS Where on earth is the spreadsheet (schedule of charges) thingy? Can't find it anywhere. It's for another claim I want to setup? :-? Thank you.

  14. Thanks...giving it a good read through now. I used to work for the RBS, so I understand how awkward they are. They send out sympathy letters when in actual fact they don't give a damn about the customers. I have a couple of quickfire questions that I'm unsure of. 1. If I already have a full set of bank statments and know how much I want to claim, does this mean I can skip sending in £10 for the S.A.R? 2. The letter I send to them says I have included a schedule of charges, is this the same thing as an S.A.R. if so does that mean I can send them in the bank statments I have showing all their charges that I want to claim back? Thank you
  15. I would like to claim the last 5yrs of bank charges, I've bought the ACTION GROUP stickers for my envelopes. Do I request an S.A.R first and is £10 the standard fee for this? Once I received the S.A.R, I take it I then print of the first letter template requesting my charges be refunded? I'm not going for the interest, just all the charges. I'm on the DHSS, my cash get's paid into a different account, yet the TSB are hitting me with charges on top of charges even though I have no direct debits with them anymore. I'm also part of a financial managment group called Baines n Ernest because of my financial difficulties, yet the bank won't remove the current charges, even though they said they are sympathetic. I've had enough of them, I've got nothing to lose and would like to get the ball rolling. I used to work for the RBS, but they paid me off on capacity grounds (illness) so I am now receiving DHSS payments which is not much. Could someone give me easy straight forward advice on the best way forward? Thank you.
  16. Hi there, my name is Mark and I'm delighted to see a place like this were the so called small person can take on the big companies. Just looking for a wee bit of advice before I send away my initial letter. I'm putting in a claim against the RBS for over £700 in unfair charges, once that's over I'll then be taking on Lloyds TSB over a 5yr period. Anyway I've copied the initial letter from the templates requesting they pay me X??? ammount over a 2-3yr period, with the intial 14days notice ect. However I'm unsure were to get this schedule of charges and do they have to be original copies. I used to work for the RBS Mortgage Center and they were always funny about docs being originals, so just wondering about this as there was a mention of getting two copies of this schedule. Obviously I want to avoid delays and I know how bad the RBS can be. Once I get the schedule, who is the best person to send it too along with my letter? I'm more than willing to go all the way with the RBS and have no nerves/doubts about doing so...these companies need to know they can't get away with this nonsense.
